But Secretary of State Jennifer Brunner said generating such a list would create numerous problems too close to the election and possibly disenfranchise hundreds of thousands of voters.

The Supreme Court last week ruled against the GOP on appeal of a lower court order directing Brunner to prepare the list.

In Florida, election officials found that 75 percent of about 20,000 voter registration applications from a three-week period in September were mismatched due to typographical and administrative errors. Florida's Republican secretary of state ordered the computer match system implemented in early September.

In Wisconsin, Republican Attorney General J.B. Van Hollen sued the state's election board after it voted against a proposal to implement a "no-match" policy. The board conducted an audit of its voter rolls and found a 22 percent match failure rate -- including for four of the six members of the board.

The Brennan Center has also documented cases across the country of possible illegal purging, impediments to college student voting and difficulties accessing voter registration.

A lawsuit has been filed over Georgia's mismatch system, and the state is also under fire for requesting Social Security records for verification checks on about 2 million voters -- more requests than any other state.

One of the lawyers involved in the lawsuit says Georgia is violating a federal law that prohibits widespread voter purges within 90 days of the election, arguing that the letters were sent out too close to the election date.

"They are systematically using these lists and matching them and using those matches to send these letters out to voters," said McDonald, director of the ACLU Voting Rights Project in Georgia.

"It's not, you know, an individualized notion of people maybe not being citizens or not being residents. They're using a systematic purging procedure that's expressly prohibited by federal laws."

Asked if he believed that eligible voters were purged in Georgia, McDonald said, "If people who are properly eligible, are getting improperly challenged and purged, the answer would be 'Yes,' " he said.

Elise Shore, regional counsel for the Mexican American Legal Defense and Educational Fund, said letters like those sent to Berry appear to violate two federal laws against voter purging within 90 days of the election.

"People are being targeted, and people are being told they are non-citizens, including both naturalized citizens and U.S.-born citizens," said Shore, another plaintiff in the Georgia lawsuit. "They're being told they're not eligible to vote, based on information in a database that hasn't been checked and approved by the Department of Justice, and that we know has flaws in it."

Georgia's Secretary of State Karen Handel, a Republican who began working on purging voter rolls since she was elected in 2006, said that won't happen. If there are errors, she said, there is still plenty of time to resolve the problems.

Report: Voter purges in 6 states may violate law

NEW YORK - Tens of thousands of eligible voters have been removed from rolls or blocked from registering in at least six swing states, and the voters' exclusion appears to violate federal law, according to a published report.

The New York Times based its findings on reviews of state records and Social Security data.

The Times said voters appear to have been purged by mistake and not because of any intentional violations by election officials or coordinated efforts by any party.

States have been trying to follow the Help America Vote Act of 2002 by removing the names of voters who should no longer be listed. But for every voter added to the rolls in the past two months in some states, election officials have removed two, a review of the records shows.

The newspaper said it identified apparent problems in Colorado, Indiana, Ohio, Michigan, Nevada and North Carolina. It says some states are improperly using Social Security data to verify new voters' registration applications, and others may have broken rules that govern removing voters from the rolls within 90 days of a federal election.

Democrats have been more aggressive at registering new voters this year, according to state election officials, so any closer screening of new applications may affect their party's supporters disproportionately, the Times said.

The result is that on Election Day, voters who have been removed from the rolls could show up and be challenged by political party officials or election workers.

The six states seem to have violated federal law in two ways. Some are removing voters from the rolls within 90 days of a federal election, which is not allowed except when voters die, notify the authorities that they have moved out of state, or have been declared unfit to vote.

And some of the states are improperly using Social Security data to verify registration applications for new voters, the newspaper reported.


"Just as voting machines were the major issue that came out of the 2000 presidential election and provisional ballots were the big issue from 2004, voter registration and these statewide lists will be the top concern this year," said Daniel P. Tokaji, a law professor at Ohio State University.

As I discussed in an article Thursday, the African-American vote could prove crucial in down-ballot elections this year, especially in the South. Democrats have a chance to pick up quite a few seats in both the House and the Senate that could hinge on the black vote.

One of the Republicans who's most vulnerable to a surge in African-American turnout is Georgia Sen. Saxby Chambliss. The incumbent's lead in recent polls is only in the low single digits, generally within the margin of error. And early voting numbers from the state have contained some really bad news for Chambliss. As of this post, the number of people who've voted early there is equal to a stunning 47.4 percent of the total number of people who voted in 2004. Of those who've voted so far, 35.1 percent are African-American; in 2004, 25 percent of the overall electorate was African-American. Since this is the Democratic Party's most loyal demographic group, well, you can imagine the potential consequences for Chambliss.

As Politico's David Rogers reports (h/t Balloon Juice), Chambliss seems to be well aware of what's happening. Rogers writes: "The Republican is outwardly confident, but there’s urgency in his voice as he tours North Georgia, trying to boost turnout in his predominately white base: 'The other folks are voting,' he bluntly tells supporters."

Mikey, the funny thing is that there actually are LBH's in use for various stuff, not all of which is dastardly.

They're a variation off OH-6 Cayuse/MD500 design, and usually used in urban areas for training and compliance with regs concerning the amount of noise allowable over populated areas.

While of course, retaining their usefulness for other dirty sneaky rotten business, of course.

A lot of this crap going around, we got a letter saying ours was changed, which is almost without a doubt phony - but in OUR puny ass town, it's not worth the effort cause you can SPIT across it, much less see across it, and there's no way to actually hide them setting it up.

Funny about that, too - it's mostly an optical scan machine that's nattered over and nitpicked by a pair of old ladies, one from each party, who are pretty fanatical about maintaining it's accuracy and performance.

But we have ONE diebold electronic machine, which resides in a lonely corner that everyone avoids as if it were contagious (in fact, no one has EVER, even once, voted on it) and crashes about every 12-15 minutes requiring a reboot anyways.

We regard the thing as a general nuisance, a stern reminder that new is not necessarily better, while we all give the thing a distant hairy-eye, as if it would leap forth and contaminate us by it's mere presence.

It's actually funny to watch people go OUT OF THEIR WAY to avoid even coming near the thing, like it's toxic or something.
