Most Unpopular President in History is Losing His Coalition

Morris: I wrote a couple of data driven takeaways—well not a couple, seven of them—on the Substack which I can reference. Then I’ll also mention a couple things from the new data analysis. For the readers, we’re recording this on Thursday. So there’s been about a day to catch up on sleep and digest the findings.

The big thing is unsurprising, but it really bears repeating. This is an electoral repudiation of Donald Trump and an electoral verdict on his unpopularity. I have appeared on your interview show a couple of times now to say essentially that the polls show he’s the most unpopular president ever, save himself in his first term. Trump’s policy agenda is also one of the most unpopular policy agendas in American presidential history, at least since we have surveys, since 1936. In that context, it’s rather unsurprising that Democrats did so well in Tuesday’s elections. They swept all of the statewide races in Virginia, all of the New Jersey races, they picked up two utility offices in Georgia, a red state—or a purple state if you’re very optimistic there as a Democrat—which is surprising. In Pennsylvania, they hold like three partisan justices and they win a lower court race as well as statewide.

In that context, it’s rather unsurprising, but it does affirm what we’ve been seeing in other data, which as good Bayesians, is always important to us. It also gives hard data to members of Congress that might want to fight Trump on things like his tariffs, or immigration, which is very unpopular, either from the right or from the left. It gives them something to point to that’s not just survey data, which is increasingly poo-pooed in Congress, as we might say.

So that’s my big takeaway. There are some smaller things which I’ll mention now. The first is it’s not just that Trump lost, it’s that he lost with voters that he supposedly had a realignment with in 2024. This is Latinos and Generation Z voters in particular. He loses with voters who say the economy is very important to them, which is the single constituency that likely propelled him to victory in 2024 in the first place. So in my article I’m putting out on Friday, I’m going to characterize this as: Trump’s losing his winning coalition; because I think that’s really what’s going on here.

The voters that put him in the White House because they wanted lower prices have said, “he’s not holding up his end of the bargain.” He’s not lowering prices. The supposed Republican ideological gains among Latinos in Generation Z who have tended to lean to the left and who, by the way, still voted for Kamala Harris despite lower margins than they did previously has evidently, evaporated. That’s really worth digesting as well.

Krugman: At one level of dispute we’ve had Trump himself insisting week after week that the polls are fake and that he’s extremely popular. And it’s basically you can argue until you’re blue in the face that “polling, it’s not a perfect science, but it’s meaningful.”

But there’s nothing quite like actual elections to settle that dispute. This sort of says that the polling saying that he’s unpopular and his policies are unpopular is right.

DOJ Had Its First Big Hearing in a “Trump Enemy’’ Prosecution. The Judge Was Not Pleased.

Let’s recall why Comey made it to the top of Trump’s enemies list.

In the world of sports, there is an old maxim that captures the essence of competitive athletics: “Play the ball, not the person.” Play the ball, focus on the competition itself, honor the game, and don’t try to humiliate or hate your opponent.

This is one of the many lessons that our current president appears never to have learned or accepted. President Trump is the classic “play the person” kind of leader. He seems to take pleasure in making everything personal.

His approach does great damage to our culture and politics. It is also deeply destructive of our legal system.

The president doesn’t hide his everything-is-personal approach. In fact, he wants the American public to know who his enemies are and to understand his embrace of an “all’s fair in love and war” political ethos.

That’s why he has been clear about his desire to see people like John Bolton, Letitia James, and James Comey prosecuted. It will now be up to judges handling those cases to push back against the president’s weaponization of the Justice Department.

On Wednesday, Magistrate Judge William Fitzpatrick, who is handling the preliminary phases of the Comey case, was the first up, and he gave a master class in judicial pushback. As the New York Times reports, he “repeatedly expressed his frustration—and at times his barely restrained annoyance—with [the federal prosecutor] during an otherwise procedural hearing in which he ordered the Justice Department to produce records from its investigation.”

Before saying more about Fitzpatrick’s pushback, let’s recall why Comey made it to the top of Trump’s enemies list.

Nine years ago, during and after the 2016 presidential campaign, no one would have predicted Trump’s vendetta against the former FBI director. In fact, but for Comey, Trump might not have ever been elected. ABC News notes: Comey announced in October 2016—less than two weeks before the presidential election—that the FBI was going to investigate Clinton’s private email server, months after federal investigators said it would not recommend charges. Trump praised the decision.

At the time, Trump said, “I have respect that the FBI has given it a second chance.”

The tone changed two days before the election, when Comey announced that he was not going to bring charges against Clinton. Never one to be bothered with evidence or the lack of it, Trump insisted, “Hillary Clinton is guilty. She knows it, the FBI knows it, the people know it.”

Things really went south in early 2017 when the president made it clear that he wanted the FBI director to pledge his loyalty, and when Comey demurred.

In March 2017, Comey got in more hot water when he went public with the fact that the FBI had been investigating suspected Russian interference during the 2016 election. Two months later, Trump claimed that “FBI Director Comey was the best thing that ever happened to Hillary Clinton in that he gave her a free pass for many bad deeds!”

In early May of that year, Trump took the unusual step of firing the FBI director.
It turned out that this was after an aggressive campaign by Trump to push Comey into dropping an investigation of his former national security adviser, Michael Flynn. Flynn would eventually be convicted and then pardoned for lying to federal investigators as part of that investigation into Russia’s election interference.

Almost a year later, Comey got a measure of revenge when he told an interviewer that the president was “morally unfit to be president.” He cited in particular his response to a white supremacist rally in Charlottesville, Virginia.

As U.S. President Donald Trump pushes the boundaries of executive power in the matters of trade and military action further and further, Congress’s conspicuous absence in pushing back against the president’s bold usurpation of authorities that the U.S. Constitution explicitly delegates to the legislative branch has become all the more glaring.

Recent votes in the Senate have highlighted just how far afield the Republican Party has traveled from its own previous long-standing stances in support of free trade. On other key votes in recent days on the permissibility of the Trump administration’s expanding regional maritime strikes on alleged drug-running vessels and the legality of any military action against the Venezuelan government, Republican lawmakers have overwhelmingly accepted the administration’s assertions that it is targeting “narco-terrorists” and have declined to preemptively put limitations on a potential effort to overthrow the Nicolás Maduro regime.

The Senate held votes last week on three separate measures to end a series of tariffs that Trump imposed this year, including his sweeping global tariffs; tariffs on Canada that the White House controversially justified by claiming a national fentanyl emergency existed on the northern border; and tariffs on Brazil that the president said were a response to the Brazilian Supreme Court’s criminal case against Trump ally and former President Jair Bolsonaro, who was convicted of attempting a coup after his 2022 election loss.

