The heart of the impeachment charges against Trump

www.motherjones.com/kevin-drum/2020/01/ukrainegate-is-all-about-a-pers
onal-benefit
/

There’s the matter of the Ukrainian aid. Republicans perceive Democrats as simply ignoring the long history of administrations using aid to reward or punish foreign governments for their actions.

This is it. The big difference between Trump and Biden — and everyone else — is that Trump used military aid as a way to extort a personal benefit from Ukraine. That’s the start and the finish of the whole thing. If he had used military aid as bait to get Ukraine to fall in line with American interests in one way or another, no one would have blinked. But Republicans pretend that Joe Biden did the same thing, withholding aid to Ukraine in return for firing a prosecutor who was investigating Hunter Biden. This is simply a lie. Biden was publicly carrying out US policy which was supported by the president, the State Department, and virtually all of Europe.

Trump used the aid as bait to get a personal favor from Ukraine: namely an investigation into an opponent in a presidential campaign. That’s as plain an example of abuse of power as you could imagine. And after he was caught, Trump didn’t apologize or promise not to do it again or anything like that. He conducted a scorched-earth attack that left Democrats with no choice but to impeach.

Lots of my fellow liberals have been calling for Trump’s impeachment practically since he was elected. I haven’t. As much as I loathe the man, I didn’t think he had done any single truly impeachable thing, and I also wasn’t sure that impeachment was politically wise anyway. Then came Ukraine. I continued to think that impeachment might be politically unwise, but it took only a few weeks for the question of whether Trump’s actions were impeachable to become obvious. Of course they were. Secretly withholding congressionally approved military aid in return for a personal benefit? Putting responsibility for this in the hands of his personal lawyer instead of US diplomats? Instructing aides to lie to Congress about what was going on? Politically wise or not, of course Trump had to be impeached over this. It would be both cowardly and a mockery of the Constitution to do otherwise.

But this all hangs on the fact that Trump’s price was personal, not national. This is the thing that I suspect hardly anyone really gets. Investigating a campaign opponent is a personal benefit. In an autocracy, campaigns are treated as mere appendages of governing, but in democracies they aren’t. We’re a democracy.

Mitch McConnell has one goal here: to keep the trial short and the public bored enough not to watch it. Refusing to allow new evidence is part of that: it ensures that nobody bothers turning on their TV in hopes that something new and exciting will happen. With no new testimony, what then is the point of watching?

As long as the trial is short and dull, McConnell wins. Very few people even know who John Bolton and Mick Mulvaney are, let alone whether they avoided having to testify.

Probably because most people know he's guilty af and they also know the math is against removing him. So no surprises, no drama - dullsville.

Now, if they could call witnesses and get 'Stache and Harry Potter on the stand... that'd be must see tv.

The Senate itself is on trial

The first question is whether Senate Republicans will hear all the relevant evidence or merely orchestrate a coverup. There are many fact witnesses who have not yet testified, including the president himself, and floods of relevant new documents emerge virtually daily. To actually try the case, the Senate must hear those witnesses and consider those documents. To refuse to do so is to deny the implicit constitutional mandate requiring an honest and good faith proceeding in the Senate to establish the truth.

Those Republicans feel compelled to engage in such transgressions for an imperative political reason. They recognize that they must exclude those witnesses and documents because they would further support the case against Trump. Indeed, their determination to exclude that very evidence testifies to their recognition that, if it is considered fairly, the additional information would almost certainly require that they convict Trump.

And here is the second article of impeachment against Richard Nixon:

He misused the Federal Bureau of Investigation, the Secret Service, and other executive personnel, in violation or disregard of the constitutional rights of citizens, by directing or authorizing such agencies or personnel to conduct or continue electronic surveillance or other investigations for purposes unrelated to national security, the enforcement of laws, or any other lawful function of his office….

Back in 1974, directing an “investigation” for purposes “unrelated” to lawful functions of the office produced a 27-11 vote in the Judiciary Committee for impeachment. Those 11 votes against impeachment? That was 11 Republicans. If the vote was today, all the Republicans would have been against impeachment of Nixon. Today, extorting an investigation from Ukraine for personal gain produces nothing but sophistry from Republicans.

It is plain to everyone that Trump’s lengthy battering of Ukraine — which went on for months and months — was not a legitimate use of his office. He never asked Ukraine to take action against corruption in general. He asked for only one thing: an investigation of Hunter Biden. That’s it. That’s all he wanted. And it was worth millions of dollars to him, far more than any ordinary illegal campaign contribution delivered in a plain black suitcase.

If the Republican Senators weren't toads, they would rid themselves of Trump over his handling of tariffs:

So here’s the story: Donald Trump has abused the powers of his office to threaten a U.S. ally. His threat is probably illegal; his refusal to produce documents about his decision process is definitely illegal. And his claims about the motivation for his actions don’t pass the laugh test.

You probably think that I’m talking about Trump’s attempt to pressure Ukraine into producing political dirt on Joe Biden by withholding aid, and the subsequent cover-up — you know, the stuff for which he has been impeached (and that half the country believes should lead to his removal from office). But there’s another, somewhat similar story: his repeated threats to impose prohibitive tariffs on imports of automobiles from Europe.

