Trump has had it in for Jimmy Kimmel, a prominent critic, for a very long time. After CBS axed fellow late-night Trump critic Stephen Colbert, the president repeatedly said that Kimmel was “next.”

The Trump administration weaponized the regulatory powers of the federal government to punish speech it doesn’t like. This is a favored weapon of modern autocrats. What just happened shows how far down the authoritarian road the United States has traveled in just eight months.

During a Wednesday podcast appearance, FCC head Brendan Carr threatened to revoke the broadcasting licenses of any stations that continued to air Kimmel’s content.

“It’s time for them to step and say this garbage…isn’t something that we think serves the needs of our local communities,” he said.

Carr’s threat should have been toothless. The FCC is prohibited by law from employing “the power of censorship” or interfering “with the right of free speech.” But Nexstar — the largest owner of local stations in America — is currently attempting to purchase one of its major rivals for $6.2 billion — a merger that would require express FCC approval.

To get FCC approval, Andrew Alford, the president of Nexstar’s broadcasting division, said that Kimmel would not be broadcast from Nexstar’s stations. Without access to Nexstar’s roughly 200 stations — covering about 39 percent of the national market — Kimmel would suffer an enormous ratings blow. And so, shortly after Nexstar’s announcement, ABC/Disney announced that he’d be suspended indefinitely.

ABC pulled late-night host Jimmy Kimmel off the air “indefinitely” Wednesday night following pressure from the Federal Communications Commission over comments Kimmel made on the suspect apprehended for the killing of right-wing podcaster Charlie Kirk.

Kimmel’s suspension comes after a monologue Monday night in which he said, “We hit some new lows over the weekend, with the MAGA gang desperately trying to characterize this kid who murdered Charlie Kirk as anything other than one of them, and doing everything they can to score political points from it.” Many read this as Kimmel implying that the shooter himself was right-wing.

Late-night talk show monologues are supposed to be funny, not rigorous journalism. It’s very unusual for a comedian to be suspended because of one, and it’s clear that Kimmel would not have been suspended if President Donald Trump’s FCC had not put extraordinary pressure on Disney-ABC. (In this case, that pressure was applied via Nexstar Media, the largest owner of TV stations in the US, which announced it would preempt Kimmel’s show. Nexstar is currently awaiting FCC approval for a planned $6.2 billion acquisition.) On Thursday morning, amid mounting outcry over Kimmel’s suspension, it was reported that ABC “hopes to have the matter resolved and the show return.”

The whole controversy is a shocking turn both in the Trump administration’s escalating war on its critics and in Jimmy Kimmel’s once pointedly apolitical career. Kimmel, after all, has spent most of his career embodying one archetype: regular American straight white dude. What could be more harmless and less controversial than that?

Kimmel started his career as a comic and radio host, an approachable everyman. In his first major television role as a host of Comedy Central’s Win Ben Stein’s Money in 1997, he was the audience surrogate, with his schlubby persona and his blue-collar accent an easy balance to Stein’s erudite snobbery. When Kimmel became the co-host of The Man Show in 1999, he was continuing to play the same character, only with the boorishness dialed up: leering at hot girls and circulating petitions to end women’s suffrage. In the raunch-obsessed 2000s, the crassness played as edgy: not politically correct, certainly, but the kind of thing it was assumed any man would probably do, if he could only unleash his id.

Kimmel left The Man Show in 2003 to launch Jimmy Kimmel Live! on ABC, where he dialed down the ogling but maintained his everyday dude persona. He also stayed away from talking too much politics. In those years when The Daily Show and The Colbert Report were at the height of their power and influence, Kimmel’s biggest running gag was a mock feud with Matt Damon. Regular guys, after all, are not policy wonks. They like making chill jokes about movie stars.

