Talk about irresponsible and just plain stupid, let's see Alabama Congressman Mo Brooks really takes the prize.

"Republican Representative Mo Brooks of Alabama thinks they can send President Obama to prison for 5 years for doing what every other modern president has done by taking executive action on immigration reform."

But then does a serious backpedal when confronted as to which law was violated by the President.

"Brooks said there is a federal statute (“I don’t have the citation for it at the tip of my tongue”) making it a felony to aid, abet, or entice a foreigner to illegally enter the U.S.
“At some point, you have to evaluate whether the president’s conduct aids or abets, encourages, or entices foreigners to unlawfully cross into the United States of America,” he continued. “That has a five-year in-jail penalty associated with it.”
Brooks isn’t sure on what grounds impeachment proceedings might be justified because he hasn’t seen the outlines of the president’s actions yet.

“I don’t know what he’s going to do yet,” he continued. “Until we see what he’s going to do, it is difficult to say whether he is violating a civil statute or violating a criminal statute.”

Watergate was a president committing a crime to be re-elected, ordering a robbery and then covering it up so not to get caught. I guess white collar crime doesn't count.

Nixon didn't order the break in, BUT when he found out what happened he should have fed Dean, Liddy, Hunt and the others to the wolves, not try to help them. The ability of the AG to appoint an IC was removed when Clinton reauthorized the OIC law. The AG appointed Fiske. When the AG's authority to appoint him was rescinded, he was removed and replaced by Starr, which was done by a 3-panel court that appointed the new SP. Which is why I quoted the part about the OIC law being reauthorized.

The AG had NOTHING to do with Starr.

Eric Holder Declines Ted Cruz’s Request For Special Prosecutor In IRS Case

"U.S. Attorney General Eric H. Holder Jr. has declined to appoint a special prosecutor to investigate the Internal Revenue Service’s targeting of advocacy groups for extra scrutiny based on their policy positions.

Attorney General Eric H. Holder announced the decision in a letter last week to Sen. Ted Cruz (R-Tex.), saying that “such an appointment is not warranted” because the case does not present a conflict of interest. Cruz had requested an independent investigation in January.

The attorney general said in his response to the senator that “career prosecutors and law-enforcement professionals” were conducting the Justice Department probe. “The Department remains committed to integrity and fairness in all of its law-enforcement efforts, without regard to politics,” Holder said.

Cruz criticized the decision on Thursday, saying in a statement that Holder “has chosen to reject the bipartisan tradition of the Department of Justice of putting rule of law above political allegiance.” He cited past examples in which attorneys general appointed special prosecutors to investigate Watergate under President Richard Nixon and the Monica Lewinsky scandal under President Bill Clinton.

In his January request, Cruz said an independent investigation was necessary because the Justice Department had not indicted anyone for the IRS behavior and because one of the prosecutors helping to lead the DOJ probe had donated heavily to President Obama and the Democratic party."

I agree with you, sort of, that the AG can appear to be biased in his choosing a special prosecutor. So, Holder refused to assign one (1) and have the DOJ investigate, as by virtue of the Constitution.
Imagine for a moment, as you already have, that Holder is corrupt and chooses a crony (the GOP is familiar with cronyism) and he decides in favor of the administration and the IRS. You guys, and the GOP, would have a kaniption fit. The seas would boil and the sky would fall.

But here, in this case, Holder says no I'm not appointing a Special Prosecutor cause he knows it's a trap. Cruz may think he's a Jedi, but Holder was 2 steps ahead of him (The Jedi mind trick only works on the weak-minded). So, what's a right wing nut job to do? Well, if he's a Congressman, he could ask his fellow Congress members to caucus (which Cruz is well aware of) and ask to have the appropriate committee investigate (such as in the Benghazi case) (2).

(1) If the attorney general suspects criminal wrongdoing within the federal government, he or she can assign a special counsel to lead the investigation. The appointment does not need congressional approval, just notification to the chairman and ranking member of the House and Senate Judiciary committees. The special counsel can be dismissed by the attorney general in extraordinary circumstances, however.

(2) Because this is an executive-branch function, Congress cannot appoint a special counsel. Instead, Congress can hold its own investigation through different committees.

Cruz very well knows the game he's playing. Wasn't one of your heroes, Issa, conducting a Congressional investigation of the IRS. Isn't that better than having Holder pick a Special Prosecutor?
