There’s the matter of the Ukrainian aid. Republicans perceive Democrats as simply ignoring the long history of administrations using aid to reward or punish foreign governments for their actions.

This is it. The big difference between Trump and Biden — and everyone else — is that Trump used military aid as a way to extort a personal benefit from Ukraine. That’s the start and the finish of the whole thing. If he had used military aid as bait to get Ukraine to fall in line with American interests in one way or another, no one would have blinked. But Republicans pretend that Joe Biden did the same thing, withholding aid to Ukraine in return for firing a prosecutor who was investigating Hunter Biden. This is simply a lie. Biden was publicly carrying out US policy which was supported by the president, the State Department, and virtually all of Europe.

Trump used the aid as bait to get a personal favor from Ukraine: namely an investigation into an opponent in a presidential campaign. That’s as plain an example of abuse of power as you could imagine. And after he was caught, Trump didn’t apologize or promise not to do it again or anything like that. He conducted a scorched-earth attack that left Democrats with no choice but to impeach.

Lots of my fellow liberals have been calling for Trump’s impeachment practically since he was elected. I haven’t. As much as I loathe the man, I didn’t think he had done any single truly impeachable thing, and I also wasn’t sure that impeachment was politically wise anyway. Then came Ukraine. I continued to think that impeachment might be politically unwise, but it took only a few weeks for the question of whether Trump’s actions were impeachable to become obvious. Of course they were. Secretly withholding congressionally approved military aid in return for a personal benefit? Putting responsibility for this in the hands of his personal lawyer instead of US diplomats? Instructing aides to lie to Congress about what was going on? Politically wise or not, of course Trump had to be impeached over this. It would be both cowardly and a mockery of the Constitution to do otherwise.

But this all hangs on the fact that Trump’s price was personal, not national. This is the thing that I suspect hardly anyone really gets. Investigating a campaign opponent is a personal benefit. In an autocracy, campaigns are treated as mere appendages of governing, but in democracies they aren’t. We’re a democracy.

Mitch McConnell has one goal here: to keep the trial short and the public bored enough not to watch it. Refusing to allow new evidence is part of that: it ensures that nobody bothers turning on their TV in hopes that something new and exciting will happen. With no new testimony, what then is the point of watching?

As long as the trial is short and dull, McConnell wins. Very few people even know who John Bolton and Mick Mulvaney are, let alone whether they avoided having to testify.

The Senate itself is on trial

The first question is whether Senate Republicans will hear all the relevant evidence or merely orchestrate a coverup. There are many fact witnesses who have not yet testified, including the president himself, and floods of relevant new documents emerge virtually daily. To actually try the case, the Senate must hear those witnesses and consider those documents. To refuse to do so is to deny the implicit constitutional mandate requiring an honest and good faith proceeding in the Senate to establish the truth.

Those Republicans feel compelled to engage in such transgressions for an imperative political reason. They recognize that they must exclude those witnesses and documents because they would further support the case against Trump. Indeed, their determination to exclude that very evidence testifies to their recognition that, if it is considered fairly, the additional information would almost certainly require that they convict Trump.

And here is the second article of impeachment against Richard Nixon:

He misused the Federal Bureau of Investigation, the Secret Service, and other executive personnel, in violation or disregard of the constitutional rights of citizens, by directing or authorizing such agencies or personnel to conduct or continue electronic surveillance or other investigations for purposes unrelated to national security, the enforcement of laws, or any other lawful function of his office….

Back in 1974, directing an “investigation” for purposes “unrelated” to lawful functions of the office produced a 27-11 vote in the Judiciary Committee for impeachment. Those 11 votes against impeachment? That was 11 Republicans. If the vote was today, all the Republicans would have been against impeachment of Nixon. Today, extorting an investigation from Ukraine for personal gain produces nothing but sophistry from Republicans.

It is plain to everyone that Trump’s lengthy battering of Ukraine — which went on for months and months — was not a legitimate use of his office. He never asked Ukraine to take action against corruption in general. He asked for only one thing: an investigation of Hunter Biden. That’s it. That’s all he wanted. And it was worth millions of dollars to him, far more than any ordinary illegal campaign contribution delivered in a plain black suitcase.

So here’s the story: Donald Trump has abused the powers of his office to threaten a U.S. ally. His threat is probably illegal; his refusal to produce documents about his decision process is definitely illegal. And his claims about the motivation for his actions don’t pass the laugh test.

You probably think that I’m talking about Trump’s attempt to pressure Ukraine into producing political dirt on Joe Biden by withholding aid, and the subsequent cover-up — you know, the stuff for which he has been impeached (and that half the country believes should lead to his removal from office). But there’s another, somewhat similar story: his repeated threats to impose prohibitive tariffs on imports of automobiles from Europe.

Granted, the auto tariff story isn’t as vile as the Ukraine story, and it poses less of a direct threat to a fair election. But it’s recognizably part of the same syndrome: abuse of presidential power, contempt for the rule of law, and dishonesty about motivations.

Some background: U.S. tariffs — taxes on imports — are normally set the same way we set other taxes, through legislation that must pass Congress and then be signed by the president. The law does, however, give the president discretion to impose temporary tariffs under certain circumstances, for example to give U.S. industries a breathing space in the face of sudden import surges, to counter foreign export subsidies or to protect national security (Section 232).

Until Trump, Section 232 cases were rare. He has, however, used the national security justification for tariffs with abandon, and zero regard for plausibility. Canadian aluminum poses a national security risk? Really?

And so it was that in 2018 the Trump administration announced that it was beginning a Section 232 investigation of auto imports, especially from Europe and Japan. Every trade expert I know considered the notion that German or Japanese cars constitute a threat to national security absurd. Nonetheless, in 2019 a report from the Commerce Department concluded that auto imports do, indeed, endanger national security.

What was the basis for this conclusion? Well, we don’t actually know — because the Trump administration has refused to release the report.

This stonewalling is clearly illegal. The statute requires that all portions of the Commerce report that don’t contain classified or proprietary information be published in the Federal Register, and it’s hard to believe that any of the report contains such information, let alone the whole thing. Furthermore, Congress inserted a provision in a spending bill last month specifically requiring that the Trump administration turn over the report.

Why won’t Trump obey the law and hand over the document? My guess is that his people are afraid to let anyone see the Commerce report because it’s embarrassingly thin and incompetent. To be honest, I have some doubts about whether the report even exists.

If you needed a reminder of what’s at stake in President Trump’s impeachment trial currently underway in the Senate, the danger Trump’s pattern of behavior poses for all of us for as long as he is president, Rep. Adam Schiff cut through the moral clutter Thursday during his closing statement. It’s been a long three years, and even if you know Trump committed a crime or simply violated the oath of his office, it’s easy to be lulled into the GOP-induced nihilism that maybe this isn’t such a big deal, maybe it’s normal, and finally maybe it’s too much, too far to remove a president, even Donald Trump, from office for it.

To this ethical fog, created by Republican relativism, Schiff provides a succinct and often stirring rebuttal, reminding reasonable, likeminded Americans, first, to trust themselves. Schiff then makes the case for why Trump is dangerous to America’s national interest and thereby dangerous to Americans themselves.

What Christopher Wray was offering him was merely the information he needed to protect his country and its elections, but that’s not good enough. What’s in it for him? What’s in it for Donald Trump? This is why he needs to be removed.

Now, you may be asking how much damage can he really do in the next several months until the election? A lot. A lot of damage.
