In “I won’t work in Attorney General William Barr’s Justice Department any longer,” Halpern painted a picture of Barr, a person who has “never actually investigated, charged or tried a case,” pulling the strings of the criminal justice system in order to help the 45th president and his allies. Halpern said he had hoped that Barr’s “preemptive misrepresentation” of the Mueller Report was “an honest mistake or a solitary misstep — rather than a deliberate attempt to conceal potential presidential misconduct.” He does not have those hopes now.

Halpern noted that Senior U.S. District Judge Reggie Walton said Barr “lacked candor” about the conclusions of the Mueller Report and “distorted” the special counsel’s findings. This was the first in a series of overtly political acts by a “lap dog” attorney general in “slavish obedience” and service of the president and his friends, Halpern wrote.

Washington (CNN)The White House was warned in 2019 that President Donald Trump's personal attorney Rudy Giuliani "was being used to feed Russian misinformation" to the President, The Washington Post reported Thursday.

Citing conversations with four former officials familiar with the matter, the Post said that US intelligence agencies warned the White House that Giuliani "was the target of an influence operation by Russian intelligence" in which Trump was the intended recipient of the misinformation.

The paper said the warnings were "based on multiple sources, including intercepted communications, that showed Giuliani was interacting with people tied to Russian intelligence during a December 2019 trip to Ukraine, where he was gathering information that he thought would expose corrupt acts by former vice president Joe Biden and his son Hunter."

One of the former officials told the Post that the warnings caused national security adviser Robert O'Brien to privately warn Trump that "any information Giuliani brought back from Ukraine should be considered contaminated by Russia."

Court documents said the six were officers in the Russian military's main intelligence directorate and used "some of the most destructive malware to date." Prosecutors said it caused blackouts in Ukraine, victimized the Olympics opening ceremony, and caused losses of nearly $1 billion to Pennsylvania's Heritage Valley Health System and three other U.S. companies, including a large pharmaceutical manufacturer.

The Russians were also accused of hacking and leaking materials targeting French President Emmanuel Macron's political party in 2017, attempting to interfere with the United Kingdom's 2018 investigations into the poisoning of Russian dissident Sergei Skripal and his daughter, and trying to compromise media in the former Soviet republic of Georgia in 2018 and 2019.

John Demers, Assistant Attorney General for National Security, said the behavior detailed in Monday's charges against Russian military officers amount to an accusation of the most disruptive and destructive computer attacks ever attributed to a single group.

"No country has weaponized its cyber capabilities as maliciously or irresponsibly as Russia, wantonly causing unprecedented damage to pursue small tactical advantages and to satisfy fits of spite," Demers said.

Charging documents said the Russians used malware known as KillDisk and Idustroyer, which caused the power blackouts in Ukraine from December 2015 through 2016, NotPetya, which caused the financial losses in the U.S., and Olympic Destroyer, which took over thousands of computers used to support the Winter Olympics.

How Biden Should Investigate Trump

The misdeeds and destructive acts are legion. The new president should focus on these three.

The third investigation (and third commission) would probe the Trump administration’s attacks on democracy itself. American democracy depends on rules, and it depends on norms. The rules largely involve setting the balance between majority power and minority rights. The norms involve the informal cushioning that keeps disagreements from becoming civil wars. There is no law spelling out the duty of the loser of an election to concede graciously to the winner. But that is what Richard Nixon did after his hair’s-breadth loss to John F. Kennedy in 1960, and what Al Gore did after his even narrower (and more controversial) loss to George W. Bush in 2000. Democracy depends on the “consent of the losers,” as political scientists have put it.

