Bank stress tests, of course, are merely mathematical exercises. They’re like crashing in a flight simulator, where one can step out afterward and fix whatever went wrong. This is real-time history happening. If Trump succeeds in his campaign to defy the Justice Department (which, if he becomes president, he intends to dismantle a substantial portion of, along with the FBI), escape conviction, and win reelection by painting the several indictments against him as political weaponization comparable to Nazi Germany, then there may be no stepping out of this crash site. Still, stress tests almost invariably make institutions more crisis-proof: Recall that the stress-tested banks did survive the Silicon Valley Bank crisis thanks to shored-up capital resulting from previous exercises.

And it’s difficult to imagine that anything more testing could be thrown at the 247-year-old American experiment than this: In an atmosphere in which a substantial portion of the country no longer believes in facts coming from the federal government, and with a former leader who openly threatens to tear down the Constitution crushing his 2024 opposition in the latest polls, just about everything is at stake. The most fundamental pillars of U.S. democracy that go back to the Founding Fathers—starting with the peaceful transfer of power—are now up against demagogic and populist forces more threatening than anything the nation has seen. And still more indictments are to come, especially related to Trump’s alleged tampering of election results in Georgia—making the test of the U.S. system one that is occurring simultaneously on the federal, state, and local level. Americans today are truly living out that ancient Chinese curse: “May you live in interesting times.” (And no doubt China’s leaders are watching these events—and the possible dissolution of its rival nation—with bemused anticipation.)

First, except for cases involving a trial defendant’s confession, the evidence establishing Donald Trump’s criminal intent is as overwhelming as I have seen in my 40-plus years in the courtroom. Second, as pointed out before, none of the six “experts” he allegedly relied upon are likely to be available to so testify. Thus, the only way the former president can rebut the mountain of evidence establishing he knew he lost the election and that his attempts to overturn the result were illegal is to testify in his own defense and somehow convince a jury it was all an innocent mistake.

Donald Trump is incapable of successfully testifying on his own behalf. He possesses no real and exculpatory facts to present to a jury and lacks the emotional and intellectual self-control to get through a direct examination, let alone a hostile cross-examination loaded with the legal equivalent of nuclear weapons. The hardest task for whoever would cross-examine Donald Trump would be to whittle it down to the best three days’ worth of material so as not to overdo it.

Bottom line—in one of the strongest and best-crafted prosecutions imaginable, we have a defendant who is historically incapable of successfully defending himself. That Jack Smith and his team have created a courtroom nightmare in which—absent a MAGA Trumpster somehow getting on the jury to hang a potential verdict—Donald Trump has no escape. This is a reality not to be glided over.

Former Russian President Dmitry Medvedev has suggested that criminal charges against Donald Trump are politically motivated. Medvedev, who was Russia's head of state between 2008 and 2012 and is now deputy chair of the country's Security Council, weighed on the January 6 indictment against the former U.S. president.

Now Medvedev, an ally of President Vladimir Putin — whose relationship with Trump has long been the subject of scrutiny — has also suggested the charges are connected to the Republican's bid to return to the White House.

"Before, objectionable U.S. presidential candidates would simply be killed. Now criminal cases are being opened against them and they are being charged. Well, there is progress," Medvedev wrote on Twitter. It is not clear which candidates Medvedev was referring to, as many of the replies to his post pointed out.

Reporting Medvedev's comments, Russian publication RBC pointed out that four American presidents had been assassinated, the most recent being Robert F. Kennedy's brother, John F. Kennedy, in 1963.

Medvedev uses his Telegram social media channel far more regularly to issue nuclear threats against the West for its support of Ukraine. Last month he wrote that the tensions between Moscow and the West were "much worse" than during the 1962 Cuban Missile Crisis, which took place under President Kennedy. This made the chances of a nuclear apocalypse "not only possible, but also quite probable."

Medvedev's remarks about Trump follow the Republican's third criminal indictment, but he remains the frontrunner for the GOP nomination. Before his arraignment, Trump denounced the case as proof of the "corruption, scandal, and failure" of the U.S. under President Joe Biden.
