Afghan prosecutors announced Wednesday that a young rape victim, jailed for adultery after reporting the crime and pushed into marrying her attacker, would have her sentence reduced from twelve to three years. The prosecutor said she would, for now, remain in jail -- with her child -- for not reporting her attack fast enough.

In a remarkable case that is all too common in Afghanistan but has drawn international attention, 21-year-old Gulnaz was attacked by a relative two years ago, but sentenced to 12 years in jail for adultery.

She has since given birth to a girl from the attack. Because of the dishonor of sex outside of wedlock, she had been given the choice of marrying her attacker to get out of jail and legitimize her infant daughter in the eyes of Afghanistan's conservative society.

The child is imprisoned with her at Badambagh Prison on the outskirts of Kabul.

Gulnaz says she at first tried to hide the attack against her because she could be killed for bringing shame on her community. Only her pregnancy exposed the attack and began criminal investigations that led to her conviction for adultery.

On Wednesday a spokesman for the Afghan attorney general said her sentence had been reduced by another court hearing to three years and that the main remaining charge against her was not reporting her attack early enough. A lawyer for Gulnaz, Kim Motley, said her client was only on Tuesday made aware of the reduced sentence and there had been no official notification of it.
.....
Human rights workers note that rape cases are often handled as adultery in Afghanistan's court system.
.....
Throughout her interview with CNN, Gulnaz was emotional but consistent and clear in telling her story of a single incident of rape by one attacker, the husband of her cousin, when her mother left her alone to make a hospital visit. http://www.cnn.com/2011/11/23/world/meast/afghan-rape-victim/index.htm

There are no words. This mentality is what was going away, when we were there, and has now been brought back by the Taliban. Women: be grateful you live in the U.S. I sure am!

First the rape. Then the decision: risk getting killed by reporting the rape, or risk going to prison by NOT reporting the rape. Good gawd.

Yeah, that's a raw deal. Sorta reminds me of something I just heard today, during an interview with the author of The Politically Incorrect Guide to the British Empire . Talked about how the Brits were able to do away with the tradition in India where widowed women were forced to lay on the burning pyres of their dead husbands. When the locals protested, the Brit commander said -

“You say that it is your custom to burn widows. Very well. We also have a custom: When men burn a woman alive, we tie a rope around their necks and we hang them. Build your funeral pyre; beside it, my carpenters will build a gallows."

Put and end to widow burning.

Oh, those meddling Imperialists!

That's damn right. We, as in the US govt, shouldn't meddle in their affairs. Be it Iran or not.

Even though I edited my post, I'm not sure a blanket statement works in all cases. We 'meddled' Libya, did we not ?

What can I say... we meddle.

Oh yes, and SUPPORTING the Fundamentalist Sunni assholes who enforce this idiotic bullshit, after bullrushing the more secular factions out cause they did not support our rabid corporate exploitation - up to and including dropping bombs on RAWA schools as "terrorist training camps" with a nod and a wink, KNOWING that they were bullshitting us when they gave us the targets.

Hell, I'm still a bit surprised that the State dept hasn't labelled RAWA a terrorist org as a sop to these pricks.... yet.

Your tax dollars at work - and frankly were we to pull out, *IF* the more rational locals have enough might to do it after we've slaughtered most of em and smashed what little organization they have, without us keeping these dicks in power they'd be thrown down pretty quick.

Which is kinda what happened to The Shah, and you saw how that turned out, which lead to this cascade failure which landed us HERE - and yet, we've not learned a goddamn thing cause future generations will suck on the backlash of this just as we wound up sucking on the backlash of Khomeni.

We create most of our own enemies, and I am of the opinion that such is in part deliberate on behalf of our so-called protectors so that they can justify their existence as they exploit us, just as those fundamentalism bastards justify theirs against us in a kind of mutual-pretend antagonism... which ever convinces me that we the peons oughta get together with THEIR peons, and dump these fuckers in the nearest river with a pair of cinder blocks for company, all of em.

The hammers of Truth. Shame. Guilt. Sadness and Despair. The bandages of Humanity, Pity, and Empathy.

The usual tools of anyone looking to open minds.

Sometimes literally.

They aren't without their allies over there, bleak as it looks. Tolerance and moderation always somehow survive brutal oppression. I've seen the sheer will manifest when a human decides to change the course of their reality, and the power when many humans rise up en masse with the same intent. It's one of the few things I put my faith into. It can be put off, briefly placated, slowed by obstacles, but like water flowing to the ocean, their time will come.

Solutions implemented on behalf of other people usually don't work right. And they usually don't last.

Systemic and mass abuse of human rights works like a cult. How do you rescue people being hurt in a cult?

We can't rescue those women. They have to rescue themselves. This is true the world over and throughout history. "Rescuers" with a messiah complex usually end up doing more harm than good. This is esp true of impersonal "rescuers" who are doing it as a job, carrying out someone else's policy, rather than personal conviction and personal connection with the rescuees.

What we CAN do is visit them. International travel and tourism is one of the best ways to exchange cultural values. One of the ways to counter the brainwashing of a cult is to expose cult members to alternative ideas and perspectives.

We can do what groups like RAWA want. Donate cameras and other story-telling support so they get to expose the dirty secrets of abuse. Telling the truth goes a long way to empowering themselves to change.

Donate films and books that tell stories that would empower the women and men to see themselves and gender roles differently.

Donate educational and medical supplies. I am talking about individuals and communities with a personal connection doing this. I am not talking about the US govt giving via foreign aid to their corrupt govts via anonymous and impersonal taxes.

I am all for meddling, as individuals who care enough to go there and do it themselves--nonviolently.

I am against meddling as a matter of policy of the US govt and by using military force as a first resort.

Not to go back to the original topic or anything, but I hate to tell you; in rural areas of India, women still get burned alive with their deceased husbands. Or become pariahs because they haven't gotten one, and end up begging to survive. Not many, but it still happens.

Was that talk of not meddling a joke? We meddle all over the world, wherever we can get a foothold (military or financial) to tell people how they should live, so I'm guessing it was a joke.

No, it wasn't a joke. Rap is pro-meddling. I am against meddling--policy-wise.

Big surprise.

Damn straight, Mr. Twain. Also part of the reason that coastal areas tend to be more cosmopolitan; they're exposed to more different people from different places than the landlocked areas. Still true today, althought FAR less so than used to be the case. Wonder if we'll ever et so everyone believes like Twain; it would be a better world, in my opinion.

My point is that it's not that simple. There's meddling, and then there's meddling. One person's view of humanitarian intervention is another person's view of a country throwing around it's imperialistic weight.

It's like Mark Twain said ... everyone complains about the genocide in Africa, but no one wants to do anything about it.

OK, not "exactly" what Mr. Twain said, but you get my point.

I can't argue with Raptor's satee point. At least it is wayyyyy less common than it used to be.

The actuall story is dreadful, poor woman. I hope someone will fight for her and she'll be let out of jail soon, her family will get a clue and behave themselves and treat her right and, maybe, when she's ready to/if she wants to, she'll find a nice husband who will love her and help her raise her daughter, treat her like his own child.
