I've been not saying this for the longest time because I have no interest in being on the birther side of the fence, but Cavetroll is correct. My brother is an expert in this sort of this, as is Obama, which means he also knows. I guess my feeling is "but who cares?" It's not really what the problem is.

ETA: the reason the birthers never thought of this was that the movement was led by orly taitz who is a moldovan, and not that familiar with the precedence rulings on us constitutional law.

That's what a ship is, you know - it's not just a keel and a hull and a deck and sails, that's what a ship needs.

I think the troll is correct according to legal precedent, but I suspect that the child of an american mother is an american. It would never fly, anyway. But opposing Obama for perhaps not really being eligible is like attacking clinton over a blue dress or bush over awol, it's sort of missing the point. If you attack someone personally, you're not asking for a better candidate, and you'll just end up replacing that flawed person with another person with a different personal flaw, but similar policies. Attack the policy, not the person.

That's what a ship is, you know - it's not just a keel and a hull and a deck and sails, that's what a ship needs.

At best (worst?) This would deprive Obama of the electoral votes from states having validation provisions. The ONLY reason it carries weight is a prior SCOTUS decision, so there is established legal precedent and that means this dog has teeth, like it or not. Now, if California, New York or Florida happens to be one of the states with these laws, then that actually would change things. Georgia does have 16 electoral college votes, a not inconsiderable number. But this still feels like a test case to me.

The validity of the plaintiff's argument is immaterial. Law isn't about fair, it is about what you can legally do. Don't agree with it myself.

Sworn into office is legally binding, unfortunately. You'd probably have a better chance at declaring it invalid by going after they mess they made of the oath of office.

And even if we could rescind all of Obama's policies this way, we can't unexplode the bombs, or clean up the gulf. Ultimately what we really want is for the last two decades to have never happened.
