SEATTLE (AP) - Two Seattle men say they spent more than two hours in a detention center at the Canadian border after U.S. border agents discovered illegal chocolate eggs in their car.

Brandon Loo and Christopher Sweeney told KOMO-TV ( http://is.gd/usuy85) they decided to bring home some treats for friends and family during a recent trip to Vancouver, British Columbia. They bought Kinder Eggs _ chocolate eggs with a toy inside.

The two men say border guards searched their car and said the eggs are illegal in the United States because young children could choke on the small plastic toys. Importing them can lead to a potentially hefty fine.

Sweeney says the bust was a waste of his time and the agents' time. The men eventually got off with a warning.

A U.S. Customs and Border Protection spokesman declined to comment about the case Tuesday night.

The agency warned on its website around Easter that the treats can't be imported legally.

The agency says it seized more than 60,000 Kinder Eggs from travelers' baggage and international mail shipments in fiscal 2011.

Hello,

I'm not sure why any detention was warranted here. Easy enough to simply seize the illicit goods and move them right along. No muss, no fuss.

As an aside, I have a strong recollection of seeing such a 'prize inside' egg during my youth, so I wonder if the regulations used to be more relaxed.

ETA: It seems from reading about them that they were always banned. I wonder if I was exposed to an illegal import?

Who is in charge of "your" government? And it's the Feds, too. Who's the big boss of the Feds? Who do you suggest is responsible for the ban? Who did you mean to hold responsible? OH, I know, it wasn't Obama's fault- it was FDR's, he was President in 1938. Another one of his socialist, commie-sellout New Deal ideas that usurped freedom and the people's and state's power to the Big Brother Central government.

In fairness, I think Geezer was suggesting that the government has continuously, over many administrations and political flavors, interfered overmuch with our choices. I did not sense that he was provoking a fight here with Obama or his supporters. It seemed more a generic discontent.

According to an email from the U.S. Consumer Product Safety Commission (CPSC):

Therefore, they must comply with the small parts requirement under 16 C.F.R. Part 1501. When the toys within the plastic shells that are enclosed in the chocolate, contain small parts and are intended for children under age three years, they are considered banned in the U.S. and cannot be sold. If the toys inside the plastic shell of the chocolate egg does not contain small parts, they are not banned in the United States. In determining what toys and children’s articles are subject to the small parts requirement, CPSC staff considers the following factors under 16 C.F.R. § 1501.2(b): “[T]he manufacturer’s stated intent (such as on a label) if it is a reasonable one; the advertising, promotion, and marketing of the article; and whether the article is commonly recognized as being intended for children under 3.” It is prohibited to sell, offer for sale, manufacturer for sale, distribute in commerce or import in the United States any toy intended for children under three years of age that contains small parts.

The person who received that email says that "I have seen the label on them many time. (sic) They are very clearly marked for OVER the age of three... Ferraro has also said the product is intended for over three." So the logic in this definitely seems faulty.
