Trump described as 'most evil person I've ever met' by member of his own cabinet

Miles Taylor, who worked for the former President, wrote on Twitter Tuesday that one Trump cabinet official even went so far as to describe the former president as "evil."

"I’ll never forget an ex-Trump cabinet member telling me: 'He is truly the most evil person I have ever met,'" Taylor wrote. "We cannot make this mistake again."

Although Taylor did not identify this former cabinet official by name, he did follow up with a quote from former Trump chief of staff John Kelly, who offered a similarly withering assessment of the former president's character.

In Adam Smith’s famed 1776 disquisition on economics, “The Wealth of Nations,” he ponders the behavior of the “great proprietors” of feudalism. They owned the most valuable property available — i.e., land — and with their income from this property supported a class of attendants and retainers, and, below them, a class of tenants of the land.

But the proprietors gradually lost the taste for this. They eventually wished to consume “the whole surplus produce of their lands … without sharing it either with tenants or retainers. All for ourselves and nothing for other people, seems, in every age of the world, to have been the vile maxim of the masters of mankind.”

“The Wealth of Nations” is full of this kind of ferocious criticism of the psychology of the powerful, so it’s peculiar how today’s powerful champion the book so frequently. There was even a vogue among male members of the Reagan administration for wearing ties with little pictures of Adam Smith. The most likely explanation here is America’s top apparatchiks don’t waste their time reading stuff.

In any case, Smith’s perspective was generally correct: both about the way societies can develop three different tiers, and the overall view of the people at the top of them. Their vile maxim — all for ourselves and nothing for other people — seems to be reaching a level of virulence Americans haven’t experienced in living memory.

Like feudal England, America has, roughly speaking, three classes. At the top are today’s great proprietors. The basis of their wealth is no longer mainly held in land but in direct ownership of their own businesses plus financial instruments including corporate stocks and bonds. The top 1 percent owns over half of U.S. corporate stock.

The people just below them are no longer attendants and retainers but technocrats. They’re the people who go to school to develop the specialized skills that are necessary to keep society running day to day: doctors, lawyers, scientists, computer programmers, engineers. (Journalists are also technocrats but among the weakest of the group.) The rest of the top 10 percent — i.e., the 9 percent — owns almost all the rest of U.S. corporate stock.

Then there’s everyone else. They’re no longer tenant farmers, but they still have to get up every day and clock in at Home Depot and Walgreens and Chipotle to cultivate the possessions of the great proprietors. This working class has the least leverage and the fewest options.

In retrospect, it’s clear America’s masters of mankind were shocked enough by World War II to dial the vile maxim back. As President Franklin Delano Roosevelt said in his 1944 State of the Union address, “Necessitous men are not free men. People who are hungry, people who are out of a job are the stuff of which dictatorships are made.” Even if you were the son of a National City Bank executive destined to follow in your father’s executive footsteps, you would be able to hear Roosevelt’s message after spending time facedown in the mud on Okinawa, covered in your platoonmate’s viscera.

Thus the great proprietors were willing to share quite a bit with the bottom two classes — for a while. During the three decades after the war, median wages went up hand in hand with productivity. That is, as America overall got richer, so did regular people.

But by the 1970s, the great proprietors had gotten tired of this arrangement. The generation with direct adult experience of how destabilized societies can explode into a worldwide slaughterhouse was retiring and dying.

So the masters of mankind decided to alter the deal vis-à-vis the working class. This was such a gargantuan success, it’s amazing they pulled it off without bloodshed. If the minimum wage had continued to go up in step with productivity, it would now be not $7.25 but about $25 an hour. A recent RAND study found that if the U.S. had remained as equitable as it was in 1975 for the next 43 years through 2018, the bottom 90 percent of Americans would have earned an extra $47 trillion. The far right’s war on “woke” has real-world consequences for the military

Alabama Sen. Tommy Tuberville has held up the confirmation of more than 260 generals for new command posts — including members of the Joint Chiefs of Staff and the head of the Marine Corps — over his objections to the Pentagon’s abortion policy.

Tuberville, a former football coach who is closely allied with former President Donald Trump, has refused to go forward with the routine confirmations and is essentially using defense policy as leverage to promote his cultural ideology. But the Department of Defense has repeatedly warned that holding up the confirmations is damaging the military’s chain of command at the highest levels.

Any senator can hold up these confirmations, even if the other 99 wish to move forward with them, because of the Senate concept of unanimous consent. The Senate has long relied on unanimous consent to promote military personnel through batch confirmations, but with Tuberville’s hold, the only way to move the confirmations forward would be to vote on them one by one, through regular order. Sen. Jack Reed, a Democrat from Rhode Island and the chairman of the Senate Armed Services Committee, told the Associated Press that doing so would take up to 84 days with the chamber working regular, eight-hour days, or 27 days if they worked “around the clock.”

