I heard this one last night, and it really jazzed me. The judge who recently declared DADT "unconstitutional" was a step in the right direction, but this one's TONS better. The "Whit Standard", is gonna kill ANY claim that DADT ensures the "effectiveness" of the armed services!

In other words, they didn't "ask", she didn't "tell", they "investigated" her because of a third-party claim! As always, the military didn't abide by the very WORDING of DADT, they used witch hunts and third-party sources to get rid of them.

The judge found no compelling reason for her dismissal.

"The application of 'don't ask, don't tell' to Major Margaret Witt does not significantly further the government's interest in promoting military readiness, unit morale and cohesion," he wrote.

Witt's lawyers argued that the Spokane native's sexuality never led to any problems within her unit. Several members of her squadron had testified they would welcome her back.

Witt was released just before she was set to retire with full benefits.

Air Force lawyers argued the military -- not the courts -- was in the best position to evaluate and enforce the "don't ask, don't tell" policy. A federal judge in California earlier this month had similarly ruled the policy unconstitutional. That judge will soon rule on whether the Pentagon will be barred from enforcing it.

More than 12,500 gays have been booted from the military since "don't ask, don't tell" went into effect.

Just before her retirement, after 20 years of service...gee, how obvious can you get? the military!!!

The crux of the case was that having gays in the military was harmful to "cohesion", etc. What they've proved is the opposite, and that goes to the very heart of DADT:

This is the most powerful statement yet that DADT is unconstitutional, as well as bad law, and that our country has moved well beyond it.”

While the ruling left in place the military’s “Don’t Ask, Don’t Tell” policy, the court found that before discharging a soldier, the military must prove that the individual’s conduct actually hurt morale and unit cohesion."

What they proved was exactly the opposite; that it was her REMOVAL which hurt morale and unit cohesion. Wanna bet a whole bunch of people tossed out under DADT now start litigating? DAMN OBAMA for not being active on getting rid of DADT, there's no excuse!

THESE are the kinds of soldiers we want tossed out of our military? The homophobia of the upper echelon of the military sickens me; I hope this "standard" puts and end to it. If Congress is too woosy to deal with such a horrendous policy (and it's even-more-horrendous implementation), the judiciary should do what's right.

Of course, I realize this will go to the Supremes, and given their recent actions, they may well once again ignore the Constitution and laws of our land, as well as the military's obvious deliberately ignoring both the very CONCEPT of "asking" and "telling", AND the fact that cohesion was damaged because of her REMOVAL rather than her being in the military to reject the appeal. Looks like Kennedy will be the deciding vote...

Still and all, at least for now, Major Witt!
