Judge rules Trump unlawfully invoked Alien Enemies Act against alleged Tren de Aragua members

A federal judge in Texas found on Thursday that President Donald Trump did not meet the necessary criteria to use the Alien Enemies Act to deport alleged Tren de Aragua members, dealing a blow to the administration as it attempts to remove criminal illegal immigrants from the country quickly.

Judge Fernando Rodriguez, a Trump appointee, said in an order that Trump could still deport Venezuelan migrants detained in southern Texas using other, more routine authorities. However, Rodriguez said the Alien Enemies Act, a powerful wartime law, was not an option.

Great. This time it was a Trump appointee who blocked it, which looks great for the winning team.

Now it goes up the chain and gets shot down on appeal just like every court case you've ever mentioned so far in this thread.

Meanwhile, keep screaming your head off about the violent gang member aliens we're kicking out of the country and watch your party become even less relevant than it is right now.

TRUMP WINS IN COURT

A DC Appeals court ruled that

Quote:

The appeals court's 2-1 ruling Saturday emphasized the judiciary's deference to executive authority in matters concerning federal employment and contractual decisions.

The court noted that the district court likely lacked jurisdiction to interfere with the administration's personnel actions and funding decisions, particularly regarding grant agreements with non-federal entities like Radio Free Asia and the Middle East Broadcasting Networks.

This ruling Trump's March 14 executive order (EO), which aimed to dismantle USAGM operations.

In other words, according to this Appeals court, district courts lack jurisdiction to rule on Presidential contract or personnel actions.

Specifically
Quote:

According to Margot Cleveland, senior legal correspondent for The Federalist, the D.C. Circuit’s ruling hinges on a critical point: jurisdiction, which has sweeping implications. As Cleveland explains, many of the legal challenges being hurled at the Trump administration involve employment decisions—precisely the kind of disputes Congress has explicitly said federal district courts have no authority to adjudicate.

In addition

Quote:

the lower court also overstepped its bounds by trying to restore federal grants—something Congress assigned to the Court of Federal Claims, not the district courts. All told, the decision is a sharp rebuke to the legal overreach being used to obstruct the Trump administration’s agenda.
The significance of this decision extends far beyond these specific cases—it establishes clear jurisdictional parameters that could affect dozens of pending lawsuits against Trump administration policies. While the administration won't prevail in every case, this ruling suggests courts may need to more carefully consider their jurisdictional authority before issuing sweeping injunctions against executive actions.

Hey, so Trump got a stay. Good for him. No, the law states the executive office cannot dismantle programs created by, and funded by Congress. It will run its course. He will, or should lose.

I'm not sure Congress can compel a President to spend money on a program, even if it's been budgeted and funded. Thinking back to my time in public service, there have been times when we had funds for personnel or programs that were intended to be spent, but thanks to rapidly changing political priorities staff was never hired and programs were set aside per CEO.

For instance, what happens if someone finds a way to do the same thing at 1/10 of the cost? Is a President required to waste money? I thought the role of the President was to administer the government, and that means hiring, firing, and counting pennies.

So it seems a gray area exists between Congress and Executive branches

Another question: In order for a case to be heard, the person bringing a complaint must have "standing". So, if the fundamental question is the division of powers, whose toes are being stepped on? Congress'?

Also... if the district courts lack jurisdiction, what court, or courts, should hear the(se) case(s)?

It'll be interesting to see this all sorted out. USA government was not meant to run on Executive Orders alone. Altho, TBH, if Congress hadn't been so dysfunctional for the past... oh 40 years or more ... we wouldn't have gotten to this point.

Supreme Court Lets Trump Admin Ban Trans Troops As Hegseth Says "We're Done With That Sh*t"
Tuesday, May 06, 2025 - 01:40 PM

The Supreme Court on Tuesday granted a stay allowing the Trump administration to ban troops who identify as transgender while litigation plays out in a lower court.

The Supreme Court on Tuesday granted a stay allowing the Trump administration to ban troops who identify as transgender while litigation plays out in a lower court.

A majority of justices agreed to enter a stay of a preliminary injunction issued by a US district judge in March, pending the disposition of an appeal.

Opposing the stay, of course, were Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson.

The decision is a big loss for seven transgender men, led by lead plaintiff Emily Schilling, a Navy commander, who sued to block the Trump admin from busting her balls.

"Today’s Supreme Court ruling is a devastating blow to transgender service members who have demonstrated their capabilities and commitment to our nation’s defense," said Lambda Legal and Human Rights Campaign Foundation - two groups representing the plaintiffs, said in a joint statement, adding that the policy "has nothing to do with military readiness and everything to do with prejudice."

In a separate case, a judge in Washington, D.C., also blocked the policy nationwide, but the U.S. Court of Appeals for the District of Columbia Circuit put that ruling on hold temporarily while it heard arguments on whether to block it more permanently. The court has yet to rule.

