Durham DA Heads to Trial Over Duke Case

On Tuesday _ more than a year after he took the lead in investigating claims three men raped a stripper at a March 2006 party thrown by Duke's highly ranked lacrosse team _ the Durham County district attorney will stand trial on ethics charges ranging from lying to the court to withholding potentially exculpatory evidence.

It wasn't until the North Carolina State Bar accused Nifong of violating several rules of professional conduct, including making misleading and inflammatory comments about the athletes under suspicion, that he turned the case over to state prosecutors.

More ethics charges followed, include allegations he withheld details of DNA evidence from the defense that showed several men's genetic material was found on the accuser _ though none from a lacrosse player.

A few months later, State Attorney General Roy Cooper minced no words when he dismissed the indictments Nifong won against the three lacrosse players, calling Reade Seligmann, Collin Finnerty and David Evans "innocent" victims of a rogue prosecutor's "tragic rush to accuse."

The effects are becoming evident. In February, a federal appeals court cited Nifong by name when commenting on what it considered to be misdeeds by government prosecutors.

Durham District Attorney and chief prosecutor in the "Duke" rape trial Mike Nifong, reached into a 4 year old's bag of tricks and turned on the waterworks in a blatent effort to win friends and influence people. Mike in prison they would tag you as a bitch for a weak move like that and you would be doing back massages on Bubba until you were once again a free man. There's no crying on the witness stand. If you are man enough to take the stand for God's sake don't fall apart like some teenage girl being presented with her first traffic ticket.

Oddly enough this Wilmington native and I used to play football together, of course he was much older and bigger but he found time to push little neighborhood kids around and shove their faces in the dirt. I earned his respect for blocking one of his punts with my face.

So I don't know, maybe I see a bully when I look at him, maybe alot of people do. Maybe that's why people hate him, don't believe his sencerity . Maybe that's why Reade Seligmann looked directly into Nifong's eyes when he said, "I felt like he was just toying with us."

And yes, Reade cried on the stand, but it was tears of an angry man, a man under control though, he didn't come across the table and choke the life out of his opponant. A bigger opponant, a bully. A bully that did more than bloody a kid's nose, a bully that hid the truth to make a few extra bucks on a govenment pension.

LOS ANGELES, California (AP) -- The city's top prosecutor's office got Paris Hilton jailed for violating probation by driving with a suspended license and then condemned her early release.

On Monday, City Attorney Rocky Delgadillo was the one apologizing for keeping quiet about a 2004 accident in which his wife crashed his city-issued vehicle -- while driving on a suspended license.

"I realized that I should have spoken up earlier. That was a mistake," Delgadillo said at a news conference. "I mishandled the situation and I apologize."

Delgadillo insisted his wife did not receive any special treatment.

He also said his wife's violation is not comparable to the Paris Hilton case.

"Paris Hilton was driving drunk, was on a probation ... she violated that probation more than once," he said. "My wife had a suspended license and then she received a ticket. She was never driving drunk."

Michelle Delgadillo's license was suspended beginning in July 2004 after her personal vehicle "bumped another car" earlier that year, said Delgadillo's spokesman, Nick Velasquez.

She did not file a report to the state motor vehicles department, but the other driver did. When she didn't provide proof of insurance to the DMV, her license was suspended "unbeknownst to her," Velasquez said.

The same month her license was suspended, she crashed her husband's city-issued GMC Yukon into a pole.

She was ticketed in September 2005 for failing to obey a turn-only sign and paid a $186 fine, but was not cited for having a suspended license.

The case went through the usual traffic court channels and was not handled by the city attorney's office. Delgadillo acknowledged the violation to the Los Angeles Times earlier this month.

He said neither he nor his wife knew her license was suspended. He said his wife didn't know about the suspension until 2006, when someone broke into her car and stole her license.

"She discovered her license was suspended when she went to the DMV to get a new license," he said.

Delgadillo said he reimbursed the city Monday for the $1,222 repair bill. Delgadillo said he did not initially pay the cost because he believed that city policy allowed for personal use of the vehicle.

Under city rules, city vehicles assigned to elected officials such as Delgadillo cannot be driven by a family member for personal reasons, but the city attorney said that the rule is ambiguous.

He said he will no longer allow his wife to drive the SUV.

Hilton is expected to be released on June 25, when she will have served about 23 days of a 45-day sentence.
