This has already been posted at Whedonesque, but I figure us over here at Fireflyfans ought to check it out as well. Also, Joss got his own 2 cents in during the Whedonesque thread, which I included below.

The site in question:
http://www.intotheblack.ca/

The Whedonesque link:
http://whedonesque.com/comments/9657

Joss' comment in the Whedonesque thread:
---
I hate to have to do this, but this has become a legal matter.

Sirs --

"According to article 16C-12 of the M.P.A., no entertainment (intended for television, radio or internet broadcast) based upon existing licensed intellectual properties may in any way be allowed or approved of by creator(s) of said intellectual property. Further, upon notification of such unauthorized entertainment, said creator(s) is in no way legally sanctioned to comment upon same. Creator(s) shall in no way refer to said unauthorized 'show' or 'site' as "wicked cool" or "bitchin'." Examination of the ship (herein designated "Samsara") shall not be in any way legally awesome, and creator(s) shall not in any contractually binding way grin. The perpetrators of this entertainment shall not have fuzzy feelings, nor be, under penalty of fine or imprisonment, all up in themselves. Dag, yo."

I hate to throw cold water on a well-meaning enterprise like this, but that's the law. Meanwhile, I in no way eagerly await the first episode or think it's about damn time this universe was expanded just a little bit more. However, I think I can safely make one or two suggestions to help. One: Have the characters get into all sorts of shenanigans on a regular basis. Two: Always remember that the integrity of your universe's reality must be maintained unless you think of something cool. Three: Have Chekhov get really old.

Thank you for understanding my precarious legal position on this. I wish I could be more supportive, but I am a machine. An android cannot cry, except that nancy-boy The Vision, who, let me tell you, you don't wanna see "Terms of Endearment" with that guy, you can't even hear the movie.

Sincerely, The JossWhedonbot, model 421-C-aplhadog-12(defective).

Sounds interesting, never been a big fan of expanded universe type stuff, but I think I'll give this a good look.

That's too bad about Joss and his "legal obligations".

I'm confused...WHAT"S SHE DOING ON THIS SHIP?!!!!!

But seriously, is this for real? A new TV series in the 'verse? go-se! It can't be true. That would be too good to exist in this feeble thing we call reality.

I'd sure like to know what station in Canada is supporting them, cause maybe I can get a contract to do cartoons for them. Always planning ahead I am, Sam.

I think that the most interesting part about all this is learning more and more about the show as days go by.

For instance, since the website was posted yesterday, 4 new images depicting the production process have been put up, several blogs from the cast and crew have been added, and a nifty CG pic of the Samsara in flight has appeared.

What's more, all this is being done by fans and funding is coming out of their own pockets.

Hopefully, these Firefly/Serenity fanfilms will catch on and soon everyone will be making them. Then we can all reminisce about the good-ol'-days of 'Mosquito', 'Waiting for Serenity', and 'Into the Black'.

Just thought I would chime in, seeing as how I'm the producer of this here thing.

First off, it is being done in "episode" format. It will be downloadable off of the net when we actually get it done. No t.v. stations involved.

Secondly, we have sooooo much more content to post up on the website, it is just a matter of getting it done. We start filming on Saturday, so we're kinda swamped at the moment.

But yeah, we're funding this all with money from our own pockets. Or rather the money we've pulled up from underneath the couch cushions.

I realize a lot of expanded universe stuff sucks. But we have specifically made an effort to NOT suck. I know there will be people against the whole idea - but hey, we're not crossing over into canon here. We're doing this cause we thought it would be a fun project. Plus, it gives us a chance to run around with guns and make lewd comments in Chinese.

Be glad the Browncoats are hungry for more content. A few months back, someone posted info about a Star Wars fan-film they were making, which he was in negotioations with Adam Baldwin to do a guest-shot in, and the poor guy was torn apart on these boards.

Really quite intrigued by this. Spent some time digging around the site, and it looks quite promising. Obviously trying to make something that's more than the average fan vid (and nothing against those at all, either...)

Looking forward to seeing how this turns out. Obviously I'll totally support it even if it turns out to be total goh-se but it looks like everyone involved is really putting some serious effort in. (And look how well that worked out with Firefly...:)

Anyways, just me saying good luck with the shiny.

I've never been a fan of that "expanded universe" stuff, either.
Reading and writing fanfic is a nice little way for people to amuse themselves, but if you really want to engage in a creative endeavor, try creating your own universe! Use Fanfiction (or fanmovies?) as a creative exercise, and then branch out. Who knows where the next Tolkien is hiding? But we'll never find out if they keep on doing nothing but creating new stories in someone else's world. We've all read fanfiction that is pure crap, but is a nice little way for beginning writers to start stretching their muscles. But we've also all read stuff that so good that we have to wonder, "Why isn't this person a published writer yet?" Oh, yeah, 'cuz all they're doing is fanfiction...

I am such a little grinch.

WhoMe, I don't feel that fanfiction is a bad idea at all. As a new writer myself, I find it much less intimidating writing in someone else's 'verse than my own. (Hey! Double meaning...LOL) The creative process has already begun for you: the characters are already fleshed out and a lot of the atmosphere is already done for you. As an inexperienced writer, that appeals to me very much. In this way I can concentrate on getting a feel of my own writing style by trying out others. Just like you do by writing a sonnet or haiku.

Do I have ideas of my own? Certainly. But this is a nice way to stretch my pens-manship muscles.