Tuberville’s hold, which could affect 650 military promotions by the year’s end, is based on a misrepresentation of how the Pentagon’s abortion policy works. And he isn’t the only Republican using legislation related to the military to force right-wing policies into defense policy.

What happened when a Republican supermajority gained control—and wasn’t satisfied

Drive along the outer rim of the exurbs north of Nashville, past structures that might be barns or might be wedding venues, around developments called Vineyard Grove or New Hope Village, and eventually you will arrive at what is meant to be the new headquarters of the election commission of Sumner County, Tennessee. A featureless one-story brick warehouse with some makeshift offices attached, it has just enough space for the tiny handful of election-commission employees, the 275 voting machines that they recently purchased, and maybe some of the maintenance workers who used to share rooms with them, back when the agency was still in the basement of the county-administration building.

Dusty picnic tables crowd against the wall. An elementary school stands a few hundred yards away. Nothing about this building or its location screams “controversy.” But when Sumner County’s local elections brought a faction that calls itself the Constitutional Republicans to power last year, that is what it nevertheless became.

To fully grasp this story, you need to understand that the standard forms of American political polarization don’t exist in Sumner, a rural but rapidly suburbanizing county where Democrats are not part of the equation at all. None has won any county office for more than two decades. Instead, the main opponents of the Constitutional Republicans, who won 14 out of 17 seats on the county commission (following a general election in which only 15 percent of eligible voters cast ballots), are the ordinary Republicans—or, as their opponents would call them, RINOs (“Republicans in name only”). The Constitutional Republicans’ website explains that RINOs are different from themselves: “They raise taxes, they vote to silence the citizens, they won’t protect private property rights. They often partner with Democrats to defeat true Constitutional Republicans like us.”

Upon taking over the county commission, the Constitutional Republicans issued a document formally declaring that their activities will be “reflective of Judeo-Christian values inherent in the nation’s founding.” They also shut down the HR department, tried to privatize a public historic building, and refused to pay for the election commission’s move to the brick building, although it had been agreed on by the previous administration. The old offices—three basement rooms that recently flooded—were too small to store the new voting machines, and also insecure. The entrance to the basement stood right beside a cashier’s window where dozens of people were lined up to pay taxes on the day I visited. The county commissioners are unmoved by those arguments. “If we don’t fund it, you don’t get to do it,” Jeremy Mansfield, one of the Constitutional Republicans on the county commission, told the election commission at one public meeting about the move last fall. At a meeting in June, another county commissioner, angered because the new voting machines had been delivered to the new building, said that although he would “hate to pull the ace card,” the commission could always “declare this property surplus, and sell it.” That would leave the election commission, and its machines, with nowhere to go.

The building seems a small thing to get worked up about. But Facebook posts and videos of public meetings, all available online—the Constitutional Republicans are very transparent—make clear that this is not a trivial jurisdictional dispute and these are not petty people. They have ambitions and interests that extend well beyond their county. Their Facebook page reacted to the news of Donald Trump’s latest indictment by declaring, “The Biden family is an organized crime family,” and “Our justice system is rigged against Trump.

One by one, the toxic giants have come crashing to earth. In the last month or so Boris Johnson has quit, Donald Trump has been arraigned on felony charges, Italy’s Silvio Berlusconi has died, and even Vladimir Putin looks significantly weaker than he did. It’s sorely tempting to conclude that the chaotic ride of recent years is finally over, and life might return to something more like normal.

But that, according to Ferdinand Mount’s absorbing tour of populist rogues through the ages, would be a rookie mistake. It may be comforting to think of so-called Caesars – a type of leader defined by what Mount calls his (and it’s mostly, though not invariably, his) “relentless egotism, his lack of scruple, his thoughtless brutality, his cheesy glitz” and above all his loathing of democratic checks and balances – as freakish aberrations from a generally orderly norm. But trace the line from ancient Rome to Oliver Cromwell, from Napoleon Bonaparte to modern-day strongmen, and it becomes obvious that they are a regularly recurring phenomenon for which nations just as regularly fall, and from which they don’t recover overnight. “These ill-starred comets,” Mount writes, “leave a long trail of debris.” But they also have something to teach us about stopping the next Caesar early.

Few are better qualified to take the long view than Mount, the sort of Tory who has done everything – run Margaret Thatcher’s policy unit, been political editor of the Spectator – and knows everyone, without feeling the need to go on about it endlessly. He is also the sort of Tory who voted remain, believes in rules-based world order, and writes skilfully enough to get away with comparing Julius Caesar’s public agonising over whether to cross the Rubicon – and thus start a war that risked destroying the Roman empire – with Johnson’s famous writing of two articles on Brexit, one for and one against. (The original Caesar, he argues, never seriously wobbled; he just wanted to suggest that he’d been nobly wrestling with his conscience when in reality he was always going to do what suited him best, ditto our former prime minister. One can’t help feeling the classicist in Johnson might have loved this book, were it not so rude about him.) For conventional politicians, Mount notes, charisma can be a useful communications tool. But in a Caesar’s hands, the ability to dazzle his way out of trouble becomes “a license to go beyond, to break the rules … he is beyond good and evil, and beyond a lot of other boring stuff too”. The true Caesar, Mount writes, feels “dangerously free”.

