José Padilla (born October 18, 1970), also known as Abdullah al-Muhajir or Muhajir Abdullah is a United States citizen convicted of aiding terrorists. Padilla (see Names below) was arrested in Chicago on May 8, 2002, and was detained as a material witness until June 9, 2002, when President Bush designated him an illegal enemy combatant and transferred him to a military prison, arguing that he was thereby not entitled to trial in civilian courts. However, on January 3, 2006, he was transferred to a Miami, Florida jail to face criminal conspiracy charges. José Padilla was found guilty of all charges against him on August 16, 2007 by a federal jury, which found that he conspired to kill people in an overseas jihad and to fund and support overseas terrorism. He is scheduled to be sentenced on December 5, 2007.

Actually, the best I can tell, the guilty pleas he put out were basically nullified by the Administration's change in tactics. The convictions they obtained were from the empaneled jury, and they were all on 'conspiracy' charges.

I have to admit to mixed feelings on this one; my gut tells me he belongs in prison; but my brain tells me they clearly trampled his rights and set some horrible precedents in the process. It really bugs the crud out of me they pulled Padilla out of federal holding before the Supreme Court assessed if they would review the case (this is regarding this part: "On April 3, 2006, the U.S. Supreme Court declined ... to hear Padilla's appeal from the 4th Circuit Court's decision ")

I think he's under the impression that everyone deserves due process to prevent another round of McCarthyism. Opening up due process to everyone isn't about protecting the guilty (as you seem to wish to portray it), it's about protecting the innocent.

As for the rest, it's a deeply philosphical question, raised in the Phillip K Dick story 'Minority Report' and the film of the same name. Is someone a murderer if they're arrested prior to committing a murder?

Innocent till proven guilty.

One of the concepts, the rights - we're supposed to be "protecting" with this counterproductive idiocy.

If we become what we're supposedly fighting against in the doing of it, then we have lost just as surely as if we'd been conquered.

Our own means and methods are a greater threat to us than any of these pathetic and incompetent 'enemies' they keep holding up to us, one of which has likely been dead since december 2001.

It's really time to quit pretending this insanity has anything to do with protecting our rights and freedoms, both sides would like to take them from us, and one of em is not only capable, but actively doing so.

That being said, which one am I gonna consider the greater threat ?