Though each of the resolutions narrowly passed the Senate after a couple of Republicans crossed the aisle to vote with Democrats, the measures face steep procedural hurdles in the House, where Republican leaders have more tools to preemptively block them from being voted on.

“I think we’ve seen probably for the last half-century an ebbing of congressional authority to the executive,” said Democratic Sen. Adam Schiff, a lead sponsor of two recently rejected war powers resolutions related to the military’s maritime attacks on alleged drug smugglers and the growing U.S. naval buildup near Venezuela.

“You could probably add up the sum total of that accretion of executive power in the last several decades, and it will be less than what’s happened in the last several months. Congress needs to reinsert itself, its control over the power of the purse and certainly its war power,” Schiff added.

With Congress under full Republican control and largely absenting itself from imposing any meaningful check on Trump, it will be likely the Supreme Court that acts first on the tariffs question. During oral arguments in a case before the high court this week, a majority of justices sounded skeptical about the administration’s contention that it has essentially unfettered powers to interfere with the U.S. economy through the mercurial imposition of tariffs.

“The legal basis for Trump’s use of tariffs is extremely weak,” said Jordan Tama, a professor at American University who specializes in congressional oversight of U.S. foreign policy. “The International Emergency Economic Powers Act, which the Trump administration has cited as the basis for the tariffs, authorizes the use of sanctions in the event of a national emergency that [constitutes] an unusual and extraordinary threat.”

His wife, Rachel Chavkin, says over the past three years, he will occasionally repeat a question, but otherwise has shown no cognitive decline since she fell in love with him twenty years ago. "Jake is now 51, which is the age that his father was when he died," she said.

The Trump administration's budget cuts have stopped or delayed millions of dollars in Alzheimer's research. The situation has already had an impact on Bateman's trials. "It's a precarious time," he said. "Research is not like building a building or painting a wall where you can start and then stop for a few years and then go back and resume what you were doing. It's much more like feeding a baby … if you stop doing that for a few weeks, it's irrecoverable."

The first clinical trials were funded by the two pharmas, Eisai and Biogen, that first produced lecanemab, a monoclonal antibody. (Any treatment ending in "mab" is a Monoclonal AntiBody.)

FDA approved lecanemab in 2023.

Heinrichs is no longer in a clinical trial, he's being treated with an FDA-approved medicine.

It's exactly what happened when car insurance was mandated, and especially after technology got to the point that the government could easily deny you the sale of your yearly car registration if you couldn't prove you had insurance. Prices went through the roof and have continued to balloon out of control. You know all about that being in the first state where many of the homeowners insurance companies closed shop because it's just simply too expensive to insure people in California anymore.

I've said it 100 times before. Prices for healthcare would never have gotten anywhere near as high as they have if insurance was never a factor. You can simply look to how "relatively" cheap it is to go get glasses or have your teeth worked on compared to anything that takes place in a hospital and/or doctor's office. In most cases, Dentists and Optometrists have to charge what people can afford.

Government and Insurance cannot co-exist.

If the Government is going to ever fix healthcare, the only way for it to do that is to make major sweeping laws banning insurance and forcing hospitals and drug companies to charge reasonable rates for their goods and services. Short of that, the only way they're going to do it is if Government completely absorbs and takes over healthcare. But I sure as shit don't trust them to do it any better than it's being done now.



I hate to sound like a fucking communist, but when it comes to healthcare there shouldn't be trillionaire companies and billionaire CEOs. There shouldn't be any fucking profit in it except for money going back into R&D, and a reasonable salary being paid to the people doing the actual work.

And don't give me any of that bullshit about nobody would do that work without a profit motive. Of course the researchers and developers would be getting paid a reasonable wage for their work. But on top of that, they LOVE doing this work. A lot of them hung around college a lot longer than they needed to so they could continue to do this kind of work with the college grant backing while still eating Ramen noodles on their stipend.

And really, at the end of the day, the entire stock market is what really needs to go.

That's what sucked all of the wealth out of the working man.

If you want to know why half the country can't find 40hr per week jobs with health insurance, it's because the money they should be getting paid is getting paid out to investors who aren't doing fuck all instead.

And they give all of you juuuuuuuuuuuuuuuuust enough of a taste where you all have a vested interest in seeing those numbers grow as your wallet grows threadbare. All for promises of a future that very well might not work out the way the "experts" have predicted your retirement would go if you did the right thing.

Hyperbolic? Perhaps. But it's not as if seniors haven't been worried about their retirement funds in retirement for going on 20 years now. Yeah... We've had some good times and things have more or less worked out so far for anybody who didn't panic sell in the bad times and screw themselves, but with $38 Trillion in debt and things getting worse economically every presidential cycle that passes, why should anybody in their mid-40's believe that all the money they put in a 401k is going to be worth anything in 20 years?

To the young who could afford it but would have to make a choice, buy the house. Don't put off buying a house so you can fund your 401k. If some international travesty occurs in the future where the USD gets undermined by a foreign currency or a digital currency, the house and the land under it are going to be worth something tangible when those old US notes you're banking online might not buy you toilet paper.

My "values" don't closely match the Democratic party. For example, I am for guns and for the death penalty, but those are not widely held valuable beliefs among the Democrats, and yet I have never in my life felt, known, detected, seen anything that strikes me as crazy, sick, mentally defective, evil, or poisonous about any Democrat. There are some silly Democrats, but nothing about them is seriously objectionable. I never get the feeling that a Democrat even needs to be yelled at or punched in the face, and certainly never that America is being harmed by a Democrat who doesn't share my so-called "values".

On the other hand, every fucking Trumptard I have gotten downwind from smells like they are not human. The Great Depression followed, and the consequences for the global economy proved calamitous.

Today we find ourselves again dancing toward new highs in the stock market. Speculative money is once more pouring into risky investment schemes, with staggering sums of money being thrown at artificial intelligence and cryptocurrencies. The financial excesses of 100 years ago teach us how high the costs of negligent oversight of our markets can be. When sentinels sleep, fraudsters flourish; their frenzied celebration of unreal profits pumps froth into the market; ultimately, with panic and pain, bubbles will burst. As stages of that cycle are recurring, we must decide whether to intervene now — or to mop up the mess later.

The parallels between the 1920s and the 2020s are numerous — and ominous. The 1920s economy boomed while America recovered from a deadly pandemic, the flu of 1918. Americans used installment plans — the precursor to today’s ubiquitous “buy now, pay later” plans at online checkouts — to spend liberally on consumer products, and they poured money into speculative new investments. That influx of buying from 1919 to 1929 drove the stock market up more than sixfold over the decade — a growth rate our market has actually surpassed over the past three years.

