But its the Prosecutor's job to say no if a case fails to meet a probable cause standard. I'll prosecute a weak case, but I wont prosecute a case that does not meet that minimum standard. The State should never have charged this case. Further, the Judge is at fault here. A Judge should have stepped in and prevented this from ever going to a jury. The State failed to meet its minimum burden, this Judge should have ended this during the motion for aquital at the end of the State's case or the second motion at the end of the Defense case (in Ohio that's a Rule 29 motion).
