Judge Chutkan imposes partial gag order on Trump. But silencing a defendant isn't a good thing.

If the judge had compelled the former president to speak, that would violate his right not to incriminate himself. Yet, when he wants to say something in his defense, she's stepping on that right.

Trump Foundation and promised to give the book’s royalties to the needy through the foundation. Trump mentioned giving to AIDs victims, the homeless, and Vietnam veterans, among others.

The Washington Post inquiry, however, showed that there were no donations that actually happened. The Washington Post further inquired into the promised $55,000 Trump donations to charity supposedly done in the first half of 2016. Trump’s camp had no response when asked about this. Did Trump apologize? Or actually make the donations he claimed to have made? No. And No. But Trump did falsely smear the Washington Post for revealing the truth about him.

Donald Trump’s testimony turns heated in New York civil fraud trial

Donald Trump played down the importance of the financial statements at the centre of a civil fraud lawsuit as he began a tumultuous turn on the witness stand that provoked several rebukes from the judge and turned a New York courtroom into a rambunctious political theatre.

At one point, an irritated Judge Arthur Engoron threatened to remove the former president, telling his attorney: “I beseech you to control him, if you can. If you can’t, I will.”

Trump’s lawyer Christopher Kise said he thought the court “should grant the former president of the US . . . a little latitude to explain himself”. Amid the chaos, Trump shook his head and declared: “This is a very unfair trial. I hope the public is watching.”

Wearing a dark suit, white shirt and blue tie, Trump took the stand just after 10am for the most anticipated moment of a civil trial that began a month ago in the lawsuit brought by New York attorney-general Letitia James.

The judge has already concluded that the ex-president committed fraud by persistently inflating his net worth to secure bank loans and insurance policies for the Trump Organization on advantageous terms.

At stake in his testimony is whether Trump will be forced to pay crippling penalties upwards of $250mn and be stripped — along with his adult sons, Donald Jr and Eric — of the ability to operate a business in New York.

Trump set the tone early, responding to “yes or no” questions with expansive lectures about the art of real estate valuation, digressions and diatribes about the legal cases against him.

By turns haughty, cool and aggrieved, he used the witness stand to lash out at his adversaries and discredit the process.

“People don’t know how good a company I built because people like you go around and try to demean me,” he said, referring to the state’s lawyers. On another occasion, he wagged his finger at the judge and fumed: “‘He called me a fraud, and he didn’t know anything about me!”

On the substantive issue of the financial statements, Trump dismissed their importance and minimised his involvement in their preparation.

“I would look at them. I would see them. Maybe on occasion I would have some suggestions,” he replied when asked by Kevin Wallace, a lawyer for the New York attorney-general, about his involvement in their preparation.

For lenders, “they were almost valueless”, he admitted, because they carried a legal disclaimer that indicated they should not be relied upon. Even so, Trump said, his brand was worth far more than stated in the reports.

The image of a former president sworn under oath and seated in the witness stand offered a vivid reminder of the legal problems besetting Trump as he plots a course back to the White House.

The leading contender for the Republican nomination is facing three criminal trials in the coming months stemming from his alleged attempt to overturn the 2020 presidential election and his handling of classified documents after he left office. He has been charged in a fourth criminal case, brought by Manhattan district attorney Alvin Bragg, with masterminding hush money payments to a porn actress with whom he allegedly had an affair.

Trump has denied wrongdoing in all matters, and dismissed the cases as partisan witch-hunts meant to end his political career.

The former president was a scowling presence in the early days of the New York civil fraud trial, using a phalanx of cameras outside the courtroom to broadcast to his supporters during breaks in the action and attack the state’s attorney-general and the judge.

He sat briefly in the witness chair when the judge halted the proceedings a few weeks ago to question Trump about disparaging comments he had made about a law clerk in violation of a partial gag order. The judge deemed the former president’s testimony “not credible” in that instance. In total Trump has been fined $15,000 for violations of the order.

Trump was preceded on the stand by Donald Jr and Eric, who have spent their entire careers at the family business and then took charge of it when their father became president in 2017.

In their testimony last week, the brothers portrayed themselves as executives with little interest in accounting who were happy to delegate to others. In particular, both sought to distance themselves from the “statement of financial condition” that outlined Trump’s wealth and which is central to the attorney-general’s case.

