BREAKING NEWS: George Zimmerman arrested and charged with murder for shooting Trayvon Martin
Charges announced at a press conference at 6pm today
Special prosecutor Angela Corey dismissed the grand jury and said she alone would decide whether to charge Zimmerman
Announcement comes one day after Zimmerman's lawyers quit, saying they have not heard from their client since Sunday
Second-degree murder charge means Zimmerman faces life in prison

http://www.dailymail.co.uk/news/article-2128392/George-Zimmerman-arres
ted-charged-murder-shooting-Trayvon-Martin.html?ito=feeds-newsxml

The announcement means Corey doesn't buy Zimmerman's
claim that he shot the teen in self-defense and instead
knowingly killed him with a 'depraved mind'

Corey opened her speech by discussing her first meeting with
Trayvon Martin's parents, Tracy Martin and Sybrina Fulton.
She said: 'It was less than three weeks ago that we told
these sweet parents that we would get answers to their
questions no matter where those answers would lead'.

While Corey refused to reveal where Zimmerman is being held,
ABC News quickly reported that he is being held at the Orange
County Jail.

Any trial that could result from the charges is likely to be
a sensational spectacle -- even for Florida, which witnessed
the drama of Casey Antony's acquittal.

Again, I stand by my initial assessment of the situation.

Only part of it which hasn't been chapter and verse is that I did not know Florida doesn't have a Grand Jury requirment for anything less than first degree murder, and situations like this are why they ought to, ya ask me.

Oh, and Wulfenwhiner ?
Take a good long look at Zimmerman - that's YOU, should the world of reality ever intersect with your pathetic little plastic bubble world fantasies in a way that causes you to act out like the overgrown child you are.
You could take a lesson from it, but you won't.

As I called it, original charge Second Degree Murder - which will now be bargained or plead down to some variation on Manslaughter.

Also, that has shit to do with public pressure other than kicking the wheels of justice into motion in the first place, cause I made that assessment BEFORE all the media frenzy, and with that level of scrutiny they kind of HAVE to go by-the-book, and follow procedure cause to do anything less would cause even more uproar.
And he did in fact, ignore his lawyers and mouth off to the prosecutor directly, which is very likely WHAT enabled them to charge his ass, as I pointed out also, would happen.

That there is going to be due process around something which, WHOEVER is guilty of whatever, almost everyone sees as not having been properly handled by the police, is viewed as "mob rule" and bowing to public pressure is...well, absurd and creepy as hell. And it all comes from the right.

How incredibly sad.

{{{shudder}}} but, sigh, probably true.

I assume the 2nd-degree-murder charge is so that they can, as you said, use it as leverage to make a deal. And she MUST know something we don't, in my opinion; certainly she's got a ton of stuff available to her that we don't, like the coroner's report, medical reports of any injuries to Zimmerman, powder burns or stuff that would show distance from gun and Martin, and who knows what else. Will be interesting to find out.

Quote MagonsDaughter: "yeah, in what reality would this not have gone to trial?"

The possible reality that many of us feared, where Zimmerman also dies by a
vigilante's hand. Thus cheating everyone else out of justice and closure.

I believe two voices will convict him. One is Trayvon's voice calling just before
the shot rang out -- showing how long it took for Zimmerman's 'depraved mind'
to get full control. Two, as Frem says, is George's own voice; he can't shut up.

Lynching George. Did anyone on this forum recommend that? If so, I missed it.

Kind'a wondering about the Second Degree Murder charge.

Per Findlaw:

"To prove second degree murder, a prosecutor must show that the defendant acted according to a "depraved mind" without regard for human life. Florida state laws permit the prosecution of second degree murder when the killing lacked premeditation or planning, but the defendant acted with enmity toward the victim or the two had an ongoing interaction or relationship. Unlike first degree murder, second degree murder does not necessarily require proof of the defendant's intent to kill."

http://law.findlaw.com/state-laws/second-degree-murder/florida/

And here's the Florida statute:

"(2) The unlawful killing of a human being, when perpetrated by any act imminently dangerous to another and evincing a depraved mind regardless of human life, although without any premeditated design to effect the death of any particular individual, is murder in the second degree and constitutes a felony of the first degree, punishable by imprisonment for a term of years not exceeding life or as provided in s. 775.082, s. 775.083, or s. 775.084.
"
http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute
&URL=0700-0799/0782/0782.html

Unless the State has more evidence than has been reveled so far, not sure if they can make the "depraved mind regardless of human life" connection.

Maybe the D.A. will try to have Zimmerman plead down to Manslaughter, or give the Jury a choice of lesser charges later on.

I've been in this position. The only evidence we know of is the 911 tapes, the eyewitnesses, and the admissions by Zimmerman.

Nothing so far revealed warrants a Murder charge.

Did he follow Trayvon? Yes, but thats not illegal. A man is free to walk in his neighborhood and even to follow someone he thinks is suspicious.

So there must be more to their case. I suspect that the forensic evidence does not support Zimmeran's story. If that is so, then his whole story collapses. There could also be new eyewitnesses or a change to the story of an existing witness.

For example, a couple years back a white cop was shot by black man during a routine traffic stop. The man's story is the cop exited his vehicle, made racial comments, and then attacked him forcing him to defend himself. He also claimed to have been sleeping with the cop's wife. There was no camera in the cruiser and no eyewitnesses. The cop was known as one of the nicest most straight forward of guys...kinda guy who'd be great to have a beer with. There was no evidence he or his wife knew the Defendant...none. The Defendant could not name when, where, or how he had met the cops wife and later admitted it was a lie. The cop's gun was never drawn, there were no signs of a scuffle on either person. There were no powder burns on the cop so the gun was fired from a distance...thus the fight theory was suspect from the begining. The nail in the coffin (litteraly once we finish executing the bastard) was the forensic evidence showed two gunshots to the chest fired from several feet away then a third shot to the head fired from someone standing directly over the prone body.