Nick Carraway, the narrator of “The Great Gatsby,” was a bond salesman. Today he might work for a crypto exchange or Robinhood, the popular app that allows neophytes to bet on financial options like a game on their smartphones. The invisible tottering tower, bigger than the stock markets (altho those are scary enough) is the hedge fund tower, which is AFAIK completely unregulated. Both ends of a hedge are bought on money borrowed from investment banks. As long as both ends of a hedge don't collapse, all is well. But if one does something unexpected, then all of that borrowed money comes due and the speculator has to liquidate catastrophically.

The stock market itself is based on borrowed money. There has been chart after chart showing the parallel between the stock markets and the Fed's various stock market props like quantitative easing. It's a little known fact that, aside from lending money to various nonbank lenders, businesses, institutions, homeowners, and hedge funds, banks buy stocks and lend money to stock market speculators.

Crypto is just IMHO essentially another value-less house of cards.

There is one more potential cause of collapse and that's the huge, and growing, wealth gap. That causes many people to take on too much debt. Any loan... auto, home, credit card, etc. ... based on impoverished people's ability to pay risks another collapse.

But most of these debts sooner or later run thru our banking system one way or another.

Government (public) debt PALES in comparison to the level of FINANCIAL debt, which is mostly unregulated. As long as the government can't, or doesn't, control the amount of debt being piled up to drive hedge funds, stock prices, and crypto to the moon, we will always risk repeated collapses.

The only way I can think of to prevent this is to require much MUCH higher bank reserves, to regulate nonbank lenders, and to once again separate investment from retail banks to limit the contagion of bank failures once they occur.

What would be Trump’s likely justification? This memorial only includes blacks who were lynched, making it completely unfair to whites. Over and over, Trump claimed overall prices have fallen since he returned to office in late January.

“Every price is down,” he said Thursday. “Everything is way down,” he said at another Thursday event. “Prices are down under the Trump administration, and they’re down substantially,” he said Friday, adding, “Everybody knows that it’s far less expensive under Trump than it was under Sleepy Joe Biden. Last Wednesday, the Supreme Court heard a challenge to Donald Trump’s “Liberation Day” tariffs that were put in place to punish foreign countries running a trade deficit against the United States, against China and Mexico for alleged fentanyl smuggling, and against Canada just for being Canada.

The consolidated cases, Learning Resources v. Trump and Trump v. VOS Selections, challenge Trump’s claim that he has the power to issue tariffs under the International Emergency Economic Powers Act of 1977, which permits the president to regulate transactions involving any property in which any foreign country or national thereof has any interest, in order to deal with an unusual and extraordinary threat.

On this week’s Amicus podcast, co-hosts Mark Joseph Stern and Dahlia Lithwick spoke with Marc Busch, the Karl F. Landegger Professor of International Business Diplomacy at the Edmund A. Walsh School of Foreign Service at Georgetown University. He’s an expert on international trade policy and law, and he signed on to an amicus brief on behalf of trade scholars explaining the history and context of the IEEPA. This transcript has been edited and condensed for clarity.

Dahlia Lithwick: These arguments were, in some sense, a very granular and fact-based parsing of statutory language. But they also played out at the highest level of questions about separation of powers and delegation. It doesn’t often happen that you have such a profound split-screen where you are seeing both micro-analysis of the verbs in IEEPA and at the same time profound questions about the limits of presidential power.

Marc Busch: Yes, but there was also no open, honest discussion about how absurd all of this is from an economics perspective. There was no discussion of that, with the exception of Neal Katyal mentioning that the U.S. has been running a trade deficit in goods since the 1970s, and they’re not persistent in a bad sense; they’re persistent in the sense that goods don’t reflect our comparative advantage. The government tried to cut services out of the calculation on Liberation Day when in fact, like all rich countries, we are a services economy. And that’s really hard to square with what is at stake, and leads us back to the macro perspective.

This case is so much bigger than trade. This is a separation of powers case, and it deserves to be taken very seriously precisely because of that. But there are some basics in economics that would have shed more light on what a power grab this is with respect to wanting a means of raising revenue.

As the plaintiffs pointed out, the DOJ’s submission was in fact the worst possible foot forward, inasmuch as we’ve been hearing since Liberation Day that these tariffs are a tax grab. We’ve heard they’re raising some crazy number of billions of dollars. We’ve heard that maybe we should have an external revenue agency. We’ve heard that maybe these can replace income taxes in the United States. Every deal has led to the president boasting about the haul of revenue he’s getting through tax collection. And that landed them in a morass, going out on a limb with respect to “regulatory” versus “revenue-raising” tariffs, and with the micro largely overshadowing the macro in a way that might have surprised many who listened in.

Republicans Are Damaged by Their Own Cruelty

They’re pathologically unwilling to help Americans in need — and Democrats should hammer this home

Like almost all progressives, I was infuriated and disheartened by Senate Democrats’ cave on the shutdown Sunday. The party won stunning election victories Tuesday — and its leaders responded with yet another preemptive surrender? (Chuck Schumer may have voted no, but he didn’t manage, and may not even have tried, to prevent defections.)

Yet while the immediate politics displayed Democratic tactical weakness, the larger story highlighted a different kind of weakness on the part of Donald Trump and MAGA as a whole — namely, their innate cruelty. They have a visceral dislike for policies that do anything to help the less fortunate, and can’t even bring themselves to be cynical, to help Americans temporarily while they consolidate power.

Consider the grounds on which the shutdown fight took place. Democrats made it about the enhanced subsidies that have kept premiums for health insurance under the Affordable Care Act fairly reasonable for millions of Americans — Americans who are now facing huge premium hikes that will create intense financial distress and force many to go uninsured.

Before the big cave, Democrats proposed a deal in which they would provide the votes to reopen the government in return for a one-year extension of those enhanced benefits. Republicans should have jumped at this deal. It’s true that Republicans are determined to destroy much of the social safety net. The One Big Beautiful Bill will impose savage cuts in Medicaid and food stamps. But these big cuts are set to happen after the midterm elections.

Drastically increasing health care costs at the beginning of 2026, causing millions to lose insurance, certainly looks like a massive political blunder. My guess is that it doesn’t reflect a considered strategy. Instead, Republicans just stumbled into this because nobody in a position of power within the party understood how the ACA works.

And polling suggests overwhelming public support for extending the enhanced subsidies: 74 percent overall, including half of Republicans.

So Republicans should have been eager for a chance to postpone the pain. Instead, by rejecting Democratic proposals, Republicans have placed the onus for soaring premiums squarely on themselves.

But the thought of doing something decent, even cynically and temporarily, doesn’t seem to have crossed Republican minds. John Thune, the Republican Senate majority leader, immediately declared the proposed deal a “nonstarter,” insisting that his party would only negotiate about healthcare after the government is reopened — which everyone understands means that Republicans will agree to nothing.

