A former campaign staffer for US Sen. Rand Paul has been charged with channeling money from Russia into the 2016 presidential election, the US Department of Justice said Monday.
In an unsealed indictment, dated September 9, prosecutors allege Jesse Benton "conspired to illegally funnel thousands of dollars of foreign money from a Russian foreign national" into the campaign.
In October 2016, Benton received a $100,000 wire transfer from the unnamed Russian national, the indictment states, promising him that he would get to "meet a celebrity" at a fundraiser in Philadelphia on September 22, 2016.
Prosecutors do not name the candidate, but former President Donald Trump was hosting a fundraiser that night at the Ritz-Carlton in Center City, Philadelphia.

If the Dept. of Justice doesn't move faster, Trump will die of old age first. Don't believe me? There's this example from today: New York real estate heir and convicted murderer Robert Durst has died at the age of 78 shortly after being sent to prison for the rest of his life—an abrupt end for a man who spent the better part of his life steeped in controversy and intrigue.
Durst murdered his wife in 1982. In 2020 he murdered the witness who was about to testify that she gave Durst a false alibi for the 1982 murder. Durst would not have died in jail if during filming of a documentary, Durst had not said into a hot mic, “killed them all, of course.” That made it hard for the prosecutors to continue ignoring murders that they had been ignoring for decades. Unless Trump confesses, I don't think prosecutors will put in enough effort to jail Trump before he dies of old age.
Durst was acquitted of murdering a neighbor, Morris Black, in 2003, whom Durst said he killed in self-defense. Durst had absconded from New York City to Texas after Kathie’s disappearance and was living in disguise when Black discovered his identity. Durst diced up Black’s body and dumped it into the sea. Maybe Trump dicing up Melania at Mar-a-Lago Club will get him arrested. But unless Trump does it in front witnesses, prosecutors would much rather not prosecute because Trump can afford defense lawyers far more skilled at convincing juries than typical prosecutors. Durst's defense lawyers got him free in the Morris Black murder because there were no witnesses. Trump's defense lawyers could do the same for Trump. Isn't America a great country, if you're born rich?

It's time for the Biden Justice Department to issue a report on the Mueller report.
There are multiple criminal investigations currently swirling around former president Donald Trump. The Justice Department is investigating the Jan. 6 riot in Washington and attempts to overturn the 2020 presidential election, with Attorney General Merrick Garland vowing to pursue those criminally responsible “at any level.” Prosecutors in Georgia are investigating Trump’s alleged efforts to interfere with the election results in that state. New York prosecutors are investigating Trump and his businesses for potential fraud.
But nearly three years ago, special counsel Robert S. Mueller III presented an exhaustive report detailing almost a dozen instances of possible obstruction of justice by Trump in connection with the investigation of Russian interference in the 2016 presidential election. The five-year statute of limitations on the first such instance — Trump’s alleged request to then-FBI Director James B. Comey to drop the criminal investigation of disgraced former national security adviser Michael Flynn — expires on Feb. 14. Other acts of possible obstruction soon will be similarly time-barred.
The fate of Mueller’s report when it was released is by now a familiar story. The special counsel outlined damning evidence of Trump’s possible criminal acts. But he decided that in light of the Justice Department policy against indicting a sitting president, he would not make a “traditional prosecutorial judgment” about whether charges were justified. The report therefore did not accuse Trump of a crime, but pointedly noted that it also did not exonerate him.
William P. Barr, attorney general at the time, infamously spun Mueller’s findings before the report’s public release, announcing that his own review had concluded there was no obstruction. Once the full, redacted report was released, it became clear how misleading Barr’s summary had been. More than a thousand former federal prosecutors signed a letter saying the evidence would justify an indictment. Trump, on the other hand, maintained that the report was a “complete and total exoneration.”
It was a foregone conclusion that Barr’s Justice Department would not prosecute the president. But there were two other potential ways for Trump to be held accountable. One would have been for Congress to impeach him for obstruction of justice. But although it later impeached Trump for attempting to extort Ukraine and for the events of Jan. 6 at the U.S. Capitol, Congress chose not to do so based on the findings in the Mueller report.
The other possibility was that Trump could be charged with obstruction if he left office in 2021. In congressional testimony in 2019 about his report, Mueller noted that a sitting president could be indicted once he left office. Once Joe Biden was sworn in as president, there was no policy impediment to his Justice Department pursuing the obstruction charges.
But more than a year has passed, and we have heard nothing but crickets from Justice about the Mueller report. Admittedly, the department has been a little busy handling, among other things, the massive investigation into efforts to overthrow the election. But the clock is ticking on the potential obstruction charges outlined by Mueller. Is anyone at Justice watching that clock?
I’m not one who argues that Mueller presented a slam-dunk case. No one should underestimate how challenging it would be to prosecute Trump for obstruction. Some of the potential charges are stronger than others, but all of them would face significant legal and evidentiary hurdles. In light of those hurdles, prosecutors might reasonably conclude that Trump’s ultimately unsuccessful attempts at obstruction do not merit the political and constitutional turmoil that would result from the first criminal prosecution of a former president.

