When I get a psycho cop threaten to arrest me for videotaping a crash on a public highway, I stand my ground and advise him "that's an illegal order". And I refuse to obey an illegal order to erase my video.

That stops cops and soldiers dead in their tracks, because they're trained that following illegal orders will send THEM to jail. Plus that verbage elevates me to "their level of rank", above "mere civilians". But it's hard to stay cool when cops threaten to steal your videocam and demand to erase all video. You must stand your ground and not grovel, nor ask legal questions, since that shows fear to a predator who is not licensed to practice law.

The "army guys" were just a couple national guardsmen returning from a training exercise who decided to lend a hand on their own, which is kinda cool of em - especially since most state governors have, since Katrina, made some disaster-relief training part of the curriculum.*

Now, admittedly that does on the face of it look damn suspicious, a couple army guys running around a wrecked tractor trailer with a cop getting kinda rabid about a film crew being on the scene.

My first thought was that this was a DoE SST involved accident, but upon further review that turns out not to have been the case.

But really, despite what it looked like, this was just a matter of a cop being an asshole, which, while unfortunate, is all too damn common.

*PS- You might find it noteable, PN, that some state Governors have also clearly instructed their guard units to uphold the rights of the people of their state even against regular army personnel, and be prepared to engage should that become necessary to do so.

NG are closer in form and function to militia than reg-army or reserve, and being residents of the state they're assigned to are less likely to commit abuses, which is why using one states "militia" against another has ALWAYS been illegal and unconstitutional.

As someone who has worked on Interstate shoulders I can speak to one fact. Often vehicles hanging out on median shoulders cause traffic to become more interested in what is occuring. We call this effect the "gaper delay". Often gapers will do idiotic stuff in their morbid fixation on a wreck and can cause secondary events. There is merit in the vein of promoting public safety to direct the news crew to vacate even though they were on the other side of the road. There are also laws for "No stopping standing or parking" which a trooper can enforce in any of the 50 states.

HOWEVER

There are ways to do this correctly. This trooper was WAAYYY out of line. Just listen to him as he climbs over the wall. His manner is much like a schoolgrounds bully. On top of it, there was no cause to detain the press reporter. At first the reporter was derisive, owning to the fact he knows he's not done anything wrong. You hear him say about the cameraman "He can shoot if he wants to" as they both move to their vehicle. But even so, the reporter was in the process of leaving (obeying the order from the trooper). The trooper, provoked by the reporter's desire to exercise free speech, STOPS THE MAN FROM LEAVING and asks "Do you want me to arrest you?" The reporter says no. The trooper orders him to leave again but look closely as he is PHYSICALLY HOLDING THE REPORTER BY THE BACK OF HIS PANTS. As in: he will not allow the reporter to physically leave. The reporter, now obviously rattled, says "OK, I'll go". And it is at that point the freaking cop decides to detain the reporter. The pants grab was a power play I think. Had the reporter obeyed the order and attempted to move to the driver door, the cop would be able to say the reporter was "physically resisting". If the reporter stands still he is "disobeying an order".

After that things get even more bizarre as the cop makes irrational statements like "get your hands off the truck" (huh?) and starts physically yanking the reporter around all the while as the reporter looks to the cameraman saying "Look at this: I'm not doing anything. I'm just trying to leave."

When the trooper moves to detain the cameraman and the camera falls to the pavement while still recording I was reminded of the end of The Blair Witch Project. What a wierd and irrational detainment.

This looks like a racial hate-crime by the cop. "Get Whitey!"

Yeah, when soldiers are violating Posse Commitatus Act during traffic stops, its the soldiers who illegally order the news media to turn off their cameras.

Cop: "Do you want me to arrest you?!"

Correct Reply: "Do you want me to sue you and file criminal charges?"

The challenge is the same as when dealing with any crazy person behaving irrationally. The most deadly job for cops is writing traffic tickets and working crashes, due to getting hit by passing cars or mass pile ups, hence the PTSD.

Seems a bit gay for a cop to stick his hand down a guy's pants. The videotape is worth a small fortune.

Note that at the moment of the illegal arrests for disobeying an illegal order, those reporters had the legal right to resist that illegal kidnapping by use of deadly force and justifiable homicide of that govt employee, via escalation of violence doctrine. Just like shooting a mad dog with rabies. Google Battle of Athens. Obviously, that would require a high skill level and logistics, as proven in Athens TN, which is why US Dept of Homeland Security is now targeting all military vets as domestic terrorists.

Many LEO depts issue "police" badges or "police" ID cards to news reporters, exactly to prevent this situation.