Why reject a deal that could have protected Republicans from their own mistakes? Part of the answer is sheer ignorance. Here was Trump’s response:

Fictional Intelligence: Imagining Trump and the Future of (Nuclear) War

I’ve just watched “A House of Dynamite”, the new suspense movie where the US gets attacked by an ICBM, that has drawn criticism from the Pentagon. The movie has been subject to some controversy in the nuclear nerd community as well, especially regarding the likelihood of the scenario. I thought it was a great movie precisely because it didn’t choose a scenario that we would commonly think likely, but one that asks the important questions: What if our adversaries don’t act and react at all the way we expect them to? What if our systems fail in the critical moment and nothing works as exercised? What if the decision-maker on the very top makes the wrong decision? Sort of what Vladimir Putin should have asked himself before marching into Ukraine in February 2022.

Perhaps the most ridiculous criticism I read somewhere was along the lines “Nuclear war? At a time like this, with everything else going on in the US? Really?”. I have to say I couldn’t disagree more. It’s precisely because of everything else that is also going on in the US that American voters should ask themselves next time they get to choose a president: Is this a person I would like to entrust the nuclear codes to wreak global havoc to? The same applies (to a somewhat lesser but not insignificant extent) to French and British voters as well. And the biggest elephant in the room is obviously that the movie features a professional US administration. My recommendation to Americans reading this is to watch the movie and imagine Trump and Hegseth in the respective roles. Makes the thriller even more thrilling.

Did you misunderstand what Washington DC, or even George Washington, did to the Redcoats, the Confederates, the Nazis, the Japanese Imperialists? You have repeatedly crossed this line, Signym, the same one Trump does all the time. Trump keeps insisting, as does Signym, that he is not guilty of anything, in this particular news story, of being a goddamn rapist, so long as he won't confess, despite lower courts saying he is a rapist.

The Democrats should give Trump a two-way choice: either pay the rape victim $88 million or kill him, but Democrats will take the third way, which is to wait forever for Trump to confess his guilt and voluntarily pay what he owes. President Donald Trump was up late Monday night trying to bully the Supreme Court into upholding his signature economic policy by warning of a national “drubbing” if it went against him.

Two key justices had sounded skeptical during oral arguments about whether Trump’s sweeping tariffs on imports from dozens of U.S. trading partners are valid under the International Emergency Economic Powers Act.

But conservative Justice Amy Coney Barrett also noted during her questioning that reimbursing almost $90 billion in tariffs already paid by American businesses would be a “mess.”

The president has repeatedly claimed that the tariffs are responsible for companies pledging to invest trillions of dollars in U.S. manufacturing, though he hasn’t provided any evidence that the number is anywhere near $3 trillion.

It’s also not a given that those investments, which include Apple’s planned $600 billion domestic manufacturing program, depend on the tariffs.

If they do, Congress could always approve the policy, since the central question in the case is whether Trump exceeded his authority by unilaterally imposing the duties.

Trump has nevertheless described the tariffs in existential terms and previously claimed that an adverse Supreme Court ruling could reduce the U.S. to “almost Third World status.”

In his latest post, he wrote that striking down the tariffs “would truly become an insurmountable National Security Event, and devastating to the future of our Country - Possibly non-sustainable!”

The post, however, undermined the legal argument that Solicitor General D. John Sauer tried to make Wednesday during oral arguments: that raising revenue was “only incidental” to Trump’s tariffs.

The duties are a type of import tax paid by American companies, which must eat the costs or pass them on to their customers. Last month, a report from Goldman Sachs found that consumers are shouldering as much as 55 percent of the cost of Trump’s tariffs.

Given that the Constitution expressly gives Congress the power to impose taxes, the administration has argued that the case is really about the president’s ability to regulate foreign powers, and not about raising revenue.

In the weeks leading up to Wednesday’s oral arguments, the administration had tried to downplay the policy’s money-making potential, The New York Times reported. The court is not expected to hand down a definitive ruling until next year.

But the Times went on to engage in some serious false equivalence:

Mr. Trump risks being in a similar position as his predecessor, defending his record by pointing to statistics that don’t capture a troubling reality that many Americans are feeling.

Sorry, but that’s a false comparison. You might even call it fake news — because Trump is not, in fact, pointing to any statistics. He’s just lying.

It is true that Biden officials liked to cite statistics that presented a favorable picture of the economy, but they were genuine statistics and did indeed seem to show an economy in pretty good shape.

Trump, by contrast, is engaged in what CNN calls a “lying spree” about inflation. We all know that many media organizations have long had a habit of “sanewashing” Trump, downplaying the craziness of his remarks. What we’re seeing now is “truthwashing,” pretending that there is some factual justification for bald-faced lies.

Let’s talk for a minute about what happened under Biden, then turn to Trump’s pants-on-fire claims about prices.

Biden officials never denied that there was a surge in inflation during 2021 and 2022. They did, however, claim that the surge was transitory. “Transitory” turned out to be much longer than they (and the Federal Reserve) initially predicted, but the surge was nonetheless temporary: Inflation peaked in mid-2022, then fell rapidly over the next 2 years. And this disinflation, defying the predictions of many economists, took place without a recession.

Biden’s people also never denied that prices were higher than they had been before the pandemic. But they said, correctly, that wages had risen even more, so that most workers’ purchasing power was higher despite the rise in prices. In 2024, Biden declared that “we’re proving that we can bring down inflation while safeguarding hard-won gains in jobs and real wages in American workers.” This was a completely truthful claim.

For a president who wants to project vigor and command at all times, Donald Trump made the worst possible spectacle of himself in the Oval Office last Thursday.

It came in the form of two images captured during a press event to announce cheaper weight-loss drugs. The first materialized when a participant fainted and several officials on hand rushed over. Not Trump, however, who, after turning to look at the fallen man, stood a few feet away at the Resolute Desk with his back to the action, wearing an indifferent expression. This was pointedly reflected in news photos that instantly went viral.

The second image, less noticed but possibly more damning, was memorialized just beforehand: As Mehmet Oz, the administration’s head of the Centers for Medicare & Medicaid Services, delivered remarks, Trump appeared to be nodding off at his desk. The Washington Post, in keeping with its dogged Watergate-era traditions, undertook a thorough “analysis of multiple video feeds” and confirmed that, indeed, the 79-year-old president had “spent nearly 20 minutes apparently battling to keep his eyes open.”

“He put his hand on his temple,” the Post investigation concluded. “He slouched in his chair.”

The White House denied that the president had been asleep, echoing Trump’s past sensitivities toward perceived somnolence. But there was something else going on here. The administration has sought to portray Trump as the main driver of all events at all times—potent, essential, and fully engaged. If there has been one unified message coming out of this White House, it’s been that of a presidency in perpetual motion. Yet Trump has looked much less daunting and invincible in recent days. He has been criticized for appearing checked out and oblivious to the economic hardships facing Americans, a sentiment reinforced by voters last Tuesday. Above all, Trump, who is not eligible to run for reelection in 2028—at least that’s what some people think—is loath to be seen as a lame duck. And yet, he is a lamer duck now than he was just a short while ago.