Admittedly, one or two of the historical comparisons feel like something of a stretch. But the power of this needle-sharp book lies in the acuity of its observations and in its ability to zoom out and see modern politicians in broader context, bringing something both fresh and timeless to an otherwise well-worn subject. When it first crossed my desk, I wondered if the world really needed another book on the dangers of populism. Then Johnson resigned and unleashed a Trumpian attack on the MPs who found him guilty of lying, and I wondered whether you can’t have too many. Every MP should be made to read its rousing final chapter, on the importance of a properly muscular and sovereign parliament in defending democracies against Caesarism.

The Florida Board of Education has approved shocking new standards for African American history, despite overwhelming backlash from the public.

Middle school students in Florida will soon be taught that slavery gave Black people a “personal benefit” because they “developed skills.”

After the Florida Board of Education approved new standards for African American history on Wednesday, high school students will be taught an equally distorted message: that a deadly white mob attack against Black residents of Ocoee, Florida, in 1920 included “acts of violence perpetrated against and by African Americans.”

Dozens of Black residents were killed in the massacre, which was perpetrated to stop them from voting.

According to members of the board, that distorted portrayal of the racist massacre is factually accurate. MaryLynn Magar, a member of the board appointed by Gov. Ron DeSantis, said at the board’s meeting in Orlando on Wednesday that “everything is there” in the new history standards and “the darkest parts of our history are addressed,” the Tallahassee Democrat reported.

The majority of the speakers who provided public testimony on the planned curriculum were vehemently opposed to it, warning that crucial context is omitted, atrocities are glossed over, and in some cases students will be taught to “blame the victim.”

“I am very concerned by these standards, especially some of the notion that enslaved people benefited from being enslaved,” state Rep. Anna Eskamani (D-Orlando) said, per Action News Jax.

“When I see the standards, I’m very concerned,” state Sen. Geraldine Thompson said at the board meeting. “If I were still a professor, I would do what I did very infrequently; I’d have to give this a grade of ‘I’ for incomplete. It recognizes that we have made an effort, we’ve taken a step. However, this history needs to be comprehensive. It needs to be authentic, and it needs additional work.”

“When you look at the history currently, it suggests that the [Ocoee] massacre was sparked by violence from African Americans. That’s blaming the victim,” the Democrat warned.

“Please table this rule and revise it to make sure that my history, our history, is being told factually and completely, and please do not, for the love of God, tell kids that slavery was beneficial because I guarantee you it most certainly was not,” community member Kevin Parker said.

Approval of the new standards is a win for the DeSantis administration, which has effectively sought to create a new educational agenda that shields white students from feeling any sense of guilt for wrongs perpetrated against people of color. The Florida governor signed the “Stop WOKE Act” last year to do just that, restricting how issues of race are taught in public schools and workplaces.

In keeping with the administration’s crusade against “wokeness,” Education Commissioner Manny Diaz defended the new standards against criticism, saying, “This is an in-depth, deep dive into African American history, which is clearly American history as Governor DeSantis has said, and what Florida has done is expand it,” Action News Jax reported.

Paul Burns, the Florida Department of Education’s chancellor of K-12 public schools, also insisted the new standards provide an exhaustive representation of African American history.

“Our standards are factual, objective standards that really teach the good, the bad and the ugly,” he was quoted as saying Wednesday by Florida Phoenix. He denied the new standards portray slavery as beneficial.

Although education officials say teachers are meant to expand upon the new curriculum in the classroom, critics say teachers are unlikely to do that for fear of being singled out and possibly punished for being too “woke.”

Trump doesn’t have a prayer of being elected president again. Democrats have drawn the same conclusion, based on a lot of sensible data — Trump’s past performances (i.e., his 46 percent high-water mark, even as an incumbent, before the stop-the-steal nonsense, the Capitol riot, and the string of indictments and civil complaints), the 2018 midterms, Trump’s costing Republicans control of the Senate in 2020, and the 2022 “red wave” that never happened thanks to Trump-supported candidates.

The Democrats are trying to get Trump nominated because they know they would beat him decisively in November 2024. The indictments (and there will probably be two more — one from Biden DOJ special counsel Jack Smith, perhaps as early as today, and one from Fulton County district attorney Fani Willis (in the next two weeks or so), coupled with the civil cases teeing up for trial (New York attorney general Letitia James’s fraud case on October 3, and a second E. Jean Carroll sexual-assault/defamation case in mid January), are both firing up the Trump base and preventing other GOP candidates from getting any traction. That is the intention.

