Ponsetto attempted to capitalize on the one-mistake narrative in her recent interview with King. First, she described herself as “super sweet.” She framed the incident as a disconnect between intention and impact. She appealed to emotion by asking, “How would you feel if…?” She plugged “sincerely” and “bottom of my heart” into her apology. She reiterated her own false story of victimhood by accusing Harrold Sr. of assaulting her. Last, she tried to portray herself as a “22-year-old girl.” Not only did she try to draw on that portrayal in her speech, but she was also wearing a black cap emblazoned with “Daddy.” For those who know it refers to the sex advice podcast “Call Her Daddy,” the cap functions as a dog whistle for White women’s need for both freedom and male protection. For those not in the know, it functions as a dog whistle for pure White womanhood. Ponsetto was attempting to change the narrative about her behavior and her personhood.

She failed.

Ponsetto, who has been arrested and charged with assault, couldn’t have scripted her interview better to demonstrate a pattern of disrespecting Black life. She compounded her original assault by denying, blame-shifting and painting herself as a victim. Poor Trump. He too is a victim. His White House was stolen.

Trump's failure to act prosecution

The First Amendment does not protect Trump from liability for his failure to act once his rally speech set serious federal crimes in motion. The strongest case for both convicting Trump on the articles of impeachment in the Senate and for convicting him on criminal charges after he leaves office would be based primarily not on what he said at the pre-invasion rally but on what he failed to do after the insurrection began. The president cannot escape responsibility for failing to take decisive action for hours while his supporters invaded, vandalized, and terrorized the Capitol.

Criminal law does recognize liability for one’s omissions when one has a legal duty to act. For example, parents can be prosecuted for failing to protect their children because parents owe a duty of care to their children.

The president has a sworn duty to preserve, protect, and defend the Constitution of the United States, a duty that in this case required him to immediately and unequivocally discourage his most ardent supporters from committing insurrectionary crimes once he realized they were occurring. Trump’s violation of that duty by failing to act makes him an accomplice to those crimes if he intended by that omission to assist or encourage those crimes. A strong case already exists that the president wanted his supporters’ insurrectionary crimes to continue in order to change the result of the election or at the very least obstruct the certification of his defeat. Recent press reports suggest that even stronger evidence might come to light. That intent, coupled with his oath of office, makes him an accomplice to those crimes if his supporters were even slightly encouraged by his inaction.

We do not yet know much about what Trump said or did in the White House while the Capitol riot was ongoing, although some press reports suggest he was lobbying senators by phone to vote his way for the election results and delaying deploying resources to quell the insurrection. Facts already known make clear that he violated these duties of protection, however. His supporters invaded the Capitol shortly after 2 p.m. Trump did not ask his supporters to leave the Capitol until 4:17, more than two hours after they first overwhelmed the Capitol Police. His 4:17 p.m. video message also repeated many of the lies about the election that motivated their crimes in the first place, pouring more gasoline on a fire that he was supposedly asking people to extinguish.

I agree with you. When it came to Jan 6, 2021, Trump never said anything they can QUOTE him on that was inflammatory. Giuliani did, Trump Jr did, and maybe others did, but Trump the President never did.

But since they can't QUOTE Trump, in extended quotes, they have to make things up.

BTW, they did the same thing with the Georgia phone call. They took an entire hour long phone conversation and condensed it down to 1 word in quotes: "find", as in:
"Trump heard on phone call urging Georgia officials to "find" enough votes ...",
"'We Won': Trump Pushes Georgia Secretary of State in Phone Call to 'Find'",
"Trump in phone call pleads with Georgia secretary of state to 'find' votes to overturn ..."
and so on.

The word "find" shows up a few times in the entire transcript.

I know about chain of custody, I've been involved in multmillion dollar lawsuits ... the kind where the litigating attorneys bring their photocopier and photocopy every scrap of relevant paper that they can find (took 5 days) saved your the lab with questionnaires, and subject our analytical process to audit samples, and scour our email server for anything that may help their case.

This is simple folks. Sig kiki and Jack are playing lawyer for Trump and the insurgents. Trump was impeached in a bipartisan vote. We are seeing the arrests and charges reported in the news. The FBI, Justice Department and Congress are all in unison of what happened.

So when reading their posts defending the inexcusable, if you even read their posts, think Rudy Giuliani and the lies and piss poor quality of his arguments. I take comfort in that and so should you because it shows history will be in unison regarding the insurrection. Hell, historians have already label this a Trump led insurgency. So as always, Sig, kiki and Jack show themselves to be morons.