Some defence attorneys have questioned the wisdom of Trump taking the stand because his testimony may be used against him in the pending criminal cases.

“You’ve already lost the battle and the war in New York and the risk of testifying is enormous,” said Daniel Horwitz, a former prosecutor who now chairs the white-collar practice at McLaughlin & Stern.

Michael Bachner, a New York defence attorney, said: “Prosecutors will be sitting in the courtroom waiting for Trump to state something under oath that can be used in the criminal prosecution.”

But Trump may have other considerations. By testifying, he is sure to dominate the airwaves, leaving little space for his Republican rivals. He may also be able to drive home the message to voters and potential jurors that he has nothing to hide.

Ahead of Trump taking the stand, James said in a message on social media platform X, formerly Twitter, on Monday morning: “Donald Trump might lie, but the facts and the numbers don’t.”

Trump’s crumbling business empire just took another $73 million hit

More news emerged yesterday about Donald Trump’s crumbling business empire. After launching his own social media platform, Truth Social, in early 2022, new filings reveal it has lost around $73 million in net sales.

The financial disclosure form was made by Digital World Acquisition Corp. (DWAC). It’s a merger partner with Trump Media & Technology Group (TMTG). Trump launched TMTG in 2021, boasting it would rival tech giants such as Facebook.
The Hollywood Reporter was the first to pick up the story. The filings reveals that in 2022 Truth social lost $50 million and made just $1.4 million net sales. It fared slightly better this year, bringing in $2.3 million in sales but again losing $23 million so far.
Ouch.

Trump’s stake in Truth Social is believed to be worth somewhere in the region of $5-$25 million

It doesn’t take a business genius to work out the situation is dire. The filing itself notes, “[Trump Media & Technology Group’s] independent registered public accounting firm has indicated that TMTG’s financial condition raises substantial doubt as to its ability to continue as a going concern.”

Typical story about how slow American justice system operates: FAIRFIELD, Iowa — One of the two Fairfield teens who admitted to killing a high school teacher was sentenced Wednesday to life in prison. Jeremy Goodale, who pleaded guilty in April to killing Fairfield High School Spanish teacher Nohema Graber back in November 2021, must spend at least 25 years in prison before the possibility of parole.

In fact, the very same things — like separating migrant families at the border — that used to be implemented in secret and denied in public are now overtly set forth as policy and justified as wins. Our threat is from within.”

When Trump finished his speech, the audience erupted in applause.

Trump’s comments came only a few weeks after he had been asked about immigration and the southern border in an interview with the host of a right-wing website. “Did you ever think you would see this level of American carnage?” Trump was asked.

“No. Nobody has seen anything like this,” Trump responded. “I think you could say worldwide. I think you could go to a banana republic and pick the worst one and you’re not going to see what we’re witnessing now.” The front-runner for the Republican nomination warned that immigrants pose an immediate threat. “We know they come from prisons. In a September 20 speech in Dubuque, Iowa, Trump said, “What they’re doing to our country, they’re destroying it. It’s the blood of our country. What they’re doing is destroying our country.”

Trump’s rhetoric is a permission slip for his supporters to dehumanize others just as he does. He portrays others as existential threats, determined to destroy everything MAGA world loves about America. Trump is doing two things at once: pushing the narrative that his enemies must be defeated while dissolving the natural inhibitions most human beings have against hating and harming others. It signals to his supporters that any means to vanquish the other side is legitimate; the normal constraints that govern human interactions no longer apply.

At a Trump event in Iowa, days after that post, one Trump supporter asked why Milley wasn’t “in there before a firing squad within a month.” Another told NBC News, “Treason is treason. There’s only one cure for treason: being put to death.”

Trump has taken to mocking the violent attack on Nancy Pelosi’s husband, which left him with a fractured skull that required surgery and other serious injuries. Special Counsel Jack Smith, who has brought two indictments against the former president, is a “Trump-hating prosecutor” who is “deranged” and a “disgrace to America”—and whose wife and family “despise me much more than he does.” The former president posted the name, photo, and private Instagram account of a law clerk serving Judge Arthur Engoron, who is currently presiding over Trump’s civil fraud trial and whom Trump despises and has repeatedly attacked, describing him as “CRAZY” and “CRAZED in his hatred of me.” (Trump later deleted the Truth Social post targeting the law clerk, whom he called a “Trump Hating Clerk,” but not until after it had been widely disseminated.)
