Copyrights, 'TNWSNBN', and a Browncoat Backup Plan

I had a question here. It seems to me that there are some pretty strong relationships that have developed in here and I assume that some of you have been chatting for several years now. I was wondering, considering that the reavers at "The Network Who Shall Not Be Named" have recently been cracking down on sites selling Firefly merch and had closed fansites for shows like X-Files in the past, is there a backup plan in case this site got a C&D notice.... perhaps another message board which could still have the browncoat feel without all the shiny Firefly pics or anything else that's copyrighted that could cause any problems with the evil copyright holders.

Just yesterday I had to watch an Office Max commercial bastardize another great song, "Takin' Care of Business", because they can afford the royalties, but us poor browncoats get shut down left and right.... no justice or room for creative growth in this corrupt, greedy, capitalistic and political system we live in. I can barely find any guitar tabs on the net now because an artist's interpretation of a song written on paper has been found in court to be a copyright violation now too.

Just a suggestion, but if the unthinkable ever happened, ya'all can feel free to message me on MySpace until we can figure out how to create another message board if nobody has a better plan at this point. Not sure if it would be the same feel considering that new browncoats would have a hard time finding us if we couldn't call ourselves a Firefly fansite at that point, but it would be a shame if the relationships built in here were to fall apart because of a copyright infringement.

Any thoughts.... suggestions?

I'd be very surprised if 'they' went after the fansites because that has proven a very damaging PR tactic. It's different when they go after websites selling their copyrighted logos when another company has paid for that right.

If they did, the cease and desist orders normally have a period of notice which would allow arrangements to be made. But like I said, this is very very doubtful.

Normally, I would be inclined to agree with you on that, but (and this is only hearsay) they did shut down the XFiles fansite. To my knowledge, they weren't selling anything there. They were just using pictures from the show.

That they did. Paramount has been worse when it comes to Trek.

Actually, this site would still be okay if the screen captures were removed, should a C&D come along. I think TNTSNBN learned a bit from the PR nightmare they got for the XF policing.

I am going to go with Simonwho on this one. It would be bad PR. We do promote the sale of their DVD's. So we are of some benefit. Free advertising of their DVD's certainly helps their sales.

And there is more than one site. They would have to close several. Each one is promoting the sale of DVD's, so they would be shooting themselves in the foot.

Wait a minute, didn't shoot themselves in the foot, by canceling Firefly, in the first place.

Most of what gives a company the right to shutdown a site in the US is some of its crazy laws e.g. the DMCA (This is actually the reason(s) why I made sure that my projects server(s) are not in the US). So, I imagine that simply moving the server out of the physical US would get rid of most potential legal matters.

That being said, if worse did come to worse, there are many on this board that are capable of setting something up, either temp. or perm. I count myself in this group.

So, if something did happen, Haken could contact me/us and we could figure something out (or not, he may prefer to work with (an)other(s) or figure something out himself). I know he has my email address as I've contacted him on several occasions; my offer stands.


At any rate, I really wouldn't worry about it.

Well there is also the site http://serenitymovie.org, its not exactly FFF.net I know , but its a great place plus good people there. And it is Universal related, and since the official movie site links to serenitymovie.org for forums, I would imagine they would never close that site down.

Many of the people who post here also post 'next door' as FollowMal would call it. We all have probably visited serenitymovie.org on more than a few occasions.

I don't see F** putting up too much of a fuss unless they're going to do a C&D on the photos and fan art that includes copyrighted material (screen caps, etc). Anything that isn't an outright original piece of art may be asked to be pulled, but original artwork is the property of the owner. (don't quote me!) Even those F-word space monkeys know that you kill the original fan art, the fans get REALLY ticked. Since we're the ones holding the cash that they want and we're doing their advertising, they can't be that dense.

Or maybe they can. Let's just hope F** people know where to draw the line before they cause some irreversible damage.

The fan merchandise was made to fill a void left by the blind eye that was turned to us. There was nothing left to buy once we had the ???one??? official tee shirt they put out and the series DVDs. So Browncoats stepped up and sold their creations because there WAS nothing else.

In a way, it makes me wonder. F** coming out with the episode companions and killing fan tee shirt companies... They're probably realizing that there finally IS a market for Firefly merchandise and realized they've missed out on our consumer dollars goin' on four years now. Thousands? Millions?

Wonder how much that works out to be in Alliance credits...

Just a thought-

Last I heard Firefly and Serenity wer split copyright-wise. Doesn't that mean that Universal would also have to order a C&D for this site to lose pretty much any of it's content? So much of the images look like they are from either property (ie- Firefly, BDM) that the Vampires who hired Joss to write about fictional Vampires would really have to wade through all of the content to crack down, and even then, there are so many pics from conventions, Serenity Press + BDM, I'm not sure anyone would care.

BTW- did anyone else notice that on the 'Versary Universal Studios ran out of "Serenity" DVDs? I ordered a gift of the BDM for my family and several other DVDs as per my promise to Universal as a 'thank you', and 'Serenity' was out of stock by the afternoon. Hope t was because of us- actually, I hope it was because of a legion of unknowing Browncoats in the making who have never heard of Firefly(yet!!!), but if it was because of us, then that's okay, too...

Well it seems that there already is a sort of backup plan in case anything happens. I certainly wouldn't rely on the "charity" of "TNWSNBN" or any large production studio. Here's hoping that they realize that we're giving them free advertisements.

I suppose you can do whatever you want to in this country as long as you are making the rich richer.
