OLC noted similar concerns about sealed indictments. Even if an indictment were sealed during the President’s term, OLC reasoned, “it would be very difficult to preserve [an indictment’s] secrecy,” and if an indictment became public, “[t]he stigma and opprobrium” could imperil the President’s ability to govern.”6 Although a prosecutor’s internal report would not represent a formal public accusation akin to an indictment, the possibility of the report’s public disclosure and the absence of a neutral adjudicatory forum to review its findings counseled against potentially determining “that the person’s conduct constitutes a federal offense.” Justice Manual § 9-27.220.

You can make of these paragraphs what you will, but it plainly means Mueller, from the very start, before even beginning to work, will not indict Trump, even secretly for prosecution after Trump is out of office, no matter what is discovered.

So I went back to check the actual report, a copy of which I have easily accessible on my computer, because, SECOND, you have a nasty reputation of very BIASED AND DISHONEST representation of so called 'facts'.

Of particular interest to me were the paragraphs you DIDN'T post. And then I realized that OLC (Office of Legal Council) was an extremely useful search term and checked out that information to get a more complete picture.

Re the the two paragraphs you DIDN'T post. Those paragraphs refer SPECIFICALLY to obstruction of justice, not to any potential collusion* (*shorthand for the entire phrase). And they apply ONLY to the President, not to anyone else. The fact that NOBODY WAS INDICTED FOR OBSTRUCTION, despite being legally liable for it, is very telling.

But I won't comment on the general OLC information because, frankly, it's too long, too complicated, and too contrary to your POV for you to read, understand, or even think honestly about, let alone discuss rationally.

Bur for anyone who doesn't want a biased 'source' to feed them their 'thoughts', the report is easily downloadable as a pdf, and searchable.

That's the kind of answer you get from a crook that knows he cannot be waterboarded to get a real answer. Then Trump switched to "I do not remember" on page 439, for a little variety in not answering simple questions.

rue, your confusion may stem from White House counsel Don McGahn, Corey Lewandowski and Rick Dearborn all NOT committing obstruction. Each told Trump to fuck off -- they were not going to do what Trump ordered. That is why they were not charged with obstruction of justice. rue, you are such a nitwit.

Here, Mueller wrote: “The President’s efforts to influence the investigation were mostly unsuccessful, but that is largely because the persons who surrounded the President declined to carry out orders or accede to his requests.” This disobedient group included high-level officials—FBI Director James Comey and White House counsel Don McGahn—as well as seeming longtime loyalists Corey Lewandowski and Rick Dearborn. In each case Mueller cited, the president ordered these surrogates—either directly or via another surrogate—to take some extraordinary action to obstruct the Russia probe, and in each case Trump was rebuffed.

I’ve finished reading the entire Mueller report, and I must confess that even as a longtime, quite open critic of Donald Trump, I was surprised at the sheer scope, scale, and brazenness of the lies, falsehoods, and misdirections detailed by the Special Counsel’s Office. We’ve become accustomed to Trump making up his own facts on matters great and small, but to see the extent to which his virus infected his entire political operation is sobering. And the idea that anyone is treating this report as “win” for Trump, given the sheer extent of deceptions exposed (among other things), demonstrates that the bar for his conduct has sunk so low that anything other than outright criminality is too often brushed aside as relatively meaningless. . . .

These lies have multiple consequences. First and most obviously, they demonstrate that the president’s word simply can’t be trusted. Yes, I know that there are readers who will immediately respond that “we already knew that” or that his dishonesty is already “priced in.” But don’t forget — as recently as last year, 76 percent of Republicans still believed that Trump told the truth “all or most of the time.” I personally know many people who believe that Trump’s ability to “tell it like it is” is one of his chief appeals.

Second, the extent of the lying across the Trump team shows that Trump’s lies can’t be contained to Trump. Even honest people who believe and repeat Trump’s words or the words of key members of his team can find themselves deceiving the public. Those who resist Trump’s efforts to deceive can find themselves overruled and publicly shamed. It was to Donald Jr.’s credit that his instinct — after news of the Trump Tower meeting started to leak — was to be transparent. It is Trump’s shame that he forced his own son to put out a misleading statement instead.

Third, the lies help demonstrate why the underlying investigation was so very necessary. When our intelligence agencies are aware of Russian efforts to interfere in the election and tilt it toward Trump, they know Trump officials are in contact with Russians, and they know that Trump officials are lying about those contacts, then it makes cries of “witch hunt” sound hollow indeed . . .

