In bizarre news: Biden's Justice Department moves to defend Trump in defamation suit from accuser E. Jean Carroll

Carroll has accused the former president of sexual assault and defaming her by saying it "never happened."

The Justice Department lawyers wrote that Trump was "crude and disrespectful" in questioning Carroll's credibility and that comments attacking her appearance, impugning her motives and implying that she had made false accusations "were without question unnecessary and inappropriate." But, they said, they "all pertained to the denial of wrongdoing."

Carroll's attorney Roberta Kaplan said in a statement: "The DOJ's position is not only legally wrong, it is morally wrong since it would give federal officials free license to cover up private sexual misconduct by publicly brutalizing any woman who has the courage to come forward. Calling a woman you sexually assaulted a 'liar,' a 'slut,' or 'not my type,' as Donald Trump did here, is not the official act of an American president."

Trump's legal team responded to the Justice Department's bizarre move, saying that the suit "must be dismissed in a straightforward application of Congress’s decision not to waive sovereign immunity for defamation."

After the Civil War, Confederate President Jeff Davis wrote a two volume history in which Lincoln was the bad guy and abolition of slavery was evil. Freeing the slaves caused the slaves great harm and it was all Lincoln's fault. Jeff Davis could prove he was good since he was never on trial for any crime. No crime. He was Innocent.

The Trumptards in Baytown Texas (where I live) valorized the Civil War by naming a local high school and junior college after Robert E Lee, famous Confederate General. You are probably aware of the Robert E Lee statues that Trumptards vehemently defend against Libtards' requests for removal from public places. General Lee has a history that is fascinating. The most insightful story is from when Lee was executor of his father-in-law's estate in 1857. Lee was directed in the will to free the slaves. He did not because, you know, slaves are worth money. Lee felt he had been wronged by the news media of his day. It was "Lee's first experience with the extravagance of irresponsible antislavery agitators." Lee was never arrested for treason or for murdering thousands. In the mind of Trumptards, that means Lee was as innocent as Trump is. I look forward to bronze Trump statues with him seated on a horse, perhaps waving a sword, paid for by grateful Trumptards. For teachers who violate Critical Race Theory bans, Trump has an answer: termination. As he proclaims in his op-ed: “States need to break the tenure monopoly in public K-12 schools…Educators who are alienating children from their own country should not be protected with lifelong tenure; they should be liberated to pursue a career as a political activist.”

Trump’s attack on teachers draws on fascistic eliminationist ideology, which depicts political “enemies” as a fundamental and existential threat to the nation that endangers its very existence, and which needs to be rooted out and burned away:

“Make no mistake: The motive behind all of this left-wing lunacy is to discredit and eliminate the greatest obstacles to the fundamental transformation of America. To succeed with their extreme agenda, radicals know they must abolish our attachment to the Constitution, the Declaration of Independence, and most of all, Americans’ very identity as a free, proud, and self-governing people. The left knows that if they can dissolve our national memory and identity, they can gain the total political control they crave.”

For those who don’t know the difference between conservatism and fascism, Trump’s statement above isn’t garden-variety conservatism. Conservatism values a nation’s traditions and history for its own sake, but recognizes the right of individuals to disagree without suggesting that those with whom we disagree are a threat to the nation that needs to be eliminated. Trump’s rhetoric ventures into fascistic territory, alluding to need to identify and eliminate existential threats to the nation and its existence, while also maintaining plausible deniability by failing to explicitly call for murder, vigilante violence, or mass incarceration against alleged “enemies” of the state. Such language has the dual advantage for fascistic ideologues like Trump of mainstreaming fascistic ideology, while allowing him to deny that he’s trafficking in dangerous and extremist ideas. In this case, the eliminationism he’s calling for doesn’t involve concentration camps and gas chambers, but instead a youth and parental coordinated mass surveillance state that destroys freedom of critical thought, inquiry, and expression.

