Barr’s presentation was tendentious in both substance and form. In substance, his suggestion that President Trump’s anger and frustration at the probe was an indication that he lacked criminal intent to obstruct is wrong; if anything, Trump’s fury points in the direction of obstructive intent. And it must be troubling for the Justice Department and the FBI, which looked to Barr as an incoming guardian, to see him simply ignore the president’s assault on law enforcement over the life of the probe.

The style and form of Barr’s news conference was even more one-sided. Barr crescendoed repeatedly at his several declarations echoing the president’s mantra of “no collusion” (even using that legally meaningless term). And the most bizarre aspect of the entire performance was his sympathetic portrayal of the president’s overwrought state of mind, resembling every bit a personal defense attorney rather than the chief law enforcement officer of the United States.

The Russia Investigation Will Continue

There is still much to uncover — and America’s intelligence services will work to uncover it. For example, how did the Kremlin know where to aim its disinformation effort? How did it know which communities to target, in which counties and states? One can argue that the Russians had a better sense of where to deploy their resources than did the Clinton campaign.

Why did Trump and those around him consistently parrot Russian talking points? Why was the Trump campaign so intent on disregarding expert advice on Russian issues?

The Mueller report notes that while investigators couldn’t prove a conspiracy, some people nonetheless displayed conspiratorial behavior (destroying communications, engaging in a cover-up, and obstructing the work of investigators).

The FBI, which has the benefit of secret intelligence, is certainly aware that it has only scratched the surface of Russian activities in 2016. Cyberhacks, troll farms, and the use of WikiLeaks are hardly cutting-edge espionage tradecraft. The Russian efforts that have been revealed to date were poorly hidden and displayed little professional elegance.

Counterintelligence agencies must find it hard to believe the cupboard is already bare since, as Mueller pointed out, the Russians had a dedicated and extensive program to damage the U.S. polity. . . .

Former prosecutor explains why she would charge Trump

When I was a federal prosecutor, I once indicted and tried a man named Roberto Ortiz for trying to convince his ex-girlfriend to leave town for a few weeks so she could not testify against him at an upcoming trial for illegal firearms possession. Despite Ortiz's efforts, the ex-girlfriend did not leave town, and a trial jury convicted Ortiz on various charges including witness tampering.

Ortiz's obstructive conduct pales in comparison to President Donald Trump's prolonged campaign to torpedo the investigation by Special Counsel Robert Mueller into Russian interference in the 2016 election. That is one reason why I signed a letter along with more than 400 other former federal prosecutors who said that if Trump were a private citizen they would have indicted him on obstruction of justice charges based on the evidence set forth in Mueller's report.

"Each of us believes," the letter states, "that the conduct of President Trump described in Special Counsel Robert Mueller's report would, in the case of any other person not covered by the Office of Legal Counsel policy against indicting a sitting President, result in multiple felony charges for obstruction of justice."

The letter from former prosecutors has nothing to do with politics. It has everything to do with the law.

Not only is the evidence sufficient to justify a criminal charge against Trump; it's not a close call as obstruction cases go. In the report, Mueller lays out an entire menu of "potentially obstructive acts" (Vol. 2, Page 1) committed by Trump, including trying to convince FBI Director James Comey to drop the investigation of National Security Director Michael Flynn; firing Comey to try to derail the investigation; trying to curtail Mueller's investigation; trying to have White House Counsel Don McGahn instruct Deputy Attorney General Rod Rosenstein to remove Mueller; trying to convince McGahn to lie about the effort to remove Mueller; and trying to dissuade Paul Manafort, Flynn and others from providing information to Mueller.

It was perfectly predictable that Barr would protect Trump at all costs. Trump nominated Barr because Barr had sent an unsolicited 19-page memo to the president's lawyers arguing that the investigation into whether Trump obstructed justice in the Russia probe was "overly aggressive" and "fatally misconceived." Barr had prejudged Trump innocent before Barr became Trump's attorney general.

I asterisked (*) below a section of the article that illustrates the main theme: namely that large media conglomerates paid "beaucoup" (bookoo) bucks for digital media outlets speculating that they would be worth a lot more in the future because of their potentially reaching millions of young people in
the know.

These tech-savvy digital media companies, it was once thought, would be the proverbial goose that laid the golden egg. Companies like Univision, Comcast and Disney spent hundreds of millions, and were willing to spend as much as billions to obtain these properties. They all lost money. Digital sites like Gawker, The Onion, Vox and Buzzfeed. But Disney did not lose money in the move it made in "writing off" their investment into Vice Media/Vice News, so don't worry your little head about them. Neither did Vice News and others. Vice Media co-founder Shane Smith is a billionaire, so "don't cry for me Argentina."

Just so people know how others fared (although it has nothing to do with why I posted Vice News' reading of The Mueller Report):

Mic: which raised more than $60 million, sold for less than $5 million late last year.
Mashable: which was valued at about $250 million in 2016, sold for less than $50 million in 2017.

All of those companies have different stories and different particulars. The through-line is that a few years ago, all of them were confident that they were going to shoot up in value, because they knew how to reach young audiences by exploiting the big tech platforms — in particular, Facebook and Google.


Instead, Facebook and Google have hoovered up the majority of digital ad revenue — the money the new publishers expected to get once they reached scale. And publishers that had expected Facebook and Google to rely on them for content have learned that Facebook and Google don’t really need them, after all.

Here are the Disney/Vice particulars: Disney told investors Wednesday it had wiped out $353 million of the money it had previously put into Vice. That followed an announcement last fall that Disney had knocked down the value of its Vice investment by $157 million.