The policy, announced in February, is much more comprehensive ban than a similar proposal implemented during the first Trump term. It "generally disqualifies from military service individuals who have gender dysphoria or have undergone medical interventions for gender dysphoria," Solicitor General D. John Sauer said in court papers. -NBC News

Meanwhile, Defense Secretary Pete Hegseth said in a fiery speech on Tuesday that the US military will return to a warrior ethos.

"We are leaving wokeness and weakness behind. No more pronouns, no more climate change obsession, no more emergency vaccine mandates. No more dudes in dresses. We’re done with that shit," he said, adding "We’re focused on lethality, meritocracy, accountability, standards and readiness."

This may be popular with MAGA, and it might make sense for fighting forces, but what if ... for example ... a transgender officer is a superior tactician or strategist?

We employed gay and lesbians who were superior at their jobs. We've employed white Christian males who should have been fired. When you treat people as a category you're prejudiced.

BREAKING: DOJ Won't Appeal Block on Trump's Anti-Voting Order

They're not telling you the whole story, dummy. But first off, here is what YOU ARE ARGUING AGAINST.

https://www.democracydocket.com/news-alerts/justice-department-appeal-
trump-election-executive-order
/

Quote:

The Department of Justice (DOJ) does not plan to appeal a judge’s order blocking President Donald Trump from adding a proof of citizenship requirement on a federal registration form, according to a court filing made Monday by plaintiffs in the case.

Besides the fact that Trump wants it, what specifically do you take issue with here?

Once you're done figuring out that you just fucked yourself again because you are a very stupid person, maybe you can read that article from a obvious Lefty site and see what is actually going on here.

Nobody has lost anything, and it won't even start to be decided until late fall.

And if the judgement doesn't go the right way, we'll just appeal it outside of the jurisdiction of another of your Obama/Biden plants and win it on appeal just like every single other case you've ever presented in this thread so far.

We've got nothing but time. Mid-terms are still a very long way away.

And if you don't grow the fuck up quick and fix your party and stop cheerleading for anti-American shit like this, it's not going to matter anyhow.

This is what you call, settled law. Trump loses with a 9-0 supreme court ruling. Now, it turns out two thirds of the others sent have no criminal records. Let's see what the courts do with that.

Chief Judge LOSES PATIENCE with Trump at Court Hearing

Well first off, dummy, that earlier post you quoted is a dead link to a dead story that was meaningless when you first posted it, and I went through why that story didn't cover anything close to what the headline was claiming at the time you posted it.

Go ahead and click the link. I'll wait...

And then you follow that up with more bullshit MTN clickbait that won't matter 2 weeks from now.

I've told you all of this before.

Nothing you post in any of your meaningless tick tock to nothing threads ever amounts to anything.

And you reposting a dead link to a dead story is an excellent self-own that you weren't even aware of, and this is the perfect illustration of just how stupid you actually are.

Thanks for that.

'They're gonna confine him': Legal expert flags evidence Supreme Court will rein Trump in.

"The Supreme Court is clearly concerned also, if you look at the trajectory of their cases rejecting Donald Trump again and again on issues like immigration," Eisen said. "He said he would be a dictator on day one. The essence of dictatorship is this kind of defying the constitution and laws, so it's not only on the 14th amendment, but across the board."

Eisen went on to describe a recent court victory he had against Trump.

"We were in court with a big coalition on Friday. He's reorganizing the entire federal government unconstitutionally, and that federal court agreed. We won on Friday. We got a [Temporary Restraining Order]," he added. "Trump is running amok. The Supreme Court are not just robots calculating the meaning of the words in the constitution. They're human beings. They're political actors. They see this run amok administration, this unlawful administration."

Oh OK Gilligan, never mind.

Oh yeah, Ted?

Have you bothered to look into what other predictions your "expert" of the day Eisen here has made in the past and what their track record has been so far?

Maybe I should if you won't.

I don't know this asshole from a hole in the ground, and neither do you. He means nothing at all to me, nor should he you. The only reason you're hearing about him is because your anti-American global Media is writing a story telling you that you should care about him and what he thinks.

He still scratches his balls and goes home to fuck his old floppy wife like everyone else.

Fuck this Eisen person. And fuck you.

Well... let's do some research first here...

The above story that Ted neglected to link to was found at RawStory here...

https://www.rawstory.com/supreme-court-rein-trump-in/

So it's coming from a shitlib site most likely funded through what's left of their USAID money. We know that now.

The article starts with the following paragraph:

Quote:

The U.S. Supreme Court has in some instances failed to issue negative orders against Donald Trump, but that could happen very soon, a legal expert said on Sunday.

So... what we're dealing with here, Ted, is theoreticals about something that hasn't happened yet. Well, that and just little a sprinkle of misleading cope by telling you the news that Trump is winning all the cases on the back end the easiest way they could possibly string those words together so you don't get triggered. Good to know.

