Special Prosecutor Patrick Fitzgerald spent more than half a day Friday at the offices of Patton Boggs, the law firm representing Karl Rove.

During the course of that meeting, Fitzgerald served attorneys for former Deputy White House Chief of Staff Karl Rove with an indictment charging the embattled White House official with perjury and lying to investigators related to his role in the CIA leak case, and instructed one of the attorneys to tell Rove that he has 24 business hours to get his affairs in order, high level sources with direct knowledge of the meeting said Saturday morning.

Robert Luskin, Rove's attorney, did not return a call for comment. Sources said Fitzgerald was in Washington, DC, Friday and met with Luskin for about 15 hours to go over the charges against Rove, which include perjury and lying to investigators about how and when Rove discovered that Valerie Plame Wilson was a covert CIA operative and whether he shared that information with reporters, sources with direct knowledge of the meeting said.

It was still unknown Saturday whether Fitzgerald charged Rove with a more serious obstruction of justice charge. Sources close to the case said Friday that it appeared very likely that an obstruction charge against Rove would be included with charges of perjury and lying to investigators.

An announcement by Fitzgerald is expected to come this week, sources close to the case said. However, the day and time is unknown. Randall Samborn, a spokesman for the special prosecutor was unavailable for comment. In the past, Samborn said he could not comment on the case.

The grand jury hearing evidence in the Plame Wilson case met Friday on other matters while Fitzgerald spent the entire day at Luskin's office. The meeting was a closely guarded secret and seems to have taken place without the knowledge of the media.

As TruthOut reported Friday evening, Rove told President Bush and Chief of Staff Joshua Bolten, as well as a few other high level administration officials, that he will be indicted in the CIA leak case and will immediately resign his White House job when the special counsel publicly announces the charges against him, according to sources.

Details of Rove's discussions with the president and Bolten have spread through the corridors of the White House, where low-level staffers and senior officials were trying to determine how the indictment would impact an administration that has been mired in a number of high-profile political scandals for nearly a year, said a half-dozen White House aides and two senior officials who work at the Republican National Committee.

Speaking on condition of anonymity Friday night, sources confirmed Rove's indictment was imminent. These individuals requested anonymity saying they were not authorized to speak publicly about Rove's situation. A spokesman in the White House press office said they would not comment on "wildly speculative rumors."

Rove's announcement to President Bush and Bolten comes more than a month after he alerted the new chief of staff to a meeting his attorney had with Special Prosecutor Patrick Fitzgerald in which Fitzgerald told Luskin that his case against Rove would soon be coming to a close and that he was leaning toward charging Rove with perjury, obstruction of justice and lying to investigators, according to sources close to the investigation.

A few weeks after he spoke with Fitzgerald, Luskin arranged for Rove to return to the grand jury for a fifth time to testify in hopes of fending off an indictment related to Rove's role in the CIA leak, sources said.

That meeting was followed almost immediately by an announcement by newly-appointed White House Chief of Staff Joshua Bolten of changes in the responsibilities of some White House officials, including Rove, who was stripped of his policy duties and would no longer hold the title of deputy White House chief of staff.

The White House said Rove would focus on the November elections and his change in status in no way reflected his fifth appearance before the grand jury or the possibility of an indictment.

But since Rove testified two weeks ago, the White House has been coordinating a response to what is sure to be the biggest political scandal it has faced thus far: the loss of a key political operative who has been instrumental in shaping White House policy on a wide range of domestic issues.

Rove testified that he first found out about Plame Wilson from reading a newspaper report in July 2003 and only after the story was published did he share damaging information about her CIA status with other reporters.

However, evidence has surfaced during the course of the two-year-old investigation that shows Rove spoke with at least two reporters about Plame Wilson prior to the publication of the column.

The explanation Rove provided to the grand jury - that he was dealing with more urgent White House matters and therefore forgot - has not convinced Fitzgerald that Rove has been entirely truthful in his testimony and resulted in the indictment.

