Mitch McConnell thought the Jan. 6th attack on the U.S. Capitol would finally vanquish Donald Trump, initially predicting that at least 17 Republican senators would vote to convict him in his impeachment trial, barring the former president from running again.

He was wrong.

McConnell’s miscalculation is one of the new details reported in the latest book on the chaotic end of the Trump presidency, “This Will Not Pass” by New York Times reporters Jonathan Martin and Alexander Burns.

In the weekend following the riot in early January 2021, McConnell is described by the authors as “in a lather, using profanity to refer to Trump,” and outlining what he saw as his “imminent demise.”

“McConnell told his advisers there would be at least 17 Senate Republicans ready to affirm Trump’s impeachment, supplying the two-thirds vote needed to convict,” Martin and Burns write.

But just a month later when the unprecedented second impeachment trial of Trump unfolded with him out of office and kicked off of Twitter, just seven GOP senators voted for Trump’s conviction and McConnell wasn’t even one of them.

The head-snapping change in the Kentuckian’s mindset is a vivid illustration of how he ultimately chose the preservation of his own power over damning condemnation of the man he said was “practically and morally responsible” for the Capitol attack.

In the end, when McConnell saw most of his party falling into line with Trump, he wasn’t going to be out of step.

It’s Fun That “the President Reportedly Agreed That a Mob Should Kill the Vice President” Is Only a Minor News Story

On Jan. 6, 2021, after a pro-Trump mob overwhelmed police at the U.S. Capitol and broke into the building, Vice President Mike Pence was taken into hiding by the Secret Service. While this was happening, Donald Trump wrote a tweet attacking Pence (you may remember that Pence had upset Trump by upholding his responsibility to certify the results of the presidential election in a joint session of Congress):

I had to copy and paste that text rather than embed the tweet, because it is no longer online. Twitter suspended and removed Trump—the president!—from its service after more or less concluding that he was using it to try to overthrow the government.

This all looked pretty bad in the moment. It looks even worse now! One of the details that emerged from the Capitol that day is that some of the people in the mob said they were looking for Pence; a number of them took part in an unnervingly intense “HANG MIKE PENCE” chant. Trump has since defended this behavior, and Politico reported Wednesday that according to testimony given to the House’s Jan. 6 committee, he approved of the idea of killing Pence at the time, too:

This is a tortured description of a thirdhand account, so it’s not clear exactly how much thought and specificity Trump put into his comments. We know from experience that he will kind of nod along and claim to be “strongly looking into” nearly anything that anyone suggests to him. It may not be prosecutorially actionable evidence of conspiracy to commit murder.

On the other hand, you have to admit: It’s messed up! And it’s also messed up that this revelation is so unsurprising that Politico’s story about it is not (currently) among the top five most-read on its website.

The US took many years to rid itself of Nixon. Getting rid of Trump would take as long. Why? The weakness in the United States is the same one George Washington pointed out in his farewell, that there is no mechanism to swiftly remove a bad President. There is not even a reliable method to decide what "bad" means, which is why the US gets into bad trouble so many times. Unlike with the US and its bad Presidents, countries with a better design can remove a bad Prime Minister in a few days. Meanwhile, in countries that don't function very well, a President like Nixon can get away with criminally running the Vietnam War for years. Or a President like Putin gets away with his Ukraine War.

It is impossible to scientifically compare opinions about wars from two groups of Americans, separated by 50 years, because all the Americans of 50 years ago are today either dead or decrepit, but it is easy to compare the personalities of the two groups across so many years because the same kinds of personalities reliably keep repeating over the decades. It is new people, but the same old personalities in younger bodies. What I see is the kind of Americans in the group who were of the opinion that Nixon should continue his rampage in Vietnam are the kind of Americans who would let Putin continue his rampage in Ukraine and want President Trump in 2024.

P.S. -- When I returned from Vietnam with my eyewitness report on how stupid, incompetent and dishonest Richard Nixon was, it changed no minds of people with the kind of personality who would vote for a Nixon or a Trump or a Ron DeSantis or a Ted Cruz, four slices of moldy baloney.

America’s Conspiratorial Delusions Weren’t Born Under Trump

False realities have been part of the U.S. political scene for decades.

Donald Trump lost the election, but he won the election cycle. His conspiracy-mongering and high-profile support of right-wing propaganda outlets have left an indelible mark on American culture. But while Trump may be the undisputed champion of these tactics, he didn’t create them. Far-right politicians and media personalities have been creating false realities for decades, and they’ll keep doing it as long as possible — regardless of whether it spurs extremist groups or even terrorist attacks.

Trump’s pandering to extremists may be the most obvious source of the problem. But that’s only because he lacked the self-discipline and political subtlety of ideological allies like Sen. Mitch McConnell and former Attorney General Bill Barr, both of whom acted to sabotage President Joe Biden’s legitimacy without tweeting their plans to the world. Future right-wing politicians will fine-tune their messages and orchestrate more deniable intimidation campaigns, and it’s entirely possible that the smaller left-wing extremist movements will swell up in response as more people give up on democratic norms. This may not cause the U.S. system of government to collapse, but they can certainly make the next few decades unpleasant.

This outcome isn’t inevitable, but responsible Americans from all parties need to act swiftly. Deceitful politicians need to be held accountable at the ballot box, and right-wing grifters need to see their profits dwindle. Most importantly, all Americans need to be aware of the supposed alternate realities that dominate so many lives.

On June 9, the Jan. 6 House Select Committee will hold public hearings as part of their ongoing investigation into the storming of the Capitol last year. In short order, the set of six scheduled televised sessions this month are likely to build momentum towards making the case that the president was directly involved in attempts to undermine the peaceful transition of power. And as the steady dropping of shocking findings from the committee over the course of the past months suggests, the sessions will likely have many viewers on the edge of their seats.

