Forty-eight states and the District of Columbia are backing the family of fallen Marine Matthew Snyder in a pending U.S. Supreme Court case that could decide the constitutionality of laws restricting protests at private family funerals.

Lance Cpl. Snyder, who was deployed to Iraq in 2006, was killed just a month later in an accident. His funeral in Maryland was disrupted by demonstrators led by Kansas pastor Fred W. Phelps, yelling, among other things, that America's military is evil because it defends a country that tolerates homosexuality.

Snyder's family sued, but an appeals court said the hecklers were exercising their right to free speech.

On the other hand, I don't like THIS at all:
Quote:

Now, all but two state attorneys general have signed a "friend of the court" brief, to be filed tomorrow, that argues the First Amendment should not apply to some "intrusive and harassing" forms of expression.
That's a slippery slope, and even with extremely careful wording, could be abused, seems to me...

Can't we just blow them up? Frem?

Self-righteous ignorance is not agaist the law. If they caused an actual disruption of the funeral service then I could see them being charged with disturbing the piece.

I thank God every day that my parents did not push any religion on me.

DREAMTROVE

Because I'm a suspicious sort, I suspect the WBC of being an MSM plant. Think about it. No one would believe *everything* hay they do. They love death, oil spills, and just about anything that the people universally oppose. If it's at all debatable, they don't bother with it. If someone did believe this, no one would support them, they certainly wouldn't get top media coverage and a security detail and no legal hassle.

What would be goal, I hear you cry. Well, the goal is that we will universally oppose them, which we will, and that when someone suggests that we silence them, we will agree, in spite of it being against the first amendment. Once we have silenced them, we will have set a precedent doing away with the first amendment.

Why would the media want this? Because they are now powerful enough where they can get the govt to give them license to do as they please. Hence, by banning free speech, they can secure a permanent monopoly.

So, when hating the Phelpses, be sure to direct that anger at their real source. Sure, you may disagree with my analysis, But I suspect you see that it is just not possible for them to get away with what they do without help.

Keep the Shiny side up

Seems like we should be able to respond to these sickos without legislation limiting the First Amendment. If we could find out where they were going to protest, imagine 10,000 Rolling Thunder bikers, or just any regular folks, showing up with American flags and gently singing the Star-Spangled Banner during the funeral service. If I knew where they were going to be in my area, I'd go.

Freedom is Important because People are Important

Hello,

Every dead soldier has theoretically died so that they would have the right to do this. No new laws. No regulations. Let them protest.

As despicable as it seems, it's an accidental act of rememberence on their parts. They couldn't do this without the man in the box making it possible. I'd rather not see this sort of protest blocked in public areas. Private areas are already at the property owner's discretion.

Right on.

They have a right to do this. One hopes they'd have the decency not to. Obviously their god hates decency, too.

By the way, I *WILL* be showing up at the good reverend's funeral with my "God Hates Christians" banner unfurled, wishing him a very speedy, very painful ride straight down to hell.

I hope that doesn't upset his family...

Geezer,

That's basically what rolling thunder does..

But sure, technically, you could nail them on a ton of things, but nothing will stick to them because someone is protecting thrum, or them even. I don't even know what a thrum is.,

Even if the phelps controllers, whomever they might be, aren't liking for direct pieces of legislation, I suspect they're at least looking for sympathy for the anti free speech position, so I feel determined not to give it to them, not just because it's my constitutional right, because also, whoever these bastards are, they create and/or aree protecting the phelpses...

I have read that the phelps are lawyers, and they are on family, but this doesn't explain why they are invincible or why they get media coverage or a security detail. As frem would say, it just doesn't pass the sniff test.

Check out the West Virginia response to the Phelps. This was in response to the mining accident earlier this year, unless it was late last year.

MINCINGBEAST

Fred Phelps is no longer a practicing attorney. I can't quite recall all the details, but I believe he was facing disbarment, and bailed. His children may still be lawyers, which encourages me, because anybody can be make it as a lawyer, apparently.

The security details puzzle me. When the WBC befouled an event I attended, they were surrounded by cops. I wonder who paid for it? The city, out of obligation? Was it part of a permit that the WBC had to secure? Anyway, the security was silly, and outnumbered the WBC. It was like getting barked at through a fence by a maltese, who seems to think that the fence is protecting you, not him.

Bingo.

And in public, you can counter-protest while mocking and humilating them...

Or show a little class by just silently surrounding them, with disaproving looks - we played that one recently, and it worked better than I ever woulda believed.

I agree wholeheartedly, limiting the First Amendment in any way seems a slippery slope to me, and doing so for THESE idjits is hardly a good motive.

On the other hand, I like BlackNavarre's solution...people usually recognize their own idiocy (not that it would change their actions) when put under the microscope...that's something like the "witness" thing the Amish do, isn't it?

Seems like I saw somewhere that a group (gang?) of motorcyclists were going to these funerals and harrassing the Westboro fringies...can't remember where or when.

Look for same, I found tons and tons and tons of groups/people who have staged counter-protested their attendance. Good.