Some White House staffers said it's the uncertainty of Rove's status in the leak case that has made it difficult for the administration's domestic policy agenda and that the announcement of an indictment and Rove's subsequent resignation, while serious, would allow the administration to move forward on a wide range of issues.

"We need to start fresh and we can't do that with the uncertainty of Karl's case hanging over our heads," said one White House aide. "There's no doubt that it will be front page news if and when (an indictment) happens. But eventually it will become old news quickly. The key issue here is that the president or Mr. Bolten respond to the charges immediately, make a statement and then move on to other important policy issues and keep that as the main focus going forward."

3. Rove is referred to in the Libby indictment as “Official A.” According to Schuster, every time Fitzgerald has named somebody as “Official A” that person has been indicted.

Shuster also says Rove’s lawyers expect a decision from Fitzgerald within the next two weeks.

OLBERMANN: What are you gathering on this? Is the decision by Mr. Fitzgerald coming soon? Will it be an indictment?

SHUSTER: Well, Karl Rove’s legal team has told me they expect a decision will come some time in the next two weeks. I am convinced that Karl Rove will, in fact, be indicted and there are a couple of reasons why. First of all, you don’t put somebody in front of a grand jury at the end of an investigation or for the fifth time as Karl Rove testified a week and a half ago unless you feel that’s your only chance of avoiding indictment. So, in other words, the burden starts with Karl Rove to stop the charges. Secondly, it’s now been 13 days since Rove testified. After testifying for three and a half hours, prosecutors refused to give him any indication that he was clear. He has not gotten any indication since then and the lawyers that I have spoken with outside of this case say that if Rove had gotten himself out of the jam, he would have heard something by now. And then the third issue is one we have talked about before, and that is in the Scooter Libby indictment Karl Rove was identified as “Official A.” It’s the term that prosecutors use when they try to get around restrictions on naming somebody in an indictment. We have locked through the records of Patrick Fitzgerald from when he was prosecuting cases in New York and from when he has been U.S. attorney in Chicago. And in every single investigation, whenever Fitzgerald has identified as somebody as “Official A,” that person eventually gets indicted themselves in every single investigation. Will Karl Rove defy history in this particular case? I suppose anything is possible when you are dealing with a White House official. But the lawyers that I have been speaking with who know this stuff say don’t bet on Karl Rove getting out of this.

SHUSTER: Well, Karl Rove’s legal team has told me they expect a decision will come some time in the next two weeks. I am convinced that Karl Rove will, in fact, be indicted and there are a couple of reasons why. First of all, you don’t put somebody in front of a grand jury at the end of an investigation or for the fifth time as Karl Rove testified a week and a half ago unless you feel that’s your only chance of avoiding indictment. So, in other words, the burden starts with Karl Rove to stop the charges. Secondly, it’s now been 13 days since Rove testified. After testifying for three and a half hours, prosecutors refused to give him any indication that he was clear. He has not gotten any indication since then and the lawyers that I have spoken with outside of this case say that if Rove had gotten himself out of the jam, he would have heard something by now. And then the third issue is one we have talked about before, and that is in the Scooter Libby indictment Karl Rove was identified as “Official A.” It’s the term that prosecutors use when they try to get around restrictions on naming somebody in an indictment. We have locked through the records of Patrick Fitzgerald from when he was prosecuting cases in New York and from when he has been U.S. attorney in Chicago. And in every single investigation, whenever Fitzgerald has identified as somebody as “Official A,” that person eventually gets indicted themselves in every single investigation. Will Karl Rove defy history in this particular case? I suppose anything is possible when you are dealing with a White House official. But the lawyers that I have been speaking with who know this stuff say don’t bet on Karl Rove getting out of this.

I would love for this story to be true, and it's possible that it is, but no major Democratic or progressive blog or site has any mention of this. Blogs like DailyKos, Democrats.com and MyDD have lots of real sources in DC and in the national media, so if a story like this were about to break I'm almost certain that one of their sources would have mentioned it to them. On the other hand it is possible that this is still flying under the media radar. I would advise people to not get overly excited though, it can be very depressing when this sort of thing doesn't pan out.

