Goodbye, kind world (George Monbiot) - In common with all those generations which have contemplated catastrophe, we appear to be incapable of understanding what confronts us.

Yanno my signature line about Biden* - And when Biden* fails to keep his promises - or even promote them - I'll be happy to laugh at his skinny saggy ass parading all over town in his New Clothes™. ...

That's how you can tell if a President is really behind their rhetoric, IF THEY WRANGLE AND STUMP TO MAKE IT HAPPEN.

Obama kept his dirty shit on the DL as much as he kept his failure to get behind his rhetorical treaties on the DL - though their signings were with much fanfare as meaningless as they were.

Obama didn't campaign for them, even though he was happy to take credit for meaningless gestures.

And btw, democrats would have ended up in a MUCH better position in the midterms if Obama had tried the littlest bit to make the "change" portion of his slogan real, and held the banks and loan institutions accountable. Instead he shoveled trillions at them and rewarded them most generously for their bad behavior.

Trump’s lawyers submitted a 78-page trial brief to the Senate, arguing that it is unconstitutional to try a former president on articles of impeachment, that Trump’s speech at the January 6 rally urging his supporters to “fight” was rhetorical, and that the former president was well within his First Amendment rights to speak as he did. It blames the attack on the Capitol not on Trump’s incitement of violence over time — as the article of impeachment does — but on “a small group of criminals.”

The document seems designed to appeal to an audience of one: Trump himself. It repeatedly uses “Democrat” as a derogatory adjective, accusing “Democrat members” of Congress of “Trump Derangement Syndrome.” It calls the House impeachment managers intellectually dishonest and fact free. Curiously, in what is perhaps a nod either to his vanity or to the QAnon believers who think Trump is still president, it never acknowledges him as a former president, repeatedly referring to him simply as “the 45th President.”

This document tries to rewrite what we all saw with our own eyes. It will not convince anyone who has been paying attention to what happened on January 6, but that’s clearly not its purpose. Instead, it reinforces the narrative that Trump has been persecuted by his enemies, and that he was not responsible.

Maybe somebody should count the dozens or possibly hundreds of times you've used the term Trumptard just since Biden* took office.

If you dislike Trumptard, would you prefer legal documents filed in court to use the descriptive term "fathead fucking lying sacks of shit" which would technically be more accurate?

The trial will kick off with a four-hour debate on the constitutionality of the proceeding followed by a vote at a simple majority threshold to affirm the proceedings' constitutionality.

Dude. I don't care what names you want to call me.

Trump Claims My Research Supports His Case Against Impeachment
He’s Wrong. By Brian Kalt
FEB 09, 2021

https://slate.com/news-and-politics/2021/02/trump-late-impeachment-bri
ef-research-wrong.html

Back in 2001, I wrote a long law review article exploring an abstract question: Can Congress impeach and try ex-officials for their misconduct in office? The issue of what I labeled “late impeachment” was just a hypothetical back then. It was still only a hypothetical when I wrote a book on weird presidential constitutional issues in 2012 and included a chapter on impeaching ex-presidents. Then last month … well, you know.

When it became clear that Donald Trump’s impeachment trial would not begin until after his term ended, I knew my old work would come in handy for both the House managers and Trump’s lawyers. I had concluded in my article that, on balance, the evidence solidly favored late impeachability. But late impeachment is a complicated issue, with a lot of evidence and arguments on both sides—and my article tried to present all of it (it ended up being 124 pages long).

Sure enough, the House managers cited the article numerous times in their brief. So did Trump’s lawyers in their brief. Trump’s lawyers focused their attention on the parts of my article that favored their side, and not the parts—including my overall conclusions—that favored late impeachability. Fair enough—their job is to advocate for Trump, not for me. But as I looked more closely at just how they depicted my work, it was clear that there was a problem.

In several places, they cited me as though I had concluded something when in fact I had concluded the opposite. For instance, they said:

The only purpose of impeachment is to remove the President, Vice-President, and civil officers from office. When a President is no longer in office, the objective of an impeachment ceases. (Kalt at 66.)

So what did I say on Page 66? In that section, I looked at some different ways to interpret the constitutional text. One such way, which I called “Interpretation #3,” was consistent with what Trump’s lawyers were citing me for. But after summing up Interpretation #3, I denigrated it, saying that it had “deep flaws.” More to the point, one of its flaws was that removal “is not the sole end of impeachment.” In other words, I said the exact opposite of the proposition for which they cited me.

