In issuing monetary sanctions against the DOJ, the court held, "the Government’s deception of the Court was without any factual or legal basis and simply wrong." (p. 19). The court noted issuing sanctions was necessary to "deter the Government from deceiving the Court again." (p. 2). Unfortunately, it's not clear this practice will end any time soon. The DOJ has been attempting to change its FOIA regulations to codify the procedures it used in this case. As the court noted, even though the proposed changes were withdrawn, "the deceptive policy and practice of the DOJ with respect to asserting and applying exclusions under FOIA apparently remains intact." (p. 19).

Mind you, it's a gentle slap on the wrist, cause that "fine" is of course coming out of the pockets of you and me, since it's a tax-budget item and thus fining them is essentially meaningless as it just moves existing funds around a bit - and even if they DID brig somebody for this you know the FBI would throw out a scapegoat.

For mine own, *I* would like to open asset-forfeiture to cases where a government agency has aggressed on the rights and personhood of citizens - what's good for the goose is good for the gander, right ?

Sure as fuck it'd be one hell of a deterrent to them if say, some property owner they were trying to plant drugs on to steal his property as their new headquarters, countersued and wound up with one of their own patrol cars on his lawn as a trophy, yes ?

Mind, I had MY way, aggression under color of law would be a death penalty offense, but barring heads on spikes, I'll take what trophies I can get.

These kinds of fines really need to come out of the offending party's operations budget. FBI gets fined for being fuckwits? That money comes out of their budget for next year; make do with less. And don't fuck it up, or you'll make do with even LESS the year after!

Agreed. Except it is sad it hardly ever happens that way.

Govt agencies usually feel an entitlement to their budgets. They are indispensable; that is why they were created to begin with.

Fines are useless. The death penalty is probably too much.

My vote is to fire the responsible parties. (But everyone knows the fed govt never fires anyone either.)

That, Mikey, is EXACTLY how we turned around our local law enforcement here, only we didn't wait no year, we hit them right then and there, they *demanded* a budget increase, we shot it down.

And then when they went to threats, extortive behavior, rabid "traffic" enforcement and forfeiture/shakedowns, especially of the med-marijuana people and charity gambling...
We hit them AGAIN.
And AGAIN.

And don't you know, suddenly they became a model of professionalism, and the actions of those two cops trying to clean up West Willow the old fashioned way since they couldn't AFFORD the war toys no more have both borne a lot of fruit and forced the realization of how far they'd deviated from the PURPOSE of their existence.

The court system around here is still messed up, but the local PD has cleaned up their act immensely, although it's kind of ironic that they took the guys who could not, would not, clean up their act and stuck em on courthouse guard duty - like attracts like, I guess.

Mind you, they're still unsure whether to be pissed off at me or thankful in the long run for pushing that concept along in the first place...