At least Nixon had the decency to resign. What's up Bush?

But, you're right, none of the heavy hitters appear to have talked about this. (Or maybe I'm selling Kevin Drum short. I tend to put him in my top five mainly because of his California perspective. Even if, like my brother, he's trapped behind the Orange Curtain).

On a sidenote, DallasFirefly, since it looks like we read some of the same sites, have you picked up a copy of Markos/Jerome's book? I've read mixed reviews (either the best thing since sliced bread or pablum) and the copy I ordered hasn't gotten here yet so I'm curious. I ended up ordering it as an Amazon double with Greenwald's book (and, being the cheapskate that I am, going for the, "wait until the order is filled," shipping option so I have to wait until Glenn's book is released).

The Bush Administration Is Spying On Reporters

It now comes to our attention via a reader in Seattle that we are not the only news blog reporting that the Bush administration's spying involves eavesdropping on reporters.

According to an ABC News blog called The Blotter, a senior federal law enforcement official tipped reporters off to the fact that the federal government was tracking the phone numbers reporters call in an effort to root out confidential sources in its leak investigations.

He tells Newsnight: "I worry that patriotism run amok will trample the very values that the country seeks to defend... In a constitutional republic, based on the principles of democracy such as ours, you simply cannot sustain warfare without the people at large understanding why we fight, how we fight, and have a sense of accountability to the very top."

He declares himself a patriot, but for him the essence of being American is being able to bring the government to account: "It's unpatriotic not to stand up, look them in the eye, and ask the questions they don't want to hear - they being those who have the responsibility, the ultimate responsibility in a society such as ours, of sending our sons and daughters, our husbands, wives, our blood, to face death, to take death. Now, in my position my view is not to ask the tough questions in this kind of environment is the height of lack of patriotism."

Rather is also stinging about the lack of access and information the Bush administration is giving news journalists over the war: "There has never been an American war, small or large, in which access has been so limited as this one.

"Limiting access, limiting information to cover the backsides of those who are in charge of the war, is extremely dangerous and cannot and should not be accepted. And I am sorry to say that up to and including the moment of this interview, that overwhelmingly it has been accepted by the American people. And the current administration revels in that, they relish that, and they take refuge in that.

Also, this Jason Leopold seems to have a history of faulty reporting so unfortunately it looks like this story is false. I guess there is a 1 in 100 chance that it will play out true and Rove will be indicted this week but I'm not holding my breath.

Despite right wing media and blogosphere accusations, Jason Leopold has been a reliable source for some time. For now, I am willing to take it on faith that he has numerous well placed sources that did in fact tell him that Karl Rove had been indicted. As a journalist for Truthout ( http://www.truthout.org ), Jason has broken numerous stories ahead of the rest of the media which up until now have all proven to be true. If his story on the Rove indictment is incorrect, and I want to stress that we do not know either way right now, I have a theory as to what might have happened. Admittedly, like many theories, mine has several assumptions and ‘what ifs’ but each reader will have to decide for themselves what they believe. Eventually the truth will come out anyway.

We know that the Bush White House detests leaks perhaps more than any other administration in history. It is a relative certainty that Leopold’s past articles have gotten the attention of many in the administration. Assume for a moment that an internal White House investigation was conducted to ferret out those leaking information to Leopold. Once discovered, these individuals would be an excellent avenue with which to discredit Leopold by providing them false information which would then be transferred to the reporter.

Again, I am making assumptions and I want to dutifully make that clear. Now, assuming the White House had accurately identified the leakers. Let us take it one step further. Let us assume the White House sat on that information until an opportune moment presented itself. Such an opportune moment presented itself when it became clear that an embarrassing piece of evidence regarding Vice President Cheney was going to be submitted in a filing by Fitzgerald. The administration could provide a tasty bit of disinformation to Leopold’s sources and the attention of the reporter along with a fair amount of the progressive press would be turned to a story that would turn out to be false. This story and the rapid discovery that it was a hoax would overshadow the embarrassing filing by Prosecutor Fitzgerald. Indeed, it would overshadow the entire CIA Leak-Gate investigation or at least the reporting thereof for some time.