As an aside, with all the predictions the media has made in the last year that they've gotten wrong, now that we know this is another prediction being bullhorned out by your clickbait channels, you might want to dial back your expectations so your heart doesn't break for the 1,000th time in the last 10 years.

Now... onto the man himself...

Norm is Eisen's first name.

He is thoroughbred Democrat, born and raised in Los Angeles, California. (No bias there)

He played an outsized role in the first Trump impeachment. (No bias there)

He co-authored a book called Overcoming Trumpery: How to Restore Ethics. (No bias there)

He was friends with Barack Obama in law school and worked on Obama's Presidential campaign. (No bias there)

He regularly writes for The New York Times, Washington Post and Politico. (No bias there)

Some refer to him as a CNN Journalist. (No bias there)

He's a Senior Fellow at Brookings Institute and holds a taxpayer funded position that doesn't need to exist and likely won't exist in 4 years. (No bias there)

According to the Washington Post he was a "critical force for building the case for impeachment" against Trump. (No bias there)

He wrote yet another book titled "A Case for the American People: The United States vs. Donald Trump". (No bias there)

This thread has 590 posts, and almost 12 full pages. Has Thuggery ever made any actual point in any of his posts? Somewhere around half of the posts must be his.

I thought of going through the pages to look see if anything posted by Ted was ever solid, but the endless stream of nonsense posted here was daunting.

So, 6ix, is there any posts that he made which are valid? Obviously, some are still unresolved since they have not yet played out. But are there any which have run the course of the topic, and how many?

I've thought about going through it all and catching everyone else up on where those stories are today or where they landed in the dirt years ago.

But as you can see for yourself, that would be a full-time job for 10 people trying to sift through all the bullshit to catch up to 2025 at this point. And some of the claims I couldn't even look into because Ted writes like a 3rd grader and the links to the stories he posted are just completely gone now, so who would even know what he was posting about half the time?

You've probably read a few of the debunkings so far... Just the other night he reposted some dumb comment he had made along with the MSN article he posted with the comment and if you click on the link to the article it's a 404 error now.

All I can say is that I've never seen Ted post a story that made a prediction that ended up coming true, unless you're counting Joe Biden* winning* in 2020. And any time I've gone back to look at something old he posted, it either was a nothing burger or ended up going the way Ted wouldn't have liked in court.

The first federal court hearing on Trump’s tariffs did not go so well for Trump

A federal court held the very first hearing on President Donald Trump’s wide-ranging, so-called Liberation Day tariffs on Tuesday, offering the earliest window into whether those tariffs — and potentially all of the shifting tariffs Trump has imposed since he retook office — will be struck down. The case is V.O.S. Selections v. Trump.

It is unclear how the three-judge panel that heard the case will rule, but it appears somewhat more likely than not that they will rule that the tariffs are unlawful. All three of the judges, who sit on the US Court of International Trade, appeared troubled by the Trump administration’s claim that the judiciary may not review the legality of the tariffs at all. But Jeffrey Schwab, the lawyer representing several small businesses challenging the tariffs, also faced an array of skeptical questions.

https://www.msn.com/en-us/news/opinion/the-first-federal-court-hearing

I am following the courts decisions. There are allegations made, the courts hear the case and rule; I update. Then there are appeals and so on; I update.

I am following these rulings and appeals, to see where the courts are headed when it comes to Trump shiting on the rule of law. Guess what, he is getting destroyed. That may not be important to you two ignoramuses, but it matters for America. Besides, I like watching Trump being picked apart. I've posted an example for you here concerning his use of tariffs. Can you understand what is going on? Can you see he is about to lose again? I don't think so, but you two trolls don't really matter.

You don't update anything, Ted.

Name one court case that you've mentioned since the beginning of this thread that has gone your way and isn't in some process of appeal or another.

You can't even do that.

I can't get over how stupid you are. Really, I can't believe it. Anybody posting or visiting the site can see you have posted in old threads 50 times since the last person, other than you posted there. Even my, not to old threads have you posting again and again, always off topic.

And what do these posts of yours have in common? You post one sentence and a link to god knows what. Almost always, your post will consist of a sentence and a link, another sentence and another link. Maybe as many as 5 to 10 times in one post.

Here's a thought. Have an idea, start your own damn thread.

Incorrect usage of comma after "my". How many fucking times are you going to use the wrong version of to/too/two? IT'S TOO IN THIS CASE, RETARD.

Not that the sentence fragment is even real English to begin with.

You crack me up Gilligan. Trump is a convicted felon. He has been convicted of sexual assault. His NY company was convicted of fraud. He also was able to defer 4 other felony indictments worth about another 30 felonies, until the election, so they got tossed.

He is betraying our friends and praising our enemies. He is openly corrupt. The list of his injudicious acts is endless.

An example is women and children starving to death because of his cuts to a gov. department with an already small budget. Or all the people who are going to die because they are about to lose their health care. People who may be dealing with cancer or something else.

You side with him. Nothing about you Jack is respectable, or to be taken seriously.
