The whale responsible for the attack is a bull, or male, named Tilikum. He has lived at the park since 1992, and is one of eight killer whales there.

"Currently deputies with the full cooperation of SeaWorld have secured the scene and Homicide Detectives have been requested to respond and conduct a death investigation follow-up, along with our Forensics Unit," said Capt. Angelo Nieves of the Orange County Sheriff's Office in a statement.

One witness, park visitor Victoria Biniak, told WFTV that the trainer was just introduced the whale during a live public show at the stadium.

Soon after, Biniak said, the whale came up from the water and grabbed the woman.

"He was thrashing her around pretty good. It was violent,'" Biniak said.

The whale "took off really fast in the tank, and then he came back, shot up in the air, grabbed the trainer by the waist and started thrashing around, and one of her shoes flew off," she said.

Visitors were evacuated and the park closed following the attack.

I'm hearing conflicting stories, one of which is that, unlike above, the show hadn't STARTED yet, but was just about to. One of the reports says "Park guest Victoria Biniak told WKMG-TV that the trainer had just finished explaining to the audience the show they were about to see", which sounds more like it. Also:

At the Orlando SeaWorld, the body of a naked man was found scratched, bruised and draped over a 5-ton orca named Tilikum in July 1999. Daniel Dukes, 27, reportedly made his way past security at SeaWorld, remaining in the park after it had closed. Wearing only his underwear, Dukes either jumped, fell or was pulled into the frigid water of Tilikum's huge tank.

An autopsy ruled that he died of hypothermia in the 50-degree water. But they also said it appeared Tilikum bit the man and tore off his swimming trunks, likely believing he was a toy to play with.

Personally, I don't think killer whales belong in captivity or shows. They're whales, so smart and trainable, and unquestionably impressive. But they are predators by nature; they prey on sea lions and have mistaken humans swimming with flippers before. What effect putting them in parks and training them has upon them, we can't know. I know at Marineworld when I was tere, we were allowed to be around the dolphins and seals/sea lions, but NEVER allowed near the killer whales. For good reason.

They're called that because they are predators, asshole, the only whale species that preys on warm-blooded animals...like, you kow, lions, snakes, alligators and tigers. Duh!

Supposedly this whale had never worked with humans, so I'm not sure how she grabbed the trainer, unless the trainer was standing near a holding tank or something. I'll be interested to hear more, what we're getting now is kinda scrambled. BUT the whale has two deaths on her, one in Canada and one where some idiot snuk in after hours. I should think that would have been enough to retire the animal or something; if she had access in any way to grabbing humans, that's just irresponsible.

This particular Orca was not a performing animal. It was kept only for breeding. It was unusual for the trainer to be in the holding area according to some "experts" on TV. I do understand that these Orca shows generate millions of dollars for marine research, yet the ends are not justified by the means in my opinion. These mammals have instincts, instincts than man cannot override fully. They travel the oceans for thousands of miles, and they are the fiercest predators in the sea. To keep them in arena-sized tanks just seems horribly cruel and wrong. They are also very social animals, and they have instinctal needs to be with other whales in the wild.

We live a couple miles from what is described as a "Top Zoo," and while I used to love going there as a kid, I have little interest in it now. My wife flat refuses even when relatives visit. Just seems wrong to her. Last time I went I was 14? and I couldn't wait to see the grizzly bear. When I got to his cage it was so small and dark. He was old looking and dirty and all he did was pace back and forth, back and forth, back and forth... he looked absolutely m-f*cking crazed.
The whole concept seems so old to me, like a 50's fad, like something we'll eventually outgrow.

I was going to post this in the thread about dolphin intelligence (though technically, I don't think dolphins and orcas are in the same family). I'm trying to determine whether my belief in most animals qualifying as non-human persons means I think the Orca should be charged with a crime and sentenced. It's lunatic, yet no other conclusion is logically internally consistent.

But yes, I agree that this could be considered cruel, and that a person climbing into a pool with an unpredictable predator is kind of asking for it.

Pizmo: Some zoos do this a lot better now. There's been a real push for natural habitats, so that the animal is more entertained and comfortable.

But the very best kind of zoo in that sense is still probably a safari or a national park, where it's the people who are enclosed instead of the animals.

JS, well spoken, every word. That's how I feel,too, and my husband so much so that he didn't approve of my working at Marineworld. My feelings have changed since then and I agree with them. Despite the fact that all the whales used there are captive bred, and despite the fact that the argument is made that it allows humans to get close to them and understand them, it's wrong.

Yes, she didn't deal with humans and wasn't in the shows. I haven't heard further news this morning, so I'll be interested to hear what more they've found out about it..

Pizmo, yes, our SF Zoo used to be in abominable shape as well, I wouldn't go. They've been making improvements steadily and it's much better. What Byte wrote is accurate. There are efforts all over the world to improve zoos and make the habitats much more appropriate; I hope it continues unabated because I think it IS important for people to get close to these animals and see them as creatures with the right to decent lives, so I don't feel about GOOD zoos the way I feel about animal parks anymore.

There are good animal parks too, where the animals roam freely and the humans either travel through on buses or are themselves enclosed, but we can't do that for marine mammals, and tho' I agree with keeping sea otters (because those who can be are returned to the wild and the sea otter population is delicate, so those in captivity provide the only safety net), the rest of the marine mammals do not belong in confined spaces, in my opinion.

Lacinak said he'd been told how the attack happened by other trainers who were at the scene Wednesday, when Tilikum dragged Brancheau into the water as she gave him pats and other rewards after a midday show. Based on their description, he said the rules for handling the giant orca that were in place during his tenure had either been broken or changed.

There were special protocols for handling Tilikum because of the animal's size and involvement in two earlier deaths. Tilikum was one of three orcas blamed for killing a trainer in 1991 at a theme park near Victoria, British Columbia. In 1999, the body of a naked man was found draped over Tilikum at SeaWorld. Officials said the man had stayed in the park after closing, apparently fell into the whale tank and died of hypothermia, but was also bitten by Tilikum.

It was playful curiosity, Lacinak said, and not a bloodthirsty attack. Brancheau's ponytail was merely a "novelty item" to the whale, who was not trained to be in the water with people.

The park says Tilikum will not be destroyed, transferred or released and that he is an important member of the eight-whale pod.

All court jurisdictions will charge any animal with murder of a human, or damage to property owned by a human. Ultimate sentence is death. 100-million pets are sentenced to death every year for vagrancy.

Not that that's a good thing, or a lawful sentence. Slavery for humans used to be legal too. 55-million US citizens have been genocided since 1973, when US Supreme Court legalized genocide in Roe v Wade.

This killer whale, however, is a huge moneymaker for the shareholders of Sea World, thanks to millions of paying customers. Therefor this killer whale is allowed to kill as many trainers as he wants.

Killer whales don't eat humans in the wild, so this one actually makes the species appear to live up to its name. Excellent free advertising!

Actually, that's not even close to true. Not one single aborted fetus was a U.S. citizen at the time it was aborted. Gotta be BORN here, or BORN to citizens on foreign soil, to be a U.S. citizen. "BORN" being the operative word. Hence, no fetus is deserving of the rights of a citizen, since they are constitutionally NOT citizens.
