Well, there you go. "We can't fulfill our contract to our workers", but by gawd, "We can pay huge bonuses to upper management". Yeah, it's all the unions' fault:
Quote:

Hostess Brands Inc., the defunct maker of Twinkies and Wonder Bread, told a bankruptcy court that it must cut $1.1 million a month in retiree benefits as part of its liquidation plan.

U.S. Bankruptcy Judge Robert Drain in White Plains, New York, today approved formation of a committee of retired employees to defend their rights in connection with the intended cuts. Drain is also being asked to consider Hostess’s request to close and its bid to pay as much as $1.75 million in incentive bonuses to 19 senior managers during the company’s wind-down.More at http://www.bloomberg.com/news/2012-11-29/hostess-says-it-must-cut-reti

Jezus, just how blatant can you GET!?

Hello,

The Execs should get full bonuses and incentives if they can prove that they managed the company's finances sufficiently well to make good on their obligations to their employees.

AT THE COST of those obligations? Why should they get bonuses while the company seeks to get out of their CONTRACTUAL OBLIGATIONS when it comes to retirement benefits?

There is tons of evidence that those handling the company screwed the employees, sold off parts of the company, and mishandled it in numerous ways. Why they should get bonuses for driving the company into the ground is beyond me--especially when they want to do so at the same time as wanting to wiggle out of their obligations to the employees, who did nothing but do their jobs right.

Tit for tat got us where we are today. If we want to be grownups, we need to resist the ugliness. If we each did, this would be a better reflection on Firefly and a more welcome place. I will try.

Regarding that: In 2005, the Union negotiated a deal that would save the company $150 million a year in labor.

In July of 2011, the employees got a letter informing them that the $3+ per hour that the employees contributed to their pension was going to be ‘borrowed’ by the company until they could be profitable again. Then they would pay it all back. The company filed for bankruptcy and the judge ruled that the $3+ per hour was a debt the company couldn’t repay.

Then got a new contract approved by the judge before ever showing to the Union. That contract consisted of:

1) 8% hourly pay cut in year 1 with additional cuts totaling 27% over 5 years.

2) They get to keep the $3+ an hour forever.

3) Doubling of weekly insurance premium.

4) Lowering of overall quality of insurance plan.

5) TOTAL withdrawal from ALL pensions.

The $3+ per hour they stole totaled $50 million last year. Meanwhile, They sold $2.5 BILLION in product last year.

The result would have been that an employee who was making $48,000 in 2005 went down to $34,000 in 2011, and would have been $25,000 five years from now, which doesn't take into account no pension contributions and doubling of weekly insurance premiums. ( http://susiemadrak.com/2012/11/19/how-hostess-screwed-the-workers/)

So the employees have kept on working, doing their jobs, while management ran the company into the ground; management should get BONUSES for this? How do you figure that?

Tit for tat got us where we are today. If we want to be grownups, we need to resist the ugliness. If we each did, this would be a better reflection on Firefly and a more welcome place. I will try.

Hello,

How about let's look into what management was doing with the company over this time:
Quote:

Take the notion that Hostess was out of step with America's healthful-food craze. You'd almost think that Hostess failed because it didn't convert its product line into one based on green vegetables. Yet you only have to amble down the cookie aisle at your supermarket or stroll past the Cinnabon kiosk at the airport to know that there are still handsome profits to be made from the sale of highly refined sugary garbage.

It's true that the company had done almost nothing in the last 10 years to modernize or expand its offerings. But as any of the millions of Americans who have succumbed to Twinkie cravings can attest, there has always been something about their greasy denseness and peculiar aftertaste that place them high among the ranks of foodstuffs that can be perfectly satisfying without actually being any good.

Just before declaring bankruptcy for the second time in eight years Jan. 11, Hostess trebled the compensation of then-Chief Executive Brian Driscoll and raised other executives' pay up to twofold. At the same time, the company was demanding lower wages from workers and stiffing employee pension funds of $8 million a month in payment obligations.

Hostess management hasn't been able entirely to erase the paper trail pointing to its own derelictions. Consider a 163-page affidavit filed as part of the second bankruptcy petition.

