A Trump defense team lawyer, Patrick Philbin, could only muster a weak response to Sinema.

Congress is NOT really bad at its job. Congress correctly sees, in my opinion, its job as getting reelected. Then who is bad? It is the majority of voters who keep reelecting the same old Congressmen: Reelection Rates Over the Years
Few things in life are more predictable than the chances of an incumbent member of the U.S. House of Representatives winning reelection. Senate races still overwhelmingly favor the incumbent, but not by as reliable a margin as House races.

I want to get rid of Senator Cruz and Cornyn, but the majority of Texas voters will keep reelecting those two failures forever. The voters would force/demand that their Congressman make the decision to go to war if the voters were required to go to the war the President starts.

But you have probably noticed, almost no voters go to war. Instead, mercenaries do the fighting and they do a crappy job, too, losing constantly because they do it mostly for their pay, not for a win. The voters are not at risk themselves, which is why they act irresponsibly about the wars the President starts.

The number of mercenaries is small compared to the number of voters who make money from the jobs created by the defense industries. That is another reason for voters and Congressmen to be irresponsible about going to war. The way to fix the system is to make the voters suffer or die when they make the wrong decision.

Even better idea: if the President loses a war or it is a stalemate, execute the President. That ought to be in the Constitution. It would certainly make Presidents more cautious about going to war.

Term limits is a crappy solution because it kicks out perfectly good Congressmen and it still does not force them to vote yay or nay on war. What you have not grasped is that tinkering around with the rules won't fix the problem of going to war whenever the President, one person, is in the mood. You'd have to change things either
1) radically -- a national referendum on a Declaration of War
or
2) thoughtfully -- the voters act like they give a damn about the Constitution, which requires Congress to declare war.

Placing term limits on Congressmen won't make them want to decide about war. If nobody is supervising/threatening Congress, it will just goof-off, doing only the parts of the job that are easiest.

The choice is really either the voters very slowly making the War decision themselves or the voters forcing Congress to make the decision slightly faster, or to violate the Constitution by letting the President make fast and ridiculous decisions about War. Term limits is not any one of those; it will do nothing.

You've changed topic so much here today that I'm having a hard time remembering what we were arguing about in the beginning, and an even harder time caring about it at all.

We're agreed that most people are stupid.

I'm of the mind that "average" intelligence means dumb, and those who sit right in the middle shouldn't be happy with where they're sitting.

Back when Nixon was in Watergate trouble, there weren't enough Republican votes in the Senate to remove him, but for the good of his political party Nixon stepped down to let Gerald Ford, his perfectly satisfactory V.P., run the country and run in the next election. There will never be enough Republican Senators voting for removal of a Republican to be replaced with perfectly satisfactory V.P. Mike Pence. And Trump would never step down to help his party. Besides, once he steps down Congress will get him for income tax evasion. Nixon also got caught cheating on his taxes by Congress. Trump Is Counting on the Supreme Court to Save Him

The president’s remarkable lawsuit against his own accountants and bankers can succeed only if the conservative majority intervenes on his behalf. Plainly, there is something in Trump’s tax documents that Trump dreads letting the world see.

The issues raised by impeachment in early 2020 come roaring back for the election finale. Trump’s evident corruption, the questions over his thralldom to the Putin regime in Russia, the refusal of the Republican Party to uphold law when inconvenient to Trump—you thought we’d talked them to death during impeachment? There is so much more to come.

Sometime before June 29, 2020, the U.S. Supreme Court will either plunge the United States into the severest constitutional crisis of the Trump years—or save Americans from that crisis.

Three different committees of Congress, as well as New York State prosecutors, have issued subpoenas to President Donald Trump’s accountants and bankers for his tax and business records. Trump has sued to stop the accountants and bankers from complying. He has lost twice at the district-court level and twice at the appeals-court level. Now he is looking to the conservative majority on the Supreme Court to rescue him.

On March 31, the court will hear oral arguments in the cases of Trump v. Mazars and Trump v. Deutsche Bank. The decision will be rendered sometime between then and the court’s summer break.

Although Trump is suing his accountants and his bankers as a private citizen, his case has been joined by the Department of Justice. Solicitor General Noel Francisco has signed an amicus brief on behalf of the United States. It is an astonishing document. It invites the Supreme Court to junk two centuries of precedent—and to substitute an entirely new system of judicial review of congressional subpoenas that involve a president:

A legislative subpoena must therefore satisfy heightened requirements when it seeks information from the President. At the threshold, the full chamber should unequivocally authorize a subpoena against the President. Moreover, the legislative purpose should be set forth with specificity. Courts should not presume that the purpose is legitimate, but instead should scrutinize it with care. And as with information protected by executive privilege, information sought from the President should be demonstrably critical to the legislative purpose. A congressional committee cannot evade these heightened requirements merely by directing the subpoena to third-party custodians, for such agents generally assume the rights and privileges of their principal, as this Court has recognized in analogous cases.
All the requirements in that above paragraph were devised for purposes of this litigation. None of them has ever been enforced—none of them has ever been imagined—in the previous 230 years of skirmishing between Congresses and presidents. Every must and should and cannot was invented in this very brief, for the immediate legal purposes of this president in this dilemma. The solicitor general might as well have said that subpoenas must be delivered by a sled pulled by flying reindeer, for all the connection between these demands and the previous constitutional history of the United States.

As the House of Representatives noted in the brief it filed, previous Congresses have obtained the bank records of Presidents Andrew Johnson and Jimmy Carter, and the tax records of President Richard Nixon. They have read the diaries of President Ronald Reagan and the law-firm billing records of first lady Hillary Clinton.

It’s never before been the law that a subpoena of the president must be authorized by “the full chamber,” much less that this authorization be “unequivocal”—whatever that means.

It’s never before been the law that the president’s privileges—whatever they are—also extend to his private business agents.

It’s never before been the law that the courts set themselves over Congress as scrutinizers of its subpoenas, approving or disapproving. Until now, instead, courts have always extended the utmost deference to congressional investigations, from the first Washington administration onward.

The Trump administration cannot cite case law for any of its new demands.

You read that right. 47.3% approval, vs. 49.3% disapproval. The best looking number's he's seen in either category since he was elected, and continuing to trend up.

Even the "experts" have said that Trump is a lock at 47%.

I don't think it's going to stay that high, but after all of this Trump should find a new floor, probably no lower than 46% unless all of this nonsense somehow drags on through the whole summer.


Trump wins in November easily if he is still at 45%.
