The case for charging Trump with manslaughter

During the next Jan. 6 committee hearing I will be listening for evidence of a crime that has gone largely undiscussed.

The loss of life was predictable in light of the size of the mob, their emotional state and their use of force. We recently learned from Cassidy Hutchinson’s testimony another key fact — then-President Donald Trump knew that the crowd was armed, adding to the risk that someone would be killed. According to Hutchinson, this risk was also foreseeable to White House counsel Pat Cipollone, who urged White House chief of staff Mark Meadows to persuade Trump to take action to stop it. According to Hutchinson, Cipollone told Meadows: “Something needs to be done or people are going to die and the blood’s going to be on your f---ing hands. This is getting out of control.”

First Amendment concerns about political speech could create sticky legal issues. So instead, prosecutors could focus on acts of criminal omission.

Unlike most members of the public who have no duty to take action to prevent a crime, a president has a constitutional duty to “take care that the laws be faithfully executed.” The president also serves as commander in chief of the armed forces. On Jan. 6, when Trump was alerted that the situation at the Capitol was getting “out of control,” he had a duty to call in the National Guard to quell the violence. According to Joint Chiefs of Staff Chairman Gen. Mark Milley, Trump did not do so. Nor did he call any other government agency to intervene.

On Tuesday, we heard testimony from Cipollone that Trump could have gone to the press briefing room and made a statement on camera asking the mob to disperse, and that Trump refused. Trump also had a direct communication channel in the form of Twitter, but instead of posting a tweet asking the crowd to go home, Trump rekindled the flames by tweeting that Pence lacked the “courage” to toss out the election results. It was not until the 187th minute of the riot that Trump put out a video-recorded statement asking the mob to go home. I believe his three hours of inaction could amount to an omission necessary to prove that first element of manslaughter.

Second, prosecutors would need to show the required mental state — that Trump acted without due care, which is another term for negligence. For criminal liability, prosecutors must show not just simple negligence, but gross negligence, an extreme deviation from the standard of care. Here, Trump certainly was aware, or should have been aware, of the risk of death at the Capitol. And yet he failed to take action. Testimony from staffers who urged him to act will be important at the upcoming hearing, especially for establishing a failure to take due care.

Third, prosecutors would need to prove that his act of omission caused one or more of the deaths. To prove causation, prosecutors must generally prove that the death was a reasonably foreseeable result of the act of omission. Here, it was reasonably foreseeable that a mob of thousands of angry people, whom Trump knew were armed and angry, would cause the death of another person. Even if Trump was unaware that the mob would breach the Capitol, it was reasonable to foresee that an overmatched Capitol Police officer or a member of the crowd would be killed. And of course, that is just what happened.

Even if this result was not foreseeable during Trump’s speech on the Ellipse, it certainly became foreseeable during the 187 minutes that he sat watching television coverage of the mayhem at the Capitol.

For decades, Democrats and Republicans agreed on the norms and procedures that grounded our political reality: every eligible citizen should be allowed to vote; race, gender, and religious belief shouldn’t make anyone ineligible to vote (although it did take different amounts of time to reach consensus about who was eligible); all votes should be counted; and whoever gets the most votes wins the election, except in the case of Presidential elections, which are governed by the more complex rules of the Electoral College. These rules were all part of the political paradigm that Americans once widely accepted.

But things changed. In 1980, Paul Weyrich, founder of the Moral Majority, said “I don’t want everyone to vote…our leverage in the elections quite candidly goes up as the voting populace goes down.” His declaration started a new wave of voter suppression efforts intended to make sure not everyone would get to vote and to challenge which votes would be counted. In 2000, there was ambiguity about whether Al Gore received more votes in Florida than George W. Bush. The Brooks Brothers revolution showed that if Republicans raised enough of a fuss, Democrats would protect the paradigm rather than their electoral victory. They were willing to sacrifice the power that would come with electoral victory to protect the structural stability of the entire election process.

