This court is very "corporations over people" so this isn't terribly surprising. Refusing to hear it allows the corporation to win, without the court having to actually tie itself to such a decision.

Uh... maybe I'm reading it wrong, but if the SC refuses to hear the airline's appeal, then they are in fact, for once, siding against the evil corporate power grab.

No?

Pretty damned silly of the airline, in any case, to think freedom of speech means not having to tell their customers what how much they are paying. Someone over at that airline should get a nice sharp headslap, imho.

It sounds to me a little bit like deceptive advertizing with some bit of bad-faith contract. We promise you something, but we won't tell you exactly what it's going to cost, except you're obligated to pay it all b/c you agreed to it. See - right there. Your credit card number. Legally binding.

Now, I'm not sure if this applies to the Supreme Court or not, but refusing to hear it isn't the same as refusing to hear it with prejudice. Perhaps they're legally entitled to bring the case up again?

Maybe some legal scholar could answer my question.

I've been trying to switch my service, and all I ask is one simple question. I know it's a simple question because the current carrier charges me the same amount every month, and if THEY can figure out how much to charge me, surely someone else can figure out how much they would charge me for basically the same service, right?

Here's the question: If I go by all these conditions - X number of minutes, X number of texts, etc. - if a abide by these conditions and don't go over... HOW MUCH WILL THE BILL BE? Not how much is the basic plan, because I can very well see that your ad says it will be $29.99 a month. I want to know how much the fucking bill I pay is going to be if I don't have a single minute of overage, a single text more than allowed under the plan, a single Mb of data extra above what's included...

And they cannot tell me that. No, that's not true - they WILL NOT tell me that. Because it won't add up, and everybody knows it.

And cable is the same way. I can't wait for the day HBO and Showtime divorce themselves from cable carriers and put their services on Netflix, AppleTV, Roku, etc., a la carte.

Yeah, Mal4, you got it, and Mark, you missed the details. By refusing to hear the case, they toss it back to the previous court's decision, which is AGAINST the airline.

One teeny little one for our side. I'd still like to know how they can argue that not disclosing the full price is "freedom of speech", that one made me snort...

At least with airlines and telecoms, the bill isn't likely to be 1600% higher than the estimate, although in some cases that cannot be said for Ticketmaster.

While I am no fan of more leglisation, this seems to need something like a truth-in-labelling act, all of it, and enforcement with sufficient teeth to make it meaningful.

ETA/PS: Being on the hook for about $4k of this personally, which of course digs hard into that whole food on the table thing, I will *NOT*, under any cincumstances short of death itself, remove my teeth from the ankle of this provider till I have directly and provably cost them $40,000.00USD in profit as retaliation, one quarter of that vengance being already delivered, cause there's a LESSON here which damn well needs to taught!

There's a simple answer for that, and it's DRGs - (no, not drugs, though that might be nice) - "Diagnosis-related group ... patients within each category are clinically similar and are expected to use the same level of hospital resources." WIKI So appendectomies are approximately the same, minor sutures are about the same etc. and should require on the average the same amount of reimbursement. So the theory goes.

If you find out what DRG you are, you can look up the Medicare reimbursement schedule, and voila - there's your estimate. It would be an interesting exercise to see if you can demand your DRG treatment classification code, as a matter of full disclosure and perhaps informed consent.
