The Senate on Thursday passed the most sweeping regulatory overhaul of the financial system since the New Deal.

The bill, which passed 59-39, imposes more oversight and stronger capital cushions for the largest banks and Wall Street firms, while aiming to stop bailouts, shine a light on complex financial products and strengthen consumer protection.

The legislation would establish a consumer financial protection regulatory agency that could write new rules to protect consumers from unfair or abusive mortgages and credit cards.

It would create a council of regulators that would sound an alarm before companies are in position to trigger a financial crisis. The bill would also establish new procedures for shutting down giant financial firms that are collapsing.

The bill aims to shine a brighter light on some of the different kinds of complex financial products, called derivatives, that are blamed for bringing down financial companies such as American International Group (AIG, Fortune 500) and Lehman Brothers. It would force most derivatives on to clearinghouses and exchanges, to help pinpoint the value of the trades.

Republicans objected to some of the bill's major provisions, particularly parts that establish the consumer agency and create new rules for the derivatives. While they generally favored more consumer protection and more regulation of derivatives, they argued that the legislation is too heavy-handed in these areas.

So now it goes to the House, hopefully not to be watered down further, since it doesn't go far enough, especially on derivatives (which amendment never made it), in my opinion.

Hello,

I would rather firm steps be taken in the bill itself, rather than see an agency created that will have the authority to engage rules at their discretion.

It sounds like someone just voted for an agency that will have the power to do what it feels like in regards to financial institutions.

Specific regulatory actions are fine. Ambiguous 'do whatever' agencies rub me the wrong way.

Ditto. I'm not happy with it, but it's better than nothing...just like voting for the "lesser of two evils", that seems to be what we've come to have to live with.

Hello,

Something is not always better than nothing.

(See Arizona's solution to the immigration problem.)

I hope it will all work out, or at least not be worse than what we have now.

I can't see it being worse, hard to imagine anything worse than the "gambling" mentality we have now! Yes, the AZ law is a bad one, and yes, the health reform isn't good, but the idea of passing a bill then amending it is one that has long been used and seems to be the only way anything gets done anymore. You haggle and compromise, get SOMETHING through, then work on improving it. Not very efficient, but it's what we've got...

Hello,

Well, I guess that has been true for a while. I think the Constitution was passed without the Bill of Rights, and then they were included by amendment.

I'll wait and see. I'm not going to jump up and down and cry foul until I see what happens next.
