Have to disagree with you there Whozit. They have the right to peaceful protest. It is thinking like that which lead directly to the burning of the bonus army's "Hooverville" back during the great depression.

Looks like the Park Police are there to begin enforcing the ban on camping in the park. They will apparently allow a 24 hour vigil to continue, but will not allow camping or laying down bedding material.

They're also removing the blue tarp that had been draped over the statue of General McPherson, and signs etc., from the monument.

WASHINGTON - Some things really are sacred. Occupy D.C. protesters are changing the time of their daily general assembly meeting Sunday so they can watch the Super Bowl.

After many tents were cleared from the park Saturday, the group held their normal 6 p.m. decision-making meeting and decided to move their Sunday meeting up to 4 p.m. to accommodate protesters who want to watch the game.

General Assembly meetings are held at Occupy camps around the nation and give all protesters an opportunity to speak and to play a role in making decisions about what the protesters will do.

The Occupy folks apparently don't either. Too bad they haven't been watching the demonstrations that include non-violent civil disobedience that have been occurring in D.C. as long as I can remember, for everything from civil rights, to gay rights, to D.C. statehood, and on and on.

It's pretty easy. Go where you aren't supposed to be, sit down and block the road/sidewalk/steps/doors/hallways, go limp when the cops come to arrest you, go to jail, get released a few hours later with no charges(unless you demand that charges be pressed so you can have your day in court), rinse, repeat.

Throwing bricks at cops is not recommended, although the Park Police seem to have been very restrained in this case - just arresting the actual brick thrower and not acting against anyone else. Metro PD and the Park guys got years of experience dealing with stuff in a non-confrontational manner.

What I'm saying is, no matter what side of what line you are on, you go putting massive groups of unwashed masses together there's bound to be a lot of dirtyness going on, despite the best of intent, and I think they intended well.

See the bit that says "The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution..."

That means that the Supreme court has the duty to decide how the Constitution applies. In the instant case, it means that the Supreme Court has decided that the First Amendment right to free expression can be limited in particular ways.

It's sort'a like how they decided the 9th and 10th Amendments protect the right to abortion, which isn't specifically stated in the Constitution.

But you already knew this.

Its more of a Due Process issue.

Do the pro Occupy folks think a Pro Life Group should be allowed to block access to an abortion clinic? Should the KKK be allowed to block black voters from entering a polling place? Should a rapist be allowed to sit outside the home of a victim and then explain to her as she's coming and going that testifying would be a BAD idea?

If you don't agree with those things then you must agree that limited time, place, and manner resrtictions are ok.

Should the government allow the Tea Party to hold a rally but deny the NAACP the right to hold a rally because they agree with the Tea Party, but not the NAACP?

If you say "no" then you agree that the rules should be content neutral.

Do you believe that a person has the right stand outside of a fire station and block the engine from responding to a fire at a nursing home or school? If "no", is it because you think going to the emergency to save lives is important?

If "yes", then you agree the rules must serve a legitimate government interest.

If you believe that people should be allowed to interfere with or endanger others in the manner described, then you have bigger problems then the government.

If, however, you agree that the behaivor describe should be prohibited then you agree that there is a limit to your exercise of rights. The rest is deciding where that limit is and making sure the same rules apply to everyone.

Off all of the possibilities that HERO brought up, none of them seem to apply to the Occupy arrests. They did not block emergency vehicles, for example. So as far as I can tell everything that HERO mentioned is moot. The most complete description I can find of the reasons for the clearing and arrests is from the Boston Globe:

Of the possible charges the DC police commonly bring against demonstrators, they are:

Incommoding, especially bridges.
Failure to obey a (lawful) Police Officer. Unfortunately, what is lawful is only decided AFTER you have been arrested and brought to trial.
Unlawful entry on property (trespassing).
Resisting or interfering with a police officer, including pulling away from them (When they are beating you??) Resisting arrest is unlawful even if the officer has no rightful basis for arresting you.
Failure to appear.
False statement. This can come up with forms you are asked to complete before being released.