When the guy from The Man Show becomes Walter Cronkite

Kimmel wouldn’t start to get political in earnest until 2017, when his son was born with a rare congenital heart defect. At the time, a Republican-controlled Congress was pushing to repeal the Affordable Care Act. Kimmel lashed out in a rare emotional monologue. “Before 2014, if you were born with congenital heart disease like my son was, there was a good chance you’d never be able to get health insurance because you had a preexisting condition,” Kimmel said, adding through tears. “If your baby is going to die, and it doesn’t have to, it shouldn’t matter how much money you make.”

Later that year, Kimmel was once again in tears over the news. There was a mass shooting in Las Vegas, Kimmel’s hometown. “It’s the kind of thing that makes you want to throw up or give up,” Kimmel said. “I don’t know why our so-called leaders continue to allow this to happen, or maybe a better question, why do we continue to let them to allow it to happen?”

All of a sudden, marveled New York magazine, Jimmy Kimmel was Walter Cronkite. In an interview, Kimmel noted that his background made it “hit harder” when he talked about politics: “To hear the guy from The Man Show talk about [gay rights] in an inclusive way — I have some credibility,” he allowed. He felt his evolution showed that “the country has come a long way.”

Kimmel, after all, was the avatar of regular American straight white guys. He was where the mainstream was. In The Man Show days, the implication was that you would have to be a humorless prude not to laugh at the joke if Kimmel was the guy making it. Now, if Kimmel was cool with gay rights and health care and gun control, the implication was that you would have to be a real heartless freak not to agree with him.

Kimmel’s liberal turn came with a fair amount of anti-Trump jokes, all of which infuriated Trump. In 2018, in a sign of things to come, Trump reportedly had his administration make repeated calls to executives at ABC parent company Disney, telling them to rein Kimmel in. Much to Trump’s displeasure, Kimmel, if anything, doubled down on his Trump material.

“Jimmy Kimmel is — every night, he hits me, I guess. His ratings are terrible,” Trump told Fox News in 2024. “He’s not a talented guy.” During Trump’s 2024 criminal trial, Kimmel made an unexpected cameo: Prosecutors entered into evidence text messages in which Trump’s lawyers fretted over Trump’s anger when Stormy Daniels appeared on Kimmel’s show. After CBS fired Stephen Colbert earlier this year, Trump gloated that Kimmel would be next.

Now, Trump has finally managed to accomplish what he wanted to do in 2018. He used government pressure to get Jimmy Kimmel off the air.

Yet Kimmel’s suspension throws into relief how symbolic he’s become. His evolution from smug post-feminist crassness in the 2000s to a sincere and outraged liberalism during Trump’s first term mirrors the political evolution American pop culture underwent at the same time. Perhaps that’s why, despite how dramatically American culture has shifted since the days of The Man Show, and despite how envelope-pushing his early comedy looks now, Kimmel emerged from the so-called cancel culture moment relatively unscathed. He’s never faced serious career repercussions for people outraged in retrospect by the Juggy Dance Squad or Hot Girls Jumping on Trampolines. In 2020, he apologized for having worn blackface in old Man Show episodes, and that was the end of that. People have been more or less willing to take him at his word when he says that his intentions were good and that his outlook has sincerely changed.

Instead, the thing that got Jimmy Kimmel right up to the edge of losing his show is that he said something the president doesn’t like. Kimmel is acting as a mirror yet again, and this time, what he’s showing us is that we are lost in an illiberal moment.

Conservatives rushed to exonerate the president from the charge of censorship. He swiftly contradicted them.

Minutes after news broke that ABC had bowed to the Trump administration’s threats and indefinitely suspended Jimmy Kimmel, Ari Fleischer, the former Bush-administration press secretary, tried to explain why the thing that just happened was not actually what happened. “Liberals want to make this firing about ‘free speech,’” he wrote on X, “Did it ever occur to them the issue might be accuracy? Kimmel told his viewers that Charlie Kirk was murdered by MAGA.”