Coupled with his reactionary education policy, Trump is setting the stage for a political-electoral return that looks to impose one-party rule and a soft coup in 2024 based on Big Lie election propaganda. Trump’s attempt to overturn the 2020 election results were clumsy, although no less authoritarian as a result. His legal efforts in the courts to overturn Biden’s wins in swing states were widely rejected by judges as baseless. His stoking of insurrectionists on January 6 caused much havoc at the Capitol, resulting in death and destruction, but he was ultimately unable to rollback certification via his attempted coup because House and Senate Democrats refused to comply with his efforts. But authoritarians’ attempts to overturn the rule of law are always outlandish and unrealistic, until they’re suddenly not – until the day that people start taking them seriously. This is what has been happening within the Republican Party throughout 2021, as Trump has consolidated official support behind his Big Lie election propaganda. This position has gained steam via the removal of Liz Cheney – the primary Republican who has opposed the Big Lie – from her leadership position in the House.

Like Hemingway’s Mike Campbell, the Trump Organization is confronting troubles that accumulated gradually and have coalesced suddenly. And once again, friends are at the bottom of it.

A grand-jury indictment of Donald Trump’s business and its chief financial officer, Allen Weisselberg, unsealed this afternoon in New York, alleges tax evasion arising from an attempt to pay Weisselberg and other Trump Organization executives extra money “off the books.” Prosecutors charge that Weisselberg and others received rent payments and other benefits without paying the appropriate taxes on them. Weisselberg and the Trump Organization have said they will plead not guilty.

So far, the danger is to Trump’s friends and his business, not the former president himself. But the danger could spiral, because Trump knew only so many tricks. If Trump’s company was bypassing relatively moderate amounts of tax on the income flows to Trump’s friends, what was it doing with the much larger income flows to Trump and his own family? Even without personal testimony, finances leave a trail. There is always a debit and a credit, and a check issued to the IRS or not.

An early indication that things may end badly for Trump is the statement released today from the Trump Organization. “Allen Weisselberg is a loving and devoted husband, father and grandfather who has worked for the Trump Organization for 48 years. He is now being used by the Manhattan District Attorney as a pawn in a scorched earth attempt to harm the former President. The District Attorney is bringing a case involving employee benefits that neither the IRS nor any other District Attorney would ever think of bringing. This is not justice; this is politics.”

Here is what is missing from that statement: “I’m 100 percent confident that every investigation will always end up in the same conclusion, which is that I follow all rules, procedures, and, most importantly, the law.” That’s the language used by former Trump Interior Secretary Ryan Zinke when he was facing ethics charges in 2018. Likewise, when Virginia Governor Terry McAuliffe was accused of violating campaign-finance laws in 2016, he too was “very confident” that “there was no wrongdoing.” Plug the phrases very confident and no wrongdoing into a search engine and you will pull up statement after statement by politicians and business leaders under fire. For some, their matter worked out favorably; for others, not so much. Either way, everybody expects you to say that you’re confident you didn’t do anything wrong. It’s the thing an innocent person would want to say. So it’s kind of a tell when it goes unsaid.

An earlier statement from Trump himself likewise omitted an affirmative defense of his company and its employees, and instead attacked the professional prosecutors as “radical Left” (not to mention “rude, nasty, and totally biased”). The key line in Trump’s own statement is an anticipation of the possibility that one or another of his friends might flip: “They”—the prosecutors—continue to be “in search of a crime; and will do anything to frighten people into making up the stories or lies that they want.”

One of Trump’s skills as a politician is preparing the battlefield in advance. In the case of his first impeachment, he chose to argue outright innocence—“it was a perfect call”—and no matter how mountainous the evidence of wrongdoing, that was the line he maintained to the end.

There are several clues in the indictment that others are cooperating against Weisselberg and the Trump Organization. One of the clues is pretty overt: the indictment states that Weisselberg lied to his tax preparer about his status as a New York City resident. Ivanka Trump could be the next target of Manhattan District Attorney's criminal investigation into Donald Trump and his family, a former federal prosecutor said.

Cynthia Alksne, a legal analyst for MSNBC and a former Assistant District Attorney in the Brooklyn, NY District Attorney's office, said Monday that the indictment presented in Weisselberg's case indicated that Ivanka Trump could be next to face charges.