There Driscoll outlined a "Turnaround Plan" to get the firm back on its feet. The steps included closing outmoded plants and improving the efficiency of those that remain; upgrading the company's "aging vehicle fleet" and merging its distribution warehouses for efficiency; installing software at the warehouses to allow it to track inventory; and closing unprofitable retail stores. It also proposed to restore its advertising budget and establish an R&D program to develop new products to "maintain existing customers and attract new ones." As of January 2012, Hostess still hadn't gotten around to any of this.

The company had known for a decade or more that its market was changing, but had done nothing to modernize its product line or distribution system. Its trucks were breaking down. It was keeping unprofitable stores open and having trouble figuring out how to move inventory to customers and when. It had cut back advertising and marketing to the point where it was barely communicating with customers. It had gotten hundreds of millions of dollars in concessions from its unions, and spent none of it on these essential improvements.

The company has had six CEOs in the last 10 years, which is not exactly a precondition for consistent and effective corporate strategizing.

The most recent and presumably final incumbent, Gregory Rayburn, had been with the company all of nine days before taking over in March when Driscoll, who earlier had been described in court papers as "key to … the future well-being" of the company, departed suddenly and without explanation.

Hostess first entered bankruptcy in 2004, when it was known as Interstate Bakeries. During its five years in Chapter 11, the firm obtained concessions from its unions worth $110 million a year. The unions accepted layoffs that brought the workforce down to about 19,000 from more than 30,000. There were cuts in wages, pension and health benefits. The Teamsters committed to negotiations over changes in antiquated work rules. The givebacks helped reduce Hostess' labor costs to the point where they were roughly equal to or even lower than some of its major competitors'.

But the firm emerged from bankruptcy with more debt than when it went in — in with $575 million, out with $774 million, all secured by company assets. That's pretty much the opposite of what's supposed to happen in bankruptcy. By the end, there was barely a spare distributor cap in the motor pool that wasn't mortgaged to the private equity firms and hedge funds holding the notes (and also appointing management). http://articles.latimes.com/2012/nov/25/business/la-fi-hiltzik-2012112

For this, management should walk away with $1.75 million in bonuses, while the employees--you know, the ones who went on doing their job all this time and taking cuts in pay--get screwed out of $1.1 million in what remains of retiree benefits? Sure.

Tit for tat got us where we are today. If we want to be grownups, we need to resist the ugliness. If we each did, this would be a better reflection on Firefly and a more welcome place. I will try.

Sorry, I misread...I agree fully with your comments. Given that, they sure as hell SHOULDN'T get bonuses for MIS-MANAGING the compaqny.

Hello,

Absolutely. The only way they can prove they deserve the bonuses is to pay out on their obligations. If they can't pay out on their obligations, how can they claim to deserve incentive pay?

If I ran the company and I found out it had been so severely mismanaged that benefits owed could not be paid, I'd fire everyone responsible. No bonuses, naturally.

Big bonuses for execs at a bankrupt company? .... sure, that seems right!

To be far that works out to about 90K per manager in bonuses. Now if these are just something new it is a problem. If these were promised before hand I see little problem with this. The $1.75 million one time amount is still smaller than $1.1 million per month they are looking to cut. If that is just a cut imagine what the total cost of the pentions are for a year.

Hello,

I see no reason why previously arranged obligations to executives should be honored if previously arranged obligations to the general employees are not being honored.

I concur.

Fuck "size", there's no excuse - you don't do the job, you don't get PAID.

This is why I operate purely by Contract these days, with brutal penalties for violation thereof, cause the employer-employee "relationship" in this day and age bears a strong resemblence in my eyes to a collar and a whip.

As noted before, that's not quite accurate.

Quote:

The new contract cuts salaries across the company by 8% in the first year of the five-year agreement. Salaries then bump up 3% in the next three years and 1% in the final year.

I've also noted comments about things in the previous contracts that probably didn't help the company stay solvent. For example, the Teamsters contract required that bread and pastries going to the same store must go in different trucks.