Last week was rough for Trump in that regard. Republicans suffered election routs in the Virginia and New Jersey governor’s races, as well as in a statewide ballot initiative pushed by California Governor Gavin Newsom. It wasn’t only that Democrats prevailed by massive margins or that the results confirmed that Trump’s second-term act was playing terribly with a critical mass of Americans, including many of those who’d voted for him. The GOP’s losses suddenly made Trump look vulnerable. By my informal estimation (without the benefit of “multiple video feeds”), “lame duck” was applied more often to Trump last week than in any prior stretch of his second term.

“Donald Trump Enters His Lame Duck Era,” declared one post-election headline in Politico. The accompanying article cataloged recent signs of Republican defiance of Trump. It led with a scene in which the president summoned Senate Republicans to the White House and demanded that they eliminate the filibuster. “Upon returning to the Capitol, the senators made it very clear: they planned to blow Trump off,” according to Politico. (Mike Rounds of South Dakota apparently “laughed out loud.”)

No officeholder welcomes being labeled a lame duck. From its earliest adoption, the phrase has never been meant as a term of flattery. Senator Lazarus Powell of Kentucky is credited with the first political usage, in 1863, when he described the U.S. Court of Claims as “a receptacle of ‘lame ducks’ or broken down politicians.” Over time, lame duck evolved into more of a time marker, referring to an elected official completing their final phase in office.

That’s the clinical definition, at least. But lame duck also carries deeper connotations of diminishing cachet, relating to a leader’s lost status and creeping

Why don’t people return their carts?

People had all sorts of reactions to being asked to do the right thing (see Figure 1). There were those who deflected, challenging the question itself rather than answering it. Do you work here? Are you the cart police? Do you represent this company? Who are you? Can I see your ID? Do you have any authority? Who do you work for? Who do you think you are? Why don’t you get a real job?

Some responded with anger and aggression. They yelled, cursed, and mocked. Some threatened to (or did) call law enforcement. Others escalated further, brandishing weapons like guns, tasers, or knives. “I’m gonna slash your face,” warned one man. “Why don’t I kick your ass?” asked another. A third shopper told the Cart Narc, “This is how you get killed.” If only returning the cart stirred as much passion as did refusing to.

Then there were the many, many excuses. In over half of the encounters I watched, shoppers provided at least one justification for their choice to abandon the cart (see Figure 2).

Many invoked entitlement, sometimes mentioning an identity they believed exempted them from common decency. “I worked at Safeway for lots of years and people left their carts all the time,” one man said. Another explained his choice to leave his cart by saying, “After 40 years of working retail grocery, I’ve earned it.” Earned what, exactly? The right to not pick up after yourself?

There were those who cited physical limitations barring them from cart return. “I’m 72 years old. I can’t walk that far,” explained a man after pushing his cart to the furthest edge of the lot. Another shopper clarified her choice to leave the cart in the middle of a handicap parking spot by mentioning, “I’m handicapped myself.” And one woman, upon being confronted about leaving her cart, declared, “I have really bad vertigo,” before getting behind the wheel and driving away. To be clear: Disabilities deserve accommodation. But if you could push the full cart to your car, why couldn’t you return the empty one?

Other people were simply too busy to return their carts. “I’m over an hour late to my own kid’s birthday party,” revealed one hurried shopper. “We have somewhere we need to be,” another alleged, before spending the next eight minutes arguing with the Cart Narc about how he didn’t have time to return his cart. Some mentioned inconvenience. “Them carts don’t even roll,” one shopper complained, after going out of his way to dig the wheels of his cart straight into grass and dirt.

Many justified their behavior by invoking norms and pointing to other cart abandoners. “Everyone else puts them there,” one shopper said, leaving his cart with a gaggle of similarly unreturned ones. “The culture around here is doing it,” insisted another, as if not returning one’s cart were a local tradition. This reasoning—everyone else does it—pairs best with a juice box and a timeout. If everyone else jumped off a bridge, would you?

Another type of excuse invoked other people by shifting responsibility (or blame) to others. Many shoppers pointed to their choice to leave the cart as a form of job stability or creation. “They pay someone to collect them all” explained one man. Another insisted that returning the cart is selfish because, “You’re putting someone out of a job.” It’s true that many stores do employ people to gather carts, but the job is to collect them from designated return areas—not to chase them down across the lot like loose cattle.

In some interactions I watched, people feigned ignorance. Like the woman who was unaware that carts shouldn’t be left on the curb: “I don’t kno

Attitudes started shifting when The Wall Street Journal reported in July that Trump wrote Epstein a birthday note saying "may every day be another wonderful secret" — inside the outline of a naked woman.
A picture of the note was later published to confirm the report, but MAGA's tide had already turned.
"I'd say MAGA/base looks at Democrats as corrupt and untrustworthy messengers, and anything they do damages credibility of the message," Breitbart News Washington Bureau Chief Matt Boyle texted Axios. He noted Trump kicked Epstein out of his club before his crimes were known.

Catch up quick: Democrats on the House Oversight Committee released emails Wednesday in which Epstein, who died in prison in 2019, wrote that Trump "knew about the girls" and that Trump had "spent hours at my house" with one victim.

Trump has denied any involvement in Epstein's crimes and said he and Epstein had a falling-out over unrelated issues.

White House Press Secretary Karoline Leavitt said Wednesday that Democrats "selectively leaked emails to the liberal media to create a fake narrative to smear President Trump."

He proudly pointed out the gilded details - which had been mocked online as resembling $58 trinkets from the hardware store - saying: 'You know one thing with gold? You can't imitate gold. There's no paint that imitates gold.'

The conservative host then directly asked the president: 'So these aren't, like, from Home Depot or something?'

'No, this is not Home Depot stuff. This is not Home Depot,' Trump replied.

Ingraham captioned the video on Facebook: 'In the Oval Office with President Trump and can confirm that it is REAL gold!'

The president has previously bragged about redecorating the Oval Office with '24 karat' gold spectacles, including gold medallions over the fireplace, Rococo mirrors hung over the doors, and golden eagles perched on the office side tables.

Nine months into his second term, the golden trinkets are more noticeable during visits from foreign leaders and press conferences.

There are almost 150 million dwelling units in America. Most homes are covered by insurance, and most home insurance covers losses due to fire. Yet in a normal year there are fewer than 400,000 home fires. Even if we allow for the fact that some homeowners don’t have insurance and some policies don’t cover fire damage, the vast majority of homeowners are paying for fire coverage that they will never use.

