The offending trees, three redwoods and an 80-year-old acacia, are growing in the $6.9-million backyard of Bernard and Jane Von Bothmer who moved into a manse downhill from Ellison’s residence in 2004.

The “tree problem” started not long after the Von Bothmers moved into their home and decided to let the trees grow naturally without regular trimming as they enjoyed the privacy that the towering green canopy behind their home provided. Upslope in his 10,742-square-foot home used primarily for “entertaining,” Ellison was not too pleased. After several years of back and forth bickering and allegations of "tree-passing," Ellison and the Von Bothmers were to go before state Superior Court in San Francisco on June 6. Representing Ellison: Barri Bonapart, an arbor-oriented attorney who specializes in “tree and neighbor law.” According to Bonapart's website, Treelaw.com, her firm offers "practical solutions for an impractical world."

But as new details emerge, it looks like Ellison and the Von Bothmers won't be heading to court after all: over the holiday weekend, the lawsuit was settled out of court and the Von Bothmers have agreed to cut the three redwoods and landmark-worthy acacia that have been causing Ellison so much grief. Paging Julia Butterfly Hill ...

In my humble opinion, Ellison sounds like nothing more than a schoolyard bully — an extremely powerful, multi-billionaire schoolyard bully who is used to getting what he wants ... including unobstructed San Francisco views.

Keep the Shiny side up


According to SF Curbed, the von Bothmers will keep their trees trimmed to within two feet of Ellison's 2nd floor window height, not cut them down. Also, Ellison bought the house next door to his for $40 million, and it has unobstructable views of the bay. Must be nice.

Thank you, Geezer, I didn't know that. Also for the photo, which shows just how absurd the entire argument is. I'm glad they found a middle ground; it seemed to me there'd be no problem in just trimming them to a decent height, tho' I hate to see it done to ANY redwood tree. At least they're not old growth redwoods, in that case, I'd have been out there screaming along with everyone else.

We appreciate things like that around here, and yes, sometimes to an extreme. Like the deer on Angel Island, which have become weak and ill because there are no predators there, while the battle rages what to do about them. It's an absurd situation, and shows how such things can become downright silly.

But in other ways I do appreciate it. I’ve mentioned Baltimore Canyon, which is one of our favorite nearby hikes. To get there the road winds through the redwoods, and they’ve left the redwoods, so that the road has trees right in the middle of it. It was a big hippie area way back when, with Janis Joplin, Jerry Garcia and Ken Kesey all having homes there. I can’t find any photos of the roads, but this photo of Joplin’s home illustrates the mentality. Note the redwoods; she couldn’t have built the house unless they had accommodated them, typical of Baltimore Canyon.

Grace Slick’s house, further down, burned a few years back. Baltimore Canyon is unique, the road will never become larger, and it dead ends at the beginning of a gorgeous hiking trail which connects to others all over that area, a lot of which is protected.

So yes, sometimes it matters here. George Lucas ran up against it a long tme ago when he wanted to expand his acreage--he had to set aside some as protected space to do so, and when he wanted to put up a "deer-proof fence", his neighbors were up in arms and sued him. They said in effect "We like our deer, if Lucas doesn't like 'em, he can move elsewhere". They came to an understanding in the end, but it reflects our (sometimes nutty) appreciation of our wilderness and wildlife.

So yes, to me it was an issue, as it was to others around here. I'm glad they resolved it. Your attitude, Raptor, is akin to the old "Once you've seen a tree, you've seen them all" type of attitude of the Reagan era. Not surprisingly.