Over the past generation, rules and norms have eroded. There is a reason books on guarding against autocracy—for instance, On Tyranny, by Timothy Snyder, and Twilight of Democracy, by Anne Applebaum—have become popular. The erosion was transformed into deliberate policy during the Trump years. Even before he was installed in office, and with no evidence, Trump called into question the popular vote in the 2016 election, alleging that millions of ballots had been cast fraudulently. Trump created a task force to look into the matter, which generated headlines (but quietly disbanded when it found no fraud). Elections are in the hands of the individual states. Now emboldened, many state legislatures have used fraud as an excuse to erect new barriers to voting by the poor, by members of minority groups, and by immigrants—reversing the gains of half a century. When the pandemic hit, prompting a shift away from voting in person, the Trump administration falsely equated mail-in ballots with fraudulent votes. When Biden won a decisive victory in both the popular vote and the Electoral College, the president refused to concede and launched a war of attrition against the legitimacy of the electoral process itself.

An investigation of America’s democratic process must start by decisively separating truth from lies. It must document the assault on voting rights and the cynical distortions of gerrymandering. It must reckon with the most lethal form of domestic terrorism in recent years, that from armed white supremacists. It must also explain what needs to be done to secure elections against interference by Russia and other foreign powers—a threat confirmed by all of the nation’s intelligence agencies, but one whose reality and significance were questioned by Trump. Finally, it must address how to rekindle a spirit of grassroots engagement among ordinary citizens. An excellent place to start is a recent report from the American Academy of Arts & Sciences called “Our Common Purpose.”

First, no pardon. Second, Biden doesn't touch the investigation. He needs to be completely hands off. He can’t even ask who he chooses to run the DOJ what his intentions are regarding Trump. He should pick someone who he believes would go after Trump, because it’s necessary. It starts when Trump pardons himself. That needs to be challenged on its legality. That definitely opens the door the widest to go after him in a way that can be described as nonpolitical.

All actions must be based on the evidence and not politics, but let’s hope whoever winds up heading the FBI goes after him as well. The message needs to be that the type of corrupt and retaliatory behavior displayed by Trump, if repeated by a future president, will have consequences. And changes need to be made, protections put in place, to block future presidents from being able to corrupt the system as easily as Trump did. We've now learned the republicans cannot be counted on to do the right thing.

Donald Trump was a tool in a long-running Russian campaign to weaken the United States. That's been documented in Republican-led investigative reports, and now it has been updated with new evidence, thanks to the U.S. Intelligence Community's assessment of the 2020 election. The report, drafted by the CIA, the FBI, and several other agencies, was released in unclassified form on Tuesday, but it was presented in classified form on Jan. 7. In other words, it was compiled, written, and edited during Trump's administration. It destroys his lies about the election, and it exposes him as a Russian asset.

The report debunks conspiracy theories, promoted by Trump and his lawyers, that hackers in other countries robbed him of victory. "We have no indications that any foreign actor attempted to interfere in the 2020 US elections by altering any technical aspect of the voting process,” including "ballot casting, vote tabulation, or reporting results,” says the document. A separate analysis released by the Department of Justice reaches the same conclusion. The IC report adds that evidence of such operations, if they existed, would have shown up in U.S. surveillance or in "post-election audits of electronic results and paper backups.” The report implicitly mocks insinuations from Trump's lawyers that former Venezuelan dictator Hugo Chavez, who died in 2013, somehow rigged Trump's defeat. "We have no information," it notes drily, that "current or former Venezuelan regimes were involved in attempts to compromise US election infrastructure."

In a December 2019 conversation, then–national security adviser Robert O’Brien told Trump that Giuliani had been “worked by Russian assets in Ukraine.” Trump shrugged and went on promoting the allegations Giuliani was feeding him. That makes Trump more than a Russian asset. It makes him, in technical terms, an agent of a foreign power.

‘At Some Point, Litigation Must End’: Another Federal Judge Dismisses Another Devin Nunes Lawsuit

In what has become a regularly reoccurring result, a lawsuit filed by Rep. Devin Nunes (R) and his attorney Steve Biss has been tossed out of court — this time for good.

A federal judge in Virginia this week dismissed with prejudice the California congressman’s complaint against Fusion GPS, the research and investigative firm behind the production of the “Steele Dossier” in 2016. The dismissal means Nunes will not be afforded the opportunity to amend any deficiencies and re-file the case. Nunes had previously filed three different versions of the lawsuit that were dismissed without prejudice.
