Have we discussed this one?

from CNN:
Quote:

“This was not required by American law,” King { E-T-A: Peter King, Republican congressman} said. “The fact is the FBI was only 16 hours into an interrogation. They had already gotten some significant information, but much more was still not there. Who else was involved? What was his mother's role? Did his father have any role? Where did the radicalization start? How did it start? Are there any other conspirators out there? Who was part of it? Who assisted him in any way?”

When asked about the timing of the Miranda rights, Holder { E-T-A: administration Attorney General Eric Holder } told CNN’s Brianna Keilar on Saturday night that the decision, made by the magistrate, was “totally consistent with the laws that we have.”

"We have a two-day period to question him under the 'public safety' exception. So I think everything was done appropriately, and we got good leads,” he said.

D'Joker was talking. They Mirandaized him. He clammed up. Good choice , or bad?

Seems, to me, they got enough out of him for the short term, public safety concern, which is that the Bros acted alone, there was no follow-up attack scheduled. And nothing has happened since, which seems to confirm his story.

Now, he didn't answer every possible question they've asked him since, or thought up since, or read about because some media reported it, correctly or not. It would be nice to find out who radicalized him, was it his Mama's fault, to have him spill on every friend he ever had, every speech or sermon he ever listened to, everybody he met in Russia. But none of that stuff is hot pursuit, immediate danger to the public information

And he is not, never was, under any LEGAL obligation to answer questions about that stuff.

If the cops want to know that stuff, they gotta get offa their butts, get outta the donut shop and the black-and-white, and go do the leg work, go ask other folks and put links together. IT'S THEIR JOB.

Just because they've captured him, doesn't mean he has to confess everything they want to know, he has to give them ALL the answers, he has to give them everything they want to make their case. They've got enough to convict him of 3 counts of murder, multiple counts of grievous bodily harm, and setting off an explosive device. Let 'em try him for that, convict him, put him away-- should be easy money.

E-T-A:
What the cops and magistrate did was consistent with Constitutional law and Rights, as currently interpreted.

Gettin' old, but still a hippie at heart...

Well, I put up all the idiot things those on the right have been saying about how we should torture him, he shouldn't have been mirandized, etc., etc., under some of my "insanity on the right" threads, but I don't know if we've "discussed" it much here per se.

Personally, I'd like to know if anyone HERE thinks we shouldn't have gone the "legal route", that he should have been treated as an "enemy combatant" and tortured, tossed in Gitmo, tried via military, or whatever. Would be illuminating to know what people think.

I'm easy: we should always follow the Constitution, we should have closed Gitmo long ago, and we should prosecute those who HAVE ALREADY BEEN FOUND to have tortured.