Legal citations use something called “signals.” . . . explanation of signals . . . For Trump’s lawyers to cite me without a signal for something that did not support their proposition—let alone support it directly—was a breach of professional standards.

When lawyers quote the wrong people and cite sources for the opposite of what those sources actually say, it is never a good sign. Judges hate that. It makes their jobs harder. How senators feel about it is less clear.

Can a president be impeached without evidence? Or worse, in the presence of exculpatory evidence?

Can a person be convicted by a jury without evidence, in the presence of exculpatory evidence, and without the presumption of innocence?

I guess we'll see these Constitutional mysteries revealed.

Can a bank robber be convicted if he drops the bag of loot as he runs from the bank? How is it Constitutional to punish someone when he did not gain what he sought? I think the jury of 100 senators won't convict the attempted robber because 50 of the jurors are related to the defendant.

The Senate ultimately voted 56-44 that the impeachment trial is constitutional.

An adviser to Trump's team offered a candid assessment of the messy opening day, asking pointedly, "What the hell is going on?"

The adviser said the former President could be in serious jeopardy if he finds himself charged in criminal court, given his inability to attract a high-powered legal team for the impeachment trial.

"Trump is f--ked if anyone ever charges him. No one wants to work with him," the adviser said.

Did you understand, 1kiki, that Trump is claiming to be a great patriot whose landslide victory was unceremoniously & viciously stripped away? He was fired from his job and he started a riot about the firing. If the rioters had killed Mike Pence, Trump's firing would not been certified on Jan 6th. But Pence lived and the certification was delayed until Jan 7th. Pence is still hiding from the people who want to kill him.

And since there is zero space between blind acceptance and calling it fraud, hat's why I bet they were even storming the barricades!

Trump referred to Pence 13 times in his Riot Day speech on Jan 6th:

I hope Mike is going to do the right thing. I hope so. I hope so. Because if Mike Pence does the right thing, we win the election … All Vice-President Pence has to do is send it back to the states to re-certify and we become president and you are the happiest people. And I actually, I just spoke to Mike. I said: ‘Mike, that doesn’t take courage. What takes courage is to do nothing. That takes courage’ … And Mike Pence is going to have to come through for us, and if he doesn’t, that will be a sad day for our country because you’re sworn to uphold our constitution … And Mike Pence, I hope you’re going to stand up for the good of our constitution and for the good of our country. And if you’re not, I’m going to be very disappointed in you. I will tell you right now. I’m not hearing good stories … They want to re-certify. But the only way that can happen is if Mike Pence agrees to send it back. Mike Pence has to agree to send it back. So I hope Mike has the courage to do what he has to do. And I hope he doesn’t listen to the Rinos [Republicans In Name Only] and the stupid people that he’s listening to …

Arriving at the Capitol that day, taking his place in the Senate chamber at 1pm, Pence issued a statement: “It is my considered judgment that my oath to support and defend the constitution constrains me from claiming unilateral authority to determine which electoral votes should be counted and which should not.”

Trump was just finishing speaking. The spearhead of the mob had already broken through the police perimeter on the west side of the Capitol. Just after 2pm, led by the Proud Boys and other paramilitary groups, the mob poured through smashed windows and doors and rushed into the corridors, chanting: “Hang Mike Pence!”

“Once we found out Pence turned on us and that they had stolen the election, like, officially, the crowd went crazy. I mean, it became a mob,” said one rioter, later arrested, in a video posted on YouTube. Another of those arrested texted: “When we found out Pence fucked us, we all stormed the Capitol building and everyone forced entry and started breaking shit. It was a like a scene out of a movie.”

But many of those assaulting the Capitol had already received Trump’s tinfoil cue to focus on Pence. The FBI charging paper for one arrested rioter, an alleged QAnon militant, quoted a text message two weeks before the attack: “I’m there for the greatest celebration of all time after Pence leads the Senate flip!! OR IM THERE IF TRUMP TELLS US TO STORM THE FUKIN CAPITAL IMA DO THAT THEN! We don’t want any trouble but they are not going to steal this election that I guarantee bro!!”

Secret service agents hustled Pence out of the chamber. “Where’s Mike Pence?” chanted the mob, racing to locate him. They carried a noose, marked with his name. Pence was in an office only about 100ft away. A quick-thinking Capitol police officer steered the rampaging throng to chase him in the opposite direction. At 2.24pm, amid the mayhem, Trump tweeted: “Mike Pence didn’t have the courage to do what should have been done to protect our country and our constitution, giving states a chance to certify a corrected set of facts, not the fraudulent or inaccurate ones which they were asked to previously certify. USA demands the truth!”