Nothing to see here, just a network imposing a zero-tolerance standard for factual accuracy upon its comedians and implementing it without warning. (Despite his fanatical belief in the importance of factual accuracy, Fleischer’s own tweet substantially misconstrues the facts: Kimmel’s joke implied that it was possible Kirk’s murderer was a MAGA supporter, but did not say so outright. Fleischer’s self-punishment for this error will no doubt be merciless.)

These are glorious, heady days for the Republican Party’s unselfconsciously authoritarian wing. Every day President Donald Trump tramples on the rights of their enemies, and the natcons rejoice, This is what I voted for.

But we should spare a thought for the party’s more conflicted wing, the anti-anti-Trump conservatives such as Fleischer. They profess support for free speech, democracy, and the rule of law while attempting to remain Republicans in good standing. They resolve this tension by focusing on the hypocrisy and foibles of their old liberal foes and ignoring the actions of the world’s most powerful person.

It is a survival strategy, and not a pleasant way to spend four years. That which causes the natcons unremitted joy forces the anti-anti-Trumpers into painful mental contortions. No event to date has given them more anguish than Trump’s gleeful defenestration of Kimmel.

As the story developed, a slightly more complicated explanation than Fleischer’s hasty effort took shape. The anti-anti-Trumpers conceded that the sequence of events looked bad. Yes, the Federal Communications Commission chair, Brendan Carr, threatened to revoke broadcast licenses from ABC stations, warning, “We can do this the easy way or the hard way.” Rolling Stone reported that “multiple execs” at ABC and Disney considered Kimmel’s comments to be minor, but “the threat of Trump administration retaliation” forced their hand.

But perhaps the relationship between these events was purely coincidental. “Neither Carr nor the FCC ever asked ABC or any of the broadcast stations to do anything specifically. There was no formal complaint or a specific action requested,” Conn Carrol wrote in the Washington Examiner. The conservative commentator Mike Solana insisted that, despite the perception that Trump ordered Kimmel off the air, “this didn’t happen.” Rather, Solana elaborated on X, “jimmy’s ratings were abysmal. he spread a conspiracy theory about kirk. two major affiliates refused to carry his show. ABC fired him.”

Ilya Shapiro, a fellow at the Manhattan Institute, argued on X that Kimmel was fired because his show “was losing money”—“there was thus no govt coercion here.” But, he allowed, “FCC statements were unhelpful because makes it look like threat of govt action for bad viewpoints.”

Trump’s FCC chair threatened to destroy ABC’s business, and the network just so happened to then do something Trump very much wanted it to do, but only paranoid leftists would presume these two things were somehow related. Sure, the threat was “unhelpful” for the way it might seem like coercion to the uninitiated. But if anybody was the victim here, it was Trump, who was unfairly blamed for the blunders of a subordinate.

Alas, as often happens when his friends attempt to devise a tortured alibi, Trump promptly blurted out his intentions the following afternoon.

“I have read someplace that the networks were 97 percent against me again, 97 percent negative, and yet I won, and easily,” Trump said about the 2024 election to reporters on Air Force One on Thursday. He added: “I would think maybe their license should be taken away. It will be up to Brendan Carr.”

Indeed, the idea that Trump would threaten the networks because he wants them to stop criticizing him was floated by Trump himself last month: “Despite a very high popularity and, according to many, among the greatest 8 months in Presidential History, ABC & NBC FAKE NEWS, two of the worst and most biased networks in history, give me 97% BAD STORIES. IF THAT IS THE CASE, THEY ARE SIMPLY AN ARM OF THE DEMOCRAT PARTY AND SHOULD, ACCORDING TO MANY, HAVE THEIR LICENSES REVOKED BY THE FCC.”

Awkwardly, these comments do make it seem like Trump may very well be extorting the networks by threatening their broadcast licenses so they’ll remove his critics from the airwaves. But surely there’s another innocent if convoluted explanation for these facts brewing in the minds of the not-yet-openly authoritarian Republican elite. Their future in the party may depend on it.