Again, we do not know at this point whether Leopold’s story is accurate or not and it if is not, we do not know why but I want to point out that if it turns out to not be accurate, there are a lot of possibilities. Rushing to a negative judgment of Jason is unfair until all the facts come out.

Rove Informs White House He Will Be Indicted

Within the last week, Karl Rove told President Bush and Chief of Staff Joshua Bolten, as well as a few other high level administration officials, that he will be indicted in the CIA leak case and will immediately resign his White House job when the special counsel publicly announces the charges against him, according to sources.

Details of Rove's discussions with the president and Bolten have spread through the corridors of the White House where low-level staffers and senior officials were trying to determine how the indictment would impact an administration that has been mired in a number of high-profile political scandals for nearly a year, said a half-dozen White House aides and two senior officials who work at the Republican National Committee.

Speaking on condition of anonymity, sources confirmed Rove's indictment is imminent. These individuals requested anonymity saying they were not authorized to speak publicly about Rove's situation. A spokesman in the White House press office said they would not comment on "wildly speculative rumors."

Rove's attorney, Robert Luskin, did not return a call for comment Friday.

A few weeks after he spoke with Fitzgerald, Luskin arranged for Rove to return to the grand jury for a fifth time to testify in hopes of fending off an indictment related to Rove's role in the CIA leak, sources said.

That meeting was followed almost immediately by an announcement by newly-appointed White House Chief of Staff Joshua Bolten of changes in the responsibilities of some White House officials, including Rove, who was stripped of his policy duties and would no longer hold the title of deputy White House chief of staff.

I read the denials by Rove's lawyer and spokesman (he wasn't fired by Bush, his assignment was changed form policy to political so he still needs a spokesman) and they are stout denials. No ifs ands or buts, the denials are point blank and straightforward. Generally if there is some truth to a story a pr flack is denying, the flack will do lots of qualifying and won't flat out deny anything. In this case I would say it looks like Leopold was misled by his sources, but I hope I'm wrong. I would love to see piggy Rove sent to prison. And Bush is a human, technically at least, but he is neither fine nor patriotic. It would appear pretty silly to deny one day what is going to happen the next. Would Leopold really reveal the names of his sources should the story turn out incorrect? What is really the difference between the use of anonymous sources in this instance and the many un-named sources we see in the MSM? It's possible that part of Leopold's story is accurate, but not all of it. For example, it's possible that the prosecutor has threatened Rove with an indictment if Rove doesn't turn on his bosses, and that the negotiations are still ongoing. Of course that is only speculation on my part, but it would explain why Rove's flack is denying everything while some sources are speaking of an imminent indictment. This would be a disaster for the msm. being scooped on a story of this scale by an internet reporter would be extremely embarrassing for them and would bring their credibility into question.

Maybe Hero can comment on this, but Leopold did write the indictment would be "sealed", which presumably means it's not a public record. So does that mean Rove is officially indicted, but since it's "sealed", he can lie and deny it all he wants and get away with it, since no reporter is allowed to verify it?

Rover/Roverer and the White House staff are NEVER under oath when talking to the public or the press.

When "Rush" Limbaugh was INDICTED, ARRESTED, PLED GUILTY AND WAS CONVICTED, the Media Mafia pretended there was no arrest and never said the word conviction, and never attempted to videotape his perp walk. Well, from the way the Leopold story is written we should all know what's going on in the next few days. If there is anything to the Rove indictment it should hit the media by the end of this week. My guess is that if Piggy is indicted he will be indicted on lesser counts due to his multiple appearances before the grand jury. I assume that he's been cooperating with the prosecutor to a certain extent in exchange for copping to less serious crimes.

99% of the sheeple, including reporters, don't comprehend the fact that a grand jury can return a True Bill to indict, and corrupt prosecutors routinely refuse to file motions with a judge to issue arrest warrants.