SIGNYM

I believe in solving problems, not sharing them.

It's all political theater by the DNC and RNC. I doubt that "impeaching" a private citizen - which Trump is now, btw - is even legal or Constitutional, no matter what the Senate voted. The one thing that establishment members of BOTH parties need is preventing another populist victory.

So they're looking for ANY way possible ... muck up the voting process even more than it was mucked up already (mandatory mail-in voting, no signature required, no address required, no postmark required etc. https://www.gatestoneinstitute.org/17031/hr1-chaotic-elections), impeachment, making DC a 51st state, appealing to relatives of illegal aliens, designating conservatives and libertarians as "domestic terrorists", allowing internet censorship, and so forth.

This kinda reminds me of the military's response to Vietnam war protests. The military felt it was nightly news coverage that turned people against the war, so instead of looking into their hearts to find where they had failed and fixing the problem so that any further wars COULD be fully supported by civilians, there was a whole series of actions to disable the antiwar movement so that mass antiwar protests would never happen again (including "embedding" journos with USA troops).

Oy. Dems and establishment Repubs are taking a wrong lesson from Trump. Instead of looking in their hearts to see where they had failed so many Americans, they just want to regain power and jam their agenda down everyone else's throat. Or else.

I just want to add this, in a place where you might read it, SECOND.

I've posted this before - that Trump is one smart dood, in a way that none of your ridicule of him as a pumpkin-faced clown seems to grasp. Maybe not smart in a way that could, say, design a refinery. But in his own way he's brilliant in knowing where the line is between what's criminal and what's debatable enough to be not quite over.

In the lead-up to the rally/ protest, which then turned into a riot by some people (as is usually the case, like with BLM and ANTIFA), Giuliani made statements that I thought were over the line. So did Trump Jr. And probably others did as well, those were just the two people I stumbled across whose statements had me goggling. But Trump himself never did.

And while I have no clue about Trump Jr's mental abilities, I don't think Giuliani is a dummy. So how it is that the people in Trump's orbit seem to repeatedly step right up in front of the bullseye (when Trump himself never does), I have no idea. And how it is they seem to somehow escape without any shots being fired at them for anything in relation to Trump is a further mystery.

In any case, despite the rhetoric of the people around him, PRESIDENT Trump himself will not be found with an awkward word on tape or on twitter.

He exhorted the rally to be peaceful and patriotic. Others may have called for action, but not Trump. When he called Georgia Secretary of State Brad Raffensperger, unless I missed it, he never used the word "you" as in "you need to find me votes". He always used the word "I" or "we", as in "I need to find votes". So technically, he never pressured Raffensperger to 'do' anything. On the Ukraine call he was even more removed, 'asking' 'if you could' and not pressuring for an answer immediately during the call. I think Sondland was being an eager beaver and trying to make things happen to impress his boss, and throw his weight around, (and pretend to be a big shot with direct access), but you can't find any Trump quotes saying anything about withholding funds unless Ukraine investigated Hunter. Well, maybe you can task someone to do try, but I never found any. Going further back, even Mueller, with the winds of the FIB and the rest of the Five Eyes all blowing his way, tens of millions of dollars and years of time, couldn't find any "collusion" - or - "any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump".

So you got to ask yourself - how is it that nobody can find anything to pin on Trump?

I've posted this before - that Trump is one smart dood, in a way that none of your ridicule of him as a pumpkin-faced clown seems to grasp. Maybe not smart in a way that could, say, design a refinery. But in his own way he's brilliant in knowing where the line is between what's criminal and what's debatable enough to be not quite over.

. . . PRESIDENT Trump himself will not be found with an awkward word on tape or on twitter.

1kiki, if you are waiting for a confession from Trump that he plotted to kill Pence, you won't get one from him. Unfortunately for your argument, Trump did tell the world to kill Pence unless Pence certifies Trump as the winner:

On the day before the electoral college votes were to be certified, 5 January, Trump tweeted, “The Vice-President has the power to reject fraudulently chosen electors.” Hours later, Trump cornered Pence in the Oval Office. He had brought along a rightwing law professor, John Eastman, from Chapman University, who argued that Pence had the power to overturn the electoral college. Eastman had written an op-ed asserting that Kamala Harris was ineligible to run for vice-president because she was not a proper US citizen – a new birtherism. Trump told Pence Eastman was “very highly qualified”. For once, Pence stood his ground. His reverence turned into recalcitrance. He rebuffed Trump. There was a line he would not cross.