I find fanfiction the sincerest form of flattery for any genre. It means that you have affected someone in such a way that they can also see your vision. They respect it and love it so much as to spend hours, days, and weeks on writing something so precious to them. Is it copying? Of course it is.

And it's always a fanfic writer's dream to be picked up as a full time writer or to at least be noticed by the people who've created the world they are borrowing... Sure would be nice, wouldn't it?

These people who are doing Into the Black found recognition by the one who's work they admire. I, for one, am impressed beyond belief and wish them well. Not only that, but I bug them constantly asking when they'll be done so I can get my Firefly fix. Would I be excited if they took some of my writing and decided to use it? HELL YES!

Even if it's a fan film, even if it never gets seen by anyone but me. (Which is rediculous.)

Good luck guys. Your fellow Browncoats are rooting for you!

This is just a shameless try to keep this thread where people can see it. I've been wondering if any fan films would show up. It's not like we don't have enough scripts.

I wonder if Joss Whedon would be able to do the same that George Lucas did and make it perfectly legal and all that for fan films... It sounds like he wants to, but it may not be in his contracts.

This is just a general quesiton about Joss's terms. He said "wicked cool" I'm from MA and I was under the impression "wicked" was mostly only said around here and other parts of the country other people would look at you like "what?" if you said it. Have I been misinformed or do other people outside of MA use "wicked"?

Which is why I said that stuff about "writing exercise." Anyone who ever tried to be a writer (myself included) went through that phase of trying to emulate someone else's work, or "being inspired" by someone, or whatever. I used to write fanfic-like stories when I was a teenager, too. Lots of people did. It's fun. I'm just saying, I'd like to see what some of these people can really do once they stretch their muscles and start creating their own universes. When they start paying more attention to "fanon" than canon, and create whole new characters and situations, they're most of the way there, anyway.

Not all writers are thrilled by fanfiction based on their work. Anne McAffrey, for one, has some pretty strict rules about it. I know that at one point she was prohibiting any publication of it (including posting on websites). Now she's just got some "no slash, stick to the truth of the universe, and please use good taste" guidelines. And, while JK Rowling has said things like "I'm so glad to have ispired so much creativity," I've also read interviews where both she and the actors from the Harry Potter movies have expressed some alarm at some of the sex and violence in related fanfiction.

I know some people are going to be annoyed by my comments. To be clear: I've never seen this Vancouver show. For all I know, it's brilliant. My comments are on fandom creations in general.

In regards to this whole "fan fiction" thing, I personally think that writing someone else's character can sometimes be harder than writing your own. You have to stick to a very rigid definition of something that someone else has created. That said, fan fiction is usually just harmless fun. I don't think that the majority of people who write fan fiction have aspirations of becoming published writers. I don't see why so many people have problems with it.

In relation to our project - we are not using any previously created characters. We are simply using the same setting, and the same "tone". Other than that, it is an entirely original creation. A great deal of thought went into it.

Still, some people are going to ask why we are doing something based on a previously existing property, rather than doing something on our own. Why? Because we can. We're geeks, and we love Firefly, and this give us an excuse to hang out together, and do something we love. Who cares if anyone watches it in the end? It has been an absolute blast so far, and we're having a good time with it.

But in terms of the audience - fan films have one built right in. Star Trek fans will watch Star Trek fan films. Star Wars fans will watch Star Wars fan films. Hopefully, Firefly fans will watch our little fan film. Having a built in audience is quite the benefit. If we had instead gotten together and done a great coming of age story about a young girl and her pet iguana - we would have had a hell of a time getting people to watch it. By doing a fan film, hopefully some of the browncoats out there can have a helluva time right along with us!

There is another fan film in the works as well. I'm on the writing staff there. We have two scripts in the works right now. Check out the original thread I started a long time ago.

http://fireflyfans.net/thread.asp?b=2&t=14949

Also check out our website. We don't have much, but we have some shiny concept art for the characters and the story pretty much ironed out.

Check it out.

EDIT: I should warn you though.... We haven't hidden the story very well so if your dedicated enough you can happen on it. We have a rich background to all of the characters, so if you don't want to know what that history is I suggest you stay out of the Writing Forumn. Just a friendly warning.

Once we got the website we pretty much stayed there to converse on the story. It was slow going [mainly because we took a democratic approach to the script], but it's finally just about done, the script that is.

We hoping for a few episodes if possible, but we're going to do the first if it's not so at least we'll have that one.

We have a shiny poster on the way and some concept art for the characters. We also have some early CGI work done by myself and some others on the site. Fletch[designated leader] is in the process of making t-shirts. Once the script is done we're hoping to drum up some support of the project so we can start filming soon. Hopefully this summer.

We plan to start looking for actors when the scripts finished and we decide how's the best way to do it. Hopefully you all like it when it's finished. We're working really hard to give a rich story and character development, with a mix of action. Just about everything that it loved about Firefly.

Sure... if you do it right. I think what annoys people (what annoys me, anyway) is when the fanfiction writer screws with the character so much that they're almost unrecognizable. Different voice, different personality. Why bother using that character at all? Or, when they whine that the latest installment of whatever isn't in keeping with the "fanon." (This happened quite a bit when the latest Harry Potter book came out.) On the other hand, I never had any problem with the Star Trek series' that didn't involve direct input from Gene Roddenberry.

Yeah, I'll agree with ya on that one. If you're going to bother writing fan fiction, ya gotta stay true to the original work. I know we had some issues even with our script - though they were different characters, we had to make sure we sounded 'verse like. Took some thought.