You practically have to put a gun to the head of a prosecutor to force them to drag a rich, powerful man into court and then jail. The exceptions? The rich man either confesses, or as in Jeffrey Epstein's case, the media does all the gathering of evidence, in which case prosecution is easy.
Only poor men, on the other hand, are what prosecutors want to prosecute because the poor can't fight back, which makes easy work for a prosecutor. Prosecutors almost always win those cases, while they lose cases very often against the rich and powerful. That is the beauty of the jury system. There is often some jackass jurors who won't convict a rich man with elegantly arguing attorneys defending him.

By the way, after Aaron Burr got away with murdering Alexander Hamilton, Burr committed treason, but a jury ruled not guilty. He was guilty:
Almost no one in 1807 knew for sure what Burr had been up to on the frontier, but President Jefferson demanded that he be charged with treason—a crime punishable by death. (Burr had been Jefferson's V.P.) Burr and his team of lawyers—which included two former U.S. attorneys general—mounted a robust defense against the charges.
They argued that the definition of treason outlined in the Constitution required evidence of an “overt act” from the accused. When Supreme Court Chief Justice Marshall ruled in favor of this interpretation of the law, the prosecution’s case crumbled. Burr had repeatedly spoken about various illegal schemes, but since he had been absent when his troops gathered on Blennerhassett’s island—the only “overt act” that could be proved—there was no evidence that he had picked up a rifle and fired it at a government official (taken up arms against the government). With this in mind, the jury found him not guilty of treason.

Trump won't be charged because his lawyers will argue that as President he can destroy documents, except there is no exception in the actual law for the President. If a prosecutor tried to enforce the law as written, the Supreme Court, loaded with Trump's friends, would carve out an exception for the President with some specious reasoning that Congress overlooked adding the exception. It would be just one more of those ridiculous 5 to 4 decisions that Trump's Supreme Court appointees are famous for making.

Last week, it was revealed that Trump’s former Secretary of Defense Mark Esper wrote in his new memoir that his ex-boss wanted to attack Mexico with missiles — during peacetime between the two nations — and then try to pin the blame on another country.
Despite leaving office in disgrace, Trump has continued on as the undisputed leader of the Republican Party and by far its most popular and influential national figure. He is currently the clear favorite to win the 2024 GOP presidential nomination, should he ultimately decide to launch another campaign. Though a final decision has not yet been made, Trump has strongly signaled to a variety of associates and counselors that he intends to run again, having made it his mission to turn his anti-democratic lies about the 2020 election being “stolen” from him into party orthodoxy.
A Trump spokesperson did not provide comment on this story.

In a February 2022 scoop (also given to Axios by the Times reporter in a confusing book-publicity maneuver), Haberman had revealed that Trump’s staff “periodically discovered” wads of printed paper clogging his toilets and believed him to have been responsible for attempting to flush them. (Discarding paper in a toilet is a violation of best practices concerning both presidential record-keeping and plumbing.) Trump had called this report—the report that he, an adult man, was apparently under the belief that one can successfully dispose of office documents by putting them in a toilet—”fake news.” But now it has been proved fairly definitively that the president tried (many times) to flush regular paper down a toilet in the White House and then lied about it.

The Mueller report made a compelling case that these actions could support a reasonable inference of obstruction of justice. The memo also says that the former president’s grooming witnesses before they testified and then turning on them if they implicated him did not qualify as obstruction. Tell that to former Trump attorney Michael Cohen, who was the subject of repeated presidential intimidation targeting him and his family before his 2019 House Oversight Committee testimony.

Bill Barr’s Memo speaks of all this in mild terms, as Trump “appearing to praise or condemn” witnesses, when he was actually doing much worse. Trump’s behavior went so far as dangling pardons to his former campaign chairman Paul Manafort (who later received one). Bill Barr’s Memo bends the facts so far that it breaks them.
Its treatment of the law is as bad. The notion that there are no comparable legal precedents to justify prosecution, as the memo claims, is laughable. For instance, both that report and Bill Barr’s Memo focus on the same key case: United States v. Cueto (1998). In Trump’s case like in Cueto, someone was under investigation and attempted to interfere with that investigation by taking acts that would have been legal but for corrupt intent. The prosecution in Cueto was held lawful and so would one have been here. The evidence of obstruction that Mueller documented would have resulted in charges for anybody else who did not occupy the Oval Office. Barr gave Trump special treatment — and not because the law or the facts merited it.
But inside access is not needed to see that something is rotten here. It was always puzzling how this memo was submitted just two days after Barr received the 400-page Mueller report. How could he and his colleagues possibly process all of that information in 48 hours and come to such a weighty decision not to prosecute? That apparent hastiness was always an indication that Barr’s goal was to cover-up — and not uncover — the truth. But now that we have the memo that is even more clear.