Harry Enten’s CNN polling analysis, to which Rich and MBD refer, deals mainly with the nomination battle and the patent unlikelihood that another Republican could beat Trump given his quasi-incumbent status and his commanding lead in the polls — pulling more than 50 percent and registering more support “than all his competitors combined,” as Enten tautologically puts it. This squares with the latest RCP data, which has Trump polling at 54 percent — nearly 26 points ahead of his closest rival, Ron DeSantis.

The problem for Trump is he has no upside. He is as known a quantity as has ever sought the presidency. In a normal race, the 46 percent of Republicans who do not favor Trump could be expected to “come home” in droves in the general election if he is the nominee. That is not true of Trump. As the Guardian reports, recent Pew polling indicates that just a hair under a third of Republicans now view him very or mostly unfavorably. The remaining two-thirds view him favorably, but that is down from three-quarters last year. It is reasonable to forecast that at least a quarter of Republicans will not support Trump under any circumstances. That doesn’t mean they will vote for an unpopular Democrat, they just won’t vote (or will vote third-party, write-in, or some similarly futile vehicle for registering discontent).

To have a chance in the general election, Trump has to make up that support. But from where? Polls consistently show that Democratic opposition to Trump is nearly universal. They also consistently show that his unfavorability with the general public hovers around 60 percent. There is no reason to believe this will change. To the contrary, about 54 percent of voters cast their ballots for someone other than Trump in 2016 and 2020, when he was more popular nationwide than he is now. He couldn’t win in 2020 with 46 (he won by a miracle in 2016 with 46). He is not going to win with less than 46, but there’s no reason to think he would ever sniff 46 again.

Two bodies have been found stuck in the lines of orange buoys installed by Texas authorities in the Rio Grande along the U.S.-Mexico border. The Texas Department of Public Safety notified the Mexican Consulate in Eagle Pass, Texas, on Wednesday afternoon that a person was found dead in the southern part of the floating barriers. Members of the Mexican National Institute of Migration's assistance unit, Grupos Beta, are spearheading efforts to recover the body, according to the Mexican Ministry of Foreign Affairs. The Mexican National Institute of Migration told ABC News on Wednesday that a second body has been discovered in the buoys.

The Mexican Ministry of Foreign Affairs repeated its condemnation of the buoys, calling them a "violation of our sovereignty." The U.S. Department of Justice has sued Texas Gov. Greg Abbott over the use of the buoys.

The long-awaited federal indictment of Donald Trump for his efforts to overturn the 2020 election may be necessary to contain the threat to American democracy that he has unleashed. But it’s unlikely to be sufficient.

The germ of election denialism that Trump injected into the American political system has spread so far throughout the Republican Party that it is virtually certain to survive whatever legal accountability the former president faces.

With polls showing that most Republican voters still believe the election was stolen from Trump, that the January 6 riot was legitimate protest, and that Trump’s efforts to subvert the 2020 results did not violate the law or threaten the constitutional system, the United States faces a stark and unprecedented situation. For the first time in the nation’s modern history, the dominant faction in one of our two major parties has repeatedly demonstrated its willingness to accept antidemocratic means to advance its interests.

The most telling measure of that dynamic inside the GOP is that Trump remains the party’s central figure. Each time GOP voters and leaders have had the opportunity to move away from him—whether in the shock immediately after January 6, or the widespread disappointment over the poor performance of his handpicked candidates during the 2022 election—the party has sped past the off-ramp.

Polls now show Trump leading in the 2024 GOP presidential race by one of the biggest margins ever recorded for a primary candidate in either party. The Republican majority in the House of Representatives has been exploring ways to expunge his two impeachments and/or block the investigations he faces. Even the other candidates ostensibly running against him for the 2024 GOP nomination have almost uniformly condemned the indictments against him, rather than his underlying behavior. Prominent conservatives have argued that Trump cannot receive a fair trial in any Democratic-leaning jurisdiction.

All of these actions measure how much of the GOP is now willing to accept Trump’s repeated assaults on the basic structures of American democracy. While the key state-level Republicans rejected Trump’s direct demands to invalidate the results in their own states, most House Republicans voted to reject the election results and most Republican state attorneys general filed a lawsuit to decertify the outcome in the key swing states won by President Joe Biden. In the election’s aftermath, the majority of Republican-controlled states, inspired by Trump’s baseless claims of endemic voter fraud, passed laws on a party-line basis making it more difficult to vote, or increasing partisan control over election administration.

Sean Wilentz, a Princeton historian who specializes in American politics, told me that U.S. history has no exact precedent for a party embracing a leader so openly hostile to the core pillars of democracy. Presidents have often been accused of violating the Constitution through their policy actions, he said, but there is not another example of a president moving as systematically to “manipulate the apparatus of government or elections in order to subvert the will of the people.”

The closest parallel to Trump’s actions, Wilentz said, may be the strategies of the slaveholding South in the decades before the Civil War. 20 Million jobs were lost when the Democrats teamed up with China to unleash Covid on the world to remove Trump from office, and 20 Million people went back to work when it was over after they successfully destroyed the American voting system to keep Trump out of office.