Sometimes when the police overcharge, you will see
Assault on a Police Officer- Any unwanted touching of a police officer is an assault, including touching anything they are holding (nightstick, bullhorn, etc.) Same for throwing anything at an officer, even if you only accidentally hit them.
Destruction of property. defacing public or private property.
Kidnapping. It is possible to be convicted of kidnapping for confining someone against their will, even without transporting them anywhere. Be very careful about blocking all the exits of hotels and offices. It is an extremely serious offense -- you can be sentenced to life imprisonment.
Rioting or inciting to riot.
Aiding and Abetting. It is possible that if you help someone commit a crime, you can be charged even if you do not take any actions personally.
Conspiracy. Similar to aiding and abetting, when two or more people work together to do something illegal, they can both be charged with the additional offense of conspiracy.
Unlawful assembly; profane and indecent language. Most jurisdictions have laws like this on the books. As applied to political protest and speech, they are generally unconstitutional and unenforceable.

Now, some of these laws seem quite reasonable, but I would argue that many are overly broad, especially the ones giving the police on-the-spot absolute authority. I would like to point out to RAPPY that many arrests are on charges more or less made up on-the-spot. That is pretty typical of how the police handle demonstrations... even peaceful ones... that they don't like. Even peaceful civil rights marchers and anti-war demonstrators were subject to arrests, beatings, and shootings. In my experience, the arrests say more about the police than the demonstrators. So that long list is also moot.

Probably crossing a police line. The Park Police set up barriers so the clean-up crews could work undisturbed. Several people jumped the barriers with, per the WTOP reporter who's been pretty much embedded with the McPherson Square folks, the aim of getting arrested.

"Laying down bedding material" seems pretty clear. Other things that separate 'camping' from just being on-site would probably include sleeping, setting up permanent kitchens and stuff like that.

The other rules require all tents to be open to view so Park police can verify that no one is camping.

Here's the text of the flyer the Park Police have been handing out.

Bedding is... whatever you make of it, I guess. I can see that setting up stoves for heating food might be a danger, but I wonder what earlier precedents have been set? For example, at Tea Party rallies I've seen BBQ grills set up, so...?

I did specify "permanent" cooking facilities. You can take a grill out to the park for a day, but when you build a permanent kitchen and eating area for the folks who live 24/7 in the tents since October, that's somewhat different.

So, how "permanent" is permanent? Putting in a gas line to cooking facilities is "permanent". Putting in a sewer line to toilets? Definitely permanent. But like all words... for which we think bright lines exist (but in reality, don't*) ... there is a spectrum of meaning. So I would be curious exactly what tripped the "permanent" threshold.

*Imagine a cup.

What is it?
It is a container meant to hold liquids.
How is that different from a jar?
Jars have lids.
But what about insulated coffee cups?
How is it different from a jug?
Is it smaller?
But what about those giant drink cups?
Does it have a handle?
What about Japanese tea cups?
How is that different from a small bowl?
As you should be able to see, we THINK we know what we mean by our words, but in reality, we really don't...

It may not be fair minded, but gosh, it's GREAT for political expediency. Pointing out the shortcomings isn't the purpose; it's blackening the opponent with anything and everything one can grab out of the air, preferably as bad as you can think of.

Thank you...that's all that really needs saying, and to go on and on and ON with the same argument with the same people writing the same things time after time after time...geeeez. One can only wonder "WHY???" Neither side will ever convince the other, it's the same stuff every time, why not just let them spew their hate and go on to better things?

Good question.

In the context of whether it's camping or not, I'd say by the end of the next day. Several months would certainly qualify, again in the context of camping.

Even absent a permanent cooking structure, people living outdoors in tents and sleeping bags on the ground for four months would obviously be camping, so the "What is permanent cooking facilities?" argument is pretty much moot anyway.

I guess we all come here with an agenda. And agendas are generally fixed, given that people hold them for emotional reasons rather than rational ones.

I'd say so. Anything overnight that involves sleeping and tents and sleeping bags and being outdoors would seem to qualify. Another moot point anyway, since there have been folks staying at the Occupy camps for longer than that.

They're not disingenous because apparently the rules governing this particular site are different from most. So I'm just trying to get a bead on what they are. You posted a notice sent out by the park service, Curiously, there was no citation of any violated code. Also, the arrests seem not to be for park service violations, more like for disobeying authority. This is about curiosity on my part... what threshold was violated, what pulled the trigger?

Do you have a problem with people asking questions?

BTW, the more you twist yourself in knots trying to make peaceful assembly to petition the government into something unlawful, the more you expose what you really are.