Disney declined to comment. But one bit of language in Disney’s quarterly filing Wednesday is telling: Disney describes the $353 million “impairment charge” it took on Vice as a “write-off” — which in accounting-speak means there’s nothing left to get rid of after this. It’s all gone.

Per Investopedia: “A write-down becomes a write-off if the entire balance of the asset is eliminated and removed from the books altogether.”

If you’ve been doing the math, you’ll note that $353 million plus $157 million is $510 million — well more than the $400 million Disney invested directly in Vice.

Since Disney won’t comment, we will assume that the additional sum includes Vice investments that Disney owned through A&E, the TV programmer that Disney owns along with Hearst, which also backed Vice; as well as $70 million that 21st Century Fox sunk into Vice. That ownership stake transferred to Disney earlier this year when Disney bought a good chunk of the Fox empire.

One last caveat: You can’t say that Disney is saying Vice Media isn’t worth anything at all — just that Disney thinks its investment isn’t going to be worth anything. That’s a distinction with a difference for some Vice investors, who have deals that allow them to get their money from the company, in the case of a sale, before other investors.

In any case, Vice is certainly worth much less than Disney and many other big, sophisticated media companies thought quite recently. And while Disney can’t feel great about losing money on Vice, it will be quite happy that it didn’t pay billions for all of it — an idea that seemed very plausible as recently as 2016.

Vice, meanwhile, is trying to overhaul itself under the leadership of CEO Nancy Dubuc, who took over for founder Shane Smith a year ago. Dubuc has been tasked with cleaning up the company’s books, as well as its in-house ethos.

Vice and Smith, who remains the company’s executive chair, used to revel in a pirate persona. But now, in the #MeToo era, the company has apologized for a “detrimental ‘boy’s club’ culture that fostered inappropriate behavior that permeated throughout the company.”

6ix, nobody has to buy Congress or the White House. They already sold themselves BEFORE they got into politics. Actually, they were sold before they were born, back in the days of George Washington and Thomas Jefferson, when the voters kept electing the wealthy slave-owners to Congress and the Presidency. Voters had a high tolerance for slave-owners (exception for the owners that habitually tortured their slaves -- that could disqualify a politician with the voters). These crappy voters got the crappy government they deserved. That never stopped, even until today, although we no longer have the easy tattletale of slave-owner/not-slave-owner to sort out who should not be elected. But we do have a newer selection criteria: pays-taxes/cheats-on-taxes as a substitute for sorting candidates.

The government never, never, never had the equivalent of football referees to call a foul or penalty on illegal moves by Congress or the White House, so there is rampant cheating going on all the time in the game, cheating that can be seen by the audience, who are people like you and me. But the fun part is that half of the audience declares there is no cheating when it is a player from their side who just cheating in front of everybody in the world. The audience is worse, a more dishonest bunch of cheaters, than the players.

What government really needs is either referees that can instantly penalize the players or it needs an audience that will rush onto the playing field and penalize a cheater.

6ix, nobody has to buy Congress or the White House. They already sold themselves BEFORE they got into politics. Actually, they were sold before they were born, back in the days of George Washington and Thomas Jefferson, when the voters kept electing the wealthy slave-owners to Congress and the Presidency. Voters had a high tolerance for slave-owners (exception for the owners that habitually tortured their slaves -- that could disqualify a politician with the voters). These crappy voters got the crappy government they deserved. That never stopped, even until today, although we no longer have the easy tattletale of slave-owner/not-slave-owner to sort out who should not be elected. But we do have a newer selection criteria: pays-taxes/cheats-on-taxes as a substitute for sorting candidates.

The government never, never, never had the equivalent of football referees to call a foul or penalty on illegal moves by Congress or the White House, so there is rampant cheating going on all the time in the game, cheating that can be seen by the audience, who are people like you and me. But the fun part is that half of the audience declares there is no cheating when it is a player from their side who just cheating in front of everybody in the world. The audience is worse, a more dishonest bunch of cheaters, than the players.

What government really needs is either referees that can instantly penalize the players or it needs an audience that will rush onto the playing field and penalize a cheater.

I never said that Trump didn't cheat his taxes, although I'm guessing that what he did with them is entirely legal according to the rule of law that has been written by crooked politicians over the years.

If broken down by the people under a microscope, seeing what the Rich are allowed to get away with by having Trumps mountains of paperwork available to pour through might enrage people... at least until another war is started to distract them.

I find it hilarious that when Obama's returns were released that they were a simple two sided form like the rest of us on a payroll have, as if that's the only money he made and the only taxes he paid. I'm assuming that if Hillary were voted in, we'd see something quite similar from her as well.

Judge orders public release of what Michael Flynn said in call to Russian ambassador

A federal judge on Thursday ordered that prosecutors make public a transcript of a phone call that former national security adviser Michael Flynn tried hard to hide with a lie: his conversation with a Russian ambassador in late 2016.

U.S. District Judge Emmet G. Sullivan in Washington ordered the government also to provide a public transcript of a November 2017 voice mail involving Flynn. In that sensitive call, President Trump’s attorney left a message for Flynn’s attorney reminding him of the president’s fondness for Flynn at a time when Flynn was considering cooperating with federal investigators.

In one of the unredacted filings released Thursday, prosecutors said Flynn described multiple episodes in which “he or his attorneys received communications from persons connected to the Administration or Congress that could have affected both his willingness to cooperate and the completeness of that cooperation.”

In addition to the transcripts, it also is possible that the judge may release the audio recordings of the conversations. In his Thursday order, Sullivan directed that the government provide a copy of those recordings to him in his chambers, along with any other calls Flynn made to the Russians, so he can review them.
