When the USS Vincennes was hit by the Exocet missile , and when the Iranian jetliner was accidentally shot down. Both incidents occurred in a theatre of war. There was no 'war' going on, when the drone was shot at, in int'l waters. It wasn't shooting anyone, save for possibly by video. According to the details, as they're known, Iran was completely and fully the aggressor here, and is fully at fault. Except it was the USS Stark and it was in 1987, not 1988 when the Vincennes shot down a large civilian passenger jet. And at that time, the Vincennes was in Iranian waters, and the passenger jet was in Iranian airspace.

Neither which were germane to the issue anyways, but thanks for the clarification.
