"Fifty years of public service is on the line. And I truly believe that I am not being treated fairly," he declared. "I deserve a lawyer."

He complained that he was not being given enough time to raise funds to hire new lawyers because the committee was rushing to complete its work before the conclusion of the current lame duck Congress.

Rangel's original defense team left him in September.

"What theory of fairness would dictate that I be denied due process ... because it is going to be the end of this session?" he asked.

He later released a statement calling the committee's decision to proceed without delay a violation of "the most basic rights ... guaranteed to every person under the Constitution."

"The (ethics committee) has deprived me of the fundamental right to counsel and has chosen to proceed as if it is fair and impartial and operating according to rules, when in reality they are depriving me of my rights," he claimed.

Ethics committee chair Rep. Zoe Lofgren, D-California, replied that it was Rangel's responsibility to assemble his legal team. She also noted that Rangel had received advice numerous times from the committee on how to raise funds for his defense.

"Retention of counsel is up to the respondent," she said.

Several subcommittee members, however, also blasted Zuckerman Spaeder, the law firm originally representing Rangel.

It is "fundamentally unfair" for lawyers to abandon a client on the eve of a trial, said North Carolina Democratic Rep. G.K. Butterfield, a former trial judge. "That would not have happened in my courtroom." We need to "make sure that this firm explains its conduct to the committee."

Rep. Peter Welch, D-Vermont, expressed his "astonishment at Zuckerman Spaeder for taking the money ... and then kicking their client to the side of the road when it came time for the actual hearing."

The firm did not respond to CNN's request for a response.

Numerous House Republicans -- as well as some House Democrats -- have called for Rangel to resign because of the alleged ethics violations.

R. Blake Chisam, the committee's chief counsel, told members in the hearing Monday that "there are no genuine issues as to any material facts in this case. As a result, the case is ripe for decision."

Chisam asserted that there's no evidence Rangel was trying "to personally enrich himself." But he believes "the congressman quite frankly was overzealous" in many instances and "at least sloppy in his personal finances."

I have issues with Rangel, but I have to buck the trend here: The whole thing was a set up.

They made it impossible for him to defend himself.

Here's how, in his own words:

He was told there would be 2 years, and so he hired a legal team for 2 million. A month ago, they quit. Who knows, maybe someone paid them off, maybe they got sick of him, or whatever. Anyway, one week ago he was told that he would have to answer to 80 pages of charges based on 30,000 pages of documents and testimony. He then retained pro bono legal counsel. This was then banned as an ethics violation as a "gift." So he was told he would have to hire them through a defense fund. He was required to set up such a fund to raise money from contributors. The fund was not even operational by the time of the hearing. The hearing refused any more time, and so there was no chance for Rangel to have a legal defense team.

30.000 pages of testimony cannot be combed through for inaccuracies and inconsistencies by one 80 year old man in one week. Each charge would have to be dealt with, and each piece of testimony applied to, to see if in fact there was an argument to be made.

Rangel does not seem to have done anything major, he did little stuff that black people and Ted Stevens get in trouble for. This seems to be a bias in the system, and so the use of this process is purely political.

Rangel made some valid points, which he frequently does. I disagree with the man on many levels, but I don't think that he's a crook or a moron.

Sure, he's at times hypocritical and corrupt, but think of the body of people who are judging him: His fellow congressman.

Now, on to the real reason I opened this thread today - a question.

How many here would like to see a rule that says that if you're convicted of ethics violations and censured, fined, etc., you don't get to run for public elected office again?

I agree with Dream. It does not even matter if the defendant in this inquiry/hearing manipulated events to delay proceedings. He is entitled to representation by an advocate, and that advocate is entitled time to prepare a response or defense. It's always best to err on the side of caution, and grant defendents every right under the law and every accommodation due.

I did say "so Zuckerman Spaeder are assholes", so I definitely agree on that point. There was unfairness there, as well as counting his counsel as a "gift". Bullshit. And it wasn't done properly, as some of the other points you made show. But I don't think it was a put-up job; I tend to believe Rngel is quite capable of acting arrogantly and illegally...so many of them feel like they're "above the law" and do stupid things, it wouldn't surprise me in the least.

I see he got a "reprimand"--I'm guessing they thought it was at least somewhat unfairly done, too, or it's a partisan thing, or just the "we can do whatever we want with little responsibility" thing, I dunno.

But if he DID do what he's accused of, a reprimand is pathetic and disgusting. I'd like to see it done PROPERLY, but it's beyond that, so, eh, I don't care. Time he left, which he won't anyway, so to me there's no difference. Vitter was APPLAUDED upon his return to the floor...there ain't no fairness nohow in politics.

My opinion may well be biased by a distinct dislike of Charlie Rangel.

On the other hand, gee, here's a bunch of "liberals" denouncing a Democrat...last time the opposite happened, please? Just to say, and remind us the next time someone says we "bow" to everything Democrat.

Anthony is correct. No law should par you from your citizen rights. If such a law were put into place, it would be used endlessly to frame political opponents in ethics schemes to remove them from office.


Has anyone else noticed that these days being black is a principle ethics violation? I seems that every black politician is under review, and many of these seem to be penny ante stuff.


Also, what has Rangel done that is so horrid? I didn't see anything which compared to Cheney's secret energy commission, or Clinton's drug smuggling money laundering campaign that got him elected in the first place.

I don't dislike Rangel at all. I just disagree with him. I get where he is coming from, and he sees the system as manipulating the population to the adverse effects on his constituents, but I disagree that forcing fairness by giving the govt. more power is the answer. I think it would make matters worse. But this falls into the basic model of most political disputes: I don't disagree with his analysis of problems, only with his proposals of solutions. I think it's probably good to have someone like Rangel in congress, because he will speak his mind on topics that sometimes results in exposing problems that other people are not seeing. Congress is only human. If someone solicits gay sex in an airport bathroom, that doesn't mean that he shouldn't be there to shoot down provisions in the patriot act.


Even one of the people on the board seemed to thing there was a pretty serious miscarriage of justice when, through technicality, a man was denied due process.

We're in complete agreement. I think this war on blacks started around the time the dems took congress, but that doesn't mean it was started by them, if could be a reaction.

My primary suspect is the Clintons, but they're clearly not working alone. There's been some GOP resistance to Steel and other black republicans but so far none have been sacked, so it's less than that against black dems.

So far my digging has lead me to suspect that all attacks are primarily *internal* to each party: dems attack dems, reps attack reps. But I'm just as sure that each are getting resource support from their racist friends on the other side.

The result will not be a white congress, but a new "everybody but black" diversity. In time, new, more docile blacks will be brought in. They will represent white america, and may even be people who identify as white, but they won't be so damned uppity. This will help the illusion and prevent a new black panthers

Interesting. I disagree with most of your conclusions, but I do see the apparent trend. I wish you'd save that last paragraph, however, because I don't think it will come true. I definitely think our country has representation enough to fight this trend, if not now, in the not-too-distant fugure. How many new Black legislators were elected this time around (I wasn't paying much attention)? Rangel only got a "reprimand", he's still quite happily there.

I just don't think it's as extreme as you do, or that it's going to end up the way you do. Racism has reared its ugly head ever since before Obama took office in this country, it could be no more than that, as I see it.