He was suspended because the president of the United States decided to make an example of him. Yanno, there is only so much bandwidth for broadcast TV and radio. That's why the FCC has licenses: to parse out the broadcast spectrum. Part of the licens says that it's being granted for the public good.

If someone ... say, Trump ... wants to help break the hold that $$$ has on politicians, the first requirement of getting a license should be free, prime time airtime for people from different parties running for office. And the debates, which are controlled and managed by a bipartisan corporation, shoi,d be ended, and true multiparty debates should be televised.

Further, the law forbidding the government from DIRECTLY broadcasting or disseminating stories to the media .... a law axed by Mr. CIA Obama himself ... should be re- enacted.

People go off on the stupidest tangents.

Donald Trump is being cagey about how many people he’s ordered the U.S. Navy to kill on the high seas. The official toll from American military strikes on two boats suspected of running drugs from Venezuela is now 14, but a few days ago, Trump teased the possibility that a third boat had been “knocked off,” presumably on his orders.

The Trump administration’s justification for these strikes, such as it is, seems to be that any shipment of drugs connected to the Venezuelan gang Tren de Aragua is a direct threat to the United States. These “narco-terrorists” may therefore be destroyed on sight, and without the fuss of asking permission from the U.S. Congress. This argument reflects the president’s childlike but dangerous understanding of his role as commander in chief. The United States, once the leader of a global system of security and economic cooperation, is now acting like a rogue state on the high seas.

The White House position is wrong on many levels. I taught the rules and theories that govern the use of force to military officers at the Naval War College for many years, and every summer for two decades to civilians at Harvard; I always reminded students that international law and traditions require states to show that they are acting in some form of self-defense, either in response to an attack or to forestall more violence. Moreover, American law does not permit the president to designate people as terrorists and then declare open season on them in defiance of international agreements and without any involvement from Congress. Perhaps Trump’s people are watching too many Tom Clancy movies, but he cannot legally send the Navy out onto the world’s oceans as though they are seagoing sheriffs with satchels full of death warrants.

No one in the White House seems to care very much about the rules that govern killing people, at home or abroad, but these rules actually exist. International law allows interdicting contraband—drugs, weapons, captured human beings—under many circumstances, and countries execute such missions legally every day. These activities require great care to limit the danger to the military and the loss of civilian life, including diligently identifying suspect vessels, warning them to stop, and sometimes boarding them to identify and seize their cargo.

Military ships can engage these targets in combat under limited conditions. If they open fire on American vessels, for example, no one would deny that they’re signing their own death warrant. But in general, when states want to initiate the use of force in the international arena, their arguments are subject to what international law calls “the Caroline test,” an 1837 case that led the U.S. to agree that to employ force, a threat must be “instant, overwhelming, leaving no choice of means, and no moment of deliberation.” This is an elegant way of saying that nations can use violence in self-defense when they have neither the time nor ability to do anything else. What constitutes an “imminent” threat is an ongoing debate among international lawyers, but the recent Venezuela strikes do not appear to fall even remotely under any of this doctrine.

To understand just how far off the rails Trump has taken the military, imagine an alternate example. If the boats were carrying, say, explosives rather than drugs, and headed on a course for American waters, then yes, U.S. officials could claim that they had no choice but to act: Each minute would bring the chance of immediate death closer to American citizens, and no military is going to try to arrest or quarantine a giant, speeding bomb.

Now let’s return to what Trump is actually doing. The president is trying to argue that drugs pose a similarly immediate threat to American lives, because once the smuggling boats unload their poisonous cargo, Americans will just as surely die as if they had been blown up in a harbor in Miami, and therefore the Navy must kill the terrorist-traffickers with the same alacrity it would use to destroy a bomb-laden paramilitary vessel.

