Yep, if you don't arrange it first, you can get sued for using a company's logo without permission. Though I hardly call that foolish, myself. A company should have a say in how their products are presented, and may not choose to associate their product with something. As a filmmaker, it's easy enough in most cases to keep company logos out (and in the case of animation, where nothing is accidental, it's kinda daft to think they could just use whatever they want, so there's literally no excuse.) And there is a specific type of insurance, called "Errors and Ommission" coverage, that is available to films/TV/etc. that covers a production if they don't have the ability/desire to remove signage and logos, and don't want to worry about penalties.
