It just affirms what everyone already knows, Trump and everyone around him lied their asses off. Non-guilty people don't need to lie and delete communications...

pg 18 The investigation established that several individuals associated with the campaign lied (and deleted relevant communications) to the Office and to Congress about their interactions with Russian affiliated individuals and related matters

pg 418 We viewed the written answers to be inadequate.

However, appendix D on transferred cases still has a lot of redacted names yet to be charged.

I will be interested how Cohen fills in the blanks there.

Trump also met his former campaign chief Corey Lewandowski and dictated a message to Sessions to publicly announce the investigation was 'very unfair'
Lewandowski never delivered the message, rather passed it to deputy chief of staff Rick Dearborn who also did not relay the message to Sessions


Sure sounds like intent to obstruct to me.

Mueller actually looked at exactly this point. He didn't indict only because the rules he works under forbid him from indicting a President. Indicting a President is left to Congress. (The political calculus: the Democratic House won't vote to indict because the GOP Senate won't vote to convict. Instead, the 2020 Election decides Trump's fate. In his report, Special Counsel Robert Mueller concludes that nothing in statute or the Constitution shields a president from obstruction-of-justice charges. (Again, Mueller was operating under rules forbidding him, but not Congress, from indicting a President.) Obstruction-of-justice charges, for example, wouldn’t have a “chilling” effect on a president because they require a showing of corrupt motive, which “sets a demanding standard.” That standard rules out obstruction charges related to actions a president takes for political or policy reasons. “For instance, the President’s decision to curtail a law-enforcement investigation to avoid international friction would not implicate the obstruction-of-justice statutes.”

However, direct or indirect action to influence an investigation in order to avoid “personal embarrassment or legal liability” for himself or his family would qualify as corrupt.

With that in mind, here’s a selection of conclusions from the report about President Trump’s corrupt intent related to different aspects of the investigation. There are no redactions in the sections I’m quoting:

Firing of James Comey

Substantial evidence indicates that the catalyst for the President’s decision to fire Comey was Comey’s unwillingness to publicly state that the President was not personally under investigation….Some evidence indicates that the President believed that the erroneous perception he was under investigation harmed his ability to manage domestic and foreign affairs….Other evidence, however, indicates that the President wanted to protect himself from an investigation into his campaign….[T]he evidence does indicate that a thorough FBI investigation would uncover facts about the campaign and the President personally that the President could have understood to be crimes.

Attempt to fire the Special Counsel

Substantial evidence indicates that the President’s attempts to remove the Special Counsel were linked to the Special Counsel’s oversight of investigations that involved the President’s conduct—and most immediately, to reports that the President was being investigated for potential obstruction of justice.

Attempts to influence Jeff Sessions

Substantial evidence indicates that the President’s effort to have Sessions limit the scope of the Special Counsel’s investigation to future election interference was intended to prevent further investigative scrutiny of the President’s and his campaign’s conduct….There is evidence that at least one purpose of the President’s conduct toward Sessions was to have Sessions assume control over the Russia investigation and supervise it in a way that would restrict its scope….A reasonable inference […] is that the President believed that an unrecused Attorney General would play a protective role and could shield the President from the ongoing Russia investigation.

I really want to know what the point of a special investigation is if he couldn't file charges/indict. Why bother with 2 years of angst if all it can be is just a data dump?

Nothing new in the report (so far) for me. Just more of the same, proving what a whack job Dump has been and will always be. He tried to obstruct on so many occasions, so don't say you (Mueller) couldn't tell what his mindset was. My chief hope is this will tarnish him for 2020, but this pos has 90 lives, so who knows. I'm sure he'll spin it like a victory and an ignorant public will believe him.

The Special Counsel was only authorized to continue the investigation started by FBI Director James B. Comey, the same investigation he testified about before the House Permanent Select Committee on Intelligence on March 20, 2017, including:
(i) any links and/or coordination between the Russian government and individuals associated with the campaign of President Donald Trump; and
(ii) any matters that arose or may arise directly from the investigation.

Mueller didn't have any authority to indict that fat liar Trump. It's left to either the Attorney General or the House of Representatives to kick Trump's ass. If neither will do the kicking, Mueller can't do it for them, but the voters could decide in 2020 to kick Trump's fat ass out of the White House.

Come to think of it, the best way to get Trump is to show the voters he is a tax cheater. The way Trump is so protective of his returns shows that is where he is weakest. There is an extra bonus: if Trump cheated in the last 6 years, he won't be able to pardon his way out of paying the taxes he owes. Nixon and his Vice President Agnew both cheated on their taxes and they had to pay. President Ford's pardon could not excuse them from paying, although it did keep them out of jail for the crime of tax evasion.

I don't think of him as much of a religious man. I seriously doubt that he'd be worried what Melania would think, as I'm sure that even if they do manage to "love" each other on some level, she's aware of the business level relationship of their marriage. I think the worst thing that would happen to Trump's marriage if a pee tape came out would be that Melania would make him burn his clothes and take a shower before touching anything in the house whenever he got home.

Trump is not stupid. If he has to pay his back taxes, it will hurt him. He won't go to jail for tax cheating. Nixon didn't. Vice President Spiro Agnew didn't.