Clearly, this is a massive waste of money, a huge giveaway to the insurance industry.

OK, presumably almost no one believes that. While it’s unlikely that your house will burn down, losing your house to fire would be a crushing financial blow if you are uninsured. So we all pay premiums to protect ourselves against disaster. All Fannie Mae and Freddie Mac loans require home insurance.

Health insurance operates on the same principle. Without health insurance, you are at risk of a catastrophic financial blow if you get sick and require hospitalization. Moreover, even if you don’t require hospitalization, you are more likely to avoid getting regular check-ups and preventative care, thereby making it more likely that you will indeed suffer a health crisis and, possibly, death.

Yet the shutdown drama made it clear, once again, that Republicans, from Donald Trump on down, refuse to understand this basic point. Or if they do and say so publicly, like Marjorie Taylor Greene and say so, they become a pariah within the party. But most prefer to behave like the hapless and probably doomed New York Republican Rep. Mark Lawler, and blame Democrats for having forced the issue into the headlines.

But the fact that Republicans have been misrepresenting how health insurance works since Obamacare was first proposed in 2009 is a testament to their cruelty and intentional ignorance. For example, Trump’s opening salvo against the Democrats demand for continuation of the ACA subsidies blasted “money sucking insurance companies”, claiming that the subsidies should be sent directly to taxpayers so that Americans can “PURCHASE THEIR OWN, MUCH BETTER HEALTHCARE” – that is, demanding that they pay doctors and hospitals out of pocket:

The California Department of Motor Vehicles (DMV) has cancelled 17,000 non-domiciled commercial driver’s licenses following a federal audit of the state’s CDL program, according to the U.S. Department of Transportation.

In a press statement on Wednesday, DOT asserted that state officials admitted to illegally issuing the CDLs “to dangerous foreign drivers,” and that DMV sent notices to the license holders that their license no longer meets federal requirements and will expire in 60 days.

“After weeks of claiming they did nothing wrong, Gavin Newsom and California have been caught red-handed,” said Transportation Secretary Sean Duffy.

“This is just the tip of the iceberg. My team will continue to force California to prove they have removed every illegal immigrant from behind the wheel of semitrucks and school buses.”

FreightWaves has reached out to California’s DMV for comment.

FMCSA Chief Counsel Jesse Elison notified Newsom and his DMV in a September 26 letter that a sampling of the roughly 62,000 drivers in California holding unexpired, non-domiciled CDLs or commercial learner’s permits issued by the state revealed that 26% – which extrapolates to roughly 16,000 – failed to comply with federal requirements.

Donald Trump has cranked up his intense pressure campaign on congressional Republicans to oppose the full release of the justice department’s files related to Jeffrey Epstein, before a crucial and long-awaited House vote on the matter next week.

Trump reached out to Representative Nancy Mace, a Republican caucus in the House who have signed the petition. Mace wrote the president a long explanation of her own personal experience as a survivor of sexual abuse and rape, and why it was impossible for her to change her position on the matter.

The lobbying attempts came as Democrats on the House oversight committee released three damning new emails that Trump knew about Epstein’s conduct, including one in which the convicted paedophile said “of course [Trump] knew about the girls”. Another email described Trump as a “dog that hasn’t barked” and said he had “spent hours” with one victim at Epstein’s house.

President Donald Trump raged against members of his own party on Friday as a growing number of Republicans have indicated they will vote to release the Jeffrey Epstein files.

Trump, 79, has been desperately trying to stop more documents from going public after the House released a series of damaging emails from the Epstein estate on Wednesday in which he was mentioned.

That same day, the bipartisan discharge petition reached enough signatures to force a vote in the House to release the full Epstein files despite the GOP leadership’s wishes.

After months of pushing back, House Speaker Mike Johnson said that the vote would take place next week.

But the president took aim at members of both parties on Friday.

Trump accused Democrats of doing everything they can to “push the Epstein Hoax again” and claimed in his Truth Social post that it was to deflect from the “SHUTDOWN EMBARRASSMENT, where their party is in total disarray.”

However, several Republicans signed onto the discharge petition, and a significant number of GOP members are expected to buck Trump and support the release of the full files related to the convicted sex offender when the vote takes place.

“Some Weak Republicans have fallen into their clutches because they are soft and foolish,” Trump wrote in his post. “Epstein was a Democrat, and he is the Democrat’s problem, not the Republican’s problem!”

GOP Reps. Thomas Massie, Marjorie Taylor Greene, Nancy Mace and Lauren Boebert signed the discharge petition in September and refused to back down despite pressure.

Reps. Don Bacon, Rob Bresnahan, Tim Burchett, Warren Davidson and Eli Crane have all said either publicly or to a publication including CNN and Politico that they would vote for the bill when it comes to the floor.

Democratic Rep. Ro Khanna, who introduced it with Massie, said he expects 40 to 50 Republicans to back it.

Trump has ignored questions from reporters about the Epstein files since the latest documents were released on Wednesday despite being in settings where he usually engages with the media.

The president on Friday ranted on Truth Social that “Bill Clinton, Reid Hoffman, and Larry Summers about Epstein, they know all about him, don’t waste your time with Trump.”

The three, like Trump, are known associates of Epstein. None have been accused of any criminal wrongdoing.

In a separate post, the president then said he was directing the Justice Department and FBI to investigate their relationships.

“I will be asking A.G. Pam Bondi, and the Department of Justice, together with our great patriots at the FBI, to investigate Jeffrey Epstein’s involvement and relationship with Bill Clinton, Larry Summers, Reid Hoffman, J.P. Morgan, Chase, and many other people and institutions, to determine what was going on with them, and him,” he wrote.

The documents released on Wednesday showed that Epstein wrote in an email that Trump knew about the girls and had spent hours with one of the victims.

The name was redacted when Democrats released it, but Republicans on the House Oversight Committee said it was Virginia Giuffre and accused Democrats redacting her name to try and create a “fake narrative.”

The committee Republicans released 20,000 pages of documents on Wednesday. Trump was mentioned numerous times in the emails released.

The Trump administration is promising legal cover for military personnel who carry out lethal attacks on the alleged drug smugglers in the waters surrounding Latin America.

Amid mounting questions from senior military and civilian lawyers about the legality of proposed strikes on civilian boats, the Justice Department’s Office of Legal Counsel this summer produced a classified opinion intended to shield service members up and down the chain of command from prosecution, according to three government officials.

The legal theory advanced in the finding, two sources said, differs from some of President Donald Trump’s public statements on the killings. It claims that narcotics on the boats are lawful military targets because their cargo generates revenue for cartels whom the Trump administration claims are in armed conflict with the U.S.

