City Attorney Found Guilty of Malfeasance

Prosecutors Dustin Davis and Robert Culpepper convinced a judge today to find former Assistant City Attorney Darryl Jackson guilty of malfeasance in office. Jackson waived his rights to a jury trial and elected to have a judge trial. After arguments from both sides, Judge Arthur Hunter immediately found Jackson guilty as charged for malfeasance in office for accepting money for favors.

In December of 2001, Jackson accepted $500 from Stephanie Battiste to dismiss a DWI offense for her son Jamal Joseph.

Prosecutors called six witnesses to the stand, including Battiste who claimed that she paid Jackson the money to defend her son and that she did not know that he was a city attorney. Her son Jamal Joseph told Judge Hunter that he met with Jackson who told him that his mother hired him and that he would be released from jail soon. A member of the City Attorney’s Office Franz Zibilich, also took the stand and verified Jackson’s employment and outlined his job responsibilities. Prosecutors also called police officer Chad Stokes who arrested Joseph and administered the breathalyzer test. Municipal investigator Byron Woods also testified that he lead the investigation and took statements from witnesses before turning the case over to the Orleans Parish District Attorney’s Office. Sharon Calcagno, the deputy clerk in traffic court and the custodian of documents indicated that Joseph’s case was indeed dismissed.

Defense Attorney Robert Jenkins accused the State of not meeting its burden of proof. However, prosecutors discredited his argument by convincing Judge Hunter that Jackson accepted the money for dismissing Joseph’s DWI ticket.

Jackson will be sentenced on September 8, 2006 and faces up to five years in prison.

“Jackson is a predator who used his position to take advantaged of someone less fortunate. I am happy with the verdict and will continue to aggressively pursue those who break the law,” said Orleans Parish District Attorney Eddie Jordan.

Former city attorney loses his law license

The Louisiana Supreme Court on Friday permanently disbarred a former New Orleans assistant city attorney for offering to fix traffic tickets for cash in 2001.

Darryl Jackson, 48, was convicted of malfeasance in office in 2006 for accepting $500 to dismiss a drunken driving case. Judge Arthur Hunter, who found Jackson guilty as charged, later sentenced him to 18 months on probation and a $1,000 fine.

Jackson offered to represent a man charged with drunken driving for $500 and then dismissed the case, Hunter concluded. Jackson never told the man’s mother that he was a prosecutor and not a defense attorney for-hire.

The client’s Breathalyzer test registered a blood alcohol content of .119, well over the legal limit for intoxication.

The charge against Jackson arose from a special grand jury, convened by former District Attorney Eddie Jordan in 2003, that snagged 11 people accused of public corruption in New Orleans.

Jackson had the felony conviction expunged last year, but the Office of Disciplinary Counsel had already filed misconduct charges against him in 2007. The state disciplinary board asked the state Supreme Court to permanently strip Jackson of his law license.