Forensics can make or break any case. I've seen some people speculating that the Prosecutor overcharged. I suspect that myself, its the same thing that happened in the Casey Anthony case. But until we see the evidence...who knows? I was, however, disturbed by the Prosecutor during the press conference. She was relishing in the spotlight and it was a shameful political display. In contrast the fella speaking for Zimmeran was displaying a quiet professionalism. I give round 1 to Zimmerman.

The above is kinda what I believe, too. There's gotta be more. But also, apparently manslaughter in degrees and (I believe) even lesser charges are automatically available to the jury in Florida--or something like that. So there is nothing wrong with using the top charge, possibly in hopes of getting a plea and avoiding trial, since the jury can find any number of lesser charges if it wants.

I do think there has to be more than has come out publicly to even use that charge. If it turns out there isn't, that will be a miscarriage of justice, in my opinion.

As to

Can you please offer cites on this? I've only heard that ridiculous New Black Panthers offering a reward for his location and that celebrity putting out the mistaken address. You seem to be saying "numerous people" have done this, and I haven't heard that. As to "lynching", I don't find that surprising at all. There's a lot of heated anger around this, and people do and say stupid things in the heat of anger. Gawd knows if it had been Martin rather than Zimmerman, mutterings of lynching would be all OVER the place!

Excellent news. The place to determine whether or not Zimmerman shot Martin in self-defense, or shot him for the sheer joy of shooting a black teen, is court. Or an internet forum.

Of course, if Zimmerman is acquitted (or found guilty of a lesser-included offense like manslaughter) there may be a significant risk of entertaining protests and BAWWing. The same may hold true for a guilty verdict. (reaches for popcorn).

George Zimmerman can ask to have the second-degree-murder charge against
him dropped without having to stand trial in the death of Trayvon Martin.

Two years ago, the Florida Supreme Court ruled that anyone claiming "stand
your ground" immunity in a death, battery or assault case can request a
hearing on the evidence.

The hearing allows the prosecution and defense to argue all the elements
of self-defense in the case evidence. To get charges dismissed, the accused
must convince the judge that a reasonable person would believe that using
deadly force or the threat of deadly force was the only way to protect his
or her life, court records show.

This is true in every criminal case in USA. But 99% of sheeple don't know you must DEMAND this hearing in writing, or the prosecutors and judges WILL cheat you out of it. This is called a probable cause hearing. To beat a traffic ticket in most states, you must demand a PC hearing in a lower court.

In a PC hearing PROSECUTORS only have a burden of proof of 51% (a mere coin toss), with an "automatic" win by the prosecution for a "bind over" to the grand jury (where the defendant and defense lawyer is not allowed. Prosecutors joke they can get a grand jury to indict a ham sandwich. Then the defendant MUST demand in writing a trial by jury. A competent murder trial defense costs $100,000 minimum.

This prosecutor has zero evidence that Zimmerman was not acting in self defense: no eyewitnesses, no confession, no videotape. Therefore, there is no way a grand jury would find probable cause, so they bypassed the grand jury without an indictment, and the prosecutor filed an "information" which is NOT based on probable cause (just a letter by a prosecutor saying the accused "might" have done something but that the prosecutor has no "personal knowledge" the accused actually did it).

Is Zimmerman guilty of being a scumbag jew Spic wanna-be-cop who narced to cops 50 times a month and whose JEW DADDY IS A JUDGE? GUILTY!!!

Robert Zimmerman, a former Orange County magistrate judge, recently wrote a letter to The Orlando Sentinel defending his son, who’s been dragged through the mud for shooting the unarmed 17-year-old last month. In the letter, the senior Zimmerman asks people not to jump to conclusions and insists that his son didn’t follow the young boy home as he walked through their gated community. According to a records search on George, he was previously arrested for domestic violence, resisting an officer without violence and most shockingly, resisting an officer with violence — a felony charge that surely could have landed him in prison.

Judge quits Trayvon Martin case, cites conflict; new judge to preside over bail hearing =>

The Florida judge presiding over the Trayvon Martin shooting case
removed herself Wednesday after the attorney for defendant George
Zimmerman argued she had a possible conflict of interest relating
to her husband.

Judge Kenneth M. Lester Jr. will preside over the case, including
the Friday bail hearing for the neighborhood watch volunteer,
according to a news release from the court.
. . .
O’Mara said he requested that Recksiedler step down now because the
case is just beginning and he wanted any possible conflict to be ad-
dressed right away rather than in the middle of the case. Recksiedler
was assigned the case after Zimmerman’s arrest last week.

Lester, 58, was first elected to the bench in 1996. The Chicago
native grew up in central Florida and graduated from the University
of Florida College of Law in 1980, a year behind the special pro-
secutor in the case, Angela Corey.

He is a Vietnam combat veteran and is married to longtime Orlando
prosecutor Dorothy Sedgwick, who works in a neighboring jurisdiction.

(AP) — After spending a week in a jail cell by himself, the neighborhood watch
volunteer charged with murdering Trayvon Martin stands a good chance of being
granted bail Friday, despite the severity of the second-degree murder charge
he faces.

Whether George Zimmerman is allowed to leave the county as he awaits trial —
and how he would remain safe — are two questions likely to be at the center of
the hearing at the Seminole County Criminal Justice Center . . .

From A.L.E.C., we get pre-packaged, conservative laws, no thinking required.
