I think you're right that this legislation will die for now, but if the Dems build on their majority in the midterms you can bet we'll see it again.

As far as violence occurring, I doubt it will be perpetrated by gun owners, more likely by overzealous Federal agents wanting to advance in the Obama bureaucracy.

H.R. 1022 is even worse, it would let the AG declare anyone he suspects of being a terrorist prohibited from owning guns. And considering our past AG's have been critters like ashcroft, reno, etc. , thats a scary proposition.

Anyone following the latest law out of Montana? It's aimed directly at testing the feds' limits of power as regards firearms.

Apparently, if you manufacture firearms in Montana, and are selling them to Montanans who live in the state and are legally allowed to own a firearm, you can make and sell suppressors (silencers), automatic weapons, etc. - and no waiting period, no automatic background checks, no licensing or registration, no Class III paperwork or tax stamps...

It all hinges on the transactions being part of INTRASTATE commerce, not INTERSTATE commerce, so the Montana legislature said the feds have to business sticking their noses in it in the first place. Montana's governor has apparently signed it into law, and from what I gather it goes into effect October 1, 2009.

At least, that's what I've heard about it.

Now it seems that two more states are looking into doing the same thing - Tennessee and Texas. We'll see.

If Texas does this, I'll absolutely buy a silencer and an automatic. I have need of neither, but would buy them simply because I could, and because I doubt I'd be able to legally buy such things for very long, and then they'd skyrocket in value after being grandfathered in... Personally, I view full-auto weapons as a waste of ammo, but as an investment, I'm okay with 'em. I certainly wouldn't be able to feed one of the beasts very often at today's ammo prices!

Interesting times. We may see more states'-rights cases like this come about, and it will be interesting to see what happens with them.

No need to ask- for a little while there, I thought I was LIVING the Norinco nightmare! I bought a Norinco MAK-90 last summer at a pawn shop because the price was too low and the rifle was too good to pass up, and I *knew* the prices were about to go through the roof. I knew enough about the MAK's reputation as being among the better of the AK clones (it uses thicker steel in the receiver stampings, 1.5mm instead of 1mm thick, so it's a little heavier, but way more rugged), but what I DIDN'T know was that Norinco had shipped over at least one batch, and probably several, of barely-demilitarized AK-47s to CJ Arms in Michigan (which, it turns out, was an armory that was wholly owned by the Chinese government).

Seems that some of the guns that went through CJA weren't even demilitarized - they were just your garden-variety fully-automatic AK-47, sold as a "sporter" model with a cheesy wood stock thrown on 'em. And lots more were full-auto models that had had some of the parts removed, but were still, according to the BATFE, considered a "machinegun" because they had the ABILITY to be made into such with the addition of a few parts. Those were the infamous "third hole" models, so named because there was a rivet run through where the select-fire sear had been.

Upon learning of this - and too late for me! - I was almost in a panic trying to figure out what the heck they were talking about. Finally, I found pictures of one of the third-hole models, and compared very closely to mine, and found that I WASN'T going to be invited to spend 10 years at Club Fed for possessing an illegal machinegun.


Like I said before, it's going to be interesting to watch as these laws make their way through the various states, and the aftermath if the Fed tries to argue the point. The way the states see it, this is wholly a state issue, and if you break the law in the state, that's their business to deal with, not the Feds'. And if you're not trafficking across state lines with these weapons, that's also none of the Feds' business.

Maybe so, but the MI Constitution is pretty specific on the matter, you see.

ARTICLE I Section Six:
"Every person has a right to keep and bear arms for the defense of himself and the state."

EXACTLY that, and no more.
See anything about restrictions or what type of arms in there ?

It's actually a pretty tight, sparse, and clearly worded document which does not in any way ever surrender one *ounce* of State rights to the FedGov, outside of a voluntary, temporary partnership for specific purpose.

You'd actually have a better chance of legalising drugs here than in Kalifornia for that very reason.

As for the MI Militia - while overall, decent enough folk, I got serious issues with the weapon handling and general safety compliance of the bunch, and the northern collective has it's handful of mighty-whitey-righty types waitin for the day of the rope when they can get back at all those damn immigrants and N*****s, you know, which is damn ironic cause the southern collective is made up of a VERY high percentage of those folk (whom I've found safer in practice AND better behaved) and thus in a TEOTWAWKI situation, those two factions will be too busy killing each other to be of any use anyhow.

Despite those differences however, they're pretty solid for neighborhood watch, missing person and fugitive searches, and anything that needs a bunch of bodies with a minimum of training and discipline - they CAN put those hatreds aside for the common good, and generally do, it's just a sore point with me that some of the northerners aren't shy about expressing opinions and beliefs that *I* would eject them for as a danger to the very principles they claim to defend.

At least they're better than them morons from Ohio, one of their leaders had a tendancy to wave around that ratty old M1911 of his without concern for where the muzzle was pointing and made the unforgiveably stupid mistake of having an accidental discharge when I approached him to tear him a new one over it, and the worse luck to give me a powder burn in the doing - whooeee I was PISSED.
(I dunno if you know much about em, but a powder burn friggin HURTS REAL DAMN BAD, mano.)

Yeah, he got a bit.. ok, more than a bit, roughed up over that - no matter in the end cause the damn fool got stung trying to buy class-III without a permit (although THEY approached him, which constitutes entrapment) and happens to be in slam - but there's some folk who's behavior clearly indicates they should NOT be carrying a firearm cause they present a danger to folks around them.

Proper training as a requirement eliminates about 90% of that, which is why I don't have an issue with making it a condition of sale, I just don't want the Gov involved cause of their history of abuse of the process.

Yer always gonna have them folk, and career criminals, and as such there's really no way to prevent the bad elements from being armed - and to respond to that by trying to disarm everyone results in the kind of dynamic we're witnessing as regards Somalian Pirates - easy prey for the bottom feeders.

I'd imagine the practice would fall off fairly quick if one or more of them "defenseless" cargo vessels ripped their little boats to shreds with some .50cals and went on their merry way.

I also find it ironic that the same folk who argue in favor of herd immunity fail to see how in that aspect, CCW absolutely fits the profile by raising the possibility that a target is not defenseless, thus discouraging many opportunity crimes.

Anyhows, far as Michigan goes, we never really did give a shit what the FedGov thinks, still don't, as a general rule.