Some legal observers argue the Justice Department faces an uphill battle in determining criminal intent because Trump could claim that he actually believed his own Big Lie about massive voter fraud. Even if his Attorney General and others told him directly that the claim was false, was Trump’s outside lawyer, John Eastman, whispering contrary messages into Trump’s ear?

On that front, the committee just released new evidence showing that Eastman, too, knew the claim lacked factual foundation.

New reports also revealed that the committee has testimony that Trump Chief of Staff Mark Meadows burned documents in his White House office fireplace. Substantial evidence in the public record already pointed to his central role in the plot.

Do innocent people burn documents in the White House? The good news is that Meadows didn’t burn his phone with its text messages, and that he gave 2,319 of those messages to the committee in response to their subpoena before reversing course and not cooperating. Trump's son texted, “He’s got to condemn this shit.”

Vice President Mike Pence’s chief of staff called Mr. Pence’s lead Secret Service agent to his West Wing office. The chief of staff, Marc Short, had a message for the agent, Tim Giebels: The president was going to turn publicly against the vice president, and there could be a security risk to Mr. Pence because of it.

It is unclear what, if anything, Mr. Giebels did with the message. But as Mr. Trump attacked his second in command — and democratic norms — in an effort to cling to power, it would prove prophetic.

A day after Mr. Short’s warning, more than 2,000 people — some chanting “Hang Mike Pence” — stormed the Capitol as the vice president was overseeing the certification of Joseph R. Biden Jr.’s victory. Outside, angry Trump supporters had erected a mock gallows. After Mr. Pence was hustled to safety, Mark Meadows, the White House chief of staff, is reported to have told colleagues that Mr. Trump said that perhaps Mr. Pence should have been hanged.

For an awful lot of people the evidence about Trump and January 6th doesn't matter. They already believe that Trump tried to overturn the election results and they think that was a good thing. I mean, Democrats were the ones who originally tried to steal the election, right? So why shouldn't Trump fight them on the same level?

So we have (1) people who believe Trump tried to overturn the election and don't care, and (2) people who believe Trump tried to overturn the election and think it was an attempted coup. But I suppose there must still be some folks in the middle who don't realize what Trump did and would be outraged if they finally figured it out. That's the audience for these hearings.

Is it big enough to matter? Polling suggests that two-thirds of Republicans are in group (1) and pretty much all Democrats are in group (2). Independents split about half and half.

While this report is primarily focused on federal offenses, we also note evidence potentially probative of state criminal violations. Fulton County, Georgia is one jurisdiction currently investigating such evidence, and we briefly address the factual and legal analysis attendant to that investigation, which is also the subject of a separate report by some of the authors here.

What does “conspiracy to defraud the United States” mean?

The statutory citation is Title 18 of the United States Code, Section 371. It is sometimes referred to as the Klein Conspiracy, after a case named United States v. Klein. It is frequently used in cases of tax violations, but what it means is that someone with a fraudulent intent did something to obstruct or impede the official functioning of government. And so, in this instance, it would be something like, Trump and others conspired to defraud the American people and interfere with the proper transfer of Presidential power. Sometimes people think about the big picture, that you have to tie Trump to the physical attack on the Capitol. And that could do it, because that was one way that the certification was obstructed. But it could also simply be his efforts to pressure Mike Pence to refuse to certify the vote. And that would be an obstruction of an official proceeding.

Liz Cheney said there are seven different schemes that they’re going to try to prove in the next few weeks. It could be that they’ve got seven different ways that they’re going to try to show conspiracy to defraud the United States, but any one of them is enough to obtain a conviction. Alternate slates of electors, or trying to persuade Georgia to change the outcome in that one state. Any of those things could suffice for conspiracy to defraud the United States.

And this was through force-feeding. There was almost no broadcast option to choose other than this tripe, and any random TV which happened to be on was sure to be stuck on one of these.

Nevertheless, a defense attorney could try to argue that Trump “genuinely believed he won the election ... and was trying to stop fraud,” Barbara McQuade, former U.S. Attorney for the Eastern District of Michigan, told the New Yorker last week. “Proving mindset is really hard.”

But the concept of “willful blindness” could be used against Trump, she noted. “A person cannot ignore the probability that a fact is true” — such as the election was legitimate — “just because he wishes it weren’t true.”

The hearing brought to life a high-stakes Oval Office meeting in December 2020, where Trump considered firing the acting attorney general and installing Clark, who was willing to use the powers of federal law enforcement to encourage state lawmakers to overturn Trump’s loss.

On Thursday, we heard live testimony from some of the Justice Department officials who were in the room, including Rosen, the then-acting attorney general. (He survived the meeting, after Trump was told that there would be mass resignations at the Justice Department if he replaced Rosen with Clark.)

Trump White House lawyer Eric Herschmann said Clark was repeatedly “clobbered over the head” during the meeting. He told the committee that he called Clark a “f—ing a–hole” and said his plans would’ve been illegal. He also said Clark’s plan to send letters to battleground states was “nuts.”

In videotaped testimony that was played Thursday, Donoghue said he eviscerated Clark’s credentials during the meeting, explaining that Clark was woefully underqualified to serve as attorney general.

“You’re an environmental lawyer. How about you go back to your office, and we’ll call you when there’s an oil spill,” Donoghue said in the deposition, describing what he told Clark at the White House meeting.

Donoghue said then-White House Counsel Pat Cipollone called Clark’s plan a “murder-suicide pact.”

Donoghue himself described Clark’s plan as “impossible” and “absurd.”

“It’s never going to happen,” Donoghue said of the plan.