One senior defense official, speaking on the condition of anonymity, blasted the opinion. “I don’t know what’s more insane – that the ‘President of Peace’ is starting an illegal war or that he’s giving a get out of jail free card to the U.S. military,” said the official, referencing President Donald Trump’s self-proclaimed moniker. “Hopefully they realize there’s no immunity for war crimes. Nor is there a statute of limitations.”

The Trump administration continues to keep the OLC memo from the American people but, this week, finally allowed members of Congress and their staffs to read the document. On Wednesday, just 20 copies were made available in a secure room, causing delays among lawmakers and staffers who have been waiting months to understand the legal reasoning underpinning the attacks.

On Thursday evening, War Secretary Pete Hegseth said that the campaign of attacks is called Operation Southern Spear. Led by Joint Task Force Southern Spear and Southern Command, “this mission defends our Homeland, removes narco-terrorists from our Hemisphere, and secures our Homeland from the drugs that are killing our people,” he wrote on X. Southern Spear kicked off earlier this year as part of the Navy’s next-generation effort to use small robot interceptor boats and vertical take-off and landing drones to conduct counternarcotics operations.

The military has carried out 20 known attacks, destroying 21 boats in the Caribbean Sea and eastern Pacific Ocean since September, killing at least 80 civilians. The most recent attack, on a vessel in the Caribbean on Monday, first reported by CBS on Thursday, reportedly killed four people. Following most of the attacks, Hegseth or Trump have claimed that the victims belonged to an unspecified designated terrorist organization, or DTO.

A list of DTOs, consisting of Latin American cartels and criminal organizations, is attached to the OLC opinion which claims that attacks on suspected drug traffickers in the Caribbean and Pacific are lawful and that personnel involved are immune from prosecution.

“The strikes were ordered consistent with the laws of armed conflict, and as such are lawful orders. Military personnel are legally obligated to follow lawful orders and, as such, are not subject to prosecution for following lawful orders,” a Justice Department spokesperson told The Intercept.

He then traced that to two encrypted foreign email accounts (bcook[at]mailfence.com and americangamer[at]gmx.com). He also had a snapchat account, a Venmo, Zelle and PayPal account among several others.

"It turns out that Crooks was hardly an online ghost," Carlson reports. "And yet, federal investigators lied and told us there was no trace of him online."

The source was able to obtain all materials from Crooks' deactivated YouTube account - which includes his search history, watch history, and 737 public comments.

When Carlson's team asked the FBI why they hadn't shared this information with the public, the agency replied by asking if they could verify the authenticity of the shooter's account.

What did Crooks say?

The comments by Crooks were posted between 2019 and 2020, when he was between 15 and 17-years-old. "They show two things," Carlson explains. "First, that Thomas Crooks was not some secretive lone wolf who never warned anyone that he was planning on violence. Just the opposite. Years before he showed up in Butler, Crooks was leaving a detailed digital trail of violent threats - including calls for assassinations and political violence. Second - they show a man who started out as a radical Trump supporter, whose views on the President transformed - changed completely, during Covid. The FBI lied about that fact, and that Crooks was a right-winger."

IMHO there's no justification for striking civilian boats and killing "suspects". This reminds me very much of how GWB tortured (so to speak) the law and pressured his then legal council to OK rendition and torture. Bush did his utmost to make the most use of "enemy combatant" category and find an external American-controlled location (originally they were going to use ships at sea but settled on Gitmo) to avoid American, foreign, and international law.

The only mitigating aspect of Trump's behavior is that it's just a few dozen people killed, not hundreds of thousands, like Hillary/Obama, Bill, and GWB did.

He had personally pledged to end H.I.V. as a public-health threat by 2030. The incoming Secretary of State, Marco Rubio, had been a vocal supporter of the bureau. There would be isolated partisan skirmishes—over diversity initiatives, abortion-related policies, and the like—but more than ninety-five per cent of our bureau’s work had never been under contention.

Clearly, I lacked imagination. Within hours of being sworn in, President Trump signed an executive order for a “pause” to all foreign assistance. Secretary Rubio sent a cable suspending every program outright. No program staff could be paid. No services could be delivered. Medicines and food already on the shelves could not be used. No warning had been given to the governments that relied on them. It was immediately obvious that hundreds of thousands of people would die in the first year alone. But the Administration did not reconsider; it escalated. Elon Musk exulted in swinging his chainsaw. Within weeks and in defiance of legal mandates, he and Rubio purged U.S.A.I.D.’s staff, terminated more than four-fifths of its contracts, impounded its funds, and dismantled the agency. Neither Congress nor the Supreme Court did anything to stop it.

We are now witnessing what the historian Richard Rhodes termed “public man-made death,” which, he observed, has been perhaps the most overlooked cause of mortality in the last century. House Democrats released a batch of emails on Wednesday that suggest President Donald Trump was aware of Jeffrey Epstein’s sex crimes and did nothing to report them. The messages, sent by Epstein to his associates—including chief accomplice Ghislaine Maxwell—contradict the White House’s claims that Trump had no real relationship with Epstein and was ignorant of his criminal offenses. They also seem to discredit Maxwell’s recent testimony to Deputy Attorney General Todd Blanche, who solicited her suspiciously rosy account of Trump’s role this past summer.

On this week’s Slate Plus bonus episode of Amicus, co-hosts Dahlia Lithwick and Mark Joseph Stern spoke about Blanche’s latest embarrassment by the Epstein scandal, as well as his dangerous counteroffensive against the legitimacy of the judiciary. A preview of their conversation, below, has been edited and condensed for clarity.

Dahlia Lithwick: Deputy Attorney General Todd Blanche—who has been signing off willy-nilly on the Justice Department’s fabrications in court—got pantsed by this email dump. There’s no other word for it. On so many levels, this is just devastating for him. Can you lay out the lies and fabrications and cover-ups?

Mark Joseph Stern: So Blanche interviewed Epstein’s accomplice, Ghislaine Maxwell, in July as part of an effort to exonerate Trump from the Epstein affair. A week later, she was transferred to a minimum-security prison, reportedly with special approval by the Trump administration, where she gets extraordinary privileges like customized meals, playtime with puppies, unlimited toilet paper, special access to guests with computers. It all looked a lot like a quid pro quo. During that interview, Maxwell did what Blanche wanted her to do, which was to claim that Trump and Epstein weren’t close friends at all, and Trump didn’t know anything about Epstein’s sex crimes. The Justice Department then publicly released the interview.

I think the new emails just flatly contradict Maxwell’s account to Blanche. They suggest that Trump knew about Epstein’s abuses but did nothing to expose them. For instance, Epstein wrote: “Trump knew of” the investigation into his crimes “and came to my house many times during that period.” He told the journalist Michael Wolff that “of course” Trump “knew about the girls.” And he told Maxwell that Trump was “the dog that hasn’t barked” because he evidently did not tell investigators about Epstein’s misconduct despite spending “hours” at Epstein’s house with one of his victims.