Add that 20 Million back where it shouldn't have been taken from and subtract it where it shouldn't have been gained and Republicans created 44 Million jobs while Democrats only created 22 Million.

Last week, I put this question to readers: “Donald Trump is guilty of deplorable actions, under indictment for multiple crimes, and yet remains the most popular candidate with voters in the Republican Party’s presidential primary. Why do you think he is still their first choice?”

Replies have been edited for length and clarity.

1) Randall R. argues that Trump supporters earnestly desire national greatness:

The reason many support Trump (if you have the decency to listen to them) is because they want to make America great again, and there’s no one else close to matching Trump in both prominence and apparent ability to make what they’d say is the most promising and important part of America great, in the face of the internal conflicts that currently exist.

That’s an illusion spread by a politician, offering an addictive thrill that disconnects people from parts of reality. It doesn’t make America great. But making America great, recognizing how it has long been great and how it can be more great, remains important.

Listen to the Trump voters: the neglected, the deplored, the doomscrollers, the people who want to make something of themselves, those who want to raise their family in a better world. Those who vote against Trump fit these same descriptions. It’s essential, for people on opposing sides of what’s become Trump’s divide, to listen to each other with respect, so we can build our way out of America’s problems without being exploited by political operators. You or I have no shortage of illusions in our parts of the political spectrum; shouldn’t we be reexamining those illusions instead of looking down on Trump’s followers?

Populist movements arise from widespread dissatisfaction with cultural and economic conditions and the inability of the government to deal with public concerns. This is fertile ground for charismatic and authoritarian leaders offering quick and simple solutions. Though Trump may be a person of low character, to many of his supporters, he seems like the sort of fighter that is needed—someone who does not follow the rules because the rules are believed to be the problem. James Madison would be sad and disappointed.

3) Jaleelah analyzes what she sees as the incentives of Trump supporters:

Trump’s supporters sincerely believe that he is being framed, not only because he has been priming them for his conviction for years, but because they have to believe it lest they become severely depressed. Imagine dedicating yourself to a false religion or an unfulfilling career or a bad partner. Imagine losing relationships with your lifelong friends and your adult children who strongly disagree with your choices. When you’ve committed to something at a great cost, it is hard to admit that your commitment was all for nothing.

I don’t think it is strange that so many people insist Trump is innocent. I do, of course, believe he is a fraud who is corrupt enough to have committed the crimes he is accused of. But genuine revolutionary figures get locked up on fake charges all the time. Nelson Mandela and Mahatma Gandhi were charged, convicted, and imprisoned. Most reasonable people alive today believe their imprisonments were unjust and that states are capable of fabricating evidence against popular figures who threaten the social order. Trump’s supporters are simply applying a reasonable idea in an unreasonable context.

Liberals and progressives do not seem keen to accept repentant Trump supporters. There is little benefit to switching teams. There is a very high cost. Towns that have unified behind Trump are just as keen on cancel culture as their liberal counterparts. In 2018, the Wall Street Journal insisted that abortion rights would never be overturned

An editorial confidently proclaiming that abortion rights were safe no matter who Donald Trump appointed to the Supreme Court:

"The reason is the power of stare decisis, or precedent, and how conservatives view the role of the Court in supporting the credibility of the law....Our view, supported by more than a little reporting, is that even though they think Roe was wrongly decided, most of the current conservative Justices would shy from overturning it and handing abortion law entirely to the states. The exception is Justice Clarence Thomas, who has made his intentions clear."

That editorial board was sure that conservative justices would all shy from overturning Roe v. Wade. Four years later, every single conservative justice voted to overturn it.

Their gifts include: At least 38 destination vacations, including a previously unreported voyage on a yacht around the Bahamas; 26 private jet flights, plus an additional eight by helicopter; a dozen VIP passes to professional and college sporting events, typically perched in the skybox; two stays at luxury resorts in Florida and Jamaica; and one standing invitation to an uber-exclusive golf club overlooking the Atlantic coast.

....The pattern exposes consistent violations of judicial norms, experts, including seven current and former federal judges appointed by both parties, told ProPublica. “In my career I don’t remember ever seeing this degree of largesse given to anybody,” said Jeremy Fogel, a former federal judge who served for years on the judicial committee that reviews judges’ financial disclosures. “I think it’s unprecedented.”

But did Thomas violate any laws by hoovering up all these private gifts? YES! Will anyone do anything about it? NO! As near as I can tell, a Supreme Court justice could stand in the middle of Fifth Avenue and shoot somebody and then just disappear safely into his chambers and refuse to ever talk about it.

This whole story gets sleazier and harder to believe with every new revelation. Thomas makes Hunter Biden look like a piker. But apparently, nobody will do anything about it.

In a blunt-talking column published by the Charlotte Observer, a lifelong Evangelical expressed dismay that Christians have been taken in by Donald Trump who could not be less like Jesus Christ.

According to Isaac Bailey, Christians who are still standing by the former president despite his record of criminality and incitements to violence need to "wake up" and realize they have been suckered by a con man who has been preying on them since he was first elected in 2016.