Over time, conservatives began to establish an alternative paradigm, setting themselves apart from what an unnamed Bush aide called “the reality-based community” of people who believe that political solutions derive from a “judicious study of discernible reality.” The aide defined the new conservative paradigm both brazenly and clearly: “That’s not the way the world really works any more… We create our own reality.” In 2017, Trump advisor Kellyanne Conway embraced the new paradigm by referring to the administration’s falsehoods as “alternative facts.” For adherents to that new paradigm, those alternative facts are absolutely real.

The new paradigm explains why it’s so much more difficult to have political conversations across party lines than it once was. Those of us who are members of the “reality-based community” rely on double-blind testing and statistics to determine whether certain facts, like the efficacy of masks and COVID vaccines, are rational to believe. Those who are members of the “alternative facts” paradigm have removed the scientific method from that role, replacing it with declarations made by powerful political and media voices. Trump will run again to avoid consequences of January 6th

Four people with close ties to Trump told Rolling Stone that the twice impeached president has "spoken about how when you are the president of the United States, it is tough for politically motivated prosecutors to 'get to you.'"

The source who had recently had this conversation with Trump further told Rolling Stone, "He says when [not if] he is president again, a new Republican administration will put a stop to the [Justice Department] investigation that he views as the Biden administration working to hit him with criminal charges -- or even put him and his people in prison."

The list of illegal allegations against Trump is long. He's currently in the middle of two criminal investigations, allegations of election interference, and facing accusations of financial crimes (per the BBC). It appears that Trump believes he can turn his legal strife around by becoming president again in 2024, which may be a major motivation for running again.

I think we all know what the Secret Service did last year

Secret Servicegate is slowly coming into sharper focus. Here's what we know:

• On January 16, 2021, Congress sent a "broad" preservation and production request to the Department of Homeland Security, which oversees the Secret Service. Another was sent on January 25. Both requests were aimed at preserving records related to the 1/6 insurrection.

• On January 27, as part of a system upgrade called Intune, "USSS began to reset its mobile phones to factory settings as part of a preplanned, three-month system migration. In that process, data resident on some phones was lost."

• In February the inspector general of HHS, Joseph Cuffari, asked the Secret Service for text messages related to the 1/6 insurrection. In June the IG issued a request for all text messages sent and received by 24 specific Secret Service agents between December 7, 2020 and January 8, 2021.

• The Secret Service eventually responded with a single text message.

• But what about backups? According to CNN, "A source familiar with the matter told CNN that employees were instructed twice to back up their phones." Employees were given instructions on how to do the manual backup but apparently the instructions were widely ignored.

• Today the Secret Service said that its search for further messages had turned up nothing. They were gone for good.

Do you remember those torture videos that the CIA destroyed in 2005? Or the night in 2019 when Jeffrey Epstein killed himself in a jail cell and we later learned that the guards were all napping and his roommate had been transferred and all the CCTV video had been erased due to a "technical error"? Sound familiar?

Nothing about the Secret Service's story makes any sense. They were doing a system-wide upgrade but didn't do a system-wide backup? They instead instructed their agents (twice) to back up their phones themselves, but apparently not a single agent did? Then, literally two days after getting a preservation request from Congress, they just went ahead with the system reset without bothering to check if it would erase anything Congress was interested in?

No. That's Brooklyn Bridge stuff. One way or another, it's hard to believe anything other than the obvious: those texts were damning enough that the Secret Service knew it would get in more trouble for keeping them than for erasing them — no matter how much trouble they'd get into for erasing them.

And they were right. Sure, they're taking some heat right now, and they'll take some more. But if they stick to their story that it was just a big ol' accident, there won't be much that anyone can do.

In the meantime, common sense combined with the fact pattern of the case tells us that these text messages must have been genuinely explosive. But because they're gone, the public perception will always be a shoulder shrug and the "coincidence" story will end up being the official narrative.