Granted, the auto tariff story isn’t as vile as the Ukraine story, and it poses less of a direct threat to a fair election. But it’s recognizably part of the same syndrome: abuse of presidential power, contempt for the rule of law, and dishonesty about motivations.

Some background: U.S. tariffs — taxes on imports — are normally set the same way we set other taxes, through legislation that must pass Congress and then be signed by the president. The law does, however, give the president discretion to impose temporary tariffs under certain circumstances, for example to give U.S. industries a breathing space in the face of sudden import surges, to counter foreign export subsidies or to protect national security (Section 232).

Until Trump, Section 232 cases were rare. He has, however, used the national security justification for tariffs with abandon, and zero regard for plausibility. Canadian aluminum poses a national security risk? Really?

And so it was that in 2018 the Trump administration announced that it was beginning a Section 232 investigation of auto imports, especially from Europe and Japan. Every trade expert I know considered the notion that German or Japanese cars constitute a threat to national security absurd. Nonetheless, in 2019 a report from the Commerce Department concluded that auto imports do, indeed, endanger national security.

What was the basis for this conclusion? Well, we don’t actually know — because the Trump administration has refused to release the report.

This stonewalling is clearly illegal. The statute requires that all portions of the Commerce report that don’t contain classified or proprietary information be published in the Federal Register, and it’s hard to believe that any of the report contains such information, let alone the whole thing. Furthermore, Congress inserted a provision in a spending bill last month specifically requiring that the Trump administration turn over the report.

Why won’t Trump obey the law and hand over the document? My guess is that his people are afraid to let anyone see the Commerce report because it’s embarrassingly thin and incompetent. To be honest, I have some doubts about whether the report even exists.

About 72% agreed that the trial should allow witnesses with firsthand knowledge of the impeachment charges to testify, including 84% of Democrats and 69% of Republicans. And 70% of the public, including 80% of Democrats and 73% of Republicans, said senators should act as impartial jurors during the trial.

If you needed a reminder of what’s at stake in President Trump’s impeachment trial currently underway in the Senate, the danger Trump’s pattern of behavior poses for all of us for as long as he is president, Rep. Adam Schiff cut through the moral clutter Thursday during his closing statement. It’s been a long three years, and even if you know Trump committed a crime or simply violated the oath of his office, it’s easy to be lulled into the GOP-induced nihilism that maybe this isn’t such a big deal, maybe it’s normal, and finally maybe it’s too much, too far to remove a president, even Donald Trump, from office for it.

To this ethical fog, created by Republican relativism, Schiff provides a succinct and often stirring rebuttal, reminding reasonable, likeminded Americans, first, to trust themselves. Schiff then makes the case for why Trump is dangerous to America’s national interest and thereby dangerous to Americans themselves.
Quote:

Does anybody really question whether the President is capable of what he’s charged with? No one is really making the argument that Donald Trump would never do such a thing, because of course we know that he would, and of course we know that he did.

It’s a somewhat different question though to ask, okay, it’s pretty obvious, whether we can say it publicly or we can’t say it publicly, we all know what we’re dealing here with this President. But does he really need to be removed? And this is why he needs to be removed: Donald Trump chose Rudy Giuliani over his own intelligence agencies. He chose Rudy Giuliani over his own FBI Director. He chose Rudy Giuliani over his own national security advisers.

When all of them were telling him this Ukraine 2016 stuff is kooky, crazy Russian propaganda. He chose not to believe them. He chose to believe Rudy Giuliani. That makes him dangerous to us, to our country. That was Donald Trump’s choice. Now, why would Donald Trump believe a man like Rudy Giuliani over a man like Christopher Wray? Okay. Why would anyone in their right mind believe Rudy Giuliani over Christopher Wray?

Because he wanted to and because what Rudy was offering him was something that would help him personally. And what Christopher Wray was offering him was merely the truth. What Christopher Wray was offering him was merely the information he needed to protect his country and its elections, but that’s not good enough. What’s in it for him? What’s in it for Donald Trump? This is why he needs to be removed.

Now, you may be asking how much damage can he really do in the next several months until the election? A lot. A lot of damage.

A flash from the past - November 29, 2018:

The third remarkable thing about Cohen’s plea was its substance. The president of the United States’ personal lawyer admitted to lying to Congress about the president’s business activities with a hostile foreign power, in order to support the president’s story. In any rational era, that would be earthshaking. Now it’s barely a blip. Over the past two years, we’ve become accustomed to headlines like “President’s Campaign Manager Convicted of Fraud” and “President’s Personal Lawyer Paid for Adult Actress’s Silence.” We’re numb to it all. But these are the sorts of developments that would, under normal circumstances, end a presidency.

A blast from the past – the 20th Century:

Year after year, Mr. Trump lost more money than nearly any other individual American taxpayer when his results were compared with detailed information the I.R.S. compiles on an annual sampling of high-income earners. His core business losses in 1990 and 1991 — more than $250 million each year — were more than double those of the nearest taxpayers in the I.R.S. information for those years.