As students of the United States Constitution for many decades—one of us as a U.S. Court of Appeals judge, the other as a professor of constitutional law, and both as constitutional advocates, scholars, and practitioners—we long ago came to the conclusion that the Fourteenth Amendment, the amendment ratified in 1868 that represents our nation’s second founding and a new birth of freedom, contains within it a protection against the dissolution of the republic by a treasonous president.

This protection, embodied in the amendment’s often-overlooked Section 3, automatically excludes from future office and position of power in the United States government—and also from any equivalent office and position of power in the sovereign states and their subdivisions—any person who has taken an oath to support and defend our Constitution and thereafter rebels against that sacred charter, either through overt insurrection or by giving aid or comfort to the Constitution’s enemies.

The historically unprecedented federal and state indictments of former President Donald Trump have prompted many to ask whether his conviction pursuant to any or all of these indictments would be either necessary or sufficient to deny him the office of the presidency in 2024.

Having thought long and deeply about the text, history, and purpose of the Fourteenth Amendment’s disqualification clause for much of our professional careers, both of us concluded some years ago that, in fact, a conviction would be beside the point. The disqualification clause operates independently of any such criminal proceedings and, indeed, also independently of impeachment proceedings and of congressional legislation. The clause was designed to operate directly and immediately upon those who betray their oaths to the Constitution, whether by taking up arms to overturn our government or by waging war on our government by attempting to overturn a presidential election through a bloodless coup.

The former president’s efforts to overturn the 2020 presidential election, and the resulting attack on the U.S. Capitol, place him squarely within the ambit of the disqualification clause, and he is therefore ineligible to serve as president ever again. The most pressing constitutional question facing our country at this moment, then, is whether we will abide by this clear command of the Fourteenth Amendment’s disqualification clause.

We were immensely gratified to see that a richly researched article soon to be published in an academic journal has recently come to the same conclusion that we had and is attracting well-deserved attention outside a small circle of scholars—including Jeffrey Sonnenfeld and Anjani Jain of the Yale School of Management, whose encouragement inspired us to write this piece. The evidence laid out by the legal scholars William Baude and Michael Stokes Paulsen in “The Sweep and Force of Section Three,” available as a preprint, is momentous. Sooner or later, it will influence, if not determine, the course of American constitutional history—and American history itself.

Written with precision and thoroughness, the article makes the compelling case that the relevance of Section 3 did not lapse with the passing of the generation of Confederate rebels, whose treasonous designs for the country inspired the provision; that the provision was not and could not have been repealed by the Amnesty Act of 1872 or by subsequent legislative enactments; and that Section 3 has not been relegated by any judicial precedent to a mere source of potential legislative authority, but continues to this day by its own force to automatically render ineligible for future public office all “former office holders who then participate in insurrection or rebellion,” as Baude and Paulsen put it.

The 14th Amendment to the Constitution states that “No person shall … hold any office, under the United States … who, having previously taken an oath … to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.” Trump took that oath at his inauguration on Jan. 20, 2017.

Both Trump’s Georgia indictment, and his federal indictment in Washington, D.C., cite largely public information to spell out exactly how he engaged in efforts to rebel against the Constitution and sought and gave aid and comfort to others who also did so.

Under the 14th Amendment, Trump’s actions render him ineligible to hold office.

Why Do Democrats Get Offended When Told Basic Facts?

• Over the last fifty years, every Republican President has seen a recession, while we have had only one recession begin under a Democrat, a short six month recession under Carter.

• Over the last forty years every Republican President has created a deficit at least double the previous record. Over that same time, every Democratic President (including already Biden) has cut the deficit by half or more.

• The last three Democratic Presidents (including Biden) have all seen unemployment effectively cut in half. The last two Republicans both saw it effectively double.

• Over the last fifty years, despite holding the Presidency for only 22 years compared to Republicans holding it 28, stock market return has been just over 100% under Republicans and just shy of 1,000% under Democrats. Over 42 million jobs have been created under Democrats compared to only 24 million under Republicans. Income growth averaged 2.2% under Democrats compared to 0.6% under Republicans. GDP growth averaged 4.1% under Democrats compared to 2.7% under Republicans.

• Going back to Truman, four of the five Presidents who have seen the largest increase in domestic oil production were Democrats (with Trump scoring the number five spot and Obama placing first). Only six Presidents over that time have seen domestic oil production fall, and five of them were Republicans.

• Since 1980, The abortion rate held steady under Reagan, Bush 41 and Bush 43. It fell under both Clinton and Obama, and under Trump rose for the first time since the 1970’s.

• Since the Nixon Administration, 338 members of Presidential administrations have been indicted on criminal charges. Three of these were in Democratic administrations, 335 were in Republican administrations.