That night, after the New York Times reported that Pence felt “he would need to balance the president’s misguided beliefs about government with his own years of preaching deference to the constitution”, Trump issued a statement: “The New York Times report regarding comments Vice-President Pence supposedly made to me today is fake news. He never said that. The Vice-President and I are in total agreement that the Vice-President has the power to act.”

Before dawn on 6 January, after it was clear the Republicans had lost both seats in Georgia and with them control of the Senate, Trump frantically engaged in a tweet storm.

“States want to correct their votes, which they now know were based on irregularities and fraud, plus corrupt process never received legislative approval. All Mike Pence has to do is send them back to the States, AND WE WIN. Do it Mike, this is a time for extreme courage!”

Then Trump called Pence at the vice-presidential residence, the Naval Observatory, to deliver an ultimatum. “You can either go down in history as a patriot, or you can go down in history as a pussy,” Trump said. But Pence spurned him again.
Pence hung up and got into his motorcade. As he drove to the Capitol, Trump mounted the platform at his “Stop the Steal” rally outside the White House, to address thousands of followers.

Trump knew Pence intended to perform his constitutionally prescribed duty to preside over the process that would seal Joe Biden’s election. Pence had repeatedly told Trump that was what he would do. Trump had tried every means to dislodge him from his position, but Pence proved immovable. Trump’s call that morning, threatening him as a “pussy”, was the last desperate gambit.

Trump knew the string was played out.

But when he addressed the crowd he had assembled, Trump pretended he did not know what Pence was going to do. Stung by Pence’s emphatic refusal, he knew he was retailing a false narrative. He feigned that Pence had not yet made up his mind – and that the entire decision now depended upon him. Trump built up the dramatic suspense, stoked the crowd’s anger and directed its fixation. Trump turned the entire crisis on to Pence.

Trump referred to Pence 13 times in his speech: I hope Mike is going to do the right thing. I hope so. I hope so. Because if Mike Pence does the right thing, we win the election.

Dozens of messages immediately appeared on Gab, a social media networking site favored by neo-Nazis and white supremacists, encouraging those inside the Capitol to capture Pence.

“I heard at least three different rioters at the Capitol say that they hoped to find Vice-President Mike Pence and execute him by hanging him from a Capitol Hill tree as a traitor,” reported Jim Bourg, the Reuters picture editor in Washington. “It was a common line being repeated. Many more were just talking about how the VP should be executed.”

Trump told the entire world to kill Pence unless Pence certifies Trump as the winner. Some of the world listened and intended to kill Pence. 1kiki, your best next move is to claim that since Pence is alive the Republican Senators on the jury should vote that Trump is innocent. 1kiki, your move after that is to point out that Pence hasn't complained about the murder plot. Pence is now hiding at the Hoover Institute, and he doesn't want to talk about it to the Senate, possibly for fear that if Trump is convicted on Pence's testimony, Pence really will be killed next time.

The former President screamed inside his Florida resort as his defense team unrolled slapdash and illogical counter-arguments, sources told CNN's Kaitlan Collins. His lawyers made a bad case badly.

The opening day of the trial begged the question: what level of comical flailing by an outmatched legal team would convince 17 Republican Senators to put the national interest before their own political futures and split with a former President who is still beloved in the party's grassroots?

The central truth of Trump's tumultuous White House term held firm: Most Republican Senators are still too scared to cross him.

Democrats managed to add only one GOP senator -- Louisiana's Bill Cassidy -- to five of his colleagues who had already signaled they believed the trial was constitutional.

Oopsy! Just a coup attempt complete with terrorism, murder, and smearing shit all over the capitol. C'mon, guys. We don't have to hold anyone accountable! Forget about it!

Why Republicans are going to war with reality
https://www.alternet.org/2021/02/rand-paul/?utm_source=&utm_medium
=email&utm_campaign=6534

The reason the Senate Republicans are questioning a certainty (i.e., Jesus God, yes, it's constitutional to prosecute a former president, will you please knock it off already?) is the same reason all Republicans are so often certain about things that might actually be in question. The truth is always a threat. Deference to truth is always tyranny. What's important is authority. Their authority. Their authority over you and everyone you love. And once you start seeing the deep authoritarianism of most of the Republicans in the Congress, once you start seeing the deep authoritarianism of millions of your fellow Americans, you also start seeing lying isn't something they do merely to get what they want. Lying is something they do, because lying is the point.

