That would be a Constitutional question — and so in keeping with my obligation not to give hints, previews or forecasts of how I would resolve a case, that's not one that I can answer."

The five freedoms the Judge didn't want to answer: speech, religion, press, assembly, and the right to petition the government.

Barrett gave at least seven talks at Notre Dame Law School she didn't reveal in her Senate questionnaire, including one with the school's anti-abortion group, public calendars from the school show. Those new discoveries were enough to convince Sen. Richard Blumenthal (D-Conn.), a member of the Judiciary committee, that the final day of Barrett's hearings should be delayed. The new reports, combined with her refusal to answer many questions during the hearings, "have been actually very revealing about how unrevealing, uncandid this nominee has been," Blumenthal said.

The steamrolled confirmation of Amy Coney Barrett will, if it succeeds, lock in a pro-fascist majority to throw the election to Trump no matter how we vote. It will transform the highest court in the land into an instrument of white supremacist, Christian theocratic atrocity, stripping women, LGBTQ people, and many more of their basic human rights.

The Trump/Pence regime has already called legitimate protest "sedition." During a Fox interview, Trump branded protests after the election "insurrection" that he would "put down in minutes." Unbelievable? This would be a good time to remember the Russian dissident Masha Gessen’s first rule for dealing with authoritarian heads of state: “Believe the autocrat. He means what he says.”

For four years, this regime has demonized and brutalized immigrants, Black people, Latinos, Native Americans, women, LGBTQ people, the media and peaceful protesters. It opposes science, leading to a country and a planet burning and drowning, and to unconscionable unnecessary death and illness from COVID.

This is fascism, hammering in a form of rule that relies on terror and violence. If fascism fully takes hold in this country, the consequences for humanity will be catastrophic.

Amy Coney Barrett Knows Exactly What She Did in 2000

The Supreme Court nominee would be the third(!) sitting justice, alongside Brett Kavanaugh and John Roberts, who worked on the Republican side of Bush v. Gore. Justice Clarence Thomas decided for Bush and is still on the court.

BARRETT: "I did work on Bush v. Gore on behalf of the Republican side. To be fully honest, I can't remember exactly what piece of the case it was."

I don't believe that Barrett doesn't remember what she did in 2000. I think she's proud of it and knows that is why she is Trump's choice. I think what she told the Senate is a barefaced non-fact.

Even though it laughably defined itself as non-precedential, Bush v. Gore established as fact the Supreme Court's ability to meddle in presidential elections and, indeed, to decide them de facto. When she is confirmed, this nominee will join two other justices who worked with her on the legal strategy that ended up as the illegitimate meddling in Bush v. Gore. She will be on the Court when and if the decisions relating to this election arrive there.

There’s bipartisanship, and then there’s bringing a pillow to a gun fight. The Republican Party has gotten very good at playing constitutional hardball. If Democrats can’t or won’t match that energy, there won’t be a prize for maintaining the moral high ground. There will just be a lot of predictable political impotence.

Adding insult to injury for progressives is the fact that Feinstein can be ferocious with political opponents. She just saves it for the real threats to our democracy — like, say, 11-year-old climate activists.

A video of Feinstein speaking dismissively to a group of tweenaged Sunrise Movement activists who asked her to support the Green New Deal went viral in February 2019, and it resurfaced this week as many liberals heavily criticized the senator. The contrast between the Feinstein of the Barrett hearings and the Feinstein of the Sunrise Movement encounter is jarring.

Compare friendly questions like “You don’t have a magic formula for how you do it and handle all the children and your job and your work and your thought process, which is obviously excellent, do you?” with curt remarks like “You come in here, and you say it has to be my way or the highway. I don’t respond to that.” Or “I was elected by almost a million-vote plurality. And I know what I’m doing. So maybe people should listen a little bit.” Who does Feinstein seem to hold in more disdain: a judge whose nomination is an affront, or a bunch of kids who are afraid of dying in a climate apocalypse?

Of course Feinstein’s (very, very, very) long political career can’t be adequately summed up by a handful of quotes from two events. But for young progressives, it’s deeply disappointing for one of the most senior Democrats in Congress to treat the Republicans rushing Barrett’s confirmation with kid gloves — after treating young Californians concerned about climate change with open contempt.

By a 4–4 vote, with Roberts joining the remaining liberals, the court refused to block a decision by the Pennsylvania Supreme Court that compelled the state to count mail-in ballots received by Nov. 6. You should also take the time to note that despite all of the false claims over the last 4 years here that I'm a misogynist, I have no problem with Barrett getting the nomination. In fact, despite all of the false claims that I'm a racist (White Nationalist), Barrett wasn't even my first choice. I wanted Trump to nominate Barbara Lagoa, who was a descendant of two (legal) Cuban immigrants.

7. As a result, the idea of a judicial retirement age was specifically rejected. It was envisioned that a lawyer would need a lifetime of experience to become fully versed in the precedents that would govern their decisions as a Supreme Court Justice.

8. We are now on the verge of all of the errors in the framers’ arguments for the Supreme Court coming to fruition. In the 19th Century, the average tenure of a Justice was less than 10 years, due mainly to life expectancy. Now that it is common to live into one’s 80s, Justices serving for 25 years or more are becoming increasingly common. Movement conservatives are using a theory of construction that did not even exist until about 40 years ago, and using it to overturn long-standing precedents (and are also inventing novel constructions nowhere found in the Constitution when it suits them: see Shelby County). They have declared statutes unconstitutional at a rate never before seen, and they are likely to revive the Lochner doctrine of 100 years ago that deemed almost all economic regulation unconstitutional.

9. Fundamentally, there are 3 approaches that can be used to change this dynamic, but 1 of them almost certainly involves a new Constitutional Amendment.

10. The first approach is to make all circuit court appellate judges also members of the Supreme Court, and delegate the jurisdiction of the Supreme Court to rotating panels (just as the Circuit Courts of Appeal operate now). This requires being comfortable with the quality of the Appellate judiciary now, and probably moves the point of contention down from the Supreme Court to the Circuit Courts. By the way, this approach was seriously considered in the wake of Dred Scott by the Reconstruction Congress of 1869 which passed the 15th Amendment.

11. The second approach is to have single 18 year term appointments to the Supreme Court. This almost certainly requires a Constitutional Amendment, since there would be an involuntary retirement from the Court after 18 years regardless of “good behavior,” and we can certainly expect that the movement conservative justices are going to object.

12. The third approach is to have the President nominate two Justices during the 1st and 3rd years of their term, regardless of the number of justices that would create. The Court would probably have an even number of justices about half the time, leading to more split decisions (in which case the judgment of the lower court would stand).

13. Potentially the first and third approaches could be combined, so that panels of 9 Justices would hear any given case.

14. If it were up to me, I would expand the Court to 11 members immediately after Biden takes office, and also enact the third approach immediately. That would give Biden 3 appointment next year, immediately evening the number of justices appointed by Presidents of each party. Biden would get another appointment in 2023, and thereafter the winner of any Presidential election would get two appointments. Note that under this scenario the retirement or death of a Justice does not lead to any replacement appointment.

15. If the GOP got tired of this arrangement, then they could sign on to a Constitutional Amendment enacting the second option (a single 18 year term).

16. Because Biden would not get an automatic majority, this is not quite “court-packing.” It also would encourage justices to become more moderate in their decision-making, and nudge the political parties to a more permanent fair solution that maintains the framers’ intent for an independent judiciary.