The upshot here is that Trump knew something; he probably knew a lot. And he could have said what he knew to law enforcement, but he stayed silent instead. That cannot be squared with what Maxwell told Blanche, and Blanche then told to the public. Of course, Blanche is Trump’s former criminal defense attorney, and he’s used to spinning fables to protect Trump. But when you’re deputy attorney general, and your client is supposed to be the American people, you’re expected to adhere to a higher standard. That expectation has clearly gone out the window. And whatever credibility Blanche may have had with the courts—and even just the American people—should be gone after this email dump.

Advocates Warn of ‘Forced Labor’ Camp for Homeless People in Utah Designed to Enforce Trump Order

An advocate for the National Homelessness Law Center warned that the 1,300-bed facility could be a “pilot” to put homeless people into similar conditions to Florida’s “Alligator Alcatraz.”

As far back as 2023, Trump has proposed using “large parcels of inexpensive land” to set up “tent cities” or camps for homeless people, coupled with a pledge to use “every tool, lever, and authority” to clear encampments from city streets. On the podcast Invisible People, which focuses on homelessness in America, Eric Tars of the National Homelessness Law Center said Utah’s new facility could be a “pilot program” for that effort around the country.

The Democrats had 4 years to get a case to trial in Federal court, but the court system moved so slowly that nothing got to trial. Meanwhile, the state courts did convict Trump in those 4 years. The Federal court system does not work because the Republicans in Congress have partial control of who becomes a judge and how much is spent to operate the courts. The Republicans in Congress do NOT want that court system to work, just as they do NOT want the IRS to work, which is the most important reason why $1 trillion in taxes is NOT collected each year. It is also the reason why Trump recently signed a bill to lower the taxes by several $trillion dollars of the fabulously wealthy and why he fired most of the auditors who handle rich people's tax returns. He does NOT want the court and tax systems to work smoothly or swiftly.

When Donald Trump moved on his first day back in office to strip birthright citizenship from children born in the U.S. to some immigrant parents, U.S. District Judge John Coughenour called the newly inaugurated president a threat to the rule of law.

Days after Trump mass-pardoned Jan. 6 defendants who attacked the Capitol, U.S. District Judge Royce Lamberth warned that for the first time in his career, “meritless justifications of criminal activity have gone mainstream.”

And in September, U.S. District Judge William Young warned that Trump’s crackdown on pro-Palestinian immigrants studying at U.S. universities “poses a great threat to Americans’ freedom of speech.”

In a year full of judicial rebukes for the president — often followed by vindication for Trump at the Supreme Court — these judges’ fierce and direct assessments of the president have stood out. But there’s more than lofty rhetoric that binds them. All were appointed to the bench decades ago by the same president: Ronald Reagan.

Now a fourth member of the Reagan-era fraternity has joined them: U.S. District Judge Mark Wolf, who took the bench in Massachusetts 40 years ago on the same day as Young. Wolf resigned his senior judgeship last week with the sole purpose of speaking out against what he sees as Trump’s incursion on the rule of law and the high court’s acquiescence to it.

It’s not an accident. Not only do these Reagan-appointed judges wield their seniority as a weapon, but their legal and judicial careers were all forged in the embers of Watergate, when a president’s assertion of vast, unprecedented power threatened to topple the justice system. They all worked and clerked for attorneys and judges tasked with rebuilding confidence in the federal government after Richard Nixon’s resignation and saw in it a vindication of principled appeals to impartial justice.

In a wide-ranging interview with POLITICO, Wolf said his own upbringing as a public corruption prosecutor during that moment of rebuilding is what has contributed to his alarm today. He sees echoes of that era in Trump’s second term but is worried that Americans — who would not have tolerated such behavior in the Watergate era, he says — may be too conditioned to view the world through partisan lenses to respond similarly today.

Republicans consider rolling back safety rules aimed at chemical hubs like Houston's

Nine years after Congress reached a landmark deal to limit Americans' exposure to toxic chemicals in places like the Houston Ship Channel, the Trump administration and Republicans in Congress are moving to loosen what had once been bipartisan regulations on chemical plants.

The Trump administration has undertaken a series of administrative actions this year to weaken EPA's oversight of the industry. Now Congress is weighing a rollback of 2016 legislation that amended the Toxic Substances Control Act — the landmark 1976 law that put limits on the distribution of toxic chemicals including PCBs, lead and radon.

Republicans have yet to release a draft bill, but at an industry event in Washington last month Lynn Dekleva, deputy assistant administrator of EPA's Office of Chemical Safety and Pollution Prevention and a former senior director at the American Chemistry Council, which lobbies for the industry, said House legislation she'd seen was "pretty radical," according to the news site Inside EPA.

She didn't go into details but derided the 2016 legislation as "a freight train."

"Some sections I want to blow up, but that's not for me to say," she said.

The unwinding of chemical standards pose a risk to communities surrounding Houston's petrochemical plants along the ship channel, which an EPA report last year showed have long suffered from elevated rates of asthma, cancer and other disease.

The 2016 reforms were supposed to reduce those communities' exposure to some of the most dangerous chemicals.

For instance, the Oxy Vinyls plant in La Porte, produces tetrachloroethylene, a known carcinogen that also causes neurological disorders, which the EPA ordered to be phased out last year, according to data collected by the Environmental Defense Fund. And Exxon Mobil's chemical plant in Baytown produces 1,3-Butadiene, a chemical used to make synthetic rubber and plastics that EPA scientists said in a draft appraisal last year presented "an unreasonable risk of injury to human health for workers and the general population (including fence line communities)."

"You have chemical plants and lots of freeways built around houses and playgrounds," said Inyang Uwak, research and policy director at Air Alliance Houston, an environmental group. "They're being exposed to a variety of compounds, and they all have different health impacts. If it's butadiene, it's the kidneys or non-Hodgkin’s lymphoma. If it's benzene, I look for leukemia."

Earlier this year President Donald Trump issued an executive order rolling back tougher emissions standards for petrochemical plants like those that line the Texas and Louisiana Gulf Coasts. And EPA Administrator Lee Zeldin proposed last month to limit that agency's ability to declare a chemical of "unreasonable risk," which typically results in limits or prohibitions on a chemical's uses to limit exposure.

The moves come amid pushback from chemical companies over the 2016 changes, which they say have resulted in long delays in chemical approvals and made them less competitive against overseas rivals.

John Huntsman, CEO of the Houston chemical company Huntsman Corp., derided U.S. chemical safety laws at a Senate hearing last month as taking "an overly conservative approach, not based on real world risks."

"This has led to unnecessary bans and highly restrictive regulations that are well outside the range of the rest of the world," he said.
