The Constitution’s Article I, Section 8 specifically lists as a power of Congress the power “to declare War,” which unquestionably gives the legislature the power to initiate hostilities. The extent to which this clause limits the President’s ability to use military force without Congress’s affirmative approval remains highly contested.

Most people agree, at minimum, that the Declare War Clause grants Congress an exclusive power. That is, Presidents cannot, on their own authority, declare war. Although it is somewhat more contested among scholars and commentators, most people also agree that Presidents cannot initiate wars on their own authority (a minority argues that Presidents may initiate uses of force without formally declaring war and that Congress’s exclusive power to “declare war” refers only to issuing a formal proclamation).

In the early post-ratification period, the clause’s limit on presidential warmaking was read broadly. Many key founders, including Alexander Hamilton, George Washington and James Madison, referred to the clause’s importance as a limit on presidential power. In the nation’s early conflicts, Congress’s approval was thought necessary – not only for the War of 1812, for which Congress issued a formal declaration, but also for lesser uses of force including the Quasi-War with France in 1798, conflicts with the Barbary States of Tripoli and Algiers, and conflicts with Native American tribes on the Western frontier (all of which were approved by Congress, albeit without formal declarations).

In modern times, however, Presidents have used military force without formal declarations or express consent from Congress on multiple occasions.

From what I hear, she's rather well thought of in her country.

But, yanno... who knows. I don't go out of my way to investigate the state of affairs in Mexico, and I didn't hear anything about her good or bad until after Trump was inaugurated. And we know how quickly they'll come to the aid of anybody who's on the opposite side of Trump in any given situation.

Next week should be interesting. Trump just imposed a 25% tariff on Canada and Mexico, as well as a 10% duty tax on China. I hear the only exception to any of this will be a flat 10% on Canada for anything pertaining to energy.

I think this all goes into effect on Tuesday.

If, or when, Trump decides to blow something up in Mexico, he will be presented with an already prepared menu of options, sources say, which would include possible targets like high-profile cartel hubs or leadership hideouts, or drug-making facilities, as identified by American intelligence gathering. Stefano Ritondale, a former Army intelligence officer who uses the handle All Source News on X, says if the Trump administration does act, the target will likely be big and symbolic.
“Why piss off the Mexican government for a chemist or arms dealer or money launderer?” says Ritondale, who also works as chief intelligence officer for Artorias, a private intelligence and data analysis company.
In such a scenario, the president, according to those who’ve spoken to him about this, would want a target deemed important enough to drug-lord operations that he could go on TV to make a national address and tout the historic nature of the military operation, as he did with the death of ISIS leader Abu Bakr al-Baghdadi.
If Ritondale was betting, his money is on Nemesio Oseguera, also known as El Mencho, the leader of CJNG. The U.S. government has offered a reward of $10 million for information leading to his arrest, one of the highest bounties ever offered.
“El Mencho is the only person worth doing it,” he says.
One of the six designated cartels, CJNG, is considered by the Mexican government to be the most powerful drug cartel in Mexico. With assets estimated at $20 billion, CJNG generates revenue from drugs like fentanyl and cocaine as well as extorting the tortilla, avocado, lime, and chicken industries. Fuel theft and counterfeit timeshare dealing also provide a revenue stream. On Wednesday, the U.S. Treasury’s Office of Foreign Assets Control sanctioned four individuals and 13 companies in Mexico for timeshare fraud orchestrated by the CJNG.