I’m old enough to remember the closing days of the 1996 campaign, when the Clinton administration was already beset by an avalanche of scandals. Bob Dole looked into the cameras and asked a pointed question — “Where is the outrage?” The same question applies today, but to a different audience. The lies are simply too much to bear. No Republican should tolerate such dishonesty.

It's interesting - and deeply unfortunate - that Department of Justice clearly used advanced redaction software but nonetheless chose to deliver a paper-age "images only" PDF. In so doing they:

1) Dramatically increased the file's size, probably by 8-10x.

2) Permanently and substantially reduced the visual text and image quality of a document of historical interest

3) Permanently reduced text searchability (assuming they received a searchable PDF from Mueller)

4) Delivered a documents that's inherently inaccessible to users who require assistive technology (AT) in order to read, requiring substantial remediation efforts to recover any useful degree of accessibility, let alone full compliance with applicable regulations.

The method the Times used to present a genuinely fully-searchable version of the Mueller report is elaborate, and required the services of 22 people (they are credited at the bottom of the page); even so, they were not able to fully mimic the original pages. This unfortunate reality could have been avoided if DoJ's workflow was simply redact-release instead of redact-print-scan-release (or even worse: print-scan-OCR-redact-print-scan-release). They chose a method that did not improve the security of redacted content but did materially and negatively burden everyone who would try to read, consume or otherwise process this document, forever.

We know that DoJ knows better, as we've previously observed that they use professional redaction software. In our view it's simply unacceptable that they should choose an unnecessary belt-and-braces approach for this historically-significant document that impedes every downstream user.

My point was, the only other choice we had was Clinton. Her actions, such as scrubbing the server she should have had in her home clean, and having everybody involved with her smashing up her cell phones are well known and were never disputed.

So when we're talking about any similar activities that Trump may or may not have done now, we already knew that our only other choice had done all of that before the election even took place.


The clock is ticking, but it's not the tick tock to impeachment. You know that full well.

There isn't a lot of time left before the next election goes full swing, and the Democrats don't have any clear message for the people or a legitimate candidate that would have a chance against Trump. Even lefty sources have come out recently and said that all things considered and assuming nothing changes, Trump would have an advantage.


The only chance of getting Trump out of office is the election in 2020, or waiting until he serves his second term, or waiting until his health fails him. (Without going into your ultra-dark territory on that... I know that you know what I mean).


I'm just waiting for the Democrats to drop the identity politics bullshit and come up with a way of truly fixing the economy and job situation as a contrast to what we have now. We've been hearing for two years that it's getting better, but the situation has not improved at all for the working class and continues to degrade.

Strange. I got a completely searchable pdf off of a government website that is viewable by alternate software. Where did I get it? Don't remember and not my problem. rue, per your usual, you completely missed the point that Barr did a crappy job of converting the Mueller Report to a pdf. It is Barr's responsibility. He failed. Maybe his failure was deliberate. The PDF Association explained how it is suppose to be done. The NYTimes demonstrated how easy it is to do. If they could do it, Barr could do it even easier. But he didn't. It's like Barr intentionally made it as difficult as possible for the public to read his redaction. Barr was sabotaging the report without making it obvious what Barr was doing.

In the weeks between the Mueller report being finished to the redacted Mueller report’s release, Trump’s message was that the report exonerated him. Now, with the report publicly available, he’s trying to ward off any talk about his impeachment. Trump realized that he looks like a crook. Why can't 6ix see what even unaware Trump sees?

The first version of the file that Barr produced was 136 MB (145,509,756 bytes). There is a later version at www.justice.gov/storage/report.pdf It is only 143,371,361 bytes

Even Barr should have known from the size of the first version that something was wrong with his file because it is 20 times too large. Then when you look at the fonts, there are only two (the second version has more):
Helvetica, ZapfDingbats. No lawyer uses those. Then try to select the text on the first version. It can't be done because it is a photo of text, rather than text.

Donald F. McGahn II arrived in a windowless conference room in southwest Washington in November 2017 to meet for the first time with the special counsel’s investigators. He was the White House counsel at the time and he was reluctant to answer their questions for fear that President Trump would one day blame him for any damaging revelations.