• In the last century, only two Presidents have lost jobs during their administrations, both Republicans (Hoover and Trump)

• Over the last 80 years, five of the six Presidents with the highest job creation were Democrats, with only Reagan making the list. (Current rankings are Clinton, Reagan, Biden, Obama, Johnson, and Carter, with Biden likely to move into second place before the end of his first term.)

• Ten of the eleven safest states in the Union are blue or lean blue with Utah the only red state. Fifteen of the sixteen least safe states are red, with Georgia being the only non-red state in that mix (and until recently we would have considered Georgia a red state). (Scores based on a combination of personal safety, road safety, financial safety, and emergency preparedness.)

• Four of the five states with the highest poverty rate are deep red (New Mexico being the only blue state). Four of the five states with the lowest poverty rates are-blue or lean blue, with Utah the only red state.

• The five states with the best education are all blue. Four of the five states with the worst education are deep red, with New Mexico the only blue state.

• Four of the five states with the highest incarceration rates are deep red, with Delaware the only blue state. Four of the five with the lowest incarceration rates are blue or lean blue with North Dakota the only red state.

Republican scandals: A brief refresher

Just in case anyone could use a refresher, here are the most recent six "scandals" that have preoccupied Republicans during the last two Democratic administrations:

1 Benghazi
2 IRS tea party targeting
3 Hillary's email
4 Durham investigation
5 Afghanistan withdrawal
6 Hunter Biden

And here's how they turned out:

1 Benghazi (2012-14): There was no "stand down" order and no denial of air support. Nobody lied about the cause of the enemy attack. Administration statements were generally accurate given what was known at the time they were made. The "Innocence of Muslims" video really did play a role in the attacks. Security at the consulate was sufficient, and in any case was provided mostly by the CIA, not State. There was no cover-up related to security. The attack was primarily opportunistic, not planned, and was carried out by a mixed group. There was no incompetence on the part of Hillary Clinton or the State Department.

Two years after the attack, all of this was finally acknowledged by Republicans when the House Select Intelligence Committee—controlled by Republicans—issued its final report. Their exoneration of the White House was sweeping and nearly absolute.

2 IRS (2013): Initially it looked like the IRS was targeting tea party groups over their tax-exempt status. However, that was because the initial demand from Republicans was solely for records of conservative groups. It took several years, but when a broader record search was done it turned out that there had been no partisan intent and liberal groups had actually been targeted far more than conservative groups.

3 Hillary's email (2015-16): In the end, the final FBI report showed that Hillary had done nothing seriously wrong. She used a single account hosted on a private server for both work and personal emails, which was probably a mistake in judgment but not done with any intent to withhold anything. There is no evidence that any foreign adversary hacked the server. She turned over all official emails when requested. Before she handed them over her lawyers culled out personal emails, and there's no evidence that any work emails were deleted in the process. Extensive evidence makes it all but impossible that this happened. Her personal server was eventually wiped clean, but this was part of a routine change in record retention policy that was botched by her hosting service. During her time as Secretary of State, she sent and received only three classified emails, all of them trivial. After the fact, State and CIA argued over some other emails—almost none of them initiated by Hillary—with CIA concluding that they should have been classified. Hillary did nothing wrong except for relying on State's classification in real-time. The FBI's report is an almost complete exoneration of Hillary.

4 Durham investigation (2019-23): John Durham was appointed in hopes of demonstrating that the FBI's investigation of Donald Trump's ties to Russia was unfounded and illegal. However, despite continual leaks and feverish indictments insinuating otherwise, Durham never found anything of the sort. In the end, he indicted only three people, all on trivial charges, and even so managed to lose two at trial and win only a plea deal on the third. We know now that, in fact, Trump's presidential campaign did have links to the Russian government. The FBI did have a perfectly sensible reason to open an investigation into this. Vladimir Putin did try to interfere with the election in Trump's favor. There were never any intelligence operations targeting Trump. There were no illegal actions by the Hillary Clinton campaign. And several members of Durham's team did quit because of disagreements with him over prosecutorial ethics. Every leak from Durham produced excited reports from Fox News, but by the time he was finished, he had produced nothing.

From coast to coast, Republican politicians are breathing a sigh of relief. Even though most of them won’t say it publicly, it’s no secret that, privately, many Republicans don’t really want former President Trump to be their party’s nominee in 2024. They’re just hoping he’ll somehow go away.

Why? Because they know they can’t win with him at the top of the ticket. He’s got too much baggage. As commentator Keith Boykin adds it up, that includes (so far): 91 criminal charges; 26 sexual assault allegations; six bankruptcies; five draft deferments; two impeachments; one convicted company; one fake university shut down; one fake charity shut down; a $25 million fraud settlement; a $5 million sexual abuse verdict; and a $2 million charity abuse judgment.

But for Republicans the dilemma has been, short of a prison term, how were they going to move beyond Trump without totally alienating his loyal base — or, as Florida Gov. Ron DeSantis calls them, Trump’s “listless vessels”? For months, they’ve been secretly looking for some way to dump Trump without leaving any fingerprints of their own.