As for Trump voters voting a second time for Trump: it is to be expected. Stupid people don't learn on the first lesson. Stupid people have many problems in their lives. That's why they voted for Trump as the only guy who can fix their lives. It never occurs to stupid people that their problems grow from their personal shortcomings and bad decisions. Trump tried but failed to actually obstruct justice because other officials ignored him or his aides outright refused to follow his orders. This isn’t an exoneration of the president; Mueller is suggesting Trump had criminal intent but was too incompetent to act on it:

a. Our investigation found multiple acts by the President that were capable of exerting undue influence over law enforcement investigations, including the Russian-interference and obstruction investigations. The incidents were often carried out through one-on-one meetings in which the President sought to use his official power outside of usual channels. These actions ranged from efforts to remove the Special Counsel and to reverse the effect of the Attorney General’s recusal; to the attempted use of official power to limit the scope of the investigation; to direct and indirect contacts with witnesses with the potential to influence their testimony. Viewing the acts collectively can help to illuminate their significance. For example, the President’s direction to McGahn to have the Special Counsel removed was followed almost immediately by his direction to Lewandowski to tell the Attorney General to limit the scope of the Russia investigation to prospective election-interference only—a temporal connection that suggests that both acts were taken with a related purpose with respect to the investigation.

The President’s efforts to influence the investigation were mostly unsuccessful, but that is largely because the persons who surrounded the President declined to carry out orders or accede to his requests. Comey did not end the investigation of Flynn, which ultimately resulted in Flynn’s prosecution and conviction for lying to the FBI. McGahn did not tell the Acting Attorney General that the Special Counsel must be removed, but was instead prepared to resign over the President’s order. Lewandowski and Dearborn did not deliver the President’s message to Sessions that he should confine the Russia investigation to future election meddling only. And McGahn refused to recede from his recollections about events surrounding the President’s direction to have the Special Counsel removed, despite the President’s multiple demands that he do so. Consistent with that pattern, the evidence we obtained would not support potential obstruction charges against the President’s aides and associates beyond those already filed.

Mueller did his best to protect the FBI, and he did everything he could to torpedo President Trump, but the best he could manage was to create a political moment and punt to the House.

There are so many things NOT in the Mueller report, absence of which is designed to steer the discusison away from FBI malfeasance or incompetence

It didn't mention the fact that the DNC computer was never examined by the FBI
It didn't say anything about Fusion GPS
Nothing about the source of the leaks or the illegal unmasking
It said nothing about the source of the FISA warrant
They never interviewed Julian Assange, Craig Murray, or anyone who might have had direct knowledge of where the emails came from

It's a pretty thorough job of butt-covering, and I hope that the investigators get thoroughly investigated.

The tapes were fake, but even fakes can be politically damaging. The key punch-pulling passage in the Mueller report occurs on page 2 of volume 2, or page 214 of 448, where Mueller says that “we determined not to apply an approach that could potentially result in a judgment that the president committed crimes.”

The sentence is so shocking I had to read it several times. Mueller is saying that his team thought about — and rejected — going through Trump’s conduct using ordinary Justice Department standards to decide if he had violated the law.

That’s more or less what the public thought Mueller was going to do.

Mueller’s stated reason is more shocking still: He wanted to be “fair” to Trump because a president cannot be indicted under Justice Department policy, and without a trial Trump couldn’t “seek to clear his name.”

The president of the United States could, of course, use the news media to defend himself. He could also be impeached by the House and defend himself in the Senate. Mueller’s “fairness” logic is contorted to the point of being almost bizarre.

We may never know for sure what Mueller was thinking when he held back from announcing Trump committed crimes, despite having evidence to support that conclusion. The leading explanation, though, should be the adage ably expressed by Ralph Waldo Emerson, and memorably repeated by Omar on “The Wire”: “You come at the king, you best not miss.”

I think he put that in there to "poison pill" the report, since he couldn't find anything indictable.

I mean, if he was so worried about Trump not being able to "clear his name" he simply should have asked for that to be redated. But this was exactly what Comey did that pissed off so many Democrats .... air a list of possible misdeeds and then say ..."nah, not gonna indict".

It's like Trey Gowdy said: a good prosecutor should indict and shut up or not indict and shut up.

I really think that Mueller was interested in only two things: "getting" Trump on any statute whatsoever (or providing ammunition for a political process should that fail) and protecting the FBI.

There is so much missing from the report, so many interviews that weren't conducted, so much evidence that it lacking, computers that weren't examined ... it doesn't look to me like Mueller was interested in finding out "the truth" but in proving a crime. A despite the fact that he indicted so many people over process crimes to squeeze as much as he could out of them, he couldn't even do that.

At National Review, the Mueller report has confirmed that Trump gives orders and then his aides decide which of his orders to take seriously and which to ignore:

In contrast, a prosecutor’s judgment that crimes were committed, but that no charges will be brought, affords no such adversarial opportunity for public name-clearing before an impartial adjudicator.5

The concerns about the fairness of such a determination would be heightened in the case of a sitting President, where a federal prosecutor’s accusation of a crime, even in an internal report, could carry consequences that extend beyond the realm of criminal justice. OLC noted similar concerns about sealed indictments. You can make of these paragraphs what you will, but it plainly means Mueller, from the very start, before even beginning to work, will not indict Trump, even secretly for prosecution after Trump is out of office, no matter what is discovered.

Do you want to know what is odd and extremely telling? It is Trump saying, "I have no recollection." That was Trump's answer to every question asked of him by Mueller. That's the kind of answer you get from a crook that knows he cannot be waterboarded to get a real answer. Trump starts with "I have no recollection" on page 429 and ends with "I have no recollection" on page 438. Then Trump switched to "I do not remember" on page 439, for a little variety in not answering simple questions.

He could have played it cool, like Trump would, and refused to resign. He couldn't be forced out and replaced with Lt. Gov. David A. Paterson. Neither can Trump be forced out and replaced with V.P. Mike Pence. But Spitzer was a weakling. He resigned.