A year and a half later, the scapegoating has begun. Mr. Trump and his surrogates began attacking Mr. McGahn shortly after the report by the special counsel, Robert S. Mueller III, revealed he was the chief witness to the president’s attempts to undermine the inquiry. In an interview on Monday, a member of Mr. Trump’s legal team challenged Mr. McGahn’s motives and memory and accused investigators of ignoring inconsistencies in his assertions.

Mr. Giuliani acknowledged that he was amping up attacks on Mr. McGahn in an attempt to undermine the Mueller report as Democrats called for their congressional leaders to use it as a basis for impeachment proceedings. The Democratic-led House Judiciary Committee subpoenaed Mr. McGahn on Monday to testify next month and hand over documents.

Mr. Giuliani’s attacks on Mr. McGahn have unnerved some senior White House officials, who have argued privately that the president and his legal team should stop drawing attention to damaging episodes in the report, according to two people close to the White House. But Mr. Trump has privately complained about the accounts, particularly the ones given by Mr. McGahn, and has said the only way to protect himself from impeachment is to attack Mr. Mueller and Mr. McGahn, the people said.

Mr. Trump belied a lack of understanding about his agreement to waive executive privilege when he confronted Mr. McGahn in the Oval Office meeting early last year.

“What Mr. Giuliani seems to forget is that it was the president who decided Don [McGahn] should fully cooperate — despite available privileges — and who made it public,” Mr. Burck said.

The US Justice department quietly uploaded a new version of the Mueller report to its website today.

You wouldn’t notice any difference just by looking at the report, which can be downloaded here. What’s new is a layer of data that makes it possible, finally, to access the underlying text of the document.

When the Mueller report came out on April 18, it was essentially a giant file of images. (At 140 MB, the file was more than 300 times larger than an ebook of Crime and Punishment.)

The Justice department’s image-only PDF also seemed to violate the US government’s own guidelines for making documents accessible to all readers.

The website for Robert Mueller’s special counsel investigation acknowledged this shortcoming—“The Department recognizes that these documents may not yet be in an accessible format”—and offered to send a text file of the report to people who would have trouble reading it. It’s not clear if anyone requested such a file or received one. In any event, that offer was removed from the special counsel’s website today when the new version of the PDF was uploaded.

“They really did try to do a good job here to try to make it accessible,” he said in a phone interview. “Unfortunately, there are still a lot of errors in the tags.”

The software the Justice department used to OCR the report, Adobe Acrobat, generated some jumbled or incomplete text in the new PDF, especially around large redactions and photos. And many invisible markers intended to make the document more accessible were applied incorrectly.

The file is also still a 140MB set of images, albeit now with text underlying it. A never-scanned, native-text PDF of the report would likely be less than 5MB.

I saved the best for last. It happens that Mueller clearly thinks Trump can be charged once he’s out of office. Then Trump is burned at the stake by a prosecutor other than Mueller. I hope to smell Trump's fat on fire.

The special counsel makes his view plain in a single footnote.

In the report, it’s Footnote 1,091, which appears on Page 178.

The implication of both the passage and the subsequent footnote is clear: If Trump committed obstruction of justice, even through official actions, a prosecutor could charge him after his term has ended. Mueller is not saying Trump did or did not obstruct because the rule Mueller was operating under says Mueller has to leave it indeterminate for now.

But impeachment would be no “substitute” for eventual criminal charges, and “Congress is not restricted to relying only on impeachment,” which is “a drastic and rarely invoked remedy.”

This is pretty strong stuff, and it hasn’t received the attention it deserves.

Attorney General Barr stands between Trump and his burning at the stake as a witch, but Barr leaves office when Trump leaves. The next Attorney General might not protect Trump from justice.

Reading through the first volume of the Mueller Report, what is amazing is the extent to which Russia went to help Trump win. This was no hobby on their part. It was a full on, man the battle stations effort.

The release of the documents was designed and timed to interfere with the 2016 U.S. presidential election and undermine the Clinton Campaign."

The GRU spearphishing operation enabled it to gain access to numerous email accounts of Clinton Campaign employees and volunteers, including campaign chairman John Podesta, junior volunteers assigned to the Clinton Campaign’s advance team, informal Clinton Campaign advisors, and a DNC employee.118 GRU officers stole tens of thousands of emails from spearphishing victims, including various Clinton Campaign-related communications."

And on and on. This wasn't hacking Moldova, or some little Balkan state. I don't think a lot of people get that, or appreciate the level of intrusion that was made. You can't see any explosions or blood or buildings falling, so "meh."
