And then there's this incident...

http://www.guardian.co.uk/usa/story/0,,2218386,00.html

I wouldn't just kick his ass off the bench, I'd charge him with false arrest/imprisonment, misuse of city/state resources, and throw HIS ass in jail.

AND charge the security officer and the cops who assisted in this lunacy with aiding and abetting, as well as accomplice after the fact.

Not ONE cop stood up to this, called a supervisor, or refused to follow a blatantly ludicrous instruction ?

He's a judge, not god-almightly, he oversteps, you tell him where to stick it!
(and then call your supervisor!)

The Judge going bonkers isn't half as scary as every officer of the court there executing his will in spite of that obvious fact.

That, folks... is damn disturbing.
"Just following orders." - right ?

First of all cell phones in Court are a menace. One of our Judges confiscates any cell phone that goes off, especially since there are numerous signs telling them to turn them off. He also confiscates food and beverages...which are likewise banned. Only know one guy who got jailed for it. Different Judge (the nicer one) and the guy was intoxicated and had his Bluetooth in his ear talking to somebody while also in front of Judge. He was semi-famous (aka father of a celebrity). He refused to get off his phone and ended up in custody (although it was as much for his intoxication as the other thing).

That said this was going too far.

THAT said this is still within the bounds of the Judge's authority. Naturally he is paying the consequences for a bad decision, but it was still his call to make. Don't blame the Court officers and police, they are bound to obey the Judges lawful orders, and it is lawful for a judge to jail a person (or persons) for contempt. The remedy comes later when the Judge's decision is reviewed.

I believe that the judge in this case may have behaved correctly. No one in the court room could have told the judge whose cell was ringing? Not the person on either side of the goof with the ringing cell phone? Not the gutless ass whose cell was ringing? Anyone who wouldn't at least help the judge is complicit of conspiring to conceal the truth. That's contempt of court. The judge asked whose phone rang. No one fessed up.

Freedom is Important because People are Important

Hello,

Considering the nature of the 'crime' in this case, I'd have been very reticent to point to a man so that he could be arrested.

When they came for the domestic violence defendants with cell phones,
I was silent;
I was not a domestic violence defendant with a cell phone.

Also, sometimes it's damn difficult to know whose cellphone is ringing. I have MY cellphone ring and not even know it was mine! Based on that, I'd hate to point the finger at ANYBODY.

What the judge could have done was simply ask to examine all the cellphones, and see which one had just recieved a call.

I was going to say the same thing. It's even been put in as a funny scene in movies and on TV - a cell phone goes off and everybody reaches for theirs. Or a cell phone goes off and one after another people check and say 'not mine'.

Completely off track, ever notice how WELL cell and regular phone rings come across on TV ? Ever go to answer the phone only to find it was some background phone ring from an office scene ?

Back in the olden days when people had pagers set on stun... I mean, vibrate... it'd be a hoot to see people get this glazed look all of a sudden as their pockets started vibrating. And if it was a REAL urgent issue and everyone was at the same meeting, several people would suddenly go off in a cloud!

BTW- Because I carry my cell phone for medical emergencies (given my daughter's issues) I keep it with me at all times on stun... I mean, vibrate.

If it's such a big issue why not have signal blockers installed?

I think in the US many people find it comforting to have a cell phone and ability to reach 911 (all-purpose fire /medical /police emergency number) any time, any place. I know I do. I've used it a lot, especially for freeway accidents and out-in-public medical emergencies.

***************************************************************
You've probably been to the US enough to know 911, I just didn't want anyone else to think I was doing a Bush or Giuliani 9-11.

Because then the Judge could not use her's.

The Judge was talking about this today. She indicated that cell phones are among the MOST annoying things to hear when your trying to conduct a hearing (actually number 2 behind defendants who show up with all their kids thinking that the Judge wont put them in jail in front of the kids). She's yelled at people and confiscated phones.

She has no problem with this Judge's action given the circumstances.

Me, I think jailing everybody is way too much like pre-school.

You know the Verizon(?) commercial with the family who has phones, and the mom is getting on the kids for texting? Grandma replies with MYOB willya? Well, the tone for the incoming text for the daughter is the same tone my wife uses for her ring. When the commercial would come on, my wife would start looking for her phone to answer it, then realize and get all ticked off. BTW, she has very good hearing and that makes it worse. I watched the commercial quite a few times before I ever heard the tone. Hehe. She's so funny.

Let's have a black celebration

If the Judge needs to use their cellphone, let em call a recess and go do it in their chambers.

Signal blockers = good idea.

Instead of losing their cool, the Judge could have just said "Forgot, did you - will those who've forgotten to turn off their phones please do so now so we can proceed ?"

And then got on with the dog and pony show we call justice around here - rude and annoying, but also a simple human mistake oft-times, people just forget, yanno ?