This is nonsense. If the boats were carrying drugs (something Trump hasn’t proved) and if the boats were full of terrorists (something Trump has asserted but without providing names or evidence) and if the boats were headed directly for a U.S. port (which Trump cannot show), then Trump would still be in the wrong to destroy them without warning. Other presidents have used drone strikes to kill terrorists, but they acted under narrow legal conditions, including authority granted by Congress, against targets they could not otherwise apprehend. But Trump thinks he can pick up the phone and have people blown up at sea on his personal orders—and so far, no one’s stopped him from doing exactly that.

The president’s actions and rationalizations flunk the smell test both for international and American law. You don’t have to take my word for it: The former George W. Bush–administration lawyer John Yoo weighed in on this a few days ago. (Yoo came up with the legal justification for using “enhanced interrogation techniques”—also called “torture”—against captured terrorists after 9/11.) “There has to be a line between crime and war,” Yoo told Politico a few days ago. “We can’t just consider anything that harms the country to be a matter for the military. Because that could potentially include every crime.”

A former senior military lawyer, Charles Dunlap, likewise told Politico that “there might be paths where the strikes could be legal,” if the Trump administration would share evidence about the targets, which it won’t. Trump says the proof is “spattered all over the ocean, big bags of cocaine and fentanyl all over the place,” a convenient excuse that still doesn’t answer how the ships posed such an imminent danger that they had to be destroyed at sea and their crews killed.

None of this seems to bother Trump or his circle. Almost two weeks ago, Vice President J. D. Vance posted on X: “Killing cartel members who poison our fellow citizens is the highest and best use of our military.” (I think, having taught hundreds of them, that most military officers would say that defending America and the Constitution is their highest duty, not being the world’s most brutal vice cops.) When one X user replied that what Trump is doing is a war crime, Vance, a graduate of Yale Law School, shot back: “I don’t give a shit what you call it.”

Meanwhile, White House officials are having a good laugh at how much they’ve scared innocent people in the region. Trump smirked this week that “no boats” are taking to the water in the Caribbean now. “I mean, to be honest, if I were a fisherman, I wouldn’t want to go fishing, either,” presumably because the United States might think the boat is carrying drugs. Vance tried to run with the same joke a few days ago, yukking it up with Secretary of Defense Pete Hegseth at a Michigan rally. “I would stop too,” he said, laughing. “Hell, I wouldn’t go fishing right now in that area of the world.”

Not everyone is smiling. Despite Trump’s firing of the top legal advisers in the military, the Pentagon still employs attorneys, and they’re worried. According to The Wall Street Journal, military lawyers are concerned not only about the justification for the strikes on the boats—something any other president would have worked out before ordering the attacks—but also the “legal implications for the U.S. military personnel involved in the operations.”

Trump may have a special Immunity Necklace from the Supreme Court, but others do not. The military has a responsibility to reject orders that break American or international law, even if those orders come from the president himself. But the bar for disobedience is high: The military, as a general legal principle, must presume that orders coming down the chain of command are legal and must be executed. Nor are officers getting much guidance; attorneys and other officials in the Pentagon who have raised such objections, the Journal reported, are “being ignored or deliberately sidelined.”

A more worrisome problem here is that Trump’s illegal orders to kill drug smugglers could acclimate the American public to the sinister idea that the military is the president’s personal muscle and that it must do whatever he says. Earlier this week, he declared “antifa”—a loose affiliation of people who identify themselves as “anti-fascists”—to be a “major terrorist organization.” But because “antifa” isn’t a single group with a headquarters and identified leaders, Trump could apply the label to anyone he thinks opposes him. The president has now claimed he can kill terrorists at will, and he has designated many of his American opponents as terrorists.

The Supreme Court majority, in its Trump v. United States decision, didn’t seem very worried about Justice Sonia Sotomayor’s hypothetical objection that the president, bolstered by absolute immunity, could order the military to assassinate a political rival. But if he can order the Navy to operate as a presidential hit squad on the high seas, any number of grim hypotheticals could become reality sooner than Americans might expect.