On the night of July 28, 2016, as Hillary Clinton was accepting the Democratic presidential nomination in Philadelphia, Donald J. Trump’s campaign chairman, Paul Manafort, received an urgent email from Moscow. The sender was a friend and business associate named Konstantin Kilimnik. A Russian citizen born in Soviet Ukraine, Kilimnik ran the Kyiv office of Manafort’s international consulting firm, known for bringing cutting-edge American campaign techniques to clients seeking to have their way with fragile democracies around the world.
Kilimnik didn’t say much, only that he needed to talk, in person, as soon as possible. Exactly what he wanted to talk about was apparently too sensitive even for the tradecraft the men so fastidiously deployed — encrypted apps, the drafts folder of a shared email account and, when necessary, dedicated “bat phones.” But he had made coded reference — “caviar” — to an important former client, the deposed Ukrainian president Viktor Yanukovych, who had fled to Russia in 2014 after presiding over the massacre of scores of pro-democracy protesters. Manafort responded within minutes, and the plan was set for five days later.
Kilimnik cleared customs at Kennedy Airport at 7:43 p.m., only 77 minutes before the scheduled rendezvous at the Grand Havana Room, a Trump-world hangout atop 666 Fifth Avenue, the Manhattan office tower owned by the family of Trump’s son-in-law, Jared Kushner. Shortly after the appointed hour, Kilimnik walked onto a perfectly put-up stage set for a caricature drama of furtive figures hatching covert schemes with questionable intent — a dark-lit cigar bar with mahogany-paneled walls and floor-to-ceiling windows columned in thick velvet drapes, its leather club chairs typically filled by large men with open collars sipping Scotch and drawing on parejos and figurados. Men, that is, like Paul Manafort, with his dyed-black pompadour and penchant for pinstripes. There, with the skyline shimmering though the cigar-smoke haze, Kilimnik shared a secret plan whose significance would only become clear six years later, as Vladimir V. Putin’s invading Russian Army pushed into Ukraine.
Known loosely as the Mariupol plan, after the strategically vital port city, it called for the creation of an autonomous republic in Ukraine’s east, giving Putin effective control of the country’s industrial heartland, where Kremlin-armed, -funded and -directed “separatists” were waging a two-year-old shadow war that had left nearly 10,000 dead. The new republic’s leader would be none other than Yanukovych. The trade-off: “peace” for a broken and subservient Ukraine.
The scheme cut against decades of American policy promoting a free and united Ukraine, and a President Clinton would no doubt maintain, or perhaps even harden, that stance. But Trump was already suggesting that he would upend the diplomatic status quo; if elected, Kilimnik believed, Trump could help make the Mariupol plan a reality. First, though, he would have to win, an unlikely proposition at best. Which brought the men to the second prong of their agenda that evening — internal campaign polling data tracing a path through battleground states to victory. Manafort’s sharing of that information — the “eyes only” code guiding Trump’s strategy — would have been unremarkable if not for one important piece of Kilimnik’s biography: He was not simply a colleague; he was, U.S. officials would later assert, a Russian agent.
Their business concluded, the men left by separate routes to avoid detection, though they continued to text deep into the night, according to federal investigators. In the weeks that followed, operatives in Moscow and St. Petersburg would intensify their hacking and disinformation campaign to

And as Manafort told Kilimnik at the club, according to testimony from Gates and another witness briefed on the meeting, the polling was picking up something that Clinton pollsters and mainstream prognosticators were not — a path for Trump to the White House through traditionally blue states like Michigan, Minnesota, Pennsylvania and Wisconsin. Of course, Manafort explained, that would require a relentless assault on Clinton’s public image.
By the end of summer, vicious anti-Clinton social-media operations were intensifying, not only by the Trump campaign and its American allies but also by Russian trolls posing as Americans, who spread a raft of conspiracy theories about Clinton’s health and alleged criminality. The operations included the states that Manafort had identified as key, investigators found.
The polling data would become a major focus of the Mueller team and Senate investigators. Neither could directly link the Russian operations to the data; they reported only that Gates believed that Kilimnik was sharing it with Deripaska and his Ukrainian counterparts — an apparent fulfillment of Manafort’s pledge to keep his patrons in the loop. But last year a Treasury Department communiqué concluded that Kilimnik had passed the data directly to Russian military intelligence, calling him a “known Russian agent.”