From 1986 through 1988, while his core businesses languished under increasingly unsupportable debt, Mr. Trump made millions of dollars in the stock market by suggesting that he was about to take over companies. But the figures show that he lost most, if not all, of those gains after investors stopped taking his takeover talk seriously.

Trump has filed lawsuits against his banks and accounting firm to prevent them from turning over tax returns and other financial records and therefore we can’t place a number on Trump’s more recent incompetence at running his businesses.

www.nytimes.com/interactive/2019/05/07/us/politics/donald-trump-taxes.
html

Trump, at 73, is as financial incompetent and fiscally untruthful as he was in his 40’s. How can you know for sure, since he has 3 Supreme Court cases pending to keep his tax returns secret when laws say he is suppose to make his returns public? You only need to look at the accelerating National Debt to know that. If he actually understood money, and his business history says he does not, the debt would decrease during boom times, or at least decelerate the increase.

Yanno, given that we've long since moved to a currency beyond money and built on nothing but ones and zeros floating around in the ether that can't even be backed up by the printed monopoly money anymore, the ONLY thing that keeps the US currency value is faith.

That's something that I've heard my entire freakin' life, but it's never been more true than it is today with $22 Trillion+ debt.

That being said, it's not idiots like you that I'm worried about, when stories like these come out. It's the rest of the world that somehow still thinks it's a good idea to base every other currency against ours, and those who would like nothing more than to untie the US dollar from Oil. (Russia IS on that list, BTW)

Because of this, Russ Buettner and Susanne Craig and the NYT in general are putting out propaganda that is tantamount to treason.

Conservative commentator George Will offered a stirring and stark assessment of what Donald Trump's presidency will mean for our politics and our culture:

"I believe that what this president has done to our culture, to our civic discourse ... you cannot unring these bells and you cannot unsay what he has said, and you cannot change that he has now in a very short time made it seem normal for schoolboy taunts and obvious lies to be spun out in a constant stream. I think this will do more lasting damage than Richard Nixon's surreptitious burglaries did."

That's George Will, folks. Not Rachel Maddow.

Will's broader argument is that Nixon's coordinated burglaries at the Democratic National Committee were secret and, once revealed, broadly condemned by the public and the two political parties. What Trump is doing is happening right in front of our faces -- and with the assent of the Republican Party.

It is not faith in the US dollar that gives it value; it is that the US can make the world bend to its will. But once too many Americans get fat, lazy, and stupid (95% of Trump voters have one or more of those qualities) especially in the Pentagon and the White House, America won't be able to bend a wet noodle and dollars will depreciate accordingly.

You still don't understand that probability of Trump winning is only 50/50. I'm voting for the Democrats, but you are gonna get the enema from the GOP, 6ix, because you are a little bit poor and a whole lot stupid.

Trump told his then-national security adviser in August that he wanted to continue freezing $391 million in security aid to Ukraine until officials there helped with investigations into Democrats, including former Vice President Joe Biden. I don't think 20 GOP Senators will vote to remove Trump because of that fact, but millions of voters would. Since Trump only won by 77,744 Votes, that could make a difference.

Countdown Clock, Trumps Removal 'Starts'

So we all agree - the Senate isn't going to remove Trump.

I think this topic is dead, but just like the Mueller report, there'll be people who just can't accept reality. And this thread will stumble on and on and on, until something else loud and shiny is put in front of them, and they can mercifully let reality fade into oblivion.

I mean, how long did it take for the Mueller threads to die?

Did they finally agree that the Senate isn't going to remove Trump. I've only been telling them that since day freakin' one.

But, what about the Secret Ballot?!!!!! I thought the Secret Ballot that would require 81 senators to be on board with was going to save the world from Trump!!!!

Guess we'll just have to wait until he's voted out in November....

You keep citing Odds Shark without understanding what it is telling you. Maybe if you convert from the 3 methods of stating odds that most bookmakers and websites support into "Implied Probability" you will understand how likely an outcome is.
www.aceodds.com/bet-calculator/odds-converter.html

Odds To Win 2020 Presidential Electoral College
Option Odds
Donald Trump -130 or Implied Probability 56.5%
The Field +110 or Implied Probability 47.6%

Which Party Will Win The 2020 U.S. Presidential Election?
Party Odds
Democratic Party +115 or Implied Probability 46.5%
Republican Party -150 or Implied Probability 60%
Odds as of January 21 at Bovada
www.oddsshark.com/other/2020-usa-presidential-odds-futures

So the chances of Trump reelection are 56.5% or 60% depending on how you ask the question.

If, only last week, Trump had gone from threatening to overthrow Iran's government to actually bombing Iran's government, his Implied Probability of a second term would have dropped. In his second term, he will actually start bombing Tehran.

No I'm not. I already know he's innocent. I'm just extremely confident he wins too, is all.

The fallacy of Second's argument lies in the fact that it's Trump VS. Everybody Else right now. Once there's only one Democrat up there with a stance that varies wildly from the candidate that other people were backing, those odds (which are already very much in Trump's favor) are going to improve for Trump. You have at least two parties within the Democrat party right now.