Now that Trump's records are as unavailable as his tax returns:

Former President Donald Trump said on Wednesday that he, too, would like the Secret Service's records on the Capitol riot to be publicly disclosed.

In a post on Truth Social, Trump said he wanted these records to come to light "far more" than the January 6 panel investigating the Capitol riot.

Trump said these "Secret Service tapes" would debunk the "ridiculous and libelous story of me supposedly choking a big and strong Secret Service Agent around the neck" on the day of the riot.

"Likewise, there was no throwing of food, and I did not want to be surrounded by strangers 'with guns' during my 'Peacefully & Patriotically' speech," Trump wrote.

The unavailable records would have proved Trump is not a fat lying sack of shit. Too bad, so sad for Trump that he can't prove he is a completely different man in private.

Former acting Deputy Attorney General Richard Donoghue testified that Trump told a group of department officials that it didn’t matter if the election was rife with fraud, adding, “just say the election was corrupt and leave the rest to me and the Republican congressmen.” This is direct evidence — relayed by Donoghue under oath — of criminal intent. Trump apparently neither believed nor cared whether there was provable evidence of widespread election fraud, he simply wanted his DOJ officials to lie — “just say the election was corrupt” — and let him use that lie to help steal a second presidential term.

Former Attorney General Eric Holder described these statements as a “smoking gun” proving Trump’s corrupt intent, adding that it would be “laughable” for anyone to argue otherwise to a jury. To understand the stakes, and the motives of Republicans who brought the case, you need only one strategic fact of political arithmetic. Six swing states — Pennsylvania, Michigan, Wisconsin, Arizona, Georgia, and North Carolina — are trending blue in presidential elections but ruled by gerrymandered Republican state legislatures.

Joe Biden won five of those six swing states in 2020. Donald Trump then tried and failed to muscle the GOP state legislators of those five states into discarding Biden’s victory and appointing Trump electors instead. The Moore v. Harper case could give Republican controlled legislatures the legal cover in 2024 to do as Trump demanded in 2020, something they did not have in 2020.

Three Supreme Court judges have said in speeches that they would allow state legislatures to pick the electors sent to the Electoral College. The old way was for the voters to decide, not the legislature. The old way, old-fashion Democracy, may become the obsolete way.

That is exactly what Trump wanted in 2020, but he needed five, not three, Supreme Court judges to do that. By 2023, there probably will be five judges to give Trump what he wanted. Better late than never if you are a judge planning on overthrowing Democracy.

Five Supreme Court judges gave George Bush what he wanted in 2000 for the vote count in Florida. This time it will be a different set of five Republican judges, not the voters, picking the next President. How well did President George Bush work out? Pretty good?

Three Supreme Court judges have said in speeches that they would allow state legislatures to pick the electors sent to the Electoral College. The old way was for the voters to decide, not the legislature. The old way, old-fashion Democracy, may become the obsolete way.

That is exactly what Trump wanted in 2020, but he needed five, not three, Supreme Court judges to do that. By 2023, there probably will be five judges to give Trump what he wanted. Better late than never if you are a judge planning on overthrowing Democracy.

Five Supreme Court judges gave George Bush what he wanted in 2000 for the vote count in Florida. This time it will be a different set of five Republican judges, not the voters, picking the next President. How well did President George Bush work out? Pretty good?

The 5th amendment was intended to forbid torturing to get a confession. The Puritans dunked witches to get them to confess to witchcraft, which was the equivalent of waterboarding used at Guantanamo Naval Base. But the 5th was not written properly. Now it is used exclusively by criminals because there are no witches being tortured by drowning. Trump is a criminal, not a witch.

This week a father was convicted in Texas of killing his daughters. As one daughter was dying, she called the police on her cellphone to tell them her father was her killer. It only took 12 years, let me spell that out, TWELVE YEARS, to get a conviction. Just because Trump has not been convicted doesn't mean he is innocent.