Remember that Rand Paul and other Senate Republicans have something you don't. They have a global right-wing media apparatus to not only amplify their lies, but bend perception away from political reality and toward a favorable fictional one. To lie at this grand a scale is to create a world in which morality is perverted, politics is barbarous, and whole populations can be pushed around and told what to believe, and not only that: they want to believe, because the lies have become so totalizing that everything being upside down, backwards and prolapsed seems normal, rational and worthy of defended in the name of muh freedom. When everyone says the sky is green when the truth is in plain sight, everyone is not merely trying to deceive you. Everyone is maintaining a perversion in which speaking truthfully could inspire your murder.

The House Democratic impeachment managers are going to push through the Republicans' lies in order to reveal the whole truth to the American people about their former president, which is this: Donald Trump committed a heinous presidential crime worthy, at the very least, of being disqualified for life from holding public office. This is as it should be, but let's not forget what the lies themselves reveal.

God you're dumb.

Trump's lawyer gave the boss something to scream about: Bruce Castor Jr. said, "The people are smart enough ... to pick a new administration if they don't like the old one. And they just did." Then, soon after, Castor added that this is commonplace: "The people get tired of an administration they don't want. And they know how to change it. And they just did." Castor's assertion about what the people "just did" is obvious to anyone who is willing to acknowledge reality. Except Trump has tried hard to create an alternative reality and has a reason to scream at his lawyer.

Trump has declared again and again that the people actually reelected him in a "landslide" and that fraud and theft cheated him out of his rightful victory. (He repeated this nonsense even in the video he tweeted out during the Capitol insurrection.) Today, Trump better fire his lawyer who can't agree with Trump about who won.

As for show trials, Signym, as usual you are full of shit:

The Moscow Trials led to the execution of many of the defendants. They are generally seen as part of Stalin's Great Purge, a campaign to rid the party of current or prior opposition, including Trotskyists and leading Bolshevik cadre from the time of the Russian Revolution or earlier, who might even potentially become a figurehead for the growing discontent in the Soviet populace resulting from Stalin's mismanagement of the economy.

Stalin's hasty industrialization during the period of the First Five Year Plan and the brutality of the forced agricultural collectivization had led to an acute economic and political crisis in 1928–1933, a part of the global problem known as the Great Depression, and to enormous suffering on the part of the Soviet workers and peasants. Stalin was acutely conscious of this fact and took steps to prevent it taking the form of an opposition inside the Communist Party of the Soviet Union to his increasingly totalitarian rule.

Trump won't be executed, so it is NOT a Russian show trial. And he won't be convicted for a murder plot against Mike Pence because there are only about 6 Republican Senators who aren't afraid of Trump. And none of the evidence presented by the Democrats is faked, nor are confessions coerced by torture, so again, completely unlike the Russian show trials.

Tell all the lies you want, Signym. Nothing can stop you.

Do you see in there any instruction to "get" Pence?

No?

It's like the "incitement" charge and the "quid prop quo" charge and the "Russian collusion" charge" ... all of it hogwash, not supported by anything Trump said, or did.

Back when I was an employee, the boss could give me simple orders like "Stop The Steal." Without the help from the boss, I could make all the travel arrangements, get packed and show up where the boss wanted me to be on the day he told me. Then I handled the problem in my own way without further instruction from the boss. I knew I was following the will of my boss. The client knew I was following the will of my boss ("Stop The Steal") even if I wasn't in touch with boss at anytime once I arrived at my destination.

The rioters, much like me, were given simple instructions to "Stop The Steal" by Donald Trump, their boss. They were told where and when to "Stop The Steal" by Trump. The rioters were even told who to have a meeting with: V.P. Mike Pence.

But the rioters' boss, Donald Trump, was there that day. Trump even talked to Pence about "Stop The Steal" just before Trump talked to the rioters about "Stop The Steal" since Pence wasn't cooperating with solving Trump's election problem. And guess what? The rioters did "Stop The Steal". But because Pence got away, the next day Pence stole the election away from Trump by certifying Biden as the winner. If I had been in the riot, I would have "Stop The Steal" permanently, not like those dummy rioters who only delayed it for hours. Then I'd be on the plane back to Houston with my mission accomplished.