Suddenly — notice the big smiles on their faces — they’ve found the answer. It’s their own “deus ex machina.” Now riding to the rescue of Republicans as the way to sideline Trump once and for all is the 14th Amendment.

If Republicans are serious about capturing the White House next year, their best bet would be to ditch Donald Trump.

That’s according to the findings of a newly published University of Pennsylvania Law School study authored by two staunch conservatives that says Trump would be ineligible to serve because of his role in the Jan. 6 attack on the Capitol, Yale management professor Jeffrey Sonnenfeld writes for Just Security.

Sonnenfeld asserts that the study “shows with true authority that Trump has violated a fourth qualification, by providing aid and comfort to an insurrection and enemies of the U.S. Constitution.”

Trump summoned his top economic advisers to his private golf club in New Jersey for a two-hour dinner last Wednesday night to map out a trade-focused economic plan for his presidential bid.

Trump and top aides, including former senior White House officials Larry Kudlow and Brooke Rollins, as well as outside advisers Stephen Moore and former House speaker Newt Gingrich, spent the dinner discussing how Trump could attack President Biden in the 2024 election on the economy, amid a recent spate of positive economic news that has buoyed Biden’s fortunes, according to three people familiar with the meeting, who spoke on the condition of anonymity to describe the private event.

Among the ideas they discussed was Trump’s plan to enact a “universal baseline tariff” on virtually all imports to the United States, the people said. This idea, which Trump has taken to describing as the creation of a “ring around the U.S. economy,” could represent a massive escalation of global economic chaos, surpassing the international trade discord that marked much of his first administration. Trump advisers have for months discussed various potential levels to set the tariff rate, and they said the plan remains a work in progress with major questions left unresolved, the people said.

On Fox Business on Thursday, the former president called for setting this tariff at 10 percent “automatically” for all countries, a move that experts warn could lead to higher prices for consumers throughout the economy and could likely lead to a global trade war.

“I think we should have a ring around the collar” of the U.S. economy, Trump said in an interview with Kudlow on Fox Business on Thursday. “When companies come in and they dump their products in the United States, they should pay, automatically, let’s say a 10 percent tax … I do like the 10 percent for everybody.”

The proposed expansion of the tariff policy, which aides said is expected to be a central 2024 campaign plank, reflects how Trump is aiming to expand the power he wielded in the White House, eyeing sweeping authoritarian measures for his second term that range from deploying the military to fight street crime to purging the federal workforce. Trump is opting not to explain this vision to voters at the first Republican presidential primary debate, being held Wednesday. Trump said he will not attend.

Economists of both parties said Trump’s tariff proposal is extremely dangerous. Adam Posen, president of the Peterson Institute for International Economics, a Washington think tank, called the idea “lunacy” and “horrifying” and said it would lead the other major economies around the world to conclude the United States cannot be trusted as a trading partner. Although aimed at bolstering domestic production, a 10 percent tariff would hurt the thousands of U.S. firms that depend on imports, while also crippling the thousands of U.S. firms that depend on foreign exports, Posen said.

The United States today imposes an average tariff on imports of just above 3 percent, according to Posen. That number is higher for some countries, with goods coming from China facing an average import duty of 19 percent. “You would be depriving American families of an enormous amount of choice, making their lives much more expensive, and putting millions of people out of work,” Posen said.

Trump could use unilateral authority to exempt whatever countries he chooses from the automatic import tariffs. It would create enormous opportunities for influence-peddling, Posen said, following four years of a Trump presidency in which Saudi Arabia and other nations sought to steer Trump by frequenting his private businesses. “It is a recipe for corruption,” Posen said. “They will decide that whoever cozies up to Trump, or whoever his commerce secretary is, will get the exception.”

Trump was boasting about his poll numbers when Tucker Carlson suddenly cut him off.

“Can I ask you—that gets back to my original question,” he said. “If the protests didn’t work, and you got elected anyway; the impeachment didn’t work, twice; indictment is not working … If you chart it out, it’s an escalation, is what I’m saying. So what’s next, after trying to put you in prison for the rest of your life? That’s not working. Don’t they have to kill you now?”

Trump didn’t respond directly. “I think the people of our country don’t get enough credit for how smart they are,” he said. “They get it. I got indicted four times. All trivial. Nonsense. Bullshit. It’s all bullshit.” (As all Trumptards do, Trump denies any responsibility for the trouble he is in.)

It was the second time Carlson had brought up the strong likelihood, from his perspective, that they were going to try to kill Trump. Over the course of the 46-minute interview, Carlson emphasized, repeatedly, the looming danger from the left. It was an odd conversation in part because Trump didn’t seem to want to follow him down that particular path. Trump was eager to talk about the stolen election or the failures of the Democrats or Joe Biden’s senility, but he had little apparent enthusiasm for Carlson’s questions about the prospect of civil war. It was, oddly, an interview that served, unintentionally, to make Donald Trump seem reasonable.
